the appearer had also witnessed that when the said Piet, on a certain day in the month of October of the past year 179[illegible], was busy carrying manure behind a kraal, at which labor the eldest son of the petitioner named David Jacob Engela was also present, and the said Piet was asked by the said son of the petitioner about one of his fellow slaves, he, instead of giving a proper answer to this, snapped that he was no minder of that boy, for which impertinent statement the said Engela had given the said Piet several blows with a rattan cane he had with him, after which the said Piet, while uttering some abusive words which the appearer cannot precisely repeat as they were spoken in the Portuguese language, went to the slave house, and returned from there immediately, carrying something under his jacket which he held firmly with one hand, without the appearer having seen what that was, but subsequently heard from other slaves that the said Piet had kept a knife hidden on his person at that time. The appearer further declares, remembering this too, that about a year ago now, a slave boy named Esauw, being a child of the said Piet, having been ordered to do something by the petitioner, had been negligent therein, for which he was given several blows by hand by the petitioner's youngest son named Hendrik, who in the meantime had gone on behalf of his mother to see whether her order had been carried out by the said Esau, whereupon the said Piet had run up and struck the said petitioner's little son, who on that account went to lodge his complaint with his father. That thereupon the petitioner's late husband, having come outside, asked the said Piet who gave him the authority to beat his child, and added that he would deal with him, at the same time ordering the said Piet to remain standing there, which the said Piet answered with some insolent remarks, the exact details of which the appearer no longer remembers, and then walked away from there, while furthermore his master, having demanded a gun, aimed it at him because he was too corpulent to run after him, the said Piet having then positioned himself in front of the horse stable beneath some horses, and shouted to his master, saving your reverence, if you want to shoot then just go ahead and shoot, for thunder and lightning, while however his master, to protect his horses, had not done so. Declaring nothing further, the appearer gives as reasons for his knowledge as in the text, being prepared, if required, to confirm the foregoing further by oath. Re-examination Appeared before the undersigned commissioners from the Council of Justice of this government the aforementioned Exuwel, to whom this his preceding declaration being read out clearly and distinctly, declared to persist and abide by it. Appeared before me, Willem Stephanus van Ryneveld, Secretary of the Honorable Council of Justice of the Castle de goede Hoop, in the presence of the undersigned witnesses, the Burgher Johannes Nagel, of competent age, who, at the requisition of Maria Malang, widow of the late Burgher Hend:k Cornelis Engela, declared how true it is: That when, on a certain day in the latter part of the recently passed year 1789, without the deponent being able to determine the exact day or date any longer, some slave boys were busy on a piece of land belonging to the farm of the requisitionist cutting barley, the deponent, who resides on the said farm as a farmhand, according to custom went over to look at the work, and then found that the said boys had cut the barley very sloppily, wherefore the deponent had confronted those slaves, and specifically one of them named Piet, with this, adding a warning that they should not waste the barley in such a manner, to which the said Piet had given no answer, while the deponent proceeded a little further. And that the following day in the morning, the deponent having come into the slave house, and still finding there the said Piet, who had not gone out to the land together with the other slaves, he ordered him to proceed thither to perform his work there as before, which was refused by the said Piet, saying that he would not go, since the deponent had beaten him the day before; having furthermore, after the deponent had made some further attempts to make him go to the land, said that the deponent should take care not to touch him, because accidents would come of it. That the deponent had then made this obstinacy of the said Piet known to the requisitionist, who thereupon ordered that he should have some boys come from the land and then give the aforementioned Piet a beating, which the deponent also executed; while the said Piet, when those boys had come from the land and, on the order of him, the deponent, had gone into the slave house to fetch him out, repeated his previous words to the deponent to them, namely that if anyone dared to lay a hand on his body, accidents would come of it, and meanwhile, having resisted, had seated himself back behind some sheaves of barley. That about an hour thereafter, the deponent, having come back to the aforesaid work, and finding that the slaves were not working on as usual, had questioned them again on that account, and at the same time had given three or four of those who were busy binding the sheaves, as well as the said Piet, some cane strikes, whereupon the latter had run from the land, but was chased back by the deponent upon being given some strikes and put back to his work, with which he then continued until the evening.

However, because the cut sheaves were scattered over the land by heavy wind, and also because no care had been taken by the slaves who were supposed to make the stacks to bundle the grain properly (as the first deponent declared having seen the mentioned overseer, while the 2nd deponent had continued with his work), the aforesaid overseer had then dealt the aforementioned slave Piet several blows with his cane, and that, the same slave Piet having grabbed and held fast the cane, the frequently mentioned overseer Nagel had thereupon forcefully pulled that cane back out of his hands, and, having then given him, Piet, several more blows with it, the aforesaid slave Piet had subsequently taken to his heels, while the same overseer had pursued him and forced him back to work. That the following day, in the morning, the mentioned Piet had not gone along to the land, but remained lying in his bunk, and had requested of the deponent that, when he arrived at the land, he should make this known to the overseer, and that if the same overseer should order them to fetch him, they should take good care not to touch his body, because accidents would then come of it; the deponent had then proceeded to the aforesaid land, and, when the overseer had also arrived there, reported to him that the mentioned Piet could not come, whereupon the same overseer had left the land alone, and shortly thereafter had the deponent along with the other slaves summoned to him, who had then gone to the slave house where they encountered the mentioned overseer. Rejoinder drafted and most respectfully submitted to the Honorable Johannes Isaak Rhenius, President, along with the other Honorable Members of the Council of Justice of this government, by and on behalf of the Citizen Arend van Wielligh as the general agent of Maria Malang, widow of the late citizen Hendrik Engela, defendant, of the one part; Against The Honorable Independent Fiscal Johan Nicolaas Steven van Lynden, ex officio plaintiff, of the other part. Honorable President and Honorable Members, The said representative of the defendant shall first have the honor of expressing to Your Honors his dutiful gratitude for the favorably granted copy of the reply of the Honorable ex officio Plaintiff. And, rejoinder being made, he states briefly: 1. That while the Honorable ex officio Plaintiff seems to be of the opinion that the wicked disposition of the slave Piet has not been proven, and His Honor therefore cannot prejudice the matter, the representative of the defendant thus takes the liberty of most humbly bringing to Your Honors' attention that the wicked disposition of the said Piet, over and above what has already been alleged in the response, shines through most clearly in his conduct: in that, after having received some blows the day before, he refused to work the following day under the pretext that he was unable to do so, whereas he was nevertheless quite capable of arming himself with a club to warn his fellow slaves that they must not lay hands on him, and at the same time threatening that accidents would then occur; furthermore, that his stubbornness having been broken by being laid down and receiving some blows, he, Piet, was still able to walk fresh and hearty until around 8 o'clock in the morning, and subsequently still abscond from the farm, and, having kept himself in the veld for four to five days, went toward the Cape. An act, Honorable Members, which is not only contradictory but incomprehensible, and from which that which was posited in the response regarding the disposition of the said slave is most clearly proven. Wherefore the representative of the defendant most humbly implores Your Honors' favorable attention in this regard. 2. That the Honorable ex officio Plaintiff, in numbers 11 and 12 of His Honor's reply, is pleased to remark that the account of the case in question set forth in the response is based solely upon the report of him who lent his service to the execution of the mistreatment. This remark, Honorable Members, must notoriously overturn the argument of the ex officio Plaintiff when one considers that His Honor bases himself solely and exclusively on the report not only of a slave, but, Honorable Members, of what slave: of a slave who, for his impudence, underwent a domestic punishment by order of his mistress, and out of stubbornness and maliciousness, in the firm intention of avenging himself for that moderate and well-deserved punishment, ran away from the farm and, without any evidence other than his own word, went to the Honorable ex officio Plaintiff to complain. 3. The representative of the defendant has already shown in the response, both from the written laws and from the Statutes of India, that slaves are not proper witnesses, and explicitly so in the case subject to discussion, where the testimony of a slave against his mistress is concerned. Wherefore also the representative of the defendant submitted the deposition under Letter B in the response solely for the inspection of Your Honors, without wishing to draw any proof therefrom, to which the representative of the defendant, corroborated by the intervention of the testimony of a European, could have claimed greater right. But no, the representative of the defendant refers once again to the laws alleged in the response, although the Honorable ex officio Plaintiff seeks to dismiss them as cited not entirely in good faith and inappropriately, without adducing the least or slightest proof in that regard, and thus skips over the arguments adduced by the defendant by saying that His Honor will be able to dispense with answering them. 4. If it please Your Honor, with regard to the alleged harsh treatment by the principal defendant toward her slaves, the submitted declaration under Letter A makes not the slightest mention, much less has it been refuted, and thus it appears that the alleged harshness falls away of its own accord.

to satisfy his desire, from which it seems to follow that, since the prisoner and defendant nevertheless indulged his passions and thus carried out his desire, some violence, or at least a more efficacious means than the simple declaration of his will, must naturally have intervened. But when, on the other hand, one examines the account of the violated child Claartje produced alongside this under D: 1: l:, one will find that she on her part did barely anything by which the commission of any [illegible] and if one adds to this the declaration under D:r 2 l: of the mother, in which she says that she was prompted by Claartje's stiff walking to inquire what had happened, then it appears as though Claartje had little sense of the crime committed against her, otherwise she would indeed have revealed what happened herself immediately after her mother's return, and then one seems much more obliged to conclude that the prisoner and defendant had little trouble moving Claartje to compliance; from these circumstances, therefore, no violent rape can be inferred. At the very least, the matter remains highly doubtful and uncertain, in which case the judge must always choose the gentler side and let leniency prevail over severity. In ambiquis enim Iudicem procliviorem, ad lenitatem esse oportet. Moreover, the Lex Ultima Cod. de Probat. does not allow a judge to impose any punishment without legal and complete proof. Let it not be said that the act of defilement committed against a child of seven years is in itself considered a violent act, and that there is therefore no further proof of committed violence needed, especially since it appears in the case in question that the vulva of the child was completely swollen after the coitus and the entrance to the womb was torn; for Your Honorable Worships please remember that, when speaking in law of a violent rape, the question is not whether the perpetrator uses some violence during the coitus to consummate the act, of which kind of violence the surgical certificate speaks, but rather whether he used violence to force the object of his desires into a compelled submission. For otherwise, all defilements committed against young girls who have barely reached maturity would have to be regarded as violent rapes and be punished with death, even though the perpetrator committed nothing violent beyond the defilement, whereas such defilements among us are nonetheless almost unpunishable; see van Leeuwen Rooms-Hollands Recht Book 36, Part No. 2, in medio. No. 19 The Independent Fiscal of this Government, the Honorable Johan Nicolaas Steven van Lijnden, in his capacity as plaintiff, against the burgher Johannes Jacobus Rens, defendant, to hear on his account of the excess committed in seizing the goods of fellow burgher Christiaan Waal, such claim and conclusion as the Honorable plaintiff shall think fit to make and take against him, Rens, to answer thereto, and further to proceed according to law. The Deputy Fiscal, Mr. Johannes Andreas Truter, on account of the indisposition of the Honorable Plaintiff ex officio, submits a report from the First Court Messenger, Carel Ewald Ziervogel, and advances verbally the following: Noble and Honorable Sirs, In order to avoid lengthy and tedious proceedings in matters that can be subject to not the slightest doubt, the Plaintiff ex officio will merely have the honor briefly to state verbally to Your Noble Honors that the defendant, at the end of the month of November of the past year, having handed over to the First Court Messenger a warrant of arrest together with a summons ad proximam against the burgher Christiaan Waal, in order to seize the goods of the latter and to have him summoned for the next court day, instead of awaiting the execution of these writs, did not hesitate on his own authority, before the Court Messenger had been to Waal, to seize the aforementioned goods himself and have them stored away; while from the same report it may appear that the defendant made no difficulty in avowing this improper and unlawful conduct of his, even adding that he well knew what he had done and would also answer for it. The defendant has thus, in seizing those goods, essentially committed an excess, and may with justice be said to have been his own judge against the well-known axiom nemo sibi ipsi jus dicere potest. Thursday, the 1st of April 1791 Extract from the Criminal Court Roll held at the Cape of Good Hope. The Plaintiff ex officio deems it unnecessary to detail at length the utterly ruinous consequences that such examples can entail; nor will he weary the attention of Your Noble Honors by demonstrating that no one is permitted to be his own judge and, without judicial authority as the defendant has done, to drive someone out of his possession, because attached goods must not be held to be out of the possession of the owner, although he may not make use of them (Bort on Arrests, Part 7, No. 21). But he trusts that Your Noble Honors will perceive these matters as manifesti juris of your own accord, and thus understand very well that the excess committed by the defendant can just as little be passed over unpunished as the violation of an arrest on the part of the person arrested, but that on the contrary it ought to be severely punished as an example to others, so that through the connivance in irregularities society may not finally become entirely lawless. For which and other reasons, the Plaintiff ex officio, making claim, concludes that the defendant shall, by definitive sentence of Your Noble Honors, be condemned to such a fine pro fisco as in good justice you shall judge proper for the maintenance of judicial authority. The defendant thereupon requests four weeks' postponement and a copy in order to reply, believing that he will then be able to show by declarations that Waal did not anticipate the officer with lies. The Plaintiff ex officio refers himself to the aforementioned verbal claim. The Council grants the defendant the requested copy and a term of fourteen days to then serve his reply. On the 1st of December, a. c., the burgher Jacobus Rens presented himself to me, the undersigned, making known that he wished to have an arrest placed upon the goods of fellow burgher Christiaan Waal, to whom he had rented a house, and also to turn him out of the house, as he remained in default of paying the rent. Whereupon I pointed out to him, Rens, that before the Honorable Deputy Fiscal, Mr. J. A. Truter, he had agreed with the aforesaid Waal that the latter should vacate the house by the middle of that month, and then also pay the arrears of rent; that this term not yet having expired, he was bound to await it, and was not authorized beforehand to undertake anything against the tenant of his house; that furthermore no arrest might be placed without the prior knowledge and consent of the Honorable Governor, and when he had obtained the same, he must then present himself at the Secretariat of Justice, in order that such an arrest, with the appropriate writs belonging thereto, might be issued.

to have the summons belonging thereto properly drawn up, and that once that was done and he handed those papers over to me, I would properly execute the same and report to him thereon, but that he would still have to await the decision of the Honourable Court of Justice, where both he and his opposing party would have to appear on the first ordinary court session day, in order to examine whether the attachment was legally or wrongfully placed, and that before being furnished with the Court's verdict, he was not permitted to lay hands on the goods of the said Waal. The often-mentioned Rens having thereafter handed to me the aforesaid attachment with the citation, which I gave over to the second court messenger for execution, who also directly for that purpose went to the customary dwelling of the Burgher Christiaan Waal, but, no longer finding him there, thus searched for him, and properly delivered his exploits to him, to which he received the answer that the frequently mentioned Rens had already beforehand taken Waal's goods to himself, and had locked them away so that he could reach them nowhere, and that he, Waal, intended to go to the Honourable Independent Fiscal in order to lodge a complaint thereabout. Two days thereafter, I received orders from the Honourable Independent Fiscal to go to the often-mentioned Rens, in order to investigate whether that matter had indeed occurred in such a manner. Answer drawn up and most respectfully submitted to the Right Honourable Johannes Isaak Theunis, President, together with the other Right Honourable Councillors of Justice of this Government, by and on behalf of the undersigned Burgher Johannes Jacobus Rens, defendant in a case of committed excess in the attachment of the goods of fellow Burgher Christiaan Waal on the one part, against the Independent Fiscal of this Government, the Honourable Johan Nicolaas Steeven van Lijnden, ex officio prosecutor in the aforesaid case, on the other part. To that end, may it please Your Right Honours to be informed that the Burgher Christiaan Waal rented a certain house from the defendant, and failed to properly pay his rent to the defendant, to such an extent that his arrears of rent amount to a sum of ninety rixdollars. The defendant, wishing as a good family man to look after the interests of his wife and children, was compelled to notify the said Christiaan Waal on the last day of October that he had to vacate the defendant's house by the end of November, with a friendly request that he, Waal, pay his arrears of rent to the defendant; and the defendant subsequently had a "For Rent" notice properly posted above the door of the house belonging to him. Following which "For Rent" notice, the Burgher Claas Jonassen came to the defendant, who rented from the defendant the said house in which the Burgher Christiaan Waal was still living, in order to move into the same on the 1st of December of the past year. In the meantime, the defendant repeatedly urged the said Christiaan Waal for the settlement of his rent from time to time, but was constantly put off and disappointed by frivolous excuses and fair-seeming promises. Indeed, more than once, the defendant was told by the said Christiaan Waal, on the occasion when the defendant warned him that he had to see to vacating the house at the time notified to him, that he would not leave the defendant's house before he had paid him; to which the defendant constantly replied: those to whom I have rented the house cannot wait for that, and

to bring to the attention of the Governor and Council of Policy; and this in order to avoid all detrimental consequences and not to incur responsibility in the future for someone else's administration; that this report primarily concerned the unbelievably poor condition of the Colony's treasury, as well as the buildings, papers, and effects; that thereupon the said Council of Policy, by resolution of 18 July of the past year 1789, decreed a commission of two members from its midst, in order to proceed thither, primarily "to examine accurately everything that could have any relation to the treasury of the Swellendam Colony, as well as to the effects and papers belonging thereto, etc."; that these Gentlemen Commissioners, upon returning from their completed commission on 16 February 1790, having submitted a detailed report both of their findings and actions, the aforementioned Honorable Council, by resolution of 27 April last, thought fit "to issue an extract thereof, with the insertion of the aforementioned submitted Memorial of Report, to the undersigned; and this in order to make such use of it in his capacity as he should find appropriate"; that the undersigned, upon close examination both of the above-cited report of the present Landdrost and of the aforementioned report of the Gentlemen Commissioners, believed he saw such grievances reflected therein against the outgoing Landdrost C. van Nuldt Onkruydt and against the likewise outgoing Secretary there, Mens & Blankstein, which are highly reproachable and punishable; that the instruction of the undersigned, in Article 11, clearly commands him "concerning all matters which he, the Independent Fiscal, might have to charge against these or those subordinate servants, to institute his action before the ordinary courts." And to begin with, regarding the Landdrost Constant van Nuldt Onkruydt, dismissed at his own request, the first defendant in this matter, by this person, indeed, Honorable Gentlemen, who on 26 February 1782 was appointed Landdrost of the Colony of Swellendam, and, after having held that office for not even a full six years, was discharged therefrom on 18 December 1788: 1. The Colony's effects were so damaged, neglected, and found by the present Landdrost that they can never again be brought into a condition for use; lying, in the first place, the Colony's leaf table, which must serve at the meetings and thus belonged in the council chamber there, in the kitchen placed on four barrels. 2. The charters and papers, which must always be left behind for the successor to serve as a rule and guide for him, consisted solely of an Ordinance Book, a Plakaat Book, some loose ordinances, and receipts for paid arrears on cattle stations. in a letter book containing only such letters as were sent on behalf of this government to the late Landdrost Horak. While the Defendant will not be able to deny that there were delivered to him in proper order by the late Mr. van Ryneveld, as outgoing Landdrost, not only all incoming letters concerning his office, but also bound minutes of all such acts and documents as were dispatched by him, Ryneveld, and his predecessors, both to this Government and to private individuals on various matters, together with still other papers which an incoming Landdrost has the greatest need of. And whereas it was indisputably part of his duty and department to preserve such substantial papers carefully, in order to be able to hand them down in turn to his successor, as entrusted to him solely for his use without the least ownership; nevertheless, not the slightest remnant thereof was to be found by the present Landdrost, as appears from his report sub: B et: ad No: 2. With his buildings, matters were situated equally unfavorably upon his departure; the same consist of: 1st, in a house for the residence of the Landdrost, which, because of the neglected and shamefully omitted necessary repairs, is in such a dilapidated condition that the present Landdrost was compelled to have the large holes in the roof and other leaks stopped immediately, and furthermore to have many other repairs performed, which could not be carried out without much and extraordinary expense, and without which this house, before the heavy rains that fell there in the month of June 1789, would already have been partly turned into a ruin; see the extract report annexed hereto, quoad clausulas concernentes sub L: B ad: BV added to A: NB: 3. 2nd, in a small storehouse adjoining the aforementioned front house, and no better, but so dilapidated for lack of timely repairs that it cannot be restored again. 3rd, in a building serving as a coach house and workshop, likewise completely dilapidated for the aforementioned reason. 4th, in a square room that is completely stripped of its roof and provided with no doors or windows. 5th, in a building erected by the defendant, being arranged for the stabling of a large number of horses, with some added domestic rooms, and coops for poultry, which building, having stood for only a short time, nevertheless shows the marks of poor construction and of soon requiring very costly repairs; while already not only the roof containing the poultry coops, with a part of the wall of the dovecote, but also all the principal pilasters are broken, to such an extent that this part of the building has already become entirely unusable; concerning which building it should be noted that the defendant has dared to maintain a claim in that regard at the expense of the Colony, which still remains alive, and thus dared to erect the same at the expense of the Colony propria authoritate without the least authorization or consent of the Governor and Council, and without communication or consultation or prior knowledge of the Heemraden, and has thereby inflicted an irreparable damage upon the entire Colony's Treasury, as will presently be demonstrated in more detail. 6th, in a house and adjoining rooms for the service of the Secretary, in such a dilapidated state that during the presence of the Commissioners at Swellendam, the horse stable, which constitutes one of these rooms, collapsed. 7th, in a building serving both as a residence for the Deputy Landdrost, the Messenger, and the order cavalrymen, and for the detention of prisoners. Which building was built firmly and strongly only recently, in the time of the previous Landdrost, Rijnevelt; however, if the proper repairs, now neglected for some years past by the defendant, were further omitted, it would soon fall into the same decay in which the other Colony buildings already find themselves. 8th, in an old building, having likewise served for the aforementioned purposes, of which the roof has completely collapsed, and in which the Caffers, who belong to the administration of Justice at Swellendam, find their shelter in a completely miserable manner. § V. And as to what finally concerns the state of the Colony's Treasury, may it please Your Honours to be informed that the confusion and obscurities which surround the administration of the Colony's financial affairs permit only with the greatest difficulty the formation of a clear picture thereof; from a statement and account of that Treasury closed on the last of December 1788 and... 9th, in a so-called gunpowder or powder house, to the terror of those who must enter it, provided with an iron door running over stones, covered with thatch and even then, for the most part, stripped of thatch, in such a manner that the powder stored therein for the Citizen Drill is exposed to the rain. 10th, and finally in a pontoon across the Breede River, completely worn out and no longer capable of enduring repairs, but having to be entirely renewed, see B. ad No. 2, 3, 4, 5, 6, 7, 8, 9 & 10 & A: ad: No. 4. From all of which it appears most clearly that this defendant, for several years past, has shamefully neglected to have the repairs made that were so highly necessary and required for the same, and that the same have thereby principally fallen into that present deplorable and, for the Colony, so ruinous situation.

From which obscure calculation some elucidation cannot very easily be obtained; but one can nevertheless infer with good reason that the Colony's finances must be in a most deplorable state. Especially when one adds to those deficient funds the three years of interest on a principal sum of 22,000 Gls which the same owes to the Orphan Chamber, together with the four years of pass money due to the Colony of Stellenbosch, while the ferryman and the Colony's messenger have also not received their earned wages for several years, and likewise the substitute has not been paid his due judicial costs for some time now A. ad No. 9 and 10. Since the Gentlemen Commissioners, in a combined meeting of Heemraden and Burgher Officers expressly convened to examine those obscure and confused accounts, when the present members were asked for their elucidations concerning them, unanimously learned from the same that however much they had always endeavored to look after the Colony's affairs faithfully and uprightly according to their oath and duty, none of them nevertheless had been allowed to have any say in the administration of the Colony's treasury, B. No. 17. That they, not understanding the drawing up of those accounts, had always trusted and assumed that the same were compiled and prepared in proper order as was fitting, either by the Landdrost or by the Secretary whose duty it was to do so, and in that confidence had also signed those accounts. B. No. 18. Whereupon the combined meeting declared in that regard that the last preceding Landdrost C. van Nieldt Onkruijdt had always kept the Colony's funds under his own control, and in the respective meetings had usually only given in general terms the estimate of what he claimed to have spent on behalf of the Colony B. ad No. 19. Thirdly, dereliction of duty. Fourthly, disobedience to the orders of the Governor and Council, which, although addressed to the Landdrost and Heemraden as constituting the Board to which such are usually addressed, the execution thereof nevertheless depended chiefly and solely upon him, and thus the non-partition and non-execution thereof is likewise to be blamed entirely on him. Fifthly, indeed, even the neglect of the observance of his oath taken in his aforementioned capacity as Landdrost. For it entails: "to be holden and faithful to the government" "to serve the office of Landdrost uprightly and faithfully" "faithfully to propose and make known all matters concerning his office, according to his best knowledge and understanding, and furthermore generally to conduct himself in that office as behoves or becomes a pious and upright officer and Landdrost to do." If one now compares what has been set down here above in detail with these articles of the oath annexed hereto under letter d, one will quickly be able to perceive whether and to what extent the same has been observed, or rather neglected and forgotten. Wherefore the Plaintiff deems it superfluous to analyse this further, in order to avoid all prolixity as much as possible in a matter of such importance as this.
