P:r v: Breda. - Exhibited in Court the 4 February 1790. After the reading of which, having heard the Deputy Fiscal Mr. Johannes Andreas Truter, who acted today on behalf of the Honorable Independent Fiscal due to his indisposition; he declared that he left the request for a copy of the memorial submitted by the Fiscal Office to the judgment of the Council, and that regarding the Petitioner's desire to send the minutes kept before the Commissioners with the verified documents to Batavia, the officer fully joined with the Petitioner. Whereupon, the parties having withdrawn, the Commissioners who had officiated at the swearing of the depositions declared that, whereas the citizen Bernardus de Vaal, as attorney for the defendant on the occasion of the swearing of the depositions of the Colonel and three soldiers of Wurttemberg on 21 October 1789, had requested that a record be kept of his submitted statement; Their Honors had accordingly caused those minutes to be drawn up and had not attached them to the documents, but, because what the defendant had brought forward to reproach the aforementioned witnesses had already been cited at length in his submitted document, had considered the same as separate minutes kept at the charge of the Commissioners. Wherefore the Council, having deliberated upon the aforementioned request, granted the Petitioner a copy of the memorial exhibited in Court by the Independent Fiscal on 8 October 1789, and likewise granted the further request of the Petitioner that the minutes kept before the Commissioners on 21 October 1789, together with and in addition to the above submitted request, be attached to the verified documents and sent to the Honorable Council of Justice of the Castle of Batavia. Lastly, in the presence of the aforementioned Deputy Fiscal, acting in this matter as prosecutor, the following missive from the Landdrost of the colony of Swellendam written to the Honorable President was read: To the Honorable Johannes Izaak Rhenius, Senior Merchant and Secunde of this Government, etc., etc. Having informed Your Honor by my last letter that I would not fail to comply as far as possible in every respect with the order contained in the missive of 18 November 1789; I now have the duty and honor to report to Your Honor that after the person of Godfried Fredrik Koch was unexpectedly apprehended upon his arrival at the Honingklip by the substitute, who at the same time took proper care that he, Koch, could have no access to his slaves, I, assisted by two Heemraden, being the Honorable Messrs. Hillegard Muller and Petrus Pienaar, and by the Secretary, proceeded first to the aforementioned homestead at the Honingklip and subsequently from there to Mossel Bay, and properly inventoried everything found at both places, without having discovered anything whatsoever (as will appear from the inventory enclosed herewith) of the goods belonging to the cargo of the ship Maria stranded in Plettenberg Bay. After this was carried out, the slaves were heard and questioned individually, all testifying as with one mouth that the goods unloaded at the Honingklip from Plettenberg Bay late in the evening belonged to the said Koch, and were brought there approximately one month earlier; and as the depositions would all be identical, I judged it inexpedient to take more than that of the slave woman Pieternel, enclosed herewith, but nevertheless deemed it necessary to send the slave Cesar to the Cape, who reportedly disclosed this to Bouvé and Goliath and now denies everything, whom Your Honor, if deemed necessary, could have heard in the presence of the aforesaid Bouvé and Goliath. (At the bottom was written:) With which hoping, etc., (and signed:) A. A. Faure. Swellendam, 12 January 1790. And a request having been made thereupon by the said Deputy Fiscal that the aforementioned Landdrost be instructed to send at once to the Cape both the persons of Fredrik Wolff and Claas Rademeyer, as well as the slave woman Pieternel belonging to the abovementioned Godfried Fredrik Koch, along with the other male and female slaves and Hottentots named in the copies of the depositions of Florentinus Bouvé and the slave Goliath sent to the said Landdrost; It was thereupon resolved to dispatch this instruction at once, while also mentioning that the Council cannot at all approve that the said Landdrost only had the slave woman Pieternel make a deposition and did not carry out the further clear order to obtain attestations from all persons who have knowledge of this matter and are listed in the aforementioned depositions; while the said Landdrost will at the same time be cautioned to make the necessary provisions if, by the summoning of the aforementioned persons, the homesteads of the cited Godfried Fredrik Koch should be left destitute of proper oversight. And furthermore, the Secretary of this Council must make inquiries with the said Koch regarding one or two persons to whom he, Koch, could entrust his affairs; which persons must then also be reported to the said Landdrost, with authorization to provisionally keep watch over the homesteads of the aforesaid Koch and his further business there.

In the forenoon, present the Honorable Johannes Izaac Rhenius, President, and all the Members, with the exception of Messrs. Ronnenkamp, Maasdorp, van Echten, and Gie, through indisposition. The Independent Fiscal of this Government, the Honorable Johan Nicolaas Steeven van Lijnden, formal prosecutor, plaintiff, serves with a reply, pursuant to the presentation. Against Maria Malang, widow of the late burgher Hendrik Engela, defendant, to see served with a reply to her submitted answer. The Council grants the request. The Firemaster Arend The formal prosecutor advances orally that His Honor, today 14 days ago, had requested a copy of the defendant's written answer in order, if necessary, to serve with a reply thereto; but since he, formal prosecutor, had found that the first point of the same written reply is irrelevant to the case, the second contains a false confession of a lie, and the third point by the confession of the second cannot operate anything to the benefit of the defendant, His Honor had therefore not deemed it necessary to reply further thereto, but on the contrary persisted with the conclusion taken and hereby renounced further productions. The Bookkeeper and Former Secretary of Swellendam, Sr. Menso Blankstein, as authorized agent of the burgher Jan Smit Jurriaansz, plaintiff, Against The Independent Fiscal of this Government, the Honorable Johan Nicolaas Steeven van Lynden, defendant, to see served with a representation instead of serving with an answer to his exhibited criminal claim. The plaintiff submits a representation to which are attached 2 appendices, and says at the same time that he, before answering, requests that the one and the other may be read aloud. Against which the honorable defendant advances that whereas the plaintiff, today four weeks ago, had requested and obtained a copy of the claim submitted against him, in order to serve with an answer thereto today, His Honor had therefore with the utmost surprise received a summons to see served with a representation today instead of an answer, and this without having previously requested a delay of proceedings. That since such a manner of proceeding has never been heard of, and also directly conflicts with the express orders enacted in that regard, pursuant to which one shall proceed by claim, answer, reply, and rejoinder; it is therefore in the highest degree temerarious and presumptuous of the plaintiff, not only on his own authority to infringe upon constant practice, but also, without having requested a delay of proceedings, to deviate from the resolution of the Council. That furthermore, since the plaintiff has had enough time to prepare his answer, and at the same time by the manner of proceeding in the cities and in the countryside, Article 12, the following is prescribed: "And in cases exceeding the aforesaid sum or other real or personal actions, the defendant in enclosed cities shall be granted a time of eight days, and before bailiff and men and judges of villages fourteen days, in order to make or deliver their answer then orally or in writing. returned to the petitioner, with the order to answer immediately, on pain of default. The said petitioner persists in his request and adds thereto that the Lords Independent Fiscals in former times, such as among others also Mr. Boers in matters of Curela, in which they could not be regarded as anything other than private parties, have served statements of representation, of which several examples are available; and that he, the petitioner, on that ground trusts that his request in this matter will not be denied. The Lord respondent argues against this submission that even if there might be examples at hand where former Fiscals, considered as private individuals, had served statements of representation, such nevertheless cannot give the petitioner in this matter any right, instead of serving an answer today in accordance with the decree of this Council, to cause the fiscal office to be summoned in order to see a statement of representation submitted; the Lord respondent thus persisting in his request made just now. The Council, returning the submitted statement of representation, orders the petitioner to serve his answer precisely fourteen days from today, on pain of default. After this decree was read out to the parties, Sr. Blankstein declared that he had special instructions from his principal Jan Smit Jurriaansz to propose the Exceptio Litis Finita, because this matter was already settled with the former Lord Independent Fiscal Mr. Willem Cornelis Boers; as the petitioner, regarding the crime of which he is accused in this matter by the Lord respondent ex officio, had compounded with the said Mr. Boers, subsequently litigated over it, and, as appears from the civil court roll of 26 June 1788, that litigation was amicably settled to mutual satisfaction with the authorized agents of Mr. Boers; the petitioner requesting at the same time that this exception might be deliberated upon during the sitting of the roll. The Lord respondent ex officio advances against this that this exception proposed by the defendant, now petitioner, cannot be taken into the slightest consideration, since it can never be proven by the petitioner that he ever underwent a criminal action regarding the crime charged against him, or that he was absolved or acquitted thereof by a sentence of the judge; that furthermore, it is true that a civil action was instituted by Mr. Boers against the petitioner regarding a private bond which the petitioner had refused to pay; but that the said Mr. Boers had never proceeded ex officio as fiscal against the petitioner regarding the crime of beach robbery etc. committed by him, much less that such proceedings can be considered to have been terminated by a judgment or settled amicably; wherefore the said Lord Independent Fiscal concluded that, since the petitioner does not prove his proposed exception, the same may therefore be rejected as entirely futile and irrelevant. Johannes Blankstein in his said capacity argues against this that although the petitioner was not involved in a criminal action ex officio by the former Independent Fiscal, the aforementioned Mr. Willem Cornelis Boers, the civil proceedings, or rather the aforesaid private bond, nevertheless arose from a composition entered into between the aforesaid Mr. Boers and the petitioner precisely on account of the very same matter over which the petitioner is now prosecuted in court by the Lord respondent ex officio, and that since it appears from the aforesaid court roll of 26 June 1788 that the proceedings initiated on account of that composition were settled to the satisfaction of the parties, he, the petitioner, therefore believed that the criminal action was thereby barred, and that the Exceptio Litis Finita in this matter was thus proposed on good grounds. In refutation of all of which, the Lord respondent ex officio further submitted that it does not appear from the court rolls of this Council that the beach robbery committed by the petitioner was declared civil and compoundable; that furthermore the petitioner does not prove that the sum stipulated by composition was paid, but on the contrary that the petitioner refused payment thereof, litigated on that account, and in those proceedings sought to demonstrate the notorious nullity of the so-called composition; that moreover the composition, considered in itself, is indeed unsustainable; and that finally the petitioner himself, in his interrogatories answered before the Lords Commissioners, declared that he had signed the bond out of fear, as well as appealing, with regard to the removal of the goods from the beach, to the commission that was allegedly given to him for that purpose by Branden Chiron. The Lord respondent persisting in all this with his conclusion. The Council, having heard the parties, after consideration of the matter, rejects the Exceptio Litis Finita proposed by the petitioner. After the pronouncement thereof, the frequently mentioned Johannes Blankstein said: I request, in the name of my principal, an appeal therefrom. Which request having been deliberated upon, the following ruling was made thereon: The Council takes the requested appeal under advisement, but the petitioner shall nevertheless, pursuant to the above decree, serve his answer fully on the next court day, under the penalty specified therein.

The merchant and Landdrost of the Colony of Stellenbosch and Drakenstein, Mr. Hendrik Lodewyk Bletterman, plaintiff in his official capacity, Against The burgher Pieter Roux, defendant, in order to hear such demand and conclusion, or request or requests, as the plaintiff in his official capacity is obliged to make and take, on account of the fact that the defendant, after receiving a written order from the plaintiff in his official capacity to pay the Hottentot Lambert Boer his earned wages and cause him to depart with his wife, bound the aforesaid Hottentot with a thong and harassed and struck him with a sjambok, and furthermore thereafter paid his earned wages and detained the wife of the aforementioned Hottentot to prevent her from departing with the defendant inland towards the Swarteberg; to answer thereto and further proceed as is lawful. The Deputy Fiscal, Advocate Johannes Andreas Truter, who is authorized by the government to represent the affairs of the plaintiff in his official capacity in this matter, submits an extract from the criminal court roll of 21 January last, alongside a statement made before the Commissioner Gentlemen of this Council by the Hottentot Lambert Boer, and demands that the defendant, by definitive sentence of this Council, shall be condemned to be placed on water and bread for days and into all the costs incurred in this case. The wife of the defendant, Anna Elisabeth Steenbergen, proving her authority with a general power of attorney granted to her by her husband, says in response thereto: That it is true that her husband had given the Hottentot Lambert Boer 5 blows with a whip because of his insolence, but had not tied him up; having only held the said Hottentot fast with a rope by a ladder that happened to be standing upright in the house, and also gave him no more than 5 blows; that furthermore the wife of the said Hottentot had not come with him to the farm, but is a Hottentot woman whom the defendant had brought along from the veld; that therefore, because the repeatedly mentioned Lambert Boer had come to the farm alone, and the said Hottentot woman was currently still actually in the service of the defendant, the said Lambert Boer could not claim to take the same Hottentot woman with him;— Requesting the appearer that this slight misstep, committed by her husband in anger, namely striking the Hottentot Lambert Boer with a whip because of his insolence, may be forgiven him. suspicion of Beach Theft could be confirmed by any authentic accusations, although the petitioners have indeed heard that a certain man, being a carpenter named Florentynus Bouvé, is said to be the accuser of the mentioned Koch, yet trusting that the mentioned man, being known to your Honorable Worships, would not be admitted to give any credible testimony, much less to be allowed to advance accusations to anyone's detriment, since the same, having been assigned as a carpenter to one of the trade quarters some time ago here at the Cape, became a fugitive and thus a vagabond, without the petitioners knowing what further happened to him afterward, except only that he was subsequently in the service of the mentioned Koch as a carpenter, and that through his malicious brutality he dealt the mentioned Koch, his master at that time, a blow to the head with a heavy piece of wood, such that the mentioned Koch fell to the ground and lay as if dead for a considerable time, and in doing so the mentioned carpenter can have intended nothing less than to beat the currently detained Koch to death. Thus the petitioners take the liberty of leaving to your Honorable Worships' wise judgment whether this above-mentioned carpenter, who has sought the life of the detainee, can be accepted as a valid witness against him, with the further declaration that they have been reassured by all other people from the district of Zwellendam that the mentioned Koch is innocent, and could obtain and produce many statements to that effect. The petitioners, having far too great an interest, as has been alleged above, have informed themselves as much as possible, yet could perceive nothing from which one could even place him in the appearance or relation of having stolen goods, other than that, while the mentioned Koch always traded heavily, a wagon loaded with his own trade goods once overturned in a river, and he had to unload his goods there to dry; the petitioners then finally having learned, to their heartbreaking sorrow, that the mentioned, their principal Koch, has been criminally incarcerated, and that in such a manner that the petitioners may have no access to him, Koch, from which the petitioners have had to presume that the most dangerous accusations must have been brought against the mentioned Koch, which very apparently will have been done by the mentioned carpenter; so the petitioners have found it their bounden duty to bring the character of the mentioned carpenter, in case such should be unknown to your Honorable Worships, discreetly to your attention, so that the mentioned carpenter, currently having some relation to those accusations against Koch, may by no means retain free rein in his malice, but on the contrary be treated by your Honorable Worships according to your equity. Subsequently, the report of the Landdrost of the Colonies of Stellenbosch and Drakenstein, Mr. Hendrik Lodewyk Bletterman, concerning the proceedings of the former Field Cornet Adriaan van Zijl and burgher Pieter Wiese, who were banished from here, having been circulated and read by the respective members of this Council, it was resolved to prepare the report currently required from this assembly by the Government here, and to submit it, together with the aforementioned original report of the Landdrost, to the Honorable Governor and Honorable Council of Policy. Against The Chief Surgeon of the Honorable Company, Cornelis de Koning, defendant, in order to hear, on account of his disobedient behavior shown on the ship Zeeland toward Captain I: Bank, such oral claim and conclusion as the prosecutor ex officio shall see fit to make and take against him, de Koning, pursuant to the Article Book, to answer thereto immediately in court and further to proceed as of right. The prosecutor ex officio submits three ship's resolutions held on board the ship Zeeland lying in the roads, together with a declaration from the officers and passengers of the aforementioned vessel, which declaration has been properly confirmed and sworn to by four of the deponents before the Commissioner Messrs., and, since the defendant through his insolent behavior toward the commander of the aforementioned vessel has most strongly offended against the express orders of the Honorable Company contained in the Article Book, which is established for observance by the ship's authorities and other officers, demands orally that the defendant shall be condemned by this Honorable Council to such penalty, amende or fine as Their Honors shall deem proper. The defendant thereupon requests to submit a formal plea for the roll: Against which the prosecutor ex officio advances that, since a copy of the aforesaid declaration made to his charge has been handed to him, and he has also been summoned to answer immediately in court in order to avoid extensive procedures in a case so evident as this, the defendant ought to comply with that. requested appeal is declined by this Council, no grievance whatsoever is inflicted, since upon the decision on the principal matter, if he, the petitioner, should find himself aggrieved, ample opportunity is available to prosecute the entire suit, and thus also his aforesaid alleged exception, in appeal. That, furthermore, by granting the appeal, the petitioner would achieve precisely the aim and purpose for which he proposed the aforesaid exception and subsequently requested appeal thereof; since it is, after all, crystal clear that the appearer has not the slightest semblance of grounds to sustain the aforesaid exception, other than—because he finds himself unable to defend himself in a legally tenable manner or to demonstrate his complete innocence—to shelve the case and, if possible, drag it out ad infinitum. And that, finally, in this matter it ought to be taken into consideration that the defendant has not only attempted to surprise the fiscal office by deviating from constant practice and the manner of proceeding introduced here, having the officer summoned to see the statement of case served, and then entirely improvise and bring forth an exception which he ought to have proposed in his response; but that, moreover, however much the aforesaid exception was immediately found by this Council to be so futile and unfounded that their Honorable Worships made no difficulty in rejecting the same stante pede, in accordance with law and equity, the defendant would nevertheless, if the appeal thereon were granted to him, still obtain that effect from this entirely ridiculous exception which he had intended merely to keep the case dragging on and to dupe the judge. The Council, after deliberation on the matters, grants the petitioner Jan Smit Jurriaansz his requested appeal to the Honorable Worshipful Council of Justice of the Castle Batavia against the Exceptio Litis Finita rejected here on the last court day; thus the original documents that have served up to now, being legalized by the delegated members of this Court at the expense of the appellant in the presence of the parties, shall be sent to the said Honorable Worshipful Council, and in the meantime the proceedings on the principal matter shall be held in abeyance until the aforesaid exception in appeal shall have been disposed of. Signor Blankstein, being in this matter the authorized representative of the petitioner, says in response that he trusted the Council, since the aforesaid exception is peremptory, would grant the requested appeal. This ruling having been read to the parties, the aforementioned Mr. Independent Fiscal requested that, in order not to render the final judgment illusory through the absence of the defendant Smit, the defendant should therefore forthwith be placed in criminal custody, to remain there until the final decision of this case; or else that it may be the Council's pleasure to postpone the legalization of the documents until the lawsuit on the principal matter shall be completed, to the end that, these proceedings having been adjudicated, the defendant may then, if he should find himself aggrieved, prosecute at the same time the appeal both regarding his exception and the verdict on the principal matter. Signor Blankstein, for the petitioner, advances in response to this that his principal still refers to the decree of the Council whereby he was admitted to ordinary proceedings and permitted to act through an attorney, requesting at the same time that the documents may be legalized as soon as possible and sent to Batavia. The Council orders the petitioner Jan Smit Jurriaansz, before the legalization of the documents, to provide sufficient bail to appear in court at all times if required, and that to the sum of six thousand rixdollars; dismissing the further request of the officer. Which request also having been deliberated upon, the following order was issued thereon. After this, a request was further made by the aforementioned Mr. Independent Fiscal that the documents might be left in the custody of the Secretary of this Council, and the parties ordered to supply their evidence within 14 days, in order that final judgment may then be rendered on the documents; as his Honor was of the opinion that in criminal cases, in which corporal punishment is demanded by the Officer against the defendant in order to uphold the rights of the High Sovereign, no bail can be posted, but the obtained condemnation must be executed upon the person of the defendant.

Furthermore, the Honorable President, who was of the opinion that the requested appeal should be rejected and the principal suit pursued here according to form and practice, had his opinion entered into the minutes. Lastly, the Honorable Independent Fiscal reported orally that His Honor, having inquired closely into the reasons why the person of Philip Fredrik Wyland, concerning whom His Honor's considerations were required by decision of this Table dated 24 December 1789, was placed on Robben Island here in the year 1786 or 1787, had not been able to ascertain anything certain concerning this matter. Wherefore it was approved to inform the Right Honorable Governor and Honorable Council of Policy that, since it does not appear from the respective court rolls that in the year 1786/7 anything was brought to the knowledge of the Council of Justice here regarding the conduct of the said Philip Fredrik Wyland or the reasons why he, as stated in his petition, was placed on Robben Island, this Meeting is therefore unable to supply any clarification regarding this matter to the Right Honorable Governor and Honorable Council of Policy aforesaid. A memorial was submitted by the Deputy Fiscal Mr. Johannes Andreas Truter, on account of the indisposition of the Independent Fiscal, regarding the citizen Pieter Heinkes, accompanied by a report from the second court messenger Johannes de Wit, which memorial reads as follows: To the Right Honorable President and Council of Justice of the Castle of Good Hope. Shows with due respect the Independent Fiscal of this Government, Johan Nicolaas Steeven van Lynden. That he, the Official Remonstrant, was informed in February last that the citizen Pieter Heinkes was harboring on his estate situated behind the Rondeboschje some runaway Mozambique slaves who had come ashore from a French ship, probably with the intention of keeping them for himself after the departure of the aforesaid ship and profiting thereby; that to discover this, he sent to the estate of said Heinkes the second court messenger Johannes de Wit, assisted by the Deputy Bailiff Hendrik Matthysen. That the court messenger, having arrived at the estate of the said Heinkes with the Deputy Bailiff and having questioned him whether five Mozambique slaves who had run away from their master were staying with him, Heinkes at first sought to deny this, but subsequently made a confession and had the place pointed out where he had hidden the aforesaid slaves, from where they were also collected by the Deputy Bailiff Matthysen and subsequently transported towards the Cape; all according to the accompanying report of the 2nd court messenger. That the Official Remonstrant, having considered all circumstances according to the findings of the court messenger and deputy bailiff, is of the opinion that the aforesaid P. Heinkes deliberately acted contrary to the repeatedly issued placards regarding runaway slaves, and in addition made himself guilty of the crime of kidnapping. That the Official Remonstrant has therefore considered that he must not remain idle, but on the contrary, for the prevention of disorders, deems himself obliged to initiate criminal proceedings against Pieter Heinkes on the aforesaid account, and to that end have him taken into custody so that he does not escape his condign punishment. Reasons why the Official Remonstrant turns to Your Honors, with the request that Your Honors may be pleased to grant him their decree to take the citizen Pieter Heinkes into apprehension, in order to then be able to proceed effectively. to act ex officio on behalf of the Merchant and Landdrost of the Colonies Stellenbosch and Drakenstein here present, furthermore submitted a memorial, provided with five annexes; the said memorial reading as follows: To the Right Honourable and Respected Lords President and Councillors of Justice of the Castle of Good Hope. Shows with due respect the Landdrost of Stellenbosch and Drakenstein Hendrik Lodewyk Bletterman: How in the month of May of the past year 1789 it was brought to the knowledge of the Remonstrant by the Field Cornet Jacobus Johannes Pienaar, that by the citizen Willem Janssen van Rensburg two slaves by name of April and Mey of Madagascar, belonging to the fellow citizen Wynand du Plessis, had been apprehended; with whom had been found five wethers, together with a knapsack, coat, and knife, of a certain shepherd of the aforesaid van Rensburg who had shortly before been murdered; the Remonstrant, seeing that he had also been informed by the Field Cornet that the aforesaid two captured slaves had confessed that the shepherd had been in their company, had the same transported towards the Cape, in order to investigate judicially whether it might be possible to convict them of the perpetration of the murder; especially since in the hole where they had been staying, the hat of the aforesaid shepherd had also been found. That the Remonstrant, after the apprehension of these two slaves, has sought as far as possible to elucidate the fact, and to that end has also obtained a private inquest report signed by the aforesaid Field Cornet and three witnesses, together with a secretarial declaration of the owner of the herdsman, the citizen W. J. van Rensburg, on the basis of which documents the Remonstrant formed and presented to each prisoner individually for answering such interrogatories as he judged to be most suitable for the discovery of the truth. Yet that from the responses to the same interrogatories it has not appeared to the Remonstrant that the prisoners April and Mey have made themselves guilty of the murder of the aforesaid shepherd, and on that account could be presented to Your Honours for the obtaining of the ordinary or extraordinary punishment applicable thereto. That it is true that several indications and presumptions militate against the prisoners; yet that the same are of such a nature that even combined they cannot provide sufficient grounds to conclude ad torturam, and thereby to extort the confession of an unproven crime ex ore reorum. That nevertheless the Remonstrant, in consideration of the aforesaid indications and presumptions, has not been able to bring himself to desist entirely from his already commenced procedure; but on the contrary, as a proper Officer of Justice, deems himself obliged to conduct further investigation regarding the matter in question; in order that such enormous crimes may not be committed with impunity. While the Remonstrant on the other hand, subject to correction, is of the opinion that, since he does not yet see the opportunity offered for the further discovery of the truth, it would be unjust to withhold the aforesaid prisoners from their lawful owner as long as it has not been established that the crime was committed by them, and without complete proof to deprive someone of his property. Reasons why the Remonstrant is turning to Your Honours and submits for respectful consideration, whether Your Honours might not see fit, after the aforesaid April and Mey have first been riveted in irons by order of Your Honours for the period of two consecutive years, to restore them to their aforesaid master Wynand du Plessis, with the recommendation to take care as far as possible that the same slaves, if required for the continuation of the already commenced procedures, can be produced before Your Honours at all times; leaving it nevertheless to the enlightened judgment of Your Honours to prescribe such other measures as the same, according to the nature of the case

These documents having been read and deliberated upon, the Council, agreeing with the proposal made in the aforementioned Representation, authorized the Officer Exhibitor to return the slaves April and Mey to their master, the burgher Wynant du Plessis, with the recommendation to take care, as far as possible, that the same, if required for the continuation of the proceedings already begun, can at all times be produced before this Council; the aforementioned slaves April and Mey, however, shall provisionally be put in irons without a specified term. Furthermore, the aforementioned Adjunct Fiscal, in his capacity mentioned above, verbally made known: That on the 18th of April of the past year 1789, the widow of the late burgher Marthinus Melk sent to the prison at Stellenbosch, and delivered there, a certain slave boy who had been captured by the slaves of the said widow near her farm, calling himself Moses of Mallabaar and belonging to the burgher Jan Rensburg at Graaff Reynet; that the said Landdrost had since repeatedly caused written notice thereof to be given to the said Rensburg by the messenger, and most recently in the month of December last, had requested in person the burgher Johannes Scheepers, who declared to be the nearest neighbor of the said Rensburg and would be at his farm within a month, as he also agreed to do, to bring the matter to the attention of the said Rensburg; nevertheless, notwithstanding all this, the said slave had up to this day not been redeemed, either by the aforementioned Rensburg himself or by anyone else on his behalf. The aforementioned Adjunct Fiscal requesting that, in order to prevent further costs, the said slave Moses of Mallabaar might, by order of this Council, be publicly sold, and the auction proceeds, after deduction and settlement of the costs, be handed over to the aforementioned Rensburg. To which request the Council, after deliberation on the matter, condescended, and thus granted authorization to the secretary of this meeting for the sale of the said slave Moses. To avoid lengthy and tedious proceedings in matters that can be subject to not the least doubt, the ex officio Plaintiff shall only briefly propose orally to Your Right Worships that the Defendant, having at the end of the month of November of the past year handed to the First Court Messenger a warrant of arrest together with a citation ad proximam for the burgher Christiaan Waal, in order to seize the goods of the latter and have him summoned to the next court day; instead of awaiting the execution of this dispatch, did not shrink, on his own authority, before the Court Messenger had been to Waal, from seizing the aforesaid goods himself and having them stored away; while furthermore it may appear from the same report that the Defendant made no difficulty in acknowledging this his improper and unlawful conduct, even adding that he well knew what he had done and would certainly answer for it. The Defendant has thus, in occupying those goods, essentially committed an excess, and may rightly be said to have been his own judge, contrary to the well-known maxim: Nemo sibi ipsi jus dicere potest. The ex officio Plaintiff does not deem it necessary to detail at length the utterly ruinous consequences that such examples might bring about; nor will he burden the attention of Your Right Worships by arguing that no one is permitted to be his own judge and, without judicial authority, as the Defendant has done, to drive someone out of his possessions, because attached goods may not be held outside the possession of the owner, although he may not make use of them; Bort, Tractaat van Arresten, part 7, no. 21. To the Honorable Court of Justice of this Government at Cabo de goede Hoop Honorable Sir, and Honorable Gentlemen, With great respect, your Honorable Worships' most humble servant, the undersigned wife of the arrested burgher Pieter Heinkes, makes known: That on a Sunday of the just-past month of February, her petitioner's aforesaid husband having left home to attend to his household affairs, in the meantime five Mozambique slaves came to her farm situated at Wynberg named Bosheuvel, on which occasion her slave named February van de Caap informed her, petitioner, that he had learned from the said Mozambique slaves, who were runaways, that yet other such runaway slaves were to be expected, as it is also known that throughout the entire neighborhood the same slaves have roamed about and been sent to the Caap, and that he, February, with the aforesaid five boys, wished to capture the others who according to him were expected; that she, petitioner, on account of these very plausible and not very improbable reasons, attributed too much faith thereto and consented to this. However, on the following day, being the Monday thereafter, her said slave had likewise run away from her farm together with the aforesaid Mozambique slaves and gone into a forest, so that the aforesaid Mozambique slaves only remained on the aforesaid farm for a single night. That a certain slave girl of her petitioner named Mariane van Mosambicque, after the said slave February van de Caap had run away that day, had discovered that he had entered the house during the night and had taken some food along with a kettle with him. That the said slave girl, without reporting anything thereof, followed his tracks and subsequently, fortunately, discovered where he had gone, without her having given any notice thereof, however. That thereupon on Wednesday, being the 3rd of the past month of March, the Undersheriff Hendrik Matthysen with the court messenger De Wit came to her petitioner's farm, asked for the aforesaid slave girl, and took her with them to the place where the aforesaid slaves were staying. That on the following day her petitioner's husband was summoned by the Honorable Independent Fiscal, and having arrived there, was referred by His Honor to the Adjunct Fiscal Mr. Johannes Andreas Truter. That her petitioner's husband, in compliance with the very revered orders of His Honor, went thither, and having arrived there, was extremely surprised that the said Adjunct Fiscal informed her petitioner's husband that he was being sued over the aforesaid matter for a sum of one thousand rixdollars; that her petitioner's husband departed from there and went to the late burgher Hendrik Ehlers, and with him went again to the said Adjunct Fiscal to speak with His Honor regarding the demanded one thousand rixdollars, but the said gentleman persisted in the aforesaid demand of one thousand rixdollars; that her petitioner's husband, in order to prevent the blemishes of a criminal trial, brought to the said Adjunct Fiscal on the seventh or the eighth of March three hundred thirty-four rixdollars, and subsequently another two hundred and fifty rixdollars. And thus, more out of a vengeful disposition than on account of a lawfully proven crime for which these proceedings against her husband are to be held, he has been imprisoned, without the petitioner being able to obtain any access to her husband, so that she is consequently ignorant of the reasons for this strict imprisonment, on which her husband during the same would have to be heard and examined; what he is charged with, and what he might have confessed; by reason of which, although she, the petitioner, is by nature bound to assist her respective husband in these his difficulties, to supply and furnish him with whatever he may require for the foundation of his exception, appeals, or defenses that he may have proposed, interpreted, or settled, of which the petitioner is also completely ignorant, and to help him therein with counsel and deed, she must nevertheless still remain in default regarding her aforementioned efforts to have access, not for lack of good will, but because she has not yet been permitted to understand what it is for which these proceedings are being conducted against her husband, and consequently has been unable by any means to advance the defense of innocence, which everyone, and especially the petitioner of her husband, idque secundum normam pietatis et affectionis (that is, and that according to the rule of godliness and love), must presume until it shall have appeared otherwise to her; that the petitioner, having informed herself that the laws are very strict and harsh against those who commit such faults, crimes, or offenses in which no access is granted, and that to this end it is established that one may proceed both by accusation and inquisition, so the same laws work even more for the relief than for the encumbrance of all sorts of accused persons, such that the petitioner understands that all crimes must appear as clear and clearer than the sun shining at midday, and therefore also says that one must conduct such matters in such a way that, if everything should not be completely evident, it would be better to absolve a criminal than to condemn an innocent person; to which end all prisoners, whether one must proceed against them in the ordinary or extraordinary manner, are permitted to make their defense fully; it is certainly for that reason that by the States of India, under the title of Fiscal at Article 7, it is said that he who is addressed by the Fiscal, Bailiff, or someone else concerning any offense or crime, shall be free to answer for his affairs either by himself or through a procurator. Which, having been read in the presence of the aforementioned Deputy Fiscal Mr. Johannes Andreas Truter, who today was postulating on behalf of the Independent Fiscal, the said Mr. Truter requested, before expressing himself on that petition, to be permitted to know in what capacity the last four signatories of that written request appeared here, whether they were perhaps provided with a power of attorney from the said Heinkes, or else what relation they had to him. And after the aforementioned wife of Pieter Heinkes had answered thereto that they had signed as sureties, it was brought forward by the frequently mentioned Deputy Fiscal against the said petition: That the same was fourfold, as containing: 1st. A statement and description of the fact in question. 2nd. A so-called composition, entered into by the Independent Fiscal with her husband P. Heinkes, as the petitioner says. 3rd. An argument that defensio is juris naturalis, that it is pietatis that a wife stands up for her husband and defends him, and that on those grounds the defense may not be refused. 4th. A request to be released on bail. That he, the Deputy Fiscal, regarding the first point, had the honor to submit to the Council that the statement of fact made by the petitioner is entirely abusive and contrary to the truth; for when one were to compare it with the confession of Pieter Heinkes, together with his conduct observed upon the appearance of the Deputy Sheriff and court messenger, one will then find that the assertions in the petitioner's request differ from the confession and the conduct of her husband just as strongly as day from night; wherefore this first point cannot be taken into consideration. That, concerning the second point, namely the alleged composition, it is very natural that the Independent Fiscal need not express himself thereon, because it would be more or less ridiculous to make the actions of an Independent Fiscal or Officer of Justice accountable to every private inhabitant who might just take it into his head to come and incommodate the Council with improper requests. But nevertheless, in order to say something about it out of respect for this Honorable Council, he, the Deputy Fiscal, could testify for his own part that it was indeed true that Pieter Heinkes had been to him with 584 r., in order to effect for him with the Independent Fiscal that His Honor would compound with him; but that it was completely false that the said Independent Fiscal would already have consented thereto; which had also been the reason why he, the Deputy Fiscal, had sent back to the said Pieter Heinkes the money that had been brought to his house by him in the absence of the aforementioned Deputy Fiscal. That as regards the third point, on the side of the Independent Fiscal, one will gladly avow that defensio is juris naturalis; that it is pietatis that a wife defends her husband; that one must not use any political means in the administration of justice; and whatever else of that nature is set down in the petition; but that in this matter it is emphatically denied that Pieter Heinkes has been refused his defense; as it shall be free to him, as soon as the interrogations are finished, to consult with his wife or anyone else about his defense. That the Independent Fiscal had indeed also said this to the assistant Vercueil, who has taken up the case of the mentioned Heinkes, and appointed him to that end to come to His Honor this week; but that, as it appears, that gentleman has not seen fit to intervene in this. That it would nevertheless not be practicable at present to grant access to the detainee Heinkes, since, as he, the Deputy Fiscal, had had the honor this morning to bring to the knowledge of the Honorable President, circumstances had revealed themselves that operate to aggravate the accused, and upon which the Fiscal's Office will be obliged to gather further information; which is also the reason that the Independent Fiscal did not, as was otherwise his intention, serve the claim against Pieter Heinkes today. 133 132 turning out otherwise, the sentence would remain without execution, etc. That whereas now the committed crime, as the independent fiscal trusts, will be proven in the clearest manner, and it is on the other hand certain that the case or fact in question merits a corporal punishment: As stated in the general plaque of 11 October 1740, article 49: Whoever harbors a fugitive or runaway, whether a free person or slave, or provides them with food or otherwise, shall be punished in body and life as a harborer and concealer of runaways; The plaque of 3 September 1754, article 3: No one shall, for whatever reasons it might be, without consent of the master or mistress, harbor or conceal another's male or female slave, on penalty of forfeiting 25 rixdollars for each day or night, for the benefit of the officer who shall make the claim; Article 4: When such harboring or concealment lasts longer than twenty-four hours or takes place with the intention of facilitating their escape, or withholding the same from their masters or mistresses, those who have made themselves guilty thereof shall, without respect of persons, be considered and punished as convicted of enticement or theft of slaves. cannot grant any grace or favors, but must only judge and do justice; That even if one were to accept as truth all the arguments that the petitioner puts forward in support of his request, the same cannot in this case do much for him; since indeed everyone who wishes to purchase one parcel or another at a public auction is bound to comply with the conditions of purchase, and must thus enable himself to pay the purchase money on the stipulated installment days, without delaying a single day, let alone so many months, and not place himself in the dilemma of either acting against his commitment or, through the circumstances of the times, having to ruin his debtors; That it thus appears from this that Your Honorable Worships could very well dismiss the petitioner with his request and refer him to the Governor and the Council of Policy; That however, in case Your Honorable Worships, considering yourselves in this case as sequestrators and not so much as judges, might rather incline to meet the petitioner somewhat in this his predicament—he being certainly abundantly enough provided with temporal means so that one need not fear that the Honorable Company would ever suffer any the least damage thereby—you could grant the request made by him to the extent: That he could provisionally and for the time being keep the purchase monies that have already fallen due in his possession, until such time and while the Secretary shall see fit to transfer these and the further remaining funds into the Company's treasury, which will certainly need to take place the sooner the better; and that he, the petitioner, will therefore have to be mindful to enable himself to have the same in readiness at the first requisition, with the addition of the half percent per month offered by him, after having previously bound himself thereto by written bond. 141 140 That the Representing Officer felt all the more encouraged to take this step by the suspicion, into which he had been brought by the discovery of a partially burned piece of wood between the house of the said Captain Smit and that of the citizen Jan Smit Jurriaansz, that the aforementioned soldiers had had some intention to commit arson, and for the execution thereof had gone onto the flat roof. That the aforementioned claim was also acceded to on the part of the Colonel of the aforementioned Regiment van Wartemberg, and the soldiers Gekler and Herly were accordingly delivered to the Representing Officer, who immediately had them examined orally before the Gentlemen Commissioners from this Honorable Council, and from their answers drew up two respective declarations, annexed hereto under Letters A & B; and furthermore, with all possible speed and accuracy, collected and caused to be re-examined all such statements as he believed could serve to discover the truth regarding the intended crime. Yet that, despite all applied efforts and conducted investigations, the Representing Officer constantly remains in the impossibility of being able to convict the aforementioned soldiers of having had any intention of arson or any other intention prohibited by the civil law; indeed, that even the suspicions which at first were considered well-founded, come to cease and be extinguished by the inquiries obtained; considering that, with respect to Philip Fredrik Gekler, nothing else has been proven other than that he, Gekler, libidinis causa, came to the excess of going first onto the roof of the tavern 't Wapen van Wurtemberg and from there onto the flat roof of the aforementioned Captain Smit; while with respect to the soldier Mattys Herly, not only has the intended crime not been proven, but on the contrary it is established that he was in the barracks during the night between the 22 and 23 February, all appearing from the accompanying statements under Letter C and following. That while it is true that climbing onto another's flat roof in the dead of the night, considered in abstracto and in itself, being a civil crime, ought to be under the jurisdiction of Your Honors and thus prosecuted by the Representing Officer; yet that remaining absent from the barracks, being a more serious crime and under the jurisdiction of the military Court Martial of the Regiment van Wartemberg pursuant to the Capitulation of the 1 October 1786; the Representing Officer, under correction, is of the opinion that the civil crime, as the lesser in this case, ought to follow the military offense, as the greater, and accordingly must also be judged by the aforementioned Court Martial. That 3 143 Wherefore the Representing Officer hereby turns to Your Honors, and submitting all the inquiries obtained by him, declares that regarding arson or any other intention prohibited by the civil law, he can institute no action against the soldier Philip Fredrik Gekler, and accordingly may well permit that he be handed over to the Court Martial of the Regiment Wurtemberg; to the end that he be disciplined by the same court martial for his remaining absent from the barracks in such manner as it shall find appropriate pursuant to the prescribed military ordinances; the punishment for climbing onto the roof and flat roof then necessarily being comprehended under the military punishment. Right Honourable and Respected Sirs, With the greatest regret I have had to perceive from Your Right Honours' very esteemed missive dated 4 February 1790, the dissatisfaction which Your Right Honours were harboring, that by me in the case of the arrested burgher Koch, a statement was obtained only from the slave woman Pieternel and not at all from the other persons who also have knowledge of that case. Since this matter might sometimes cause Your Right Honours to form the thoughts, very disadvantageous to me, that the same was caused by nonchalance, I can therefore most earnestly assure Your Right Honours (since nothing is more agreeable to me than the performance of my duty) that far from any dereliction of duty or inattention having taken place herein, I, on the contrary, being aware of how many weighty matters Your Right Honours are constantly overburdened with, believed that I ought not to interrupt your precious attention with a number of declarations which in the essence of the matter contained one and the same thing, because all the slaves named in the declarations given by Bouwé and the slave Goliath were interrogated by me each in particular in the presence of the commissioned Heemraden and the Secretary, and their answers agreed in everything completely with the deposition given by Pieternel, wherefore I most humbly implore Your Right Honours that this may cause no disadvantageous influence with you regarding my person; as I shall in the future consider it a particular honour to comply with your intention to the letter. In compliance with Your Right Honours' respected orders, there are going with this toward the Cape, Fredrik Wolf, his wife, the slaves Mey, Amelia, Lena, and Pieternel, together with the Hottentot woman Maria and the Hottentots Caffer and Swartbooij, the wagon being under the supervision of Willem Nordman, who declared this to be very necessary, since he, being accustomed to driving the wagons, strongly doubted whether this would otherwise go well, and Paulus Brutto, who resides at the Honing Klip, has undertaken, because of the proximity of the Little Mossel Bay, to keep supervision over both places and to ensure that nothing is lost. proceeded against him, arrived at his farm, he was not present there, and upon his return only then noticed that the aforementioned slaves were at his farm; the prosecutor-proponent believed he ought to investigate who had first harbored the slaves. That upon investigation it appeared to the prosecutor-proponent that the wife of the mentioned Heinkes, named Johanna Davel, was actually the first who kept the slaves on the farm and accommodated them until the return of her aforementioned husband, as Your Honors may read in greater detail in the annexed interrogatories, from Article 1 to 12 inclusive, as well as in the declaration of the slaves of the often-mentioned Heinkes, named September and Mariana of Mosambicque, likewise annexed hereto. That this and other matters give rise to the suspicion with the prosecutor-proponent that she, Johanna Davel, is the principal cause of the proceedings currently brought against her husband, as well as an accomplice to the act charged against him. That the prosecutor-proponent therefore considers himself obliged also to institute criminal proceedings against her, and to that end to cause her to be summoned in person before Your Honors. For which reason the prosecutor-proponent turns hereby to Your Honors with the request that Your Honors may be pleased to grant him their decree to cause the aforementioned Johanna Davel, wife of the detained Pieter Heinkes, to be summoned in person before Your Honors, in order to hear such criminal claim and conclusion or request or requests as the prosecutor-proponent shall think fit to make in the aforementioned matter against her, Johanna Davel, to answer thereto, and further to proceed according to law. Finally, the Honorable President informed the Council that yesterday evening the wife of the aforementioned Pieter Heinkes had been at His Honor's house with a request to be allowed to present a petition today, to the end of requesting from the Council that the case between the Independent Fiscal and her husband might be declared civil and composable; His Honor had replied thereto that he wished to read the petition before it was presented to this table; that the mentioned wife of Heinkes having brought that petition to His Honor this morning, His Honor had perceived therein not only several very impertinent expressions, but also a request to have a copy of the claim and documents exhibited by the officer against her mentioned husband. That, however much His Honor had found that petition also very mal a propos and insolent, His Honor could not with propriety refuse the repeated entreaties of the mentioned wife of Heinkes to nevertheless be permitted to bring the same to the table. Whereupon the often-mentioned wife of Heinkes having been called in and her petition having been read aloud, the same was found to be very indecent, and to contain an altogether premature and improper request, namely to be allowed to have a copy of the claim exhibited by the Independent Fiscal on and against her husband, whereas that claim has not yet been submitted in the Council. For which reason the Council, after reading of that petition, has thought fit not to dispose thereof, but to return the same to the petitioner.
