That after the account given by the aforementioned Kasten at Jan Verloorenvallen, the corpse having been exhumed, there were found on it two wounds, namely one on top and the other on the back of the head, which according to the certificate of the above-mentioned surgeon were inflicted by external violence, without, however, being able to find or discover the cause of death, while the whole body had already passed into putrefaction, as all this appears more detailed from the declarations annexed hereto, together with the inquest record and surgical certificate, and referring to which, Your Honorable Worships will be convinced that the ill-treatment committed by the aforementioned Johan Fredrik Prenger upon the slave Anthony of Bengal is in the highest degree punishable; for the continuation of which proceedings the petitioner finds himself ex officio obliged to request the necessary qualification from Your Honorable Worships: Wherefore the ex officio petitioner takes the liberty of turning to Your Honorable Worships, requesting that Your Honorable Worships may be pleased to grant him, the petitioner, a decree or appointment in virtue of which he may be qualified to summon the aforementioned Johan Fredrik Prenger to appear in person before this Honorable Court, in order to hear such criminal claim and conclusion, or request or requests, as the ex officio petitioner shall be advised to make and take against him, to answer thereto, and further to proceed according to law. protesting, but in order to avoid all prolixity, to proceed immediately to the request itself made in fine therein; The same has appeared nothing but very equitable to the undersigned, and he therefore, as far as concerns him in his capacity, may well allow that it be granted by Your Honorable Worships; In so far: 1. That by the Secretary of this Council, with communication and consultation of the Cashier, there shall be drawn up and delivered to the petitioner an exact statement of what the Honorable Company has fallen short by these practices of her aforementioned husband, and thus has to claim from the sequestered estate. 2. That the sum of money determined at that time be immediately counted over and deposited into the Company's treasury, in so far as it might still be remaining under the sequester. 3. That subsequently the petitioner be left free to investigate, and to propose expost to Your Honorable Worships, which items she will then consider to have been overpaid, provided she duly verifies the same and proves them with sufficient documents. 4. That to that end the petitioner might also be granted inspection and, if desired, copies upon payment of fees, of all papers concerning those provisional counterclaims already obtained and resting at this secretariat. 5. That nevertheless the petitioner shall remain bound, before being able to claim any monies from the executed estate, in case she might hereafter become able to do so, to ensure that the other private creditors, who have already lodged their claims against the aforesaid estate at the secretariat or might still come to lodge them during the final settlement thereof within the prescribed time, and in so far as these shall be acknowledged as liquidated and valid, shall also be duly acquitted and satisfied. After the reading of which, the Council, conforming in all parts with the said report, has qualified the Secretary to produce on the next court day an accurate account of the present state of the estate of the said Horak, with an indication of what is still deficient towards the full satisfaction of the claims resting on the estate of Horak for the benefit of the Honorable Company; And in forming that account, there shall be charged to the account of the said Horak: 1st. The sum determined by the Commissioners who were expressly appointed by the Right Honorable Brave Lord Governor and Honorable Worshipful Council of Policy to investigate this matter, by a certain list of the 2nd of July 1788 concerning the deficit of the transfer duties. 2nd. Regarding the list of the recognition monies, all those items, both for which the said Horak himself stands charged, as well as the unsigned ones and those of the junior clerks vander Riet, I. C. The judicial costs incurred in this matter up to this day. 267 266 Thus the petitioner takes the liberty to turn with all submission to your Honorable Worships, most humbly requesting that it may be of your most gracious pleasure to permit the Honorable Officer Prosecutor to settle fairly with the petitioner, so that thereby not only these extensive proceedings regarding this matter, but especially those which would otherwise arise to the prejudice of others, may cease, or that your Honorable Worships may be pleased to make such disposition as your Honors shall deem proper. The Honorable Delegate, having heard the same read, asserts thereupon that, leaving aside everything that the requester seeks to put forward in the request in his excuse, he entirely left this matter to the Council's judgment, because the insinuations were made by the requester against the Honorable Members of this Assembly. The requester persists in his request. The Council, after consideration of matters, accedes to the request made by the requester, provided that, after the settlement is made, the requester shall appear before the full Council, revoke the expressions uttered by him, and ask the Council's pardon for them. That the Officer Demonstrator, seeing no likelihood of obtaining any further information, finally resolved—after the aforesaid slave Anthony had returned, recovered, from the Honorable Company's slave lodge, where he had lain ill for some months—to reach a conclusion upon the aforesaid documents, as the same lay attached to the accompanying responses, in order not to vex the aforesaid slave by a longer detention, or by a further delay not to appear to show little zeal in the conduct of his criminal proceedings. considers necessary, because perhaps on that occasion persons might be found who, knowing further circumstances regarding the case in question, could then give these to the gentlemen inspectors, and which circumstances now perhaps remain withheld from the knowledge of the prosecutor for no other reason than that he, due to the far distance from the aforesaid place, has not been in the position to be able to investigate which persons do or do not have knowledge of these remote circumstances, and thus can testify concerning them. Reasons why the prosecutor turns to Your Honorable Worships, with the humble request that Your Honorable Worships please commission two members from the Board of Heemraden at Swellendam to take an accurate inspection, in the presence of the prosecutor, of the place whereon and near which the aforementioned slaughter took place, with the qualification to take proper information of such circumstances as the prosecutor shall deem relative to the matter in question, and to gather the necessary testimonies, as well as furthermore to place the same informations and testimonies in the hands of the prosecutor, so that use may be made thereof where and as it ought. Which having been read, the Court granted the request of the prosecutor, and thus the Landdrost of the aforesaid district of Zwellendam shall forthwith be ordered to cause the necessary inspection to be made, in the presence of him, the Landdrost, as officer, by two heemraden who live closest to the place where the aforesaid slaughter occurred, and to gather the further informations required by the said memorial, while in the meantime the aforementioned slave Anthony shall be placed on Robben Eyland until such time as the aforesaid informations shall have come in. 271 Furthermore, by the aforesaid Deputy Fiscal in his aforementioned capacity, a memorial was exhibited, accompanied by three annexures; the said memorial being of the following content: To the Honorable and Respected Gentlemen President and Council of Justice of the Castle of Good Hope Shows with proper respect the Landdrost of Zwellendam, Anthony Alexander Faure: That in the beginning of the month of November of the past year 1789, having received word that a herdsman of the farmer Hendrik Cloete, named Petrus Burgert, was murdered in a murderous manner by two run-away slaves of the fellow farmer Hendrik Cloete, and that one of those run-away slaves had been captured, while the other, because he would not surrender himself, was shot dead, the prosecutor accordingly had the captured slave, named Damon, taken into custody, and subsequently sent him Cape-wards for examination. That the prosecutor, prior to examining him, made all possible endeavors to obtain the necessary information regarding this matter, in order to be able to interrogate the captured slave Damon with some foundation, but that it was not granted to him to obtain any further light except regarding the corpus delicti, as Your Honorable Worships can see from the accompanying re-sworn declarations of the citizens Lowies Jordaan and Pieter Ter Blanche. That the prosecutor nevertheless has had the prisoner examined before these commissioned members, in order to see whether from his responses any further discovery regarding such a gross crime could be extracted. Yet that the prisoner has completely denied being complicit in the murder of the aforesaid herdsman, adding, however, that the murder was committed by his comrade, and that far from having participated therein, on the contrary, through his friendly dealings with the herdsman, and the threats of his fellow prisoner that followed thereupon, he was the unfortunate cause that the herdsman, whom they claim the prisoner helped to murder, attacked his fellow prisoner and engaged in such fighting with him that he finally fell lifeless to the ground. That besides nothing being grounded in any evidence against the prisoner, he moreover, through an unforced and calm countenance, supported his given answer, and without the least change repeated under confirmation what he had answered in his interrogation. The Honorable Independent Fiscal Johan Nicolaas Steeven van Lynden, prosecutor ex officio, against the Burgher Jacobus Bierman, defendant, to see a reply served upon his submitted answer. The prosecutor ex officio states, instead of serving a reply, that because some slaves in question have been erroneously reported by the slaves, and a closer investigation should still take place regarding this, His Honor will therefore submit his reply on the next court day. — The Burgher Lieutenant Jonas Albertus van der Poel, as representative of the defendant, says he has no objection thereto. And the Council has taken satisfaction in this. — The Honorable Independent Fiscal aforesaid, prosecutor ex officio, against the former Landdrost of the Colony of Swellendam, Mr. Constant van Nult Onkruyd, defendant, to hear renunciation of further productions instead of seeing a reply served. — The prosecutor ex officio declares to renounce further productions, as His Honor has found arguments in the written answer exhibited by the defendant which are not only entirely destitute of proofs, but for the most part also contradict themselves, and therefore need no further debate. — The Burgher Jacobus van Leeuwen, for the defendant, says thereto: "I have special orders from my principal also to renounce." The detainee, having heard the claim read, says thereto: "I request a merciful punishment, for I am innocent." Whereupon the Council held this case in advice for circular reading. It was made known to the Council by the Lord Governor how, among several proposals by the military commission that recently departed from here, there was also one for the establishment of a court-martial for the national corps here in garrison, and the appointment of a military auditor thereto. That His Honour had placed a copy of this proposal without delay into the hands of the Independent Fiscal, requesting His Honour to provide his considerations and advice regarding that point, whether and to what extent the desired objective could be achieved with success; and had also delivered a similar copy to the heads of that national corps, likewise to hear their thoughts on the matter, and had received thereon the following replies, which His Honour was at the same time laying upon the table of this Council. That, both by the motives upon which the aforementioned proposal of the military commissioners was grounded, and by the advice of the Independent Fiscal, he had been most strongly confirmed in the concept of the absolute necessity for the establishment of such a court-martial, and at the same time this latter had appeared to His Honour upon reading so detailed and of such a nature that it could very well serve as a guideline and instruction for the court-martial to be established, as well as for the duties of the auditor to be appointed thereto; while His Honour had to trust that on this footing the political jurisdiction—whose intact preservation, along with the direction and conduct of all both civil and criminal matters, as well as the advocacy and protection of the sovereignty and authority of the Dutch state, had been entrusted by instruction to the one who had framed that advice—would thereby in no way suffer or be diminished. All of which having been presented by the Lord Governor, maturely considered and taken into consideration, etc.— After deliberation, it was approved and resolved by a unanimity of votes to grant to the national troops here a court-martial, along with a military auditor, on the footing as is determined and proposed in the aforementioned advice of the Independent Fiscal. Furthermore, for the performance of that post of military auditor, the adjunct fiscal Gabriel Exter was qualified, who appeared to possess the requisite capacities for it, and this without receiving any salary until such time as the same shall be granted and determined by the Lords Masters. Subsequently, it was approved and understood to give the necessary notice of this provisional arrangement by extract hereof to the head of the militia, the Colonel and Chief of the Artillery, the Colonel Commandant of the Regiment of Wurtemberg currently commanding the garrison, the Town Major, and the Captain Commander of the national depot, as well as to the aforementioned Gabriel Exter; there being inserted therewith that part of the advice of the Independent Fiscal whereby the duties both of the court-martial itself and of the auditor are determined, to serve provisionally as an instruction for both, with the reservation to alter, amplify, or amend the same at all times as the High and Mighty Lords Mayors shall deem fit, or as shall be judged necessary by this Council upon the occurrence of unforeseen events. /below stood/ Agrees /and signed/ G. Which entirely accords with the capitulation of the Regiment of Wurtemberg, article 22, holding in verbis: The Regiment shall have its court-martial for purely military offenses, it being well understood that the death penalty must not be executed except after the approval of the government, and in all other cases the regiment shall conform to the laws and customs of the Company. must be punished from among the other troops of the Garrison, with the foreknowledge of the Commander of the militia, and at the discretion of the Governor, while the imposed military punishment must be executed by the Corps to which the delinquent belonged. By pure military offenses now, the jurists understand, as does Arrius among others in lib 1 de re milit, in lib 2 ff de re milit, Groenewegen de leg abrog ad l 6 C de jurisd omni jud, Fromanteau de foro competenti lib 1 pars 9 No 13, Voet de Jure militari Cap 7 No 9, Bynkershoek quaestiones juris privati lib 1 Cap 13 de Foro militari in causis delicti, van Hasselt Onderregt over de Militaire Jurisdictie Cap 1 § 11, and several others, such offenses that soldiers commit as soldiers, and of which no one can make himself guilty unless he be a soldier. Such as are desertion, running away, going over to the enemy in a battle, desertion from one Company to another without a passport, the loss of weapons or the alienation thereof, abandoning one's post, sleeping upon the same, and one who, having been sent out to reconnoiter or forage, stays away, one who departs from the trenches, one who leaves the watch, and one who, having gone out on leave for a certain time, stays away, one who climbs over the rampart or who enters the camp over the wall, one who fords or swims the moat; furthermore disobedience, mutiny, conspiracy against his commander and other superior and non-commissioned officers, drunkenness, dissoluteness, and what more of such kinds there are, all detailed in lege 3 ff de re militari, from which are very properly distinguished the ordinary or communia delicta, which can also be committed by persons who are not soldiers, such as manslaughter, adultery, rape, counterfeiting of currency, arson, violence, forgery, highway robbery, burglary, theft, and whatever more of that kind there be. This court-martial thus having to judge solely over pure military offenses, all the remaining offenses and contraventions against the enacted laws, placards, and ordinances would remain, as of old, to the jurisdiction of the ordinary daily judge, and consequently military persons, in all other matters both civil and criminal, would be apprehensible, suable, justiciable, and executable before the civil judge, as was already established in the Year 1651 on 25 March by resolution of the common allies, after the Lords States of Gelderland and Utrecht had already made the proposition thereof in the general assembly on 30 January last and those of Overijssel on 7 February. From which it also follows that no political or civil persons, neither in civil nor in criminal matters of whatever nature, may ever be sued or addressed before the same. That in civil matters all political or civil persons having anything to claim from soldiers, or also soldiers from political persons, must institute their actions before the ordinary civil judge, and that the soldiers will be obliged to answer there, or to sue their parties. That two soldiers in civil matters, such as over the meum and tuum, regarding inheritances or successions ab intestato, testamentary dispositions, leases, rents, purchase, sale, acknowledgments of debt, borrowed monies, etc. etc., having anything to claim from one another, must likewise do so before the ordinary civil judge, to whom thus also the jurisdiction over matrimonial matters alone must remain. But that whenever soldiers among soldiers might have any dispute over their pays, wages, clothes, weapons, food, rations, and the like, the same being considered as pure military household domestic matters, ought to be terminated by the court-martial. Furthermore, the undersigned believes, subject to correction, that in case of challenges and duels between soldiers, the same should be brought before the court-martial, but between military and civil or political persons, the same should then be suable propter continentiam causae. The former among several other reasons because circumstances may often occur which, although such a challenge or duel is in general counted among communia delicta, would nevertheless rank it under pure military offenses, and the latter pursuant to the placard of the Lords States of Holland and West Friesland against duels dated 22 March 1657, to be found in Mr S van Leeuwen Manier van procederen under the appendices page 428. As to what furthermore concerns the manner in which such a court-martial ought to be constituted, the place where, the times at which it had to meet, as well as the determination of the costs of the parties, the remuneration of the gentlemen Members and judge advocate, their rank, number, presidency, manner of consultation, etc. etc., the Undersigned, believing this not to be of his department, will not need to express himself further hereon. Regarding the Judge Advocate, the undersigned is of the opinion that there ought to be chosen for this a known person of good Name and Reputation, sober and capable, possessing at least a superficial knowledge of Roman law, furthermore somewhat experienced in military science, and fully experienced in military laws and the particular military household. That the Judge Advocate might act solely and exclusively in pure military offenses and matters already enumerated hereinbefore. with the statement of the offenders and evidence that he might have at hand, and thus assist him in every way in the furtherance of justice. That he should not be permitted to execute or draft any judicial or notarial acts whatsoever, whether powers of attorney, bonds or acknowledgments of debt, antenuptial contracts or agreements, testamentary or codicillary dispositions, deeds of transfer, donations, cessions, transactions, leases or rental agreements, deeds of sale, or any other similar instruments, much less inventories or public auctions, whether of deceased or still living persons, nor to gather or have sworn any testimonies or attestations, except solely in purely military offenses, and that only from military persons; but that whenever civilian persons were also involved in purely military offenses from whom he required any statement, he should have to seek the same from the ordinary judiciary, just as all other matters being heard before the ordinary judge would have to be gathered and given there. That, however, in order to prevent the public service from suffering through the frequent demanding of such testimonies and statements from military persons at inconvenient times, and when the same were required and summoned thereto, whether on behalf of the fiscal office or on behalf of private individuals, it would be most convenient that such summonses should not be served by the messenger of justice upon the persons themselves, in case they should be non-commissioned officers or privates, but upon the auditor, or upon the commanding officer of the corps to which they belonged; who should then be obliged to ensure that what was required was properly fulfilled, and that the demanded witnesses presented themselves before the judge at a convenient time and place. All the foregoing nevertheless with this understanding: that in case either the fiscal office or the parties, for the convenience and relief of the commissioners and the secretary of the Honorable Court of Justice, or for other reasons, might prefer to have their required testimonies and statements from military persons gathered by the auditor and before military commissioners, they shall be left free to do so, and the auditor shall be obliged, upon being requested, to perform such properly, whereupon the Court of Justice should likewise be instructed to accept them and to administer justice upon them in judging. Finally, in order to avoid and cut off as much as possible all cavils, disputes, and conflicts of jurisdiction, in occurring cases that were subject to any doubt as to whether they might properly be ranked under the class of purely military offenses, the auditor or other interested parties should request the decision thereupon from the Honorable Council of Policy. However, since the High and Mighty Lords Masters in the Meeting of the Seventeen, by the instruction of the year 1785, have entrusted and committed the administration of justice to the Independent Fiscal without the least exception or distinction of political or military persons, and that by the 5th Article in the words: "The Independent Fiscal shall have the direction and management of all civil as well as criminal matters, to institute the actions, and further to prosecute them to the end, in such manner as he shall judge proper according to his oath." The undersigned therefore believes that he must still briefly present to Your Highly Esteemed Honor some considerations and reflections by which he is of the opinion that it could be prevented that his office be in any way curtailed in its lawful right. In the first place, then, the members of the court-martial as judges, together with the appointed auditor, just like the respective landdrosts, in case of delay of justice, excesses, oppression, corruption, vexation, misdeeds, or neglect and default of duty in their offices, should respectively be and remain answerable to the Independent Fiscal. Secondly, the concession to the court-martial to judge and pass sentence fully and solely upon arrest concerning purely military offenses should by no means obstruct the 14th Article of the above-cited instruction, holding: "And the fiscal, where such shall be necessary, shall be permitted to join with parties, who in that case shall not be permitted to use any writings, documents, or muniments before the fiscal shall have had inspection thereof." In order, in case of provocation or duel between military persons, which as stated above shall be judged by the court-martial, to join with the auditor before the same. Thirdly, the authority ought to be left to him, pursuant to the sixth article of the frequently mentioned instruction, reading: "The Independent Fiscal shall have access, inspection, and perusal to and of all registers, books, letters, accounts, and papers, none excepted." And thus he should each time, upon desiring such, have disclosure of the minutes regarding the proceedings in that court-martial, of the actionable documents or papers, remedies, evidence, interlocutory and definitive sentences, and cases concluded before the same. Fourthly, it should likewise be left free to him, whenever he received any reports from the auditor of other non-purely military offenses, to proceed with the prosecution thereof.

From the documents which the Prosecutor in his official capacity has the honour to present herewith to Your Worships, you will perceive that the aforementioned detained slave April, on the 27th of March last shortly after midday, being busy performing some work as a tailor in a room at his master's place, was assaulted and met with several fist blows and kicks by a certain David Kause, formerly living as a servant with the aforementioned Munnik, who was heavily overcome by drink; and that the said Kause further, notwithstanding the earnest and humiliating entreaties of the slave April, sought to make the same further feel his rage with a pressing board lying on the tailor's table, but that he, Kause, having become powerless through drunkenness to manage the pressing board while he lifted it and attempted to strike April with it, having lost his balance, fell diagonally backwards with his head against a bread knife fastened with screws to a bench, whereby he sustained a mortal wound above the left eye, from which wound, as well as from another lethal wound received to the frontal bone during the fall by the rebound of the aforementioned pressing board, he, Kause, passed away within a few moments. And with these circumstances, the responses of the interrogated person to the interrogation points put to him agree very well, which he answered with remarkable steadfastness and modesty; while in the meantime from the annexed deposition of David van Aken, residing as schoolmaster with the frequently mentioned Munnik, it appears, and if necessary could also be established, that the aforementioned David Kause was in his lifetime a bad subject, who often forgot himself in an extreme manner in the treatment of slaves, so that the Prosecutor in his official capacity, far from being able or willing to accuse the slave April of having given any cause for the death of David Kause, on the contrary from the annexed documents believes himself justified to infer that Kause himself was the cause of his death and can rightly be said to have committed suicide. The Independent Fiscal, the Honorable Johan Nicolaas Steeven van Lynden, ex officio Plaintiff, submitting an authentic copy of the publication by the Right Honorable Governor and Honorable Council of Policy regarding the naming of the streets of this district, decreed on 15 June last, as well as published and affixed on the 25th following, accompanied by a report from the court messenger, declares by word of mouth: That notwithstanding that everyone was also ordered by the aforementioned publication to allow, without hindrance or objection, the little boards or signs, which were to contain the names of the streets, to be affixed to their houses; the defendant nevertheless did not hesitate, when the commission attended to the posting of the aforementioned signs and was among other things busy therewith on the house of the defendant, to come out of his house onto the stoep, and there in a wrathful manner publicly, in the hearing of several bystanders, to exclaim: Gentlemen! That is no way of doing things, to have the signs nailed up there; that is not proper at all, I protest against that! Wherefore the ex officio Plaintiff, making claim, concluded that the defendant shall be corrected or punished in this matter with such a penalty or fine as this Council in good justice should judge fitting, cum expensis. Behold, Right Honourable Sirs, the entire state of affairs in question, my principal being prepared to declare under solemn oath that it occurred thus and not otherwise, and furthermore that he used no other terms against the aforementioned Mr. Truter, while the gentleman commissioners, being in conversation with the burgher surgeon Voogd at that time, did not witness the foregoing. For which reasons my principal expressly rejects and denies everything that has already been said by the plaintiff, or that might still be brought forward, as unfounded, frivolous, and abusive; answering, he concludes to the effect of inadmissibility, and in the alternative, that by definitive sentence the claim of the plaintiff ratione officii may be dismissed with costs. Shows with fitting respect the Independent Fiscal of this Government, Johan Nicolaas Steven van Lynden. That it came to the knowledge of the official petitioner yesterday that the citizen Pieter Benjamin Wieze, notwithstanding the express statutory orders of the government against it, has nevertheless not hesitated to graze a quantity of cattle on the Honourable Company's post Zwarte Bergvalley, granted in use to the contracted butchers; and that he, Wieze, has moreover so far forgotten himself that he gave his herdsmen a handwritten note, annexed hereto, in which he pretends to be authorized by the aforesaid contracted butchers to be allowed to graze his cattle on the said post, whereas from the declaration of the same butchers, also produced herewith, it can most clearly appear that they never gave him any permission for the free grazing of the Honourable Company's posts possessed by them; wherefore the official plaintiff, considering the notorious falsity of the aforementioned handwritten note, has deemed it necessary ex officio to initiate proceedings in this matter against him, Wieze, and to that end to cause him to be summoned in person before Your Honourable Worships. Wherefore the official petitioner turns herewith to Your Honourable Worships, requesting that you may be pleased to grant him, the official petitioner, To the Honourable and Respected Lord President and Councillors of Justice of the Castle of Good Hope a decree to cause the citizen Pieter Benjamin Wiese to be summoned to appear in person before Your Honourable Worships, in order to hear such demand or request or requests as the official petitioner shall see fit to make in the aforesaid matter on the day of the hearing; to answer thereto and further to proceed as according to law. Furthermore, there was submitted by the Deputy Fiscal, Mr. Johannes Andreas Truter, being qualified in office to attend to the affairs of the Merchant and Landdrost of the Colonies of Stellenbosch and Drakenstein, the Lord Hendrik Lodewyk Bletterman, a representation furnished with three annexes; which representation reads as follows: To the Honourable Respected Lord Johannes Izaak Rhenius, President, and the other Honourable Members of the Respected Court of Justice of this Government. Honourable and Respected Lord and Lords: Shows with due respect the Landdrost of Stellenbosch and Drakenstein, Hendrik Lodewyk Bletterman: That on the fifth day of the recently expired month of July, the petitioner was informed in writing by the Heemraad at Drakenstein, the Honourable Jacob de Villiers, J.P. son, that he, on the 23rd of the month of June previously, upon notification by the citizen Jan Enslin that he, Enslin, having punished one of his slaves named David of Boegies the day before, the same had died that evening, and requesting that the body be inspected, had proceeded together with the fellow Heemraad, the Honourable Abraham de Villiers, son of S., to the place of the aforementioned Enslin; and that they, having inspected the dead body of the aforesaid slave David, had discovered on the same, besides the marks of an ordinary punishment and various small contusions of minor importance, three wounds, namely one on the left side of the head, one above the left eye of the size of one thumb, and the third at the back of the head; which wounds having been examined by the surgeon H. Haasner present there, he had declared the third wound, inflicted on the occipital bone near the large opening and the first vertebra of the spine, as the surgeon says, situated at the neck, after it was opened, to be mortal. That the above-mentioned Honourable Jacob de Villiers, having asked the aforementioned Enslin for the cause of those wounds, the latter had said: that the above-mentioned slave David, after having been punished, had wanted to kill his fellow slave Aja of Bougies with a spade, and that the latter having taken refuge with him, Enslin, he had thereupon gone to the shop where the aforesaid David was, whereupon the aforesaid David had likewise wanted to attack him, Enslin, but that with great effort he had wrested the spade from his hands, and that the wounds might have been caused by this. Upon which aforesaid report from the said Honourable Jacob de Villiers, the petitioner having written to the above-mentioned Enslin to send his slave Aja to Stellenbosch, the same Enslin came in person on the afternoon of the 19th of the aforesaid month of July, bringing with him the very same slave Aja, with the request to have him return with him as soon as possible, as this was his only remaining slave; to which request the petitioner, suspecting no foul play and being willing to defer, told him, Enslin, that the next day, if possible early in the morning, he would have a declaration of what occurred made by the said Aja before commissioned Heemraden, and immediately thereafter he could return with him, Enslin; whereupon the said Enslin having walked away from the front of the Drostdy and hardly entered the first street, the aforesaid Aja, who was standing near one of the trees in front of the house and had probably overheard some of this, immediately approached the petitioner, saying: No! I would rather die here than go back to my master. The petitioner inquiring further of the said slave as to the reasons for this statement, the same came shortly to say that the frequently mentioned slave David, on account of the continuous mistreatment by his master, had deserted for two days.

315 had absconded, and was afterwards found in the stable under the straw, and having been punished for this by his master, his master had subsequently made the aforementioned David walk up and down in the house with an unworked wagon axle upon his shoulders; under which the said slave collapsed, whereupon his master struck him several blows with a lath, and thereafter broke a kierie to pieces upon his arms and one of his hands, and subsequently with a spade or shovel inflicted two large wounds on the back and a small wound on the front of his head; this account being accompanied by all such probable circumstances that, upon examination and comparison of the contents of the post-mortem report and the surgical certificate, not the least doubt remains that the said Enslin put his slave David to death in such a manner and in such an inhuman way, as stated; as Your Honors, if it pleases you, will also be able to observe in more detail, both from the statement made by the aforementioned slave Aja before the commissioned Heemraden, and from the post-mortem report and surgical certificate; to which the petitioner, for the sake of brevity, refers himself, maintaining therefore that such an act ought to be punished with the utmost rigor, and that the nature of that crime, as well as the execution of the sentence to be rendered in that respect, requires that he secure the person of the aforementioned Jan Enslin. Subsequently, by the said Adjunct Fiscal in his aforementioned capacity, a memorial was exhibited with 5 annexes, of which memorial the contents were. After which reading the Council qualified the officer petitioner, as he is qualified hereby, to cause the person of the aforementioned Jan Enslin to be taken into apprehension. And the gentlemen De Wet and Truter, who were of the opinion that only a personal summons should be granted to the officer against the aforementioned Enslin, caused their votes to be recorded. That the petitioner, having been informed on the 16th of December of the past year 1789 that the burgher Albert Nel, residing in the Koude Bokkeveld, on the 3rd or 4th of January of the year 1788, on the occasion that he, with his wife Christina Helena van Wyk, had paid a visit to the wife of the former Field-Cornet at the Hantam, Adriaan van Zeyl, who was banished from this government for life by sentence of Your Honors, having on his return journey from there had a dispute with his said wife, the consequence of which was said to have been that he assaulted his wife and threw her from the wagon, from which she was said to have sustained some contusions, and subsequently died on the third day thereafter, while the corpse was said to have been undressed by the wives of Willem Nel, Louis Coetzée, and Michiel Bok; the petitioner has since, with the necessary circumspection, inquired into the true state of the aforementioned case, and at the beginning of this year demanded a statement from the wife of the aforementioned Willem Nel, named Hester van Wyk, on the occasion that she, together with her husband, went towards the Cape; which having also been executed by her on the 3rd of February of this year, it indeed appeared to the petitioner from the same that the aforementioned Albert Nel, according to rumors, was said to have mistreated his wife, without the aforementioned Hester van Wyk, however, having discovered the least signs of any wounds or otherwise upon her sister when undressing her, while she had not inspected the corpse with close attention, and had understood from her sister that her illness was caused by an accident arising near her navel, and that she felt assured she would die of it, just as she had also passed away the following night. The petitioner subsequently, on the 27th of February of this year, inquiring about the aforementioned case from the wife of the abovementioned Adriaan van Zeyl, named Sara Johanna Wiese, she related that the abovementioned Albert Nel, after having stayed with her for a few days and returned home again, she had sent along with him her son Andries van Zyl, who was banished by interlocutory sentence of Your Honors, who upon his return home had told her that the said Nel, on his return journey, having drunk rather copiously of wine at the burgher Roelof Luthe's, was said to have become somewhat intoxicated thereby, and wanted to inflict some blows upon his wife with the whip, all of which, however, were warded off by him, Andries van Zyl; whereupon that woman having dismounted from the wagon, her husband, the aforementioned Nel, had unhitched three horses from the wagon and let them run off, but which having been caught again by her son and hitched to the wagon, they 316 151

Thursday, 2 September 1790. In the forenoon, present the Honorable Johannes Izaak Rhenius, President, and all the members, except for the Honorable Mr. van Echten, due to indisposition. The Honorable Independent Fiscal, Johan Nicolaas Steeven van Lynden, ex officio Plaintiff, against the Junior Merchant Johan Fredrik Kirsten, Defendant, to the end that in the case of a verbal injury committed against the Master of the Equippage here, on 27 May last, to hear such claim and conclusion as the ex officio Plaintiff shall see fit to make and take against the Defendant, to reply thereto, and further to proceed according to law. The ex officio Plaintiff submits a written claim accompanied by an annex. The former Secretary of the Colony of Swellendam, Sieur Menso Blankstein, legitimating himself with a special power of attorney granted to him by the Defendant, requested a copy of the whole and a delay of 4 weeks to deliver a reply thereto. The Petitioner having served a request whereby an adjournment was requested until four weeks from today, the Assistant of the Honorable Company, Jacobus Vernevil, standing in the payroll under discharging, as attorney for the Burgher Jacobus Johannes van den Bergh, the Honorable Respondent argued against this, stating that his client suspected the Petitioner had other reasons for requesting a term of four weeks than merely to drag the case out, requesting that the Petitioner be ordered to observe the usual term. The Petitioner persists in his request, stating that he is compelled to summon witnesses and that he therefore needs a longer term. The Honorable Independent Fiscal, Johan Nicolaas Steeven van Lynden, being asked instead of seeing a reply served to his filed claim, to hear an adjournment and term requested: The Council grants the Petitioner an adjournment of the term until fourteen days from today. The said Honorable Fiscal, ex officio Plaintiff, against the Burgher Jan Barends Gelt, in order, on account of extreme abuse committed on 15 July last against a slave boy belonging to the Burgher Firemaster Casper Loos, named Amsterdam, to hear such claim and conclusion as the ex officio Plaintiff shall see fit to make and take against the Defendant, to reply thereto, and further to proceed according to law. The ex officio Plaintiff produces a written claim with annexes. The Burgher Jacobus van Leeuwen, as general attorney of the Defendant, requested a copy thereof to serve a reply two weeks from today. The Council grants a copy and a day to answer. The Council granted. After the roll had been concluded thus far, there appeared in the Council Mr. Johannes Andreas Trüter, Adjunct Fiscal here, authorized to attend to the affairs of the Landdrost of the Colonies of Stellenbosch and Drakenstein, Hendrik Lodewyk Bletterman, who, submitting the interrogatories answered before the Commissioner Lords by the detained Burgher Jan Enslin, and other declarations, declared that, as he found the answers given by the said Enslin to the aforesaid interrogatories not to be of such a nature as to proceed against him extraordinarily; he might therefore well agree that the said Enslin be received in an ordinary trial and admitted to employ an attorney, provided he makes his defense ex carcere; whereupon the Council, having examined the aforesaid documents, in consideration of the declaration made by the officer, received the aforesaid Jan Enslin in an ordinary trial and admitted him, defending himself ex carcere, to employ an attorney. Whereupon the following petition was submitted by Anna Elisabeth van Inwegen, wife of the detained Burgher Tobias Mynhardt: To the Right Honorable Mr. Johannes Izaak Rhenius, President, together with the other members of the Honorable Council of Justice of this Government.
