Pursuant to your Right Honorable orders, we have designated the ship 'T Duifje for the transport of freight goods to the Netherlands, with which that vessel is fully laden, and regarding the ship de Resolutie we shall likewise obediently follow your Right Honorable venerated orders. With heartfelt pleasure, we may also communicate to your Right Honorable the safe arrival of the following vessels designated by the High Indian Government in return for your Right Honorable Chamber, as: On 28 August, the Geertruy en Petronella, with 3 dead, 10 sick 31 August, Constitutie, with 6 dead, 7 sick 6 January, Unie, with 11 dead, 7 sick We should, in accordance with our bounden duty, elaborate extensively on the condition in which the said vessels have arrived here, as well as on what we have carried out regarding them, as well as on what has occurred since our latest humble advices with the ship de Drie Gebroeders which ran aground in the Bay, as well as on the dispatch to Europe of your Right Honorable Chamber ships the Castor and Gouda; but since, both on account of the manifold orders which are given to us daily by the Right Honorable Lords Commissioners General, and by on 7 January, the Gouverneur Generaal Mossel, with 7 dead and 20 sick 28 January, Buitenverwagting, with 12 dead, 12 sick the 79. the presence of a large number of Company ships, we find ourselves as if overwhelmed with business, we shall, concerning all of this, respectfully refer to the copies annexed hereto of our humble letters under date of 7 July last and of today to the Illustrious Assembly of the Seventeen, humbly requesting that this shall not be taken amiss by your Right Honorable. For the rest, we let this serve to accompany your Right Honorable Chamber ships the Unie, the Constitutie, the Gouverneur Generaal Mossel, Buitenverwagting, 'T Duifje, the Castor, and Gouda, together with the private ship the Geertruy en Petronella, which vessels, with four others for the Chambers of Zeeland, Delft, Hoorn, and Enkhuysen, come to form the first squadron, which lies ready under convoy of Mr. J. O. Vaillant, commanding the State Frigates of War the Zephir and the Havik, and under the command of the Extraordinary Councillor of the Indies and Admiral Jan Greeve, to undertake the voyage to the ports of the Fatherland, where we wish that divine providence will cause them to arrive as speedily as free from disaster. We have caused to be placed on each of the aforesaid eight vessels, and addressed separately to your Right Honorable, the Bills of Lading and Invoices of what has been shipped in them here, together with the Expense Account of 80. In the Castle of Good Hope, 3 February 1793 of what has been furnished to them, as well as the Lists of Persons repatriating with them, and the further Papers appertaining to each of the said ships, to all of which we respectfully refer. 82. treatment suffered by them on board the ship West Capelle during the voyage hither, the same defense containing, among various insinuations against us and our conduct in the investigation of the said complaints, also a formal accusation against the Secretary Bergh, as if he had been imprudent and indiscreet enough to presume to tax our actions regarding the said Captain Laurentius, and to make open threats to him, and whereas the High Indian Government has been pleased to order us to reproach the Secretary Bergh for this at our Meeting in the presence of Captain Laurentius, we have, however much our continual occupations—as we hope Your Right Honours will please be assured—do not as yet permit us to take resolutions on the aforementioned Letter from the High Indian Government, nevertheless judged it our unavoidable duty to elucidate this entire affair here during Captain Laurentius's stay and to present it to Your Right Honours, and we shall therefore take the liberty to respectfully inform Your Right Honours that immediately after reading the defense submitted by Captain Laurentius to the High Indian Government and their Right Honourable's subsequent order, the undersigned commander declared that when, upon the arrival of the ship West Capelle in False Bay, Captain Lieutenant von Hugel, commanding the Wurtemberg recruits passing through here, had submitted to us a Memorial of complaints about the ill-treatment committed against some recruits who arrived at this corner with that vessel, and the investigation of those complaints had, by our resolution of 7 June last, been demanded of the Fiscal Office, Captain Laurentius had called upon him that same morning, just at a moment when the Secretary Bergh was with him, with a request that the investigation of this matter might not be assigned to the Fiscal Office, but that there might be delivered to him a copy of 83. the complaint submitted by Captain Lieutenant von Hugel, with the accompanying appendices, in order to refute the same documents and to defend himself against them; that he, the commander, had tried to make Captain Laurentius realize the futility of such a refutation and defense, since he had to assume in the Fiscal Office that impartiality which we all attribute to the same, and that there had also been handed over to the Fiscal both the representation of Captain Lieutenant von Hugel and the interrogatories to be answered by the Wirtemberg recruits under offer of oath; that since he could be present at the investigation demanded of the Fiscal, he would have sufficient opportunity to clear himself of the accusations leveled against him; that during this conversation between him, the commander, and Captain Laurentius, not a single word had been spoken by the Secretary Bergh; that he, the commander, had left the Secretary Bergh and Captain Laurentius alone in order to grant an audience to some persons in one of the other rooms of his residence, and that after a short delay he had returned to the Secretary Bergh and Captain Laurentius, whereupon the latter, 84. after having exchanged a few more words about the investigation and taken his leave, had departed. This declaration of the undersigned commander having been found not at all in accordance with what was stated by Captain Laurentius in his defense, we asked the Secretary Bergh what had actually occurred between him and Captain Laurentius, and the said Bergh thereupon made known to us upon the oath taken at the assumption of his office, that when the undersigned commander had left them alone, Captain Laurentius had persistently complained to him about the impropriety which he thought existed for him in our resolution to demand the investigation of the complaints brought by the Soldiers of Wurtemberg from the Fiscal Office; that he, Bergh, finding himself alone and thus as a private person with him, Laurentius, had pointed out to him that we, with our resolution to demand the investigation of the said complaints from the Fiscal Office, had acted in accordance with the orders of the Company and our obligation, that the nature of the brought accusations was also so grave that it indeed came to merit a judicial investigation; but that through this, the means to demonstrate his innocence were in no way taken from him; and that neither the undersigned commander nor all of us were able to avoid such an investigation, because if such atrocious accusations were found to be true, one

one could not, without rendering oneself responsible to the highest degree, fail to discipline the perpetrators of such mistreatment as that about which the soldiers of Wurtemberg had complained, without any respect of persons or use of connivance. Since we now dare to testify before Your Honors with complete tranquility of mind that we have never discovered in Secretary Bergh any inclination to critique our decisions or to assume an ill-placed authority, and as we dare no less to rely upon the testimony concerning the circumstances of this matter given both by the undersigned Commander and by the said Secretary, it would also have served as a particular satisfaction if the High Indian Government had been pleased to qualify us, prior to having Captain Laurentius obtain the prescribed satisfaction, first to conduct a meticulous inquiry into whether his submitted accusations were well-founded or not; and whereas we trust that from the foregoing account of the circumstances of this matter, from the petition of complaint submitted by Captain-Lieutenant von Hughel, from the annexed answers to the interrogatories put to the Wurtemberg soldiers, from the report delivered to us by the Fiscal officer, from the resolutions taken by us on all those documents, and from our letter on that account sent to the High Indian Government—of all which we take the liberty of presenting to Your Honors authentic copies or extracts—it will become fully apparent to Your Honors that we have acted therein without any of the least partiality according to our bounden duty, and that Secretary Bergh has sought nothing other than to persuade Captain Laurentius to acquiesce in our dispositions made according to orders, we therefore deem that we cannot fail to request Your Honors in all subservience to be pleased to declare that Secretary Bergh has not merited these reproaches, and thus to acquit him of the accusations, devoid of truth in every respect, brought against him by Captain Laurentius, and to discipline the said Laurentius for this in such manner, and to procure such satisfaction for him, Bergh, as Your Honors shall deem proper. We have further seen, not without the utmost consternation, from the repeatedly mentioned response of Captain Laurentius, his supposition that by such investigations as that which we carried out in his regard, a way might be paved toward the decline of the highly necessary subordination, and occasion be given for gruesome scenes such as occurred on the ship Barberstein; and whereas we know ourselves to be free from having ever undertaken anything that could tend to undermine good order or could give rise to dangerous mutinies, but rather have always sought, according to the sworn duty of each and every person to whom the delicate interests of the Company are entrusted, to care as well for the safety and good treatment of its servants, both here on land and upon the ships, as for the maintenance of the authority of those who command and exercise power over them, in order by one and the other to prevent all rebellion, and to preserve each individual in his right, we likewise trust that Your Honors will find yourselves fully penetrated by how offensive and in every respect distressing this shameless and to the highest degree punishable assertion of Captain Laurentius comes to be to us; and we beseech Your Honors also to procure for us such striking satisfaction on this account as will ensure that our performance of duty shall not again henceforth be exposed to the ridiculous censure of subordinate persons. Question 2 2) Even if they had done their work ever so diligently, they were nevertheless beaten like dogs by the quartermasters of the ship, and they dared not complain unless they wished to be beaten even more. 3) They had been compelled by force to tend to the sick sailors and even to clean their latrines; they had caused the Captain to be petitioned that he might let them perform sailors' duties and appoint the so-called boys, who could perform no duties, as sick-attendants, but it had not availed; they had to perform all of these services without distinction. 4. If he wished to give a true example by which one could clearly see their treatment: while the deceased Quartermaster Ekard was still alive, they had to scrub the ship one day. The first lieutenant of the ship had ordered that half of the soldiers work in the hold and the other half on the deck. Their Right Honorable Worships' sensitive and philanthropic heart, before whose illustrious tribunal I bring these grievances of violated humanity, will certainly not take it amiss of the undersigned that, compelled by his duty, he hereby accuses the officers of the Honorable Company's ship West-Capelle of severe mistreatment, oppression, and insults committed against the recruits of the Regiment of Wurtenberg, and further respectfully informs Their Right Honorable Worships that this so irregular practice of using the military as attendants for the sick sailors and to clean the nightstools can be considered to have contributed much to the extraordinary mortality and illnesses, seeing that out of only 24 souls, 10 men have died, four have remained sick in the Company's hospital at Simons Bay, and ten have arrived at the Cape for refreshment. In such a manner, it would become difficult or even impossible for the illustrious owner of the Regiment to maintain the same fit for service and at full strength, and thereby a considerable disadvantage would accrue to the Honorable Company's service. The undersigned therefore leaves it to Their Right Honorable Worships with all respectful modesty to devise such arrangements concerning this irregular and inhuman conduct as their wisdom shall judge necessary, but at the same time humbly requests to place these remaining 14 recruits on another ship, whether to send them, in accordance with an adopted resolution, to Ceylon with the daily expected Ceylon ships, or, if that should not be possible, to transfer them to other ships sailing to Batavia. Your Right Honorable Worships having, by your honored resolution of the 7th of this month, placed into the hands of the pro-interim Fiscal, Mr. Jacob Pieter de Neuf, a memorial presented to Your Right Honorable Worships by Captain von Hughel, as Commander of the affairs and recruits of the Regiment of Wurtemberg at this corner, containing complaints against the officers of the Honorable Company's ship Westcapelle concerning extreme mistreatment committed by them against the men brought on that vessel during the voyage from the Fatherland; with orders that he, the pro-interim Fiscal, should immediately proceed to False Bay and there on board the said ship Westcapelle carry out the required investigations into how far the complaints appearing in the said memorial are or are not well-founded; in order, with the return of the original memorial and the appendices pertaining thereto, subsequently to supply the required report of his findings without loss of time to Your Right Honorable Worships, to the end of enabling the same thereby to take such further disposition as the actual circumstances of the matter found shall come to require;—so the undersigned Deputy Fiscal has the honor to report with due respect: That he, pursuant to and in fulfillment of that same honored resolution of Your Right Honorable Worships, on account of the indisposition of the aforesaid pro-interim Fiscal, proceeded on the 8th of this month to False Bay, and there on board the Honorable Company's ship Westcapelle examined on each point of complaint contained in the aforesaid Memorial not only the Junior Merchant stationed on that vessel, Laurentius Reeman, and all the

That then, regarding the first point, containing that the soldiers of Wurtemberg were most grossly mistreated by the ship's crew during the voyage, never called anything other than snakes and scorpions, that when they complained, instead of receiving satisfaction, they were threatened with beatings, it was declared by the Captain that he had never heard any name of that nature used on his ship, and that no complaint about anything of the kind had ever been made to him; it being otherwise his custom to provide proper satisfaction even to the least of his subordinates; on which first point the undersigned subsequently, having heard separately the said junior merchant, Captain Lieutenant J: A: van der Putte, Lieutenant Perlé, together with the chief surgeons, sous-lieutenants and cadets, all the petty officers, and finally all the ship's crew gathered before the mainmast, all of them without exception testified that they had never seen any mistreatment committed against the military personnel during the voyage, nor committed any themselves; that the crew had in the beginning been exhorted by the Captain and other officers to refrain from reviling the military personnel; that they had also faithfully complied with this; and that they finally knew of no reason to complain in the least about the Captain. That the undersigned having proceeded in the same manner with the investigation of the second point of complaint, entailing that the military personnel, notwithstanding that they performed their work properly, were nevertheless beaten by the quartermasters as they pleased, and out of fear of more beatings were forced to remain silent, the Captain testified that this must be an absolute untruth, because he was convinced that he observed too good an order on his ship for anything of the kind to be able to happen without his knowledge: with which declaration the junior merchant, along with the officers, petty officers and the crew fully conformed; the petty officers having even added thereto that the quartermasters had no authority over the military personnel, and that they had even been forbidden to strike the soldiers, though they well knew that the military personnel constantly refused duty and indulged in all kinds of mischief. That, concerning the third point, namely that the military personnel were forced by violence to attend to the sick sailors and even had to clean the commodes, the Captain and all the others, having been questioned in the aforementioned manner, declared and testified that no violence was ever used to force the military personnel to attend to the sick, but that upon their repeated refusal they were only encouraged with words to observe their duty in this matter; for the military personnel, as well as the seafarers according to the Honorable Company's instructions, are required, on their turns, to keep watch over the sick and to perform the services attached thereto: that the military personnel were not used for this exceptionally, but along with and in addition to the seafarers, of whom always, as far as the ship's service and the weakness of the crew caused by the numerous sick permitted, some attended to the sick with an equal number of soldiers: and that finally the military personnel were exempt from watches, while nevertheless the seafarers who attended to the sick continued to keep their regular ship's watches. No. 20 We take the liberty of presenting to Your Right Honourable, alongside this in authenticated copy, a petition submitted by Captain von Hugel, who has oversight over the recruits of the Wurttemberg regiment passing through here, containing several complaints against the officers of the Company's ship Westkapelle regarding extreme mistreatment committed by them against the recruits brought on that vessel during the journey here from the fatherland, which complaints we found to be of such a nature that they demanded the most prompt and no less accurate investigation, which investigation we therefore, immediately after receiving the complaints, demanded from the ad interim fiscal De Neijs, who, having been prevented by indisposition from attending to it, had to effect the same through the adjunct fiscal Mr. Johannes Andreas Truter, who then also proceeded to False Bay for that purpose, and after having made the necessary inquiries, submitted to us today Extract of a letter written by the Right Honourable Lord Commander and Council of Cape of Good Hope to the Right Honourable Strict Lord Governor General Mr. Willem Arnold Alting and the Noble Lords Councillors of the Dutch Indies, dated 9 June 1792. the report accompanying this also in authenticated copy, from which Your Right Honourable may kindly see that the complete unanimity of the answers given to the questions of the said adjunct fiscal, both by the captain, junior merchant, officers, deck officers, and common sailors, if not entirely belying the complaints made, at least casts very great doubt on the largest part of them; wherefore we, under the most favourable interpretation of Your Right Honourable, have decided to make no further moves in this matter, since a further investigation would solely and exclusively result in a delay in the voyage of a ship which, on account of its destination to China, had to be dispatched with the utmost speed, while at the same time, in order to remove the complaining soldiers from all mistreatment which they might possibly have had to fear if the journey to Batavia had to be continued with the ship Westkapelle, we caused the said soldiers, along with their clothes, to be transported from that vessel to the ship De Unie, which is to be dispatched on the 13th of this month and which will probably arrive at Batavia at the same time as the ship Westkapelle, whereby Your Right Honourable may thus be enabled, should you deem it necessary, to have an even more accurate investigation carried out concerning the aforesaid complaints of mistreatment. The petitioner found, upon receiving his last dispatches in the roads of Rammelekens, that his crew at that time consisted of 346 men, both seafaring and craftsmen, among whom were 25 soldiers from the aforesaid regiment of Württemberg; and he takes the liberty to give a brief, true account of all that occurred during the outward voyage, consisting in this: That since the sailing day fell on 23 December 1791, and thus in the hardest part of the winter season, he, the petitioner, had the misfortune to spend 15 days in the North Sea amid severe storms and rough weather, whereby he was forced to keep the ports and hatches between decks closed during that time, which, due to the oppressive sea-sickness of the inexperienced young sailors and soldiers, and due to the exhalations of the wet and half-frozen clothes, naturally had to cause some infectious vapors. That it was not only in all respects beyond the competence of Captain Simon Laurentius to enter into an investigation or assessment of the aforementioned course of action, which appears to have been completely impartial in his regard, but that also the expressions which he permitted himself in that regard in his aforementioned report to the High Government are utterly disrespectful, and contrary to the subordination to which the officers of the Company's ships are bound toward all local Governments of its Establishments that they call upon. That furthermore, from the solemn testimony both of Commander Rhenius and of Secretary Bergh, it is fully and to the satisfaction of the Commissioners-General established that what was posited by Captain Laurentius in his aforementioned report regarding the expressions which the aforementioned Secretary Bergh was alleged to have used against him is completely contrary to the truth; and that he, Laurentius, therefore abused and misled the High Government in the Indies thereby, and also thereby caused the directive of the well-mentioned Government, according to which a servant of the Company—occupying here one of the most distinguished and difficult offices to the full satisfaction of his superiors and especially also to that of the Commissioners-General—would have had to undergo an undeserved reproach, which would have been all the more grievous in proportion to the notable distance that exists between a Secretary of Policy in this Government and a Captain of a Company ship, especially when the latter is addressed concerning matters regarding his duty. That because the indisposition of the aforementioned Simon Laurentius, which prevents him from coming ashore, exempts him from that exemplary correction which he has deserved and which the Commissioners-General would without that certainly have made him undergo, the Commissioners for the muster, after the ship West Cappelle to which he is assigned has been mustered, shall summon him, Simon Laurentius, separately before them, and by reading this resolution, of which a copy shall subsequently be handed to him, present to him the serious displeasure and the high indignation of the Commissioners-General regarding his aforementioned conduct, with a serious recommendation in their highest name to take diligent care against this in the future, under penalty of being corrected most severely and as an example to others. The undersigned Pro Interim Fiscal, having been informed the day before yesterday toward evening that a burglary had been committed on the private ship Geertruijda en Petronella, lying at the roads and commanded by Louw Willem van Bossum, and that some goods had been stolen from the hold, in accordance with his duty, had an investigation conducted on board the said vessel the following morning in the presence of the Commissioner Members from the Honorable Council of Justice, into the burglary itself as well as the quantity of the stolen goods, and whether it might also be possible to discover the authors of that misdeed. To the Right Honorable Sir Johannes Isaac Rhenius, Commander, together with the further Honorable Council of Policy of the Castle of Good Hope. He found that in the cable locker on the port side a plank had indeed been broken out of the deck and a hole made thereby, which could very conveniently serve to enter the hold through it, as has also appeared upon closer examination that such use must have been made of the said hole, because precisely at that spot in the hold an empty space was perceived, in which, according to estimation, 6 to 8 picols of coffee beans, with which this vessel is laden, had been placed; without the undersigned having been able to discover the slightest thing concerning the perpetrators, as he lacks sufficient grounds to prosecute any specific person of the ship's crew further.
