Extraordinary meeting, present the Honorable Johannes Izaak Rhenius, president, and all the members except the Honorable Independent Fiscal, as well as Messrs. Ronnenkamp and Maasdorp, the first two on business, and the latter through indisposition. After the Honorable President had communicated to the council that the burgher Sebastiaan Rothman, in the name and as the proxy of the detained burgher Godfried Fredrik Koch, had addressed his Honor with the request whether the said Koch, who had fallen gravely ill in detention a few days ago, might nevertheless submit a request as soon as possible, and that his Honor had convened this extraordinary meeting on that account: There appeared in the Council the said burgher Sebastiaan Rothman, who delivered the following request in the name of the aforesaid Koch. To the Honorable Johannes Izaak Rhenius, President, as well as the other Honorable Council of Justice of this Government. Honorable Gentlemen, Your Honors' very humble servant, the currently detained burgher Godfried Fredrik Koch, makes known with due respect: How he, petitioner, has been brought under suspicion by his own slaves before the Honorable Independent Fiscal of this government, Johan Nicolaas Steeven van Lijnden, as if he had been guilty of the theft of goods from the Dutch ship De Maria, which ran aground in Plettenberg Bay in the year 1788; which accusations, however untrue, nevertheless had that unfortunate consequence for the petitioner, that he, having been apprehended by order of your Honors, has been placed in detention here. 159 That however much he, petitioner, is also convinced in his conscience that the evidence which the Fiscal, plaintiff, may have obtained can never ever be found of sufficient weight to convict him, petitioner, who is entirely innocent and never transported any other goods than those which he had purchased for trade, of a crime that was not committed: The circumstances in which the petitioner finds himself have nevertheless made him consider that, even if he were to await the proceedings of the officer, and indeed even triumph therein, as he firmly trusts, he remains exposed to significant disadvantage, as: 1. The witnesses whom the petitioner needs in his case reside far inland, so that considerable time is required to have those persons come here, while in the meantime the petitioner's estate, consisting of two farms, a large number of slaves, livestock, as otherwise appears from the inventory drawn up thereof by your Honors, would have to be left without the petitioner's otherwise so necessary supervision, 158 and the petitioner would thus be exposed to a great loss. 2. That however favorable the proceedings might turn out for him, petitioner, he will nevertheless not be able to avoid the further prosecutions of the officer, as it is without doubt certain that the officer, upon losing, will surely appeal the verdict to the Honorable Council of Justice at Batavia, by which step the petitioner would once again have to suffer the very same inconveniences which he is currently undergoing, and which would thus render him unable to properly manage his property during the period of 2 to 3 years. That he, petitioner, for the aforementioned reasons and in order to prevent all those consequences for himself, has now deemed it most advisable to turn to your Honors, as he does hereby, with the very respectful request that it may please you to declare this case civil and composable, trusting that your Honors, 161 taking into consideration that the petitioner has already been afflicted with a severe fever for several days and has thus had to keep to his bed for several days and nights, will grant a favorable apostille upon this his request, so that he, petitioner, freed from all further unpleasantness, may return to his place and the conduct of his affairs. Below stood: Doing which, etc. Was signed: G. F. Koch. After which reading the Deputy Fiscal, Gabriel Exter, acting in these parts on account of the indisposition of the Independent Fiscal, was heard thereon, who declared that, however much the action which the Independent Fiscal has instituted against the said Koch is entirely well-founded, as maintained by the Fiscal's office, some inquiries from persons residing in the outer districts must nevertheless still be obtained, and 160 a further investigation must be made regarding several particulars, whereby this case will surely drag on for some time yet; but that on the other hand the officer, in consideration of what the petitioner has put forward in his request, left the matter to the judgment of the council, with the proviso nevertheless that the Independent Fiscal reserved the right, should the council proceed to condescend to the petitioner's request and the settlement before the Commissioners nevertheless not be reached, to proceed further with the prosecution, requesting on that account that in such case the matter might be considered on the same terms as it stood before the decree of settlement. And hereupon, after ripe deliberation on the submitted request, by a majority of votes, the following decision was made: The Council, having read the request of the detained Godfried Fredrik Koch and having heard the officer thereon, declares this case civil and composable.

O. Eischer moge hebben ingewonnen, nimmer af nooyt van dat gewig¬ zullen kunnen bevonden worden, om hem suppt die geheel onschuldig is, en nooyt eenig ander goed heeft vervoerd, als het welke hy voor negotie had s ingekogt, dus te overtuygen, van een misdaad die niet is bedreeven: De omstandigheeden, waarin den supplt. rig bevind; hem suppt echter hebben doen overweegen dat hy, schoon ook de proceduures van den officier blyvende afwagten, ja zelvs daarinne, zo als hy vast vertrouwd truimpheerende, evenwel aan important Nadeel geexponeerd blyfft: daar 1 de getuygen, welke de suppt. in zyne zaak nodig heeft, verre landwaards in woonachtig zyn, zodar 0 er een geruyme tyd word vereischt, om die per= sooren herwaards te doen op komen, terwyl intuschen des Suffts. Boedel, bestaande in twee plaatsen, een groot aantal slaven, Vee, als anderzing by den daarvan door uwelEd Agtb: geformeerden Inventaris blykende, zonder des suppts. anders 2d noodzaakelyke opzicht zoude moeten gelaaten 158 en de suppt dus aan een groot verlies t blootgesteld worden. — 2 .) Dat hoe gunstig de proceduure ook voor hem supple. mogen uitvallen, hy evenwel de verdere poursuites van den officier niet zal kunnen ontwyken, alzoo het ongetwyffeldzeeker is, dat den officier succumbeerende, gewisselyk van het vonnis zal komen in appel aan den Achtb: Raade van Justitie te Batavia, door welke demanche de suppt al wederom, die zelve in commoditeiten zoude moeten lyden, welke hy thans werkelyk ondergaat; en die hem dus geduurende den tyd van 2 a 3 jaaren buyten Staat zoude stellen, om zyne goederen na behoren te administreeren. Dat hy Suppt. uyt hoofde voorsz: en om alle die gevolgen voor hem te praevenieeren, thans raadzaamst heeft geoordeelt, zich te wenden aan UwelEd Agtb: gelyk hy doet by deezen, met zeer Eerbiedig versoek, dat het van der zelver welbehaagen zyn moge, deeze zaak te verklaaren Civiel en comporitel, ver= trouwende de supp„t. dat Uwel Ed. 163 162 While furthermore the gentleman Hendrik Justinus de Wet, who was of the opinion that the requested composition should be rejected and Koch, on account of his indisposition, be released from his detention under a surety of 2000 rds. And the gentleman van der Riet, who advised that the requested composition should likewise be rejected, on the grounds that if the crime with which Koch is charged is proven, no composition can apply to it; and if the said Koch is innocent, it would involve a hardship to impose a fine on such a person above and beyond the detention. Had their votes recorded in the minutes. After which the said deputy fiscal Exter declared verbally in the council that yesterday a report had come in that a certain Engel, who had gone out with the youth Johan Diederik Beneke to shoot at masked weavers by the hedges, just when the latter was busy putting the cock at half-cock, was struck in his loins from behind to such an extent that he died a few moments later; he, the deputy fiscal, thereupon immediately, after having performed an inquest on the corpse together with the commissioner gentlemen, made very precise inquiries among those who had been present at that unfortunate event and had meanwhile been summoned before the council chamber; that, however, not only had the own parents of the aforementioned Engel attested to him, the deputy fiscal, that the said Beneke had always lived in very good harmony with their son and had always had familiar intercourse with him, but that likewise from all further circumstances it appeared that 165 164 what occurred is to be attributed to nothing other than a sheer casualty, on which account the said G: Exter on behalf of the Fiscal Office declared that he could institute no action regarding the aforementioned matter against the person of the said Johan Diederik Beneke; requesting at the same time that the same may be relieved and acquitted thereof by this council by decree. Whereupon the aforementioned Johan Diederik Beneke, who appeared in council together with the citizens Johannes Ernestus Weesberg, Hermanus Mulder, the slave Domingo, and a certain youth Ockert Brits, being asked how the incident had occurred, answered thereto that he, with the said Engel, as they were often accustomed to do, had also gone out yesterday to shoot at masked weavers; that they had gone to sit there, by estimation thirty to forty paces from each other, in order to shoot at the birds which continuously passed by; that, while Engel had positioned himself with his back towards him, he, having held the gun on his lap, had attempted to put the cock, which had been cocked, at half-cock; that, however, the shot had immediately gone off thereupon, and he had also immediately noticed that his said comrade Engel was hit; testifying with many signs of sorrow that this incident had occurred in no other way than accidentally. The said Weesberg subsequently having declared in judicio that he had gone out with the aforementioned Ockert Brits likewise to shoot birds; that, however, as soon as he had gone to sit by the hedge, he had heard a shot there and immediately had heard the aforementioned Engel, who stood up and made his way towards him, Weesberg, cry out: O God, I have a shot, without anything else of this, however, being known to him, nor to the aforementioned 167 and requests justice The plaintiff renounces further productions The defendant likewise renounces further productions 166 Hermanus Mulder and the slave Domingo, who declared that they only arrived there after the incident had occurred; the aforementioned Engel, who was still refreshed by the just-cited Weesberg, having passed away after having lived for about 20 minutes. And whereas from all circumstances it is manifest that the aforementioned incident is to be attributed to nothing other than a sheer casualty. Thus the council, having attended to the declaration of the officer and to all that merited reflection in this matter, has relieved the person of Johan Diederik Beneke as entirely innocent from the action of the officer. acting in the affairs of the Landdrost of the Colony of Stellenbosch and Drakenstein, submitting a report from the Hottentot Gerrit Bastaard and four statements made by several other Hottentots before commissioners, made known how a certain Hottentot, Jan Paerl, had in the year 1788 caused unrest among various Hottentots in this country by making them believe that he knew that the world would come to an end on 25 October of that year, and caused a large number of the Hottentots residing with the Christians and in the kraals in the vicinity of their farms to conspire together, and further put into their minds to entrench themselves on certain high hills, furthermore to slaughter their cattle, and, as appears more fully from the abovementioned documents, to commit various other follies, which certainly in themselves considered are ridiculous, yet however foolish and childish, might nevertheless have had harmful consequences, if one had not in time convinced those creatures of their folly, and thus countered the further effects of the false delusion into which they had been led by the often mentioned Jan Paerl. That the said Landdrost, however, having considered it his duty to issue the necessary orders to have the aforesaid Jan Paerl, who had taken to flight, apprehended; the same Jan Paerl had nevertheless not been taken prisoner until now, and brought in custody to Stellenbosch. That however much he, the Landdrost, did not find himself sufficiently able to initiate criminal proceedings against the said Jan Paerl, he nevertheless, in order to check those disorders which might arise for the colony here from such conduct by the same, took the liberty to submit for the consideration of the Council whether their Honours would not think fit to have the cited Jan Paerl put in irons, and to have him work for his food on the Colony's public works at Stellenbosch, with an express prohibition not to venture further than the distance of three hours around the Drostdy. Which having been deliberated upon, the Council agreed to the proposal of the said Adjunct Fiscal in this matter, with this condition, however, that the Hottentot Jan Paerl shall only provisionally be put in irons. Furthermore, there was produced by the said Adjunct Fiscal, acting in his official capacity for the Landdrost of Graaff-Reinet, an attestation granted by the surgeon of that colony, Carel Philip Zastron, concerning the post-mortem examination of the body of the substitute Johan Adolf Jurgensen, and at the same time a request was made, whether, since the said attestation was indeed good as to form, but as to substance some obscurities had arisen in it which would hinder him in formulating the criminal charge against the detained burgher Tobias Mynhardt, in order to be able to give that elucidation regarding the condition of the wounds inflicted on the said Jurgensen, which he as an officer would otherwise be obliged to supply to the Council in this critical case; it might therefore please the Council to place the aforesaid post-mortem report into the hands of experts, in order to be able to proceed with all the more certainty in this matter upon the advice given regarding it. Which request having been taken into consideration, it was thereupon approved to place the cited surgical attestation into the hands of the three chief surgeons of this Government, the Honourable Hendrik Le Sueur, Johannes Leuwer, and Didier Pallas, in order to serve this Council with their considerations thereon. Subsequently there appeared in the Council the wife of the aforesaid detained burgher Tobias Mynhardt, presenting a petition of the following content: To the Right Honourable Johannes Izaak Rhenius, President, together with the further Honourable Council of Justice of this Government at the Cape of Good Hope. Right Honourable Sir and Sirs, Shows with required respect and submission your Honours' very humble servant Anna Elisabeth van Nimweegen, wife of the detained burgher Tobias Mynhardt. That she, the petitioner, having taken into consideration the deplorable state in which her aforementioned husband has had to languish through a lengthy detention. That she, the petitioner, by virtue of the close relationship through the bond of marriage to this her presently unfortunate husband, considers herself by nature bound and obliged to assist her aforesaid husband in this his need according to her weak ability, to administer and supply him with what he might need as a foundation for his exceptions and defenses which he might or could propose. That although she, the petitioner, has been informed that the laws are very strict and severe against those who come to commit any great faults, crimes, or offenses, and that to that end it is ordained that one may and must proceed both by accusation and by inquisition. Yet those same laws strive even more for the exoneration than for the incrimination of all kinds of accused persons, as she understands that in all offenses it must appear as clear and clearer than the sun at midday. To which end all prisoners, whether one wishes to proceed against them in the ordinary or the extraordinary manner, are fully permitted to conduct their defense. That since she, the petitioner, firmly trusts that your Honours will know that defense is of natural law, which cannot nor ought to be denied to anyone, and that the defense, without correction, must especially be permitted, if justice is to be purely pronounced.

how their Honors, pursuant to the order of the 26th of this month issued upon the petition presented by the detained burgher Godfried Fredrik Koch, having attended for the composition between the Lord Independent Fiscal and the said Koch, the agreement nevertheless could not be reached, since the Adjunct Fiscal, the Honorable Gabriel Exter, claimed 6000 rds. on account of the Lord Fiscal, and Koch had offered only 2500 rds., so that their commission had ended fruitlessly; and it was thereupon resolved by the Council to have the Lord Independent Fiscal asked by the Secretary of this meeting whether His Honor accepted the offer made by the said Koch, namely to give 2500 rds., with the addition that if His Honor did not consent thereto, the proceedings against the said Koch would then have to be continued, and the still lacking evidence obtained as soon as possible; the Secretary being required to give the necessary notice of the result thereof to the Commissioners, Thursday the 20th of May 1790. In the morning, extraordinary meeting, present the Honorable Johannes Izaak Rhenius, President, and all the Members. The Council, after reading and reviewing the documents and legal proofs exhibited in Court, considering that from the proceedings held in this matter it has clearly appeared that the servant of the defendant has transgressed in the selling of wine against the placcaat of the government, administering justice in the Name and on behalf of the High and Mighty Lords States General of the United Netherlands, Condemns indeed the defendant Jan de Villiers Jan Pietersz to the fine established by Placcaat of One Thousand Guilders Indian Valuation, but leaves the defendant his right of action in this regard reserved against his servant; with further condemnation of the defendant to all costs incurred in this case. 195 194 Composition of the detained burgher Godfried Fredrik Koch, the decision taken in Judicio having been addressed to him, he, the Honorable Independent Fiscal, on the proposal made in such manner as dictated by the decision, received as an answer: That his Honor had believed that, as his Honor had been previously informed, the estate of the said Koch was estimated to yield ƒ 80 to 9000; that his Honor for that reason could not bring himself, as an officer, to settle the case of the said Koch for a small sum, since this would not at all satisfy the rights of the High Sovereign which his Honor maintains as fiscal, all the less so because it was fully known to his Honor what evidence militated against the said Koch and what statements could still be obtained to his charge; but that his Honor, however, now being further informed regarding the condition of the estate of the aforesaid Koch and assured that his possessions do not amount to as much as had been stated, accordingly accepted the offer made by the said Koch, with the condition nevertheless that, to prevent misfortunes, the slave Galiat, as the one who brought the deed to light, must be sold for the benefit of him, Koch, under this condition of never again coming under the power of the said Koch or anyone belonging to him. aforementioned sentence with due obedience, but also finds himself fully assured that Your Honorable Worships, with your highly enlightened insight into matters, continually care for and keep in view the prosperity and welfare of your subjects and of those over whom you are placed. It is therefore that the undersigned, S K, takes the liberty to inform Your Honorable Worships of the substantial damage that his principal would suffer if the said sentence were carried into execution, the more so because the aforementioned slave was bought by him at a public auction for a sum of 200 rds, and if that slave were now to be sold publicly again for the account of the principal claimant under such conditions as are expressed in the aforementioned sentence, the same would then perhaps not yield half of the above-mentioned purchase price. In addition, the principal petitioner has further been condemned to a monetary fine of one hundred rixdollars for the benefit of the official prosecutor, to which are added not only the costs of these proceedings, but also the costs that were incurred during his detention since Primo January of the current year, along with such costs as may arise from a public sale. a written claim, furnished with an account from the messenger of the court, namely that water is led into his garden via a small gutter over the millstream, but that it was thereby deprived of the required water, and thus rendered unable to grind the necessary grains for the Honorable Company's bakery. That after his Honor had informed himself about the orders which had been drafted and determined on that matter by the government, his Honor had then spoken with the aforementioned owners of those gardens about it; that upon the answer received from them, that the miller had been drunk and had spared the truth, his Honor had then sent the court messenger thither, who subsequently had also duly reported on his findings and delivered a written account to his Honor. That his Honor had now drawn up a written claim for the convenience of the Council, which his Honor submitted, furnished with the aforementioned account of the court messenger, requesting, however, that this case might therefore be settled summarily, as his Honor could have sufficed with merely having the defendant summoned to see execution decreed. The defendant, having heard the claim read, answers thereto that he has given no order to lead the water into his garden; that he cannot deny that the water was in his garden at the time the messenger was there; but that he declares to have questioned all his slaves about this, and learned from them that none of them had opened the sluice and led the water into the garden. The honorable Plaintiff in his official capacity persists with his claim, the parties renouncing further submissions. The Council, after considering everything that merited reflection, administering justice in the Name and on behalf of the High and Mighty Lords States General of the United Netherlands, denies the honorable Plaintiff in his official capacity his claim made against the defendant, with condemnation, however, of the defendant to the costs, provided that the defendant declare under solemn oath that he not only did not himself in any way lead out the water against the order of the government, nor gave any order or commission thereto to his slaves or anyone else, but that such also did not occur with his prior knowledge; but in default of this oath, the Council condemns the defendant Coenraad Nelson to the fine determined by the ordinance of the Government dated 3 April 1787. 273 regarding the use of the water coming down from Table Mountain to this settlement, to distribute the Honorable Company's watercourse into his garden as expressed in the said placcaat, with costs; and to hear such claims and conclusion as the Honorable Independent Fiscal, pursuant to the orders issued regarding this, shall see fit to make and take, to answer thereto, and further to proceed as according to law. The assistant Senior Wm. Kolver, legitimating himself with a power of attorney granted by the defendant on the eighth instant, advances in reply orally the following: In answer to the conclusion of claim taken by the Honorable Independent Fiscal, I, as special proxy of the defendant in this matter, having first properly legitimated myself by producing a special power of attorney, shall briefly state: That, without determining the precise day or date, the court messenger Carel Ewald Lietvoogel came to the house of the defendant in order to challenge him, in the name of the Honorable Independent Fiscal, with a pecuniary fine of fifty rixdollars, regarding an alleged fraud caused by a seepage of the water coming down from the mountain, above at the end of the defendant's garden; To this point, Right Honorable Sirs, it will then be remarked that this seepage has not brought about the slightest hindrance to the usual watercourse; which insignificant seepage is to be imputed to none other than the defendant's slaves, while the defendant, being a man who suffers from a chest ailment in a debilitated condition, is on that account prevented from taking any notice or inspection of the ordinary work of his slaves, much less of the watercourse which he enjoys in his turn. While the defendant can testify in all conscience that, on account of his debilitated condition, he has taken not the slightest notice whatsoever, much less had any knowledge of having thereby perpetrated the least fraud with respect to the established laws. In order to further support in due course, if necessary, all these previously alleged motives, the defendant, rejecting and denying both generally and specifically all arguments adduced by the Honorable Independent Fiscal or yet to be deduced, and answering to that end, concludes to the effect of inadmissibility by order, and that by definitive judgment of this highly enlightened Court of Justice, the claim and conclusion made and taken by and on behalf of the Honorable Independent Fiscal upon and against the defendant shall be denied, with condemnation of the same to all the costs of these proceedings, or to such other end as your Right Honorables according to law and equity shall deem proper. The plaintiff produces a written claim, to which is attached the report of the second court messenger Johannes de Wit, concluding at the end of the same. The assisting etc. Sr. Wm Kolver, as general authorized agent of the defendant, answers thereto in the manner as follows: In response to the claim made by the Honorable plaintiff and the conclusion drawn thereafter, I, as authorized agent of the defendant in this matter, shall have the honor to inform Your Honorable Worships: How on Thursday the 25th of March of the past year, the court messenger Carel Ewald Ziervogel, in the name of the Honorable plaintiff, had presented himself to the defendant in this matter, to the end of receiving from the same, in the name of the Honorable plaintiff, a fine of 50 rds in which she was challenged by the Honorable plaintiff regarding an alleged fraud, which the defendant committed on Thursday the 20th of the said month of March regarding the damming of water which flows down from the mountains through the gardens into the canals, and of which the Company's watermills, as well as the defendant and all the gardens situated thereabouts, take turns enjoying. The alleged fraud with which the defendant is accused amounts mainly to this: that on the aforesaid 20th of March at 4 o'clock in the afternoon, the water coming from the so-called Platte Klip flowed down very weakly, since the washers had dammed and held back the same there; the defendant, however, needed the water at that time for the preparation and mixing of a quantity of clay, which served the defendant for the bricking up of a hole in a wall, and for which she notoriously had necessary use of a small amount of 4 to 5 watering cans; thus an enslaved boy belonging to the defendant held back the water a little with a stone, in order to thus be able to scoop up a little water effectively. On which occasion the Honorable Company's miller, assisted by the substitute court messenger Johannes de Wit, came to the house of the defendant in order to inspect the aforesaid water. Regarding the leaving of the water in the trench near a sluice, one shall reflect that it is indeed true that the water stood in it for about 10 to 12 feet, but such can happen there, since the trench of the water conduit lies about 10 to 12 feet from the sluice and is filled with water most of the time, and from which it also results that the trench is somewhat deeper there, as the defendant also pointed out to the court messenger Ziervogel; which water has already run into it for a considerable series of years up to the present, as well as through the garden now possessed by the burgher Servaas de Kok, while the ground absorbs no more water and consequently

216 consequence some water always remains standing in the aforementioned ditch; neither the Court Messenger nor the miller will be able to declare that water has run through the defendant's sluice, on which account he fully rejects and denies everything that has already been said, or could yet be said, on that matter. As regards now the damming up of the water in the great river, on that subject I shall have the honour to substantiate: That it is customary among all gardeners for the vegetables that are brought to market to be rinsed therein, which however mainly arises from the fact that with the excess soil, which comes from pulling them out and cleaning them, and one or two stones, one dams up the water a little, in order not to let the vegetables wash away, without preventing the Company's Watermills from having their proper use thereof, regarding which however multiple disputes have already arisen with the miller of the Honourable Company. However, I shall still have the honour to demonstrate from what this whole issue arises, since the miller of the Honourable Company is most in need of water in the afternoon, and an innumerable crowd of people wash at the so-called rock, but if the aforementioned miller were to quietly breach several dams with a couple of slaves (which is done in the summer season by most gardeners), the mills would then enjoy infinitely more water, and no complaints would ever arise concerning this: 217 With which I trust to have answered the claim of the Honourable Independent Fiscal to Your Honours most clearly, further denying, both generally and specially, all the arguments already brought forward, as being utterly unfounded, abusive, and frivolous; The defendant concludes to the effect of non-receivability in due course, that by definitive judgment of this highly enlightened court, the claim of the Honourable Independent Fiscal shall be dismissed cum expensis, or to such other effect as Your Honours shall find to be proper according to law and equity. The Honourable Independent Fiscal, in reply, advances that from the defendant's own confession in his capacity, that which was stated in the claim is corroborated. His Honour persists in his claim. The defendant likewise persists in what he has put forward, and requests permission to submit two more private declarations, which declarations had only been executed privately because there had been no opportunity this morning to draw them up notarially so quickly. Further requesting that it may please the court to stay this matter until the aforementioned declarations shall have been duly executed before a secretary. The Honourable Independent Fiscal requested against this that, since it is outside the practice of the law to render justice on private unsworn declarations, the court would therefore be pleased to return the aforementioned defective declarations to the defendant. were brought in sooner or later, to pay the aforesaid cash received on commission into the Company's treasury at that time. That subsequently the estate of the petitioner's husband was also sold by summary execution for the recovery of that which was due to the Honorable Company, so that the painful consequence of the aforesaid step taken by the petitioner's husband plunged her and her children into the most unfortunate situation; That, however, before his departure from here, the petitioner's husband assured the petitioner sincerely that he had not held more than 70 to 75000 guilders under his custody in the aforesaid manner, which also completely reassured the petitioner and made her hope to receive back a considerable capital of guilders from the monies proceeding from the sale of all her property, and thus to be enabled thereby to subsist with her children, who, like her, must share in that unhappy fate. That she, the petitioner, felt all the more strengthened in this hope when she learned that Your Right Honorable Worships had proceeded to the so praiseworthy, prudent, and in all respects advantageous decision for her, not to proceed to any condemnation or determination of the amount that would be brought forth from the estate of the petitioner's husband, before and until statements under oath had been obtained here from all the persons who had been noted on certain lists by the commissioners expressly appointed for that purpose, who had officiated to trace the deficit of the Honorable Company from the transfer books, ordinances, and cash books. That it furthermore came to the ears of the petitioner indirectly that, pursuant to the inquiries obtained thus far, much had already been found to the advantage of her estate; that various people had been gifted the Sovereign's Right; that some had also paid off the monies into the cash box and others again to clerks at the political secretariat, just as this was related to the petitioner herself by various of such deponents, so that she trusts that this point, speaking entirely to the advantage of an unfortunate woman and children, will not escape the attention of Your Right Honorable Worships. That however much the petitioner also holds herself assured that the Honorable Company is entitled to no more monies from her estate than what she has stated above, and however much she is also fully aware that after the conclusion of those investigations she will receive back a considerable sum from her important estate; the petitioner nevertheless not only has seen herself deprived of those monies since the aforesaid procedures and thus in a lapse of approximately two full years, but even now for a considerable time has had to bend under a reproach and condemnation that the Honorable Company would come up short by her estate. The petitioner declares before Your Right Honorable Worships that this circumstance is grievous to her, and still holds herself assured that the outcome will show Your Right Honorable Worships that she could safely rely upon the declarations made by her husband. Yet, Noble and Honorable Sirs, just as she on the one hand very well perceives that however actively one may proceed, it will nevertheless not be possible to obtain all the required inquiries for the time being, at least not within one and possibly two years, from the inhabitants residing so far upcountry, and to place Your Right Honorable Worships in a state of knowledge regarding the monies of the petitioner; so is she, the petitioner, on the other hand also convinced that she remains, regarding the state of her estate during all that time, in the same uncertain maelstrom as that in which she has moved until now, and not only that, but that even therefore those decent attempts which the petitioner's husband might make with the sovereign to obtain pardon, absolution, remission, or other permitted means to be relieved from the pursuits of the one who upholds the rights of the high authorities, could be rendered fruitless and of no effect, besides that she and hers must still constantly groan under that grievous delay, that the Honorable Company will fall short by her estate. The petitioner has therefore not neglected to consult with her family, who has thus also promised her, since they, like the petitioner herself, are convinced that it will later be found that her husband enjoyed no more than the sum stated hereinbefore, and thus much less than the yield of her estate currently held under Your Right Honorable Worships' sequestration amounts to, to assist her in this circumstance. And since their aim now is, if it were possible through their intercession, to cause all claims made on account of the pretension on the petitioner's estate on behalf of the Honorable Company to cease; under the express condition, nevertheless, that to the petitioner or the interested parties, if they sufficiently demonstrate that more monies were paid to the Honorable Company than the petitioner's husband actually enjoyed, all that was overpaid in the manner aforesaid shall be refunded. Ryneveld Secretary The Honorable Independent Fiscal here, Johan Nicolaas Steeven van Lynden, having made known to the Honorable Lord President how His Honor, as appears from the minutes held before the Commissioners on the 30 April last, had agreed to a composition with the burger Godfried Fredrik Koch, then held in detention, for a sum of 2500 rds in such manner that the said Koch would have to provide sufficient surety for that sum on that very date, without which security the composition would be held as not made; that however the repeatedly mentioned Koch, not having been able to provide that surety, had his 227 228 caused to be offered to His Honor provisionally, for the security of the aforesaid sum, to specially bind his following enslaved men and women here at the Cape, namely: Pieternel of the Cape Lena of Onrust Amelia of the Cape Casar of Bengal May of Ternate Frans of Mozambique, and September of Malabar until such time as he should be set at liberty, upon which he would immediately ensure that the necessary surety were provided or the agreed funds effectively paid in cash; His Honor, upon this offer, had accommodated the said Koch and entered into the aforesaid further agreement, pursuant to which, on the 3 of this month of May, a proper secretarial deed thereof was executed, whereby he, Koch, had declared to specially bind the aforesaid slaves, as stated above, for the sum of 2500 rds agreed upon by composition, and, in case he could obtain no further security nor promptly pay the aforesaid funds, to surrender the said slaves for execution before all the Lord's Courts, laws, and judges, and in particular the jurisdiction of the Honorable Council of Justice of this Government. That His Honor had therefore also expected that the said Koch would have exerted himself to comply with the aforesaid obligation, but that since His Honor had now already exercised patience for a month without Koch—notwithstanding his having been repeatedly admonished to do so, and having also made promises to provide surety or pay the funds—having 229 fulfilled either the F 231 230 one or the other; His Honor therefore, and considering that the said slaves had been held in custody here since that time, and would furthermore be exposed to illness by a longer delay and cause greater expenses, requested of the said Honorable Lord President that the mentioned slaves might be judicially sold, both for the sum agreed upon by composition and for the costs incurred in this matter. The Council grants the Defendant the requested copy, in order to serve an answer thereto fourteen days from today. The gentleman Claimant submits a dictum for the roll of the following content: Upon consideration of the request made by the burgher Jacobus van Leeuwen in his capacity, it has appeared to the undersigned that the appeal requested therein cannot be granted to the claimant, because, the petitioner's principal having been unable to deny the act, it is consequently also certain Against the Heemraad at Stellenbosch, the Honorable Jan de Villiers, Pieter's son, requested party, in order to hear proposed the arguments concerning a certain appeal requested by him, the requested party, with expenses. The said Honorable Independent Fiscal Johan Nicolaas Steeven van Lynden, ex officio, Plaintiff. certain that he had already, prior to the pronouncement of the sentence, incurred the customary fine of One Thousand guilders, and that thus the sentence of Your Noble Worships in effect merely contains a declaration that the act committed by the petitioner's aforesaid principal, or indeed his servant, in the name of the master, was fully proven and fell within the terms of the law. The petitioner in his capacity also appears to have felt the groundlessness of the request made by him, because he so emphatically testified to have lodged an appeal by order of his principal. Furthermore, Your Noble Worships may be pleased to observe that if one were to grant an appeal in similar cases, it would become almost impossible for an officer to effectively prevent smuggling; because by always allowing oneself to be constrained to payment (which the undersigned nevertheless does not expect of Jan de Villiers), and thereby obtaining the opportunity to appeal, one could in the meantime, through repeated smuggling, earn so much that one could very easily make good the legal costs, and moreover still enjoy a handsome livelihood for oneself, to the considerable prejudice of the tax farmer and consequently also of the interests of the Honorable Company. And on these grounds, the undersigned trusts that Your Noble Worships will be pleased to dismiss the request of the Petitioner. Especially since it is in living observance at this Tribunal that an appeal regarding such fines determined by law is not customary to be granted; see Criminal Court Roll of 22 January 1789. Besides it also being a constant practice throughout all of Europe that the decision over leases and what further concerns financial matters must be left to the decision of the local Judge; as being best able to apprehend the consequences that such frauds may entail to the detriment of the place situated under their jurisdiction. Case appellant, of the one part, against the Independent Fiscal, the Honorable Mr. Johan Nicolaas Steven van Lynden, former Plaintiff, now Appellee. Right Honorable Sir and Honorable Gentlemen. The appellant in his capacity will have the honor to state with the required respect that, upon special instruction from his principal's general attorney, the Comforter of the Sick mentioned in the heading hereof, under date of the 27th of the past month of May, he caused the Independent Fiscal, the aforementioned Honorable Mr. van Lynden, to be required by this Honorable Council to hear requested a writ of appeal to the Court of Justice of the Castle of Batavia, from such sentence as was pronounced by this Honorable Council under date of the 20th of last March, to the prejudice of the principal defendant, in this case appellant. That, on the appointed day, the requested writ was contested by the aforementioned Honorable Independent Fiscal, and a copy of the submitted request was asked in order to submit arguments today, as the appellant in his capacity, having been well and lawfully cited to that end in due time, also with all due propriety takes the liberty to submit counter-arguments today, and proceeding thereto, to reflect: That however much the Officer might please to maintain that, if in the present case the requested writ were granted, such would have terrible consequences for the fiscal office. That, with all due respect, this objection cannot be considered to be of such force and effect that the principal appellant would thereby be deprived of a legal remedy that is received in practice before all courts of law and tribunals in the Netherlands, and in full observance, so that in the 198th and 205th Articles of the instructions of the Court, one explicitly finds these notable words: "everyone is free to appeal from sentences, judgments, interlocutory decrees, and other dispositions by which he considers himself aggrieved." Indeed, even a third party can and may appeal for his interest, according to the doctrine of Merula folio 185, provided it is done in order, step by step, see Munniks' Modern Jurisprudence, book 48. Nieuwstadt and Coornhert: Dutch Practice, observation 36. And that this legal form of the Netherlands is not only based on reason and equity, but is also grounded both in current law and in Roman law, is a proven matter. It is for this reason that one reads, in the first law of the Digest on appeals, these words of Ulpian: "for although appeal is an ancient and customary practice, it is also at the same time necessary, which is all the more compelling when one considers its purpose, for it can be unknown to no one that thereby, namely in the appeal, everything is anew accurately reviewed and corrected, and therefore rightly called: a benefit of the law to supply that which was omitted in the first instance, either by the judges or by the advocates and proctors. See Code, Digest on appeals, saying: appeal is a privilege of the law, to correct that which was neglected in the first instance, and was overlooked both by the judges and by the advocates and proctors." And thus, with all due respect, it would in the first place be an obvious hardship that an honest man, feeling aggrieved by a judgment subject to appeal, would not be permitted to enjoy a benefit granted to him by the law. But possibly on the part of the Officer it might still be objected that from a fine or monetary penalty, being arbitrary, no appeal can be granted: The appellant in his capacity will once again remark on this that this, as he believes, only applies when such a fine is imposed upon the condemned party by summary justice, namely without the formality of a trial, so that it shows itself that this objection does not apply when a case is formally pleaded. The more so, when Your Right Honorables please to be informed that the appellant's servant Steven van der Hart, on top of all this, has absconded with a considerable sum of money and has remained absent to the date hereof. And thereby proves to the satisfaction of the judge in fact to be a person who seems to have intended solely to ruin the appellant. So that it appears sufficiently therefrom that the principal Appellant therefore trusts that Your Right Honorables will make not the slightest difficulty in favorably granting him the requested Writ of appeal. 243 242 After which reading, the petitioner submitted that the aforesaid written statement of counter-interests requires no refutation, that it either contradicts itself in all respects or cites matters that are not relevant to the case at hand, that only the terrible consequences cited by the respondent would be to fear if the officer colluded with the judge, but since such is not the case here, as the officer is always submitted to the judge, this fear of the respondent is therefore entirely unfounded, and that furthermore regarding the appeal, the positions of the respondent do indeed hold true insofar as a matter, having been left to the discretion of the judge, is adjudicated here, but that nevertheless, as in this case, when the fine has been determined by the government, then no appeal can lie against the condemnation or decree of the judge, since the judge sits only to maintain the ordinance and to decree the full execution against the violators, thus persisting with the aforesaid submitted dictum. The Council, after deliberation on what has been brought forward by the parties, declares that no appeal lies in this matter, consequently denies the request made by the present respondent, and condemns the respondent in the costs. To the Right Honorable Johannes Izaak Rhenius, President, together with the other Honorable Members of the Council of Justice of this Government. The Landdrost of Stellenbosch and Drakenstein, Hendrik Lodewyk Bletterman, respectfully shows: That on Wednesday the 14th of the recently passed month of April, notice was brought to the memorialist by the discharged soldier Johan Fredrik Prenger, earning his living with the shoemaker's trade and residing at the Knoflooks Kraal, situated on the other side of the Hottentots Holland mountains: that he, Prenger, in the night between the 10th and 11th prior, having been awakened by a noise behind the house and specifically in the stable where he had locked up his ducks, had gotten up, and presuming that there might be thieves in the stable to steal his ducks, had also awakened the Hottentot in his service, Daniel Boosman, and having provided himself with a stick and the said Daniel with a musket, had proceeded with him to the stable; but having perceived no thieves there, he had returned home again, when he heard the ducks quacking, whereupon, following this quacking together with the said Hottentot, he had discovered the thief, who, upon the repeated calls of the aforementioned Daniel to stand still, had fled into the river or into the palmiet reeds standing there. That he, Prenger, having made the aforementioned Daniel remain there, went home and brought along a lantern, and subsequently, as well as the aforesaid Daniel, threw several small stones and clods of earth into the palmiet reeds in that vicinity, until the thief, who was found to be a slave of the burgher Jan Otto, named Anthony, came forward, was taken prisoner, and was brought to the house, where he, Prenger, discovered a few light wounds on the head of the said thief, which he presumed had arisen from the throwing of the small stones and clods of earth; while the same appeared very weak to Prenger at noon or just after noon, he went to his neighbor Jan Wilkens in order to inform him thereof and invite him to his place, the said thief already being deceased upon his return. That he, Prenger, having had the body inspected by a certain Doctor Ainger and by the field corporal Pieter Lafras Moleman, who was stationed at the Zwarte Berg and happened to be on the road there at that exact time, together with a certain burgher Fourie, they had found nothing else on the same other than the aforementioned light wounds on the head, of which he had wanted to give the necessary notice to the memorialist on the following day or on Monday the 12th, and had already set out on the road for that purpose; but due to the continuous rains, the Palmiet River having become impassable, he had been forced to turn back and to wait until the aforesaid Wednesday the 14th, with the request to be allowed to have the said slave buried; whereupon the memorialist told him, Prenger, trusting that the event took place in the manner stated by him, that he could have the body buried, provided that within the first eight days he deliver to the memorialist the necessary certificates from the persons mentioned by him who inspected the body. That the memorialist, wishing to have the aforementioned Hottentot Daniel Boosman brought to him without Prenger's knowledge in order to inquire into the true circumstances of the matter, the said Hottentot was brought into custody at Stellenbosch on the 20th thereafter, and the said Hottentot, calling himself Daniel Boosman, gave the following account to the memorialist: That on the recently passed Saturday eight days ago, in the night, being awakened by his master, the aforementioned Prenger, the same had told him that there were thieves in the stable to steal his ducks, and that the aforementioned Prenger, having provided himself with a knobkerrie and him, Daniel, with a musket, had taken him along to the stable and surrounded it; but having perceived no thieves there, the same had ordered him to keep watch until he had brought a lantern, and had also gone home for that purpose.

246 Aan den WelEdelen Achtb: Heere Johannes Izaak Rhenius, praesident beneevens de verdere heeren Leeden van den Edelen Achtbaaren Raade van Iustitie deezes Gouvernements. — Vertoond met verschuldig den Eerbied de Landdrost van Stellen bosch en Drakenstein Hendrik Lodewyk Bletterman Dat op Woensdag den 14 der jongst gepasseerde Maand April door den van gagie afgeschr: Ggoeldaat Johan fredrik Prenger, zich erneerende met 't Schoenmakers Ambagt, en woonende aan de knoflooks kraal, geleegen aan de andere zyde der Hottentots Hollands gebergten, aan den Vert. her kennis gebragt zynde: dat hy Prenger in den Nagt tusschen den 10 & 11 daarbevoorens, door een geraas agter het huys en wel in den Stal, alwaar hy zyne Eenden in opgeslo¬ ten had, ontwaakt zynde, was opgestaan, en praesumeerende, dat er dieven in de stal zoude kunnen zyn om zyne Een= den te steelen, den by hem in Dienst zynde Hottentot Daniel Boosman, meede had opgewekt, en na zig zelve van een stok en gem: Daniel met een snaphaan te hebben voorsien, met denselven zich had begeeven na de stal; dog aldaar geene Dievengewaar geworden zynde was hy weeder terug na huys gekeerd, wanneer hy de Eenden had hooren schreeuwen, waarop hy met gemelde 247 Hotten tot dit geschreeuw navolgende, den dief had ontdekt, dewelke op het herhaald roepen van voorm: Daniel om te staan, in de rivier of aldaar staande palmieten was gevlugt. — Dat hy Prenger evengem. Daniel aldaar hebbende doen blyven zig naar huys tegeeven en een Lan„ taarn had meede gebragt, vervolgens zo wel als voorsz Daniel met eenige klyne klippen en Kluyten aarder daaromstreeks in de palmieten geworpen, zoo lange tot dat den dief die bevon„ den is een slaaf van den burger Jan Otto te zyn, met naame Anthony ten voorschyne gekomen zynde, gevangen genoomen en naar huys gebragt was, wanneer hy Brenger aan denzelve dief een paar ligte wonden aan deszelvs hoofd ontdekt, zoo als hy proasumeerde door 't werpen der klyne klippen en kluyten aarde ontstaan te zyn, terwyl denselven op den middag of even na den middag hem pren jer voorkoomende zeer zwak te zin, zich na zyn Buurman Jan Wilkens had begeeven, ten eynde denselven daarvan kennis te geeven en by hem te noodigen, zynde gem: dief Koltentot 249 by zyn terug komst reeds overleeden. That the aforementioned slave boy Anthony having been bound in that manner and brought home, the aforesaid Prenger had caused him to be unbound and had caused him to take off his upper jacket, and had given him some blows with a tether strap on the under jacket; but afterwards also took off the under jacket and had then severely beaten that boy on the bare body at intervals; and had given both to the same and to him, Daniel, and the aforementioned Jan a draught of wine to drink in between; after which they, having gone out together to search for the still missing ducks, had also found two again, and returned home with them; whereupon the frequently mentioned Prenger, having tied a knobkerrie under that boy's arms, had hung him up from one of the beams, then let him down again, and had then, while saying "stand like a soldier," again anew continually beaten him on the buttocks both with the tether strap 253 and a plank.
