was satisfied, the same was granted; upon the aforesaid submitted petition, full approval was granted by majority vote, and the secretary was accordingly authorized to receive the sum of Rs. 1349: 14:- mentioned in the cited petition, whereby the estate of the mentioned Johannes Marthinus Horak is hereby released from the sequestration in which it has been held until now, and at the same time the petitioner or other interested parties are left free to investigate and present after the fact to this council which entries they shall consider to have been overpaid; of which then also, provided this is properly verified and proven with sufficient documents, restitution shall take place. To which end copies of such papers and documents as are held at the Secretariat of this council and shall be deemed useful by her for that purpose are hereby granted to the petitioner, the petitioner nevertheless remaining bound to ensure that the other private creditors, who have already submitted their claims against the frequently mentioned estate at the Secretariat of this council, in so far as the same shall be recognized as liquidated and valid, also receive proper satisfaction. And of this one and other matters, the required notice shall be given to the right honorable Governor and the honorable Council of Policy by representation, with the request, for the provisional satisfaction of an amount of Rds. 39665 and 22 stivers which it presently still appears is due to the Honorable Company from the estate of the aforementioned Horak, to accept into the Honorable Company's treasury in cash money the sum of Rds. 28027. and 6 stivers, of which an amount of Rds. 26825. already being consigned into the aforesaid treasury, presently from the money paid by the aforementioned wife of Joh. Horak the sum of Rds. 1201. & 44 stivers shall still be brought into the treasury; while furthermore the remaining Rds. 11638 and 16 stivers, consisting of a mortgage bond passed by the Merchant of the Honorable Company Mr. Jacob Pieter de Nys for the benefit of the mentioned estate of Horak amounting to Rds. 8722., one ditto chargeable to the honorable George Fredrik Goetz amounting to Rds. 988: 32: -, one ditto chargeable to Jan Andries Horak amounting to Rds. 983: 16, and a mortgage chargeable to the burgher Jan Plaat of Rds. 944: 16, shall be brought into the treasury as soon as this amount, after the due date of those mortgage bonds, which takes place on the 1st of December next, shall have been collected by the Secretary of this council. Finally, a sealed paper addressed to this council having been opened, the following two petitions were found therein, from the burghers Willem and Andries van Zeil, who were banished in contumacy from this government and its jurisdiction. Right Honorable and Honorable Sirs, The undersigned defendant, after all dutiful respect, takes the liberty to turn to Your Honors, being most highly astonished at how he has become falsely accused before Your Honors, far from the truth, concerning the willful shooting to death of a Hottentot woman named Antje; whereas the undersigned did this not out of malice or any spite, but out of fear for his own life, as the mentioned incident occurred in the dark night, when the undersigned was at an outstation of his father's, with his father's cattle, when he noticed by the barking of the dogs that there must be strange people in or around the kraal, whereupon, leaping out and calling out several times: "Who is there?", he received no answer, but saw someone jump over the kraal fence, without being able to distinguish who it was, so the undersigned, out of fear for his life, not knowing whether it was a Bushman or more, or someone else, to kill him in the dark night, blindly fired a shot, and so without his knowledge, and while he was still only a youth who, in case someone had attacked him, would not have been able to defend himself, fired the said unfortunate shot. Honorable and Worshipful Lord and Honorable Worshipful Lords! The undersigned defendant takes the liberty, with all dutiful respect, to address your Honors with humble prayer and supplications, that the undersigned might be pardoned by your Honors and acquitted from the sentence resolved by your Honors, sent to the undersigned in the last summons; Although the undersigned cannot excuse himself, he nevertheless hopes that your Honors will not consider the deed committed by the undersigned, on account of the undersigned’s youth and the obedience owed to his parents, as a willfully committed crime, but one that occurred out of pure ignorance and lack of knowledge. Thursday the 16th of September 1790. In the morning, present: the Honorable and Worshipful Lord Johannes Izaak Rhenius, President, and all the Members, with the exception of the Lord Independent Fiscal Johan Nicolaas Steven van Lynden, due to occupation. The messenger, stepping inside, reports that the defendant has not appeared. Wherefore the Deputy Fiscal, Mr. Johannes Andreas Truter, appearing due to the occupation of the Lord Fiscal Claimant, requested the first default with the profits thereof and a second citation. For which reasons the undersigned's humble sigh and prayer to your Honors is also that the undersigned may be pardoned by your Honors and set at liberty again. - At the bottom was written: In which expectation &c. Signed: Andries van Zeil - In the margin: Hantum the 6th of February 1740. After the reading of which petitions, disposition was made thereon in the following manner. The Council objects to the request of the petitioners, persists in the sentence passed against the petitioner dated [illegible], and at the same time leaves him at liberty to appear in person to answer for the crimes charged against him; meanwhile, a copy of the aforesaid petitions shall be placed in the hands of the Landdrost of Stellenbosch and Drakenstein, as having acted in this matter, to make the necessary use thereof as an officer. - At the bottom: At Cape of Good Hope, day and year as above. Lower: In my presence. Signed: W. J. v Ryneveld, Secretary. The Independent Fiscal, the Honorable and Worshipful Lord Johan Nicolaas Steven van Lynden, ex officio Claimant, against the Burgher Pieter Benjamin Wiese, defendant, to hear such claim, or request or requests, as the Lord Fiscal Claimant shall find proper ex officio to make, concerning and in the matter that the defendant did not hesitate to cause a quantity of cattle to be brought to the Honorable Company’s post the Zwarte Berg, and to that end handed to his herdsman a note, dated 1 July 1790 and signed P. B. Wiese, in which he falsely pretends to do so on the order of the Honorable Company’s contracted butchers; to answer thereto and further to proceed according to law. 332 - 334 The Council agrees. The Honorable and Worshipful Lord Independent Fiscal of this government, ex officio Claimant, against the Burgher Jacobus Bierman, defendant, in order to submit a reply to his answer. The aforesaid Deputy Fiscal submits his written pleading of reply. Whereof the former Burgher Lieutenant Jonas Albertus van der Poel, as representative of the respondent, having requested a copy in order to serve a rejoinder today two weeks hence. The ex officio claimant declared to have no objection thereto, provided that the representative of the defendant in his rejoinder shows more regard for the fiscal office than he saw fit to do in his answer. The representative of the respondent states in reply that if he might have said anything in the answer from which any disrespect can be inferred, such was in truth done without the least intention, adding that he would exercise more circumspection in that regard in his rejoinder. The Council grants the respondent the requested copy and day to submit a rejoinder. The Deputy Fiscal, Mr. Johannes Andreas Truter, appearing due to the occupation of the Lord Fiscal Claimant, submits a copy of such petition as was exhibited in the Council by the Provost Marshal Jacob Ernst on the 8th of July last, together with a statement of the court messenger Carel Ewald Ziervogel, and states further that the defendant, as will appear from the aforesaid petition, gambled at the house of the Drum Major Luiten, contrary to the enacted placards, concluding therefore that the defendant shall be condemned, in accordance with the letter of the placard, to pay for the first time 25 rixdollars, and a double fine of 50 rixdollars for the second time, thus together 75 rixdollars with costs. The said Honorable and Worshipful Lord Independent Fiscal, ex officio Claimant, against the soldier Jacob Hendriks, defendant, to hear claim and conclusion for such fines as he has incurred for assisting at two successive gambling parties at the house of the Drum Major Luiten, in accordance with the placard, cum expensis. The defendant, answering, says he cannot deny having gambled, and also to be able to pay 25 rixdollars, requesting regarding the remaining 50 rixdollars a postponement until he shall have received money. The ex officio Claimant, for reply, persists in his claim. The parties renouncing further productions, The Council, having heard the parties, after consideration of that which merited reflection, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, adjudicates to the Lord Fiscal Claimant his claim, with condemnation of the defendant in the costs. 338 Right Honorable Stern Sir and Honorable Worshipful Sirs Deacon Daniel Ronouw Pietersz, in order to make the necessary provisions for the restoration of the authority of the aforesaid College, which had been violated thereby by the said de Vaal; that the Independent Fiscal, since that matter had already occurred prior to his arrival here at the Cape, had therefore deemed it proper to deliver the aforementioned petition from the Landdrost and Heemraden, which had been submitted to his Honor, together with two private declarations attached thereto, the one given by Francois Du Toit and Daniel Malan, and the other by Jacobus Retief and Johannes Arnoldus Ruijgrok, to this Council, just as he, the Adjunct Fiscal, then also took the liberty now to produce both, with a respectful request that it may please the Council to examine this matter, and with respect to the aforementioned College of Landdrost and Heemraden to take such satisfactory measures as they, according to the findings of the case, shall deem to be proper; the aforesaid petition being of the following content. Show with due respect the undersigned Landdrost and Heemraden of Stellenbosch and Drakenstein, That in the month of April of the past year 1786, a dispute having arisen between the Burgher Pieter Cilliers, and the former Deacon Daniel Ronouw Pz over a certain watercourse coming out of a kloof situated on this side of Groeneberg at the farms of the aforementioned Ronouw and the widow of Gabriel Ronouw, a commission was at that time decreed at the request of the parties, presided over by the first-signed Landdrost, in order to take an ocular inspection thereof, and to have the farm of the aforementioned Ronouw surveyed by one of the sworn land surveyors. That the Board, having heard in its meeting of the 12th of June following the report delivered in that regard by the commissioned Heemraden, and having declared by judgment that the aforementioned Daniel Ronouw shall be permitted to dam up and use the water in question from Monday morning at six o'clock until Thursday morning at the same hour, and the aforesaid Cilliers shall be permitted to dam up and use the same from Thursday morning at six o'clock until Monday morning likewise at the same hour, in such a manner nevertheless that during the time that the said Ronouw dams up and uses the water he shall be obliged always to let flow down to the frequently mentioned Cilliers as much drinking water as will be practicable for him, and that furthermore the frequently mentioned Ronouw will have to clear and keep clean the watercourse up to the dam above the vineyard planted by him, and Cilliers from there up to his farm, with compensation of all costs, a certain inhabitant of this colony, Bernardus de Vaal, as agent of the aforementioned Ronouw, finding himself aggrieved by this judgment, has appealed against it to the Honorable Worshipful Council of Justice of this government. 339

That furthermore, by honored missive of the often-mentioned Honorable Court of Justice dated 12 February 1787, the petitioners were notified that their Honors, before definitively deciding the dispute pending on appeal before the said Court between Rossouw and Cilliers, had resolved to deputize two members from their Bench in order, together with the Landdrost and the Heemraden who had already served in that capacity, to conduct an ocular inspection of the watercourse in question; that the said Heemraden, in the presence of the first-named Landdrost, pursuant to these honored instructions, duly appeared at the appointed place, where an inspection of the matter was taken by the said commissioners from the Court of Justice. That the said Court of Justice, far from annulling the aforesaid judgment of the said verdict on appeal, on the contrary approved the same, altering it only to the extent that the appellant, the aforesaid Daniel Rossouw, may use the water in question for 4 days, and the respondent, Pieter Cilliers Jansz, for only three days a week. Council on account of their violent conduct on the proprietary land of the aforementioned woman, having been placed in the hands of the officer fiscal by resolution of 19 March 1739, the same Cilliers and associates were nevertheless subsequently received into submission upon a very humbly presented petition. So that in this manner this entire, lengthy, and in every respect troublesome dispute was entirely settled, with the fortunate result that since that time not the slightest difficulties have arisen before the Council on that account, and all the same contentious parties have conducted themselves peacefully toward one another until now. That for these reasons their Honors believed they could not refrain, since the aforementioned petition of the Landdrost and Heemraden of Stellenbosch and Drakenstein primarily touches upon this long-settled dispute, and by digging up this matter again one might possibly agitate once more the minds that are now calmed, from reminding the Council of these various points, to the end that such regard might be paid thereto by Your Honorable Worships as should be deemed proper after consideration of matters. And upon this declaration of the commissioner gentlemen, the Council has approved to hold the request made on behalf of the Independent Fiscal provisionally in advice, and in the meantime, to have circulated among the gentleman members of this Council for their perusal both the above-mentioned petition of the Landdrost and Heemraden with its appendices, and also the documents and instruments of which the aforementioned commissioners made mention in their narration previously given. It having pleased Your Honorable Worships on the last ordinary court day to place into the hands of the undersigned, as qualified by resolution of the Council of Policy to attend to the affairs of the Landdrost of Graaff-Reinet, M. H. O. Woeke, a certain petition of Anna Elisabeth Inweegen, wife of the detained burgher Tobias Mynhard, tending to have the testimonies suggested by her to Your Honorable Worships for the exoneration of her husband, unconfirmed and unsworn, added to the claim and documents submitted by the undersigned in his said capacity, in order that in judging such regard may be paid thereto as Your Honorable Worships might deem fit; with orders to serve with observations on this request; so the undersigned now has the honor to submit to Your Honorable Worships with due respect in that regard: To the Honorable and Worshipful Gentlemen, the President and Members of the Court of Justice of the Castle of Good Hope. Furthermore, there having been submitted by the aforementioned Adjunct or Fiscal Mr. Johannes Andreas Truter, acting for the Landdrost of the Colony of Graaff-Reinet, his written observations on such petition as was presented on the last ordinary court day by Anna Elisabeth van Inweegen, wife of the detained burgher Tobias Mynhard, and for that purpose was placed into the hands of the officer, the same reading as follows: That it has appeared to the undersigned, subject to correction, that the petitioner's request cannot be entered into, even if the undersigned on behalf of his principal could see fit to conform therewith, because it is an established truth in the administration of justice that a judge is not permitted to administer justice upon certificates and attestations that are not confirmed and sworn, unless the witnesses were overseas or already deceased; as can be seen in the 17th article of the Ordinance on Justice of the year 1580. And this not only in civil cases, when dealing with what is mine and thine, but also and most especially in criminal and corporal cases, according to the 21st article of the Style of Procedure in Criminal Cases of the year 1570, explicitly implying that the judge ex officio, that is by virtue of his office, without being requested or admonished thereto, is bound to confirm the testimonies. The suggested testimonies after all militate either in favor of the prisoner or against the same. In the latter case, when they would tend to the detriment of the accused, the judge is not permitted to omit the confirmation and swearing, because the public interest demands that crimes be precisely investigated, detected, and punished; and the Sovereign Authority cannot be considered to have granted to the judicial colleges the power to dispose of the public interest at their pleasure: in a word, Honorable and Worshipful Gentlemen, the confirmation and swearing of testimonies is not left to the arbitrium judicis, but is on the contrary something that is expressly commanded to all courts by our revered Sovereign, so much so that even if Xenocrates were to come back to life, from whom the Athenians judged on account of his proven loyalty that an oath could not be demanded, the undersigned would nevertheless, with Matthaeus, under respectful correction, be of the opinion that he ought to confirm his testimony by oath, see Matthaeus de Criminibus book 48, title 15, chapter 4, number 7. And as for the first case, namely when the suggested testimonies militate in favor of the prisoner, the undersigned believes that it is also beyond dispute that the same must be confirmed and sworn; because besides the obligation of a judge to inform himself ex officio of the innocence of an accused person, it is moreover also certain that the prisoner T. finally enacted, that the re-examination of witness depositions, in cases involving corporal punishment, may not be renounced by the prisoner. Nor could the consent of the undersigned in this case avail the petitioner or her husband, on whose behalf she makes the request, because it is not as in civil cases where parties by their consent can bring it about that judgment is rendered on unre-examined attestations; so also in criminal cases an officer cannot agree with the delinquent to request judgment on the produced witness depositions without first having the same re-examined and sworn; the reasons for this being that parties in the latter case would dispose not of their private interest, but of a matter concerning the common weal and the sovereign, which, as it is not permitted to the judge, so it is not to be conceded to the parties, Mattheus, book [illegible], title [illegible]. Meanwhile, the undersigned cannot conceal that the grounds laid down by the petitioner in support of her request, although they cannot outweigh what has been argued thus far, nevertheless still remain strong enough to make the judge understand that it involves a hardship to make the petitioner's husband, who through an unfortunate concurrence of adverse circumstances has seen his imprisonment already so extraordinarily prolonged, feel the horrors thereof any longer. However much the undersigned therefore persists in the view that the petitioner's request cannot be entered into, he would nevertheless, subject to the favorable judgment of Your Honorable Worships, be of opinion that, since a considerable time is required to have the witness depositions suggested by the petitioner to Your Honorable Worships for the exoneration of her husband re-examined and sworn, the prisoner Tobias Mynhard ought in the meantime to be placed on Robben Island, to the end that his imprisonment may serve him not as a punishment, but, as is proper, solely and exclusively for the secure custody of his person. The undersigned trusts hereby to have fulfilled the respected intention of Your Honorable Worships and respectfully submits these his arguments to their better and more enlightened judgment. Subsequently was brought to the table the lawsuit instituted by the Independent Fiscal, Johan Nicolaas Steven van Lynden, ex officio, against the merchant and former Landdrost of the District of Swellendam, Constant van Nult Onkruydt, and the former Secretary there, Menso Blankstein, on account of the negligent performance of their aforesaid respective posts; which having been deliberated upon with all possible attention, the Council, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, has condemned the defendants Constant van Nult Onkruydt and Menso Blankstein, the first mentioned in a fine of three hundred rixdollars, and the latter in fifty rixdollars, for the benefit of the plaintiff ex officio, and in all the costs incurred in this case, with this understanding, however, that each of the defendants shall have to pay his own incurred costs; whilst the further judicial costs shall have to be satisfied by the defendants by compensation between the two of them. That he, the petitioner, had instructed the schoolmaster residing with him, named Johannes Mulder, to address himself to the burgher ensign Sebastiaan Valentyn van Rheenen, and to request him to be willing to lease the place called the Zwarte Bergvaley to the petitioner for a month or three weeks, so that the petitioner's cattle, a large part of which, due to the lack of a proper pasture, were dying from poverty and want, might graze there; but if that could not be done, that he would then permit the petitioner to put his cattle behind the Zwarte Bergvaley in the dunes. That the said schoolmaster, having brought back in answer to the petitioner that the said place could not be leased, but if the petitioner wished to put his cattle behind the dunes, the said Van Rheenen would indeed agree to it; upon which report the petitioner had sent his cattle, consisting of 47 head, thither, and also gave along a consent note to the Honorable Company's butchers, signed by the petitioner. The citizen Jacobus van Leeuwen, as attorney of fellow citizen George Barends, petitioner, against the aforesaid Honorable Independent Fiscal, respondent, to hear the answer served to his filed claim. The public prosecutor exhibits a written claim, to which are annexed nine appendices, in addition to four pieces of folded paper, a copper plate, pencil, and penknife, used by the prisoner for the manufacture of counterfeit money, requesting the office of judge in this matter, and that justice may be impartially administered to the prisoner. The Court decrees a copy and a day to reply. The Honorable Independent Fiscal Johan Nicolaas Steven van Lynden, prosecutor ex officio in a criminal case, on the one hand, against the former sergeant under the regiment of Württemberg, Hans Casper Safmeester, prisoner and defendant in the aforesaid case, on the other hand. The Prosecutor ex officio advances on this matter that since he has already shown in his claim that a corporal punishment ought to be inflicted upon the defendant, he is accordingly of the opinion that the defendant ought by no means to be set at liberty, leaving this however, as well as the further request of the defendant, to the judgment of the Court. The Independent Fiscal of this Government represents with due respect that a certain Narcis of Mozambique, currently located on Robben Island, has addressed the petitioner ex officio on several occasions with the request to be removed from the said Island and restored to his former freedom, of which he was deprived, in order to be able to return to his native country. That the petitioner ex officio believed himself obliged to seek out the necessary information concerning the reasons why this Narcis was placed on Robben Island, and that it has appeared to the petitioner from this information that the said Narcis, who according to his statement and the produced private letter of manumission was set free by a French merchant in Bengal, and hired himself out to an English passenger for six rupees a month to serve on the voyage to Europe, having arrived at the Cape had to remain there, and was sold to the Junior Merchant Kirsten as a slave belonging to the said Englishman. That the consequence of this was that he lodged his complaint about it with the Fiscal's Office. That upon the memorial submitted regarding this by the said Fiscal's Office and also the subsequent substantial document produced by the aforesaid Kirsten, this Court on 8 September 1785 thought fit to place this Narcis provisionally on Robben Island until such time as further evidence in this case should be received. That since this unhappy creature, who was not accused of the least crime, has now already been confined there for 5 full years, and this time is more than sufficient to have been able to produce further evidence from all parts of the world if any were to be found, the petitioner ex officio therefore believes, under correction, that he ought no longer to suffer and remain confined because of this, and since a further decree of Your Honors is required for this purpose, the undersigned takes the liberty to address Your Honors and hereby kindly request the same. Burger Jacobus van Leeuwen, petitioner, having submitted the same, requests a copy thereof for the defendant, and a term of four weeks to then submit his rejoinder on the reply to be served upon his submitted written statement of answer, against Burger Jan Baerends, defendant, stating that he still needs to gather some evidence and to spare costs since he, the defendant, would otherwise still have to trouble the Council to ask for an extension, now to grant a term of four weeks. The Officer argues against this that it was contrary to the manner of proceeding to still add evidence to a rejoinder, as his Honor would thereby be compelled to surrejoin, and one would therefore deviate from the rule prescribed by the statutes of India not to proceed further than a rejoinder, requesting that the defendant may be ordered to serve his rejoinder in fourteen days. The defendant counters this, stating that however strictly taken one ought not to produce new documents with a rejoinder, this nevertheless does not preclude that when new facts are asserted in the reply, he then also has the capacity, in order to refute them, to gather evidence and submit it with his rejoinder, and he persists in his request. 371 370 The plaintiff having submitted his replication, Sr. Willem Kolver, as representative of the detained Eusliu, requests a copy thereof in order to make his duplication fourteen days from today. his own child, to see it, so to speak, dying for lack of indispensable food, and when one considers, Honorable Sirs, the slight importance of such trifles, which to be sure have not escaped the attention of the legislator, it is no less true that the legislator, observing the common imperfection and weakness of mankind, especially of a father toward his child, does not make unintentional designs the objects of punishment, and therefore the petitioner might very easily be pardoned; and besides, it is indeed so situated with human nature that something can easily be conceded to the natural weakness and frailty of men; the petitioner, as much by reason of the uncertainty thereof as because the same criminal proceedings, even were they decided in favor of the petitioner, would always drag along a blemish on his reputation, which might possibly in the future be of the most detrimental consequence in the advancement of his fortune, the petitioner has therefore also been advised to prevent the same criminal proceedings in time, if it were possible, by appropriate means. That the petitioner ex officio immediately had the aforesaid girl examined by the chief surgeon Leeuwer, and then found that she had been abused and beaten from her head over her entire body in a barbarous manner, just as the girl also previously appeared before this council and showed the perceptible marks of the abuse inflicted upon her, which account is most strongly corroborated by the accompanying statement of the soldier Fredrik Doring, who resides with the aforementioned Oostendorp and is a daily witness to the cruelties committed by the wife of Oostendorp. In the morning, extraordinary meeting, present the Honorable President Johannes Izaak Rhenius and all the members except the Honorable Independent Fiscal Johan Nicolaas Steven van Lynden, and the gentlemen Rönnenkamp, Van der Riet, Fleck, and Truter, due to business as well as indisposition. The first deputy fiscal Gabriel Exter, acting on behalf of the prosecutor due to his indisposition, states orally that the prisoner yesterday morning around nine o'clock gave such free rein to his lust for revenge that he did not shrink from attacking the female slave Maria of Bengal, belonging to Captain Smitgal of the Württemberg regiment garrisoned here, who was walking down Grave Street with a small child of her own in her arms, as soon as she had proceeded to near the slave lodge there, and in a cruel manner, by inflicting diverse wounds upon her with a knife and five truly mortal injuries, deprived her of life, and furthermore, in his cruelty, cut open his own lower abdomen, in such a manner that according to the surgeon's declaration, the prisoner currently runs the risk of thereby escaping his well-deserved punishment. In the forenoon, present the Honorable Johannes Izaak Rhenius, President, and all the Members except the prosecutor fiscal Johan Nicolaas Steven van Lynden due to indisposition. The Adjunct Fiscal Mr. Johannes Andreas Piuter, on behalf of the Honorable Johan Nicolaas Steven van Lynden, Independent Fiscal of this Government, in his official capacity, plaintiff, against the Burgher Jacobus Johannes van den Berg, defendant, to hear requested renunciation of further productions. The Adjunct Fiscal Mr. Johannes Andreas Piuter, because of the indisposition of the Independent Fiscal, states that whereas the plaintiff ex officio has discovered nothing essential in the rejoinder submitted by the defendant on the last court day, but merely this and that, though disrespectful, yet meaningless arguments only tending to shorten the rights belonging to the Commissioners, which the plaintiff ex officio boldly dares to leave to the judgment of the Council, and because of its entirely evident groundlessness has not deemed it necessary to explain himself thereupon by reproach, he the Adjunct Fiscal therefore, in the name of the Independent Fiscal, renounces further productions. The Assistant Jacobus Perreveel as attorney for the Defendant advances against this, that he on his side trusts that in the rejoinder nothing was said except what is according to law, and likewise renounces further productions. The Council holds this case for circular reading in advice after the declarations that have served in this lawsuit shall first have been re-examined and sworn as far as possible. The said Honorable Independent Fiscal, plaintiff ex officio, against the Junior Merchant Johan Fredrik Kirsten, defendant, to hear requested extension of term instead of seeing submitted reproaches to his submitted rejoinder. Mr. Johannes Andreas Piuter, Adjunct Fiscal here, requested for the plaintiff ex officio, whereas both the plaintiff ex officio and he the Adjunct Fiscal have been prevented by indisposition from reproaching, an extension of term until today in two weeks. The Defendant says he has nothing against it. The Council grants the requested extension of two weeks. The Honorable Independent Fiscal Johan Nicolaas Steven van Lynden, plaintiff ex officio, against the widow Sebastiaan Richard, defendant, to purge her first default and further in the principal matter in the case of committed smuggling to see served such claim and conclusion as the plaintiff ex officio shall see fit to take against her, to answer thereto and further to proceed as according to law. The Defendant, to purge her default, says that she had been ill and for that reason had not been able to appear, of which the burgher surgeon Lange, who practiced upon her, could give testimony. The Defendant, having had the same read to her, says thereupon: I did not smuggle, van den Berg has been to my house, made an inspection and found nothing but an empty half aam, which was standing in the room and in which for 3 days prior there had been no wine; it is indeed true that I have always had a half aam of wine in my house, but not to smuggle, or to sell anything out of it to anyone, but solely for my own use and to give a glass of wine to this and that person who comes to buy pickled fish or to eat sandwiches, which is my sole means of livelihood, being a poor woman whose children are supported by the deaconry, to encourage them in so doing to get their fish and sandwiches from me, thus I have also sold no wine to the two deponents, which I can declare under oath, and at the same time confirm with the testimony of two credible people who were at my house on Sunday and Monday. The plaintiff ex officio, rejecting the allegations of the defendant, further brings forward for replication: that the bare negative of the defendant cannot avail her, since not only has that charged against her been proven by two irreproachable witnesses, but she the defendant is also known as a person who has all too many times made herself guilty of smuggling, without one having been able, however, to demonstrate such to her other than by a single witness; that furthermore the two persons who might declare in her favor cannot detract anything from the truth and probity of the witnesses produced by the plaintiff ex officio, it being certain that two witnesses who affirm deserve more credit than a thousand negative witnesses; thus persisting in his conclusion and claim.
