Monday the 27th of February 1792 In the forenoon, extraordinary meeting, all present. The Commander communicated to the members present at this meeting of the council that he had purposely convened them in order to review an incoming letter written to this council by the English Captain H. M. Sutton, as well as to transmit the same to the Lords Majors, most humbly requesting their High Mightinesses to send the stated cash here as soon as possible. Furthermore, the accompanying amount of 385 rix-dollars for the 55 loads of hay shall, upon written warrant, be transferred into the Company's treasury and entered into the trade books. To serve as a reply to that which their Right Honorable High Mightinesses have been pleased to require in that regard, with a most humble request to have the cash which their Right Honorable High Mightinesses have been pleased to allocate to this Government sent here successively, and among it, or by way of a new allocation, to cause to be delivered as soon as possible the sum of 20,000 guilders in half, quarter, and eighth guilders, as specified in the aforementioned representation by the appointed commissioners. Lastly, Messrs. Le Sueur and Van Reede Van Oudtshoorn submitted a list of 55 loads of hay mowed at the Company's post the Clapmuts and sold by their Honors to various residents for 7 rix-dollars per load. Thus it was resolved to transfer the amount thereof, being 385 rix-dollars, into the treasury of the Honorable Company upon written warrant, in order to be entered into the trade books to the credit of the ordinary expense account. The Council being seated, it pleased the Commander to inform them that his Honor had found himself necessitated to convene the meeting extraordinarily once again, since this morning another letter had arrived, written to this government by the Captain of the English King's ship Crown, Mr. Robert Manners Sutton, mentioned under dates of the 20th and 21st of the present month. The contents thereof appeared to the Commander to require not only careful consideration but also an immediate reply, since the aforementioned ship commanded by the said Mr. Sutton (the opportunity being favorable) would depart this Government today and make the voyage to Europe. Whereupon, having immediately proceeded to the reading of the aforementioned letter, the same was found to be of the following contents: Crown Table Bay Cape of Good Hope February 26, 1792. Honorable Sir and Sirs, Although the American has at last thought proper to do justice to the British seamen, which I attribute solely to the friendly interference of Captain Staringh, Commander in Chief of the Dutch ship of war in these seas, I therefore still consider in force the unprovoked insults which you have been pleased to heap on the British Nation through me. Insults that I shall here recapitulate: viz. Upon my claiming the British subjects and taking them from out of the employ of the American vessel and demanding their wages due for their services on board the said ship, which wages her master refused to pay, I immediately sent a Lieutenant (an officer second in rank on board a British man of war) to wait on the Governor and request his interference in this business, to which I received an unsatisfactory answer. I then immediately addressed a letter to him in Council and sent it by the same Lieutenant. How he was received I will relate to you. To His Excellency the Governor in Council. Upon his attempt to deliver the letter to the orderly sergeant, it was rejected by him, and the Lieutenant desired to retire, and suffered to remain for some time at the Governor's door, in as contemptible a situation as the most abject servant, and all this done in the sight of a gentleman who was present at the interview he had with the Governor some time before and whom I believe to be one of your Council. At last, however, the letter was received, and now Gentlemen I shall speak to its reply, wherein you take no further notice of my requests than the telling me that there is a Court of Justice that I may appeal to. Is it to be supposed, Gentlemen, that a National question is to be put to the decision of a Court instituted for the purpose only of deciding on private quarrels and under the control of your Council? The idea is insulting. All this, however, I have tamely endured from an anxious desire of not giving the least shake to that happy friendship and alliance that now subsists between Great Britain and Holland, which appears to me obviously are not your sentiments, for I am informed that you have been manning your batteries and sending forges in to heat shot for the destruction of the ship I have the honor to command. Laughable enough, and as such I treat that part of your conduct, and it shall be made known in Europe. Therefore, I consider the unprovoked outrages still in force, which it has pleased Your Honorable Worships to heap upon the British Nation through me—outrages which I shall briefly recount here, namely: When I reclaimed the British subjects, and took them out of the service of the American vessel, and demanded their wages earned on board the said vessel, which wages the master refused to pay, I immediately sent a Lieutenant (an officer second in rank on board a British warship) to attend upon the Governor and request his intervention in this matter, to which I received an unsatisfactory reply. Whereupon I immediately addressed a missive to him and the Council, and dispatched it by the same Lieutenant. How the said Lieutenant was received, I shall relate to you. And all this occurred under the eyes of a gentleman who was present at the verbal conversation which the said Lieutenant had had with the Governor some time before, and whom I believe to be one of Your Honorable Worships' Council. But finally that letter was received. And now, Honorable Worships, I shall speak of the answer to that letter, wherein Your Honorable Worships pay no further heed to my request, merely telling me that there is a Court of Justice to which I may appeal. Can one suppose, Honorable Worships, that a national dispute can be brought for decision before a Court of Justice, established solely to settle common disputes, and which is under the control of your Council? The idea is insulting. Yet all this I have endured with submission, out of a careful desire not to give the slightest shock to the happy friendship and alliance which presently subsists between Great Britain and the United Netherlands. Which appears to me evidently not to be your sentiments; for I am informed that Your Honorable Worships have manned your batteries and sent forges thither to make red-hot shot, for the destruction of the ship which I have the honor to command. Ridiculous enough, and as such I treat this part of your conduct. And I shall take my leave by assuring you that all this shall be made known in Europe. And whereas, after the reading was concluded, and the allegations occurring therein had been considered by the said Lord Commander, and following the explanations given by the said Lord Commander with regard to the passage in the said missive appearing among others as though the officer whom Mr. Sutton came to charge with the delivery of his letters to him, the Lord Commander, was supposedly treated with such contempt as the description dictates, it has clearly appeared to this Council that everything said thereof is either entirely fabricated, or presented quite differently from how the matters actually took place. So it has been approved and agreed, after prior mature deliberation, to reply to the said Captain Sutton in answer to his above-mentioned missive: That if the officer who had been dispatched by him, Mr. Sutton, to deliver his first missive to the Lord Commander, instead of handing that letter in at the door (as has now taken place), had properly announced himself, he would then most certainly have been received with just as much politeness as that officer who was the bearer of his Honor's second missive. That this Council has furthermore employed everything that was in its power to remove the dispute arisen with the American captain out of the way by means of friendly intercession, just as the same, as appears from the letter of him, Mr. Sutton, finally brought about the desired effect. That the Council, with this intercession of hers, as well as with referring Mr. Sutton to the Court of Justice for the obtaining of justice for his Britannic Majesty's subjects, had nothing else in view or intended than to give proof of her sentiments with regard to the friendship and alliance so happily subsisting between the Crown of England and our Republic. in order to inflict the least possible shock upon those relations, she therefore cannot conceal her surprise, both regarding the entire insulting contents of His Honour's now received letter, cited several times above, as well as principally regarding the assertion that smiths were supposedly sent to the batteries to make red-hot shot in order to destroy therewith the stranded ship commanded by His Honour. That this conduct was indeed branded with the name of ridiculous by Mr Sutton, and rightly treated as such, but that the Council can assure His Honour that it is incapable of committing similar other acts which would make it appear in the highest degree ridiculous, not only to the English, but even to its own nation. However, since on none of the batteries has the slightest preparation been made for the production of red-hot shot, nay, not even an idea of anything of the kind has existed, and consequently nothing in the world can have demonstrated such an intention, the Council is therefore quite willing to presume that some malice has sought to stir up Mr Sutton against it through the invention of such a lie. That, meanwhile, an accusation of such a dangerous nature has not only filled this Government with indignation, but also comes to require that the strictest investigation be made concerning it; it therefore requests and insists that Mr Sutton be so good as to state who has imputed that charge to it, in order to be able to obtain sufficient satisfaction in this regard, both for itself and for the Dutch nation, and to be able to convince him, Mr Sutton, how little credit His Honour ought to have given to such a malicious insinuation and imputation. And that the Council, for the rest, on the very first occurring occasion, will dispatch a true report of this correspondence held with him, Mr Sutton, to the Netherlands, in order that such use may be made thereof as shall be found proper. Wherefore it was then furthermore resolved to give notice in all respect, on the first occurring occasion, to the assembly of the 17 of what has occurred with the same, as well as the correspondence arising therefrom. To which end the alongside mentioned documents shall be collected and transmitted in authentic copy with the report to be made. Wherefore it has further been agreed to request of the Right Honourable and Strict Gentleman, Captain at Sea currently present here, in the service of Their High Mightinesses, commanding the country's ships of war lying in the roadstead, who has also been troubled with the dispute between the often-mentioned Captain Sutton and the captain of the American vessel The Fame, a copy of the reports which regarding the aforesaid matter were sent to His Honour from his board; as well as to require in addition thereto a written declaration from the Colonel and Chief of Artillery, Philippus Hermanus Gilquin, together with a statement from the bookkeeper Petrus Johannes De Wit, placed on written-off pay, with whom Mr Sutton happens to be lodged, and likewise to supply all the same documents to the High and Mighty Lords Masters, in order that it may appear to them therefrom that this Government, in the present case, has not only acquitted itself of its duty, but also that it in no way merited the threats which, instead of a friendly farewell, were made so unjustly and recklessly by Mr Sutton. 444, 445, Upon the resumption of a memorial submitted by the deputy fiscal Truter. The Lord Governor again produced to the table the memorial presented at the session of the 17th of this month by the Deputy Fiscal Mr Johannes Andreas Truter; and which was then taken into circulation by the respective Members of the Council, the said memorial with its annexes being of the following content: To the Right Honorable Johannes Isaac Rhenius, Governor of this Government and its jurisdiction, etc., etc., together with the Honorable Council of Policy. Respectfully shows Mr Johannes Andreas Truter, Deputy Fiscal of this Government; That Your Right Honorable and Honorable, by your honored resolution of 15 November of the last-passed year 1791, were pleased to place into the hands of the memorialist an extract from the revered missive of the High Indian Government, addressed to this Council, dated 31 December 1790; together with an annexed complaint, submitted at Batavia by twenty-six men of the Pépinière against Major de Sandolroy, as well as some documents presented to Your Right Honorable and Honorable by the Member of this Council, the Honorable Robert Jacob Gordon, with an attached note relating to the said Major; in order to carry out the investigation ordered by the aforesaid revered missive as speedily as possible, and furthermore to act ex officio in this matter as is more fully expressed in Your Right Honorable and Honorable's honored resolution of 28 October. Tuesday, 28 February 1792. In the morning, all present. That the memorialist, in dutiful compliance with the orders of this Honorable Council, as quickly as his numerous official duties have permitted him, has examined both the aforesaid complaint and the documents produced by the aforementioned Mr Gordon, and furthermore 446, 447, has judicially obtained all such statements by which he believes the acts imputed to the aforementioned de Sandol Roy can be verified, especially with the aim of investigating whether any weighty fact might result from them, the adjudication of which belongs to the Civil judge, and whereby the memorialist might thus be enabled, in accordance with the intention of Your Right Honorable and Honorable, to bring this matter to the cognition of the Honorable Court of Justice and to have the said Court, propter continentiam causae, judge both the Military and Civil acts of him, de Sandol Roy. However, from the pieces of evidence obtained by the memorialist, which he has the honor to present herewith to Your Right Honorable and Honorable, nothing has appeared that could successfully subject the aforesaid case to the jurisdiction of the aforementioned Court of Justice, since all these same statements contain no other circumstances than those relating to some of the accusations appearing in the aforementioned documents placed in the hands of the memorialist. That therefore, since the acts appearing in the said documents, if considered criminal, ought without any doubt to be ranked among purely military offences, having been committed by Major de Sandol Roy qua miles, in his capacity as a military man, the memorialist, under respectful correction, believes that after the establishment of a Military tribunal in this Government, the adjudication over the aforesaid acts cannot be avocated from the court-martial and brought to the Court of Justice without the concurrence of the parties; at least in that case one has reason to fear that the defendant will avail himself of the exceptio fori, and thereby, if not immediately returning the matter to the military judge, at least by interposing an appeal 448, 449, in case the aforesaid exception were rejected, will always manage to direct things in such a way that the principal case could only be commenced after the lapse of entire years; whereby not only the punishment, si qua esset infligenda, would be of less effect, but also the ordered speedy investigation could be rendered for the most part illusory. That besides these consequences, the commencing of proceedings before the Court of Justice, in casu subjecto, furthermore exposes the memorialist to being condemned in costs from his private purse, as having summoned Major de Sandol Roy before a notoriously incompetent judge; which condemnation would not only bring little credit to the memorialist, but would also suit him very ill in his modest circumstances. That therefore the memorialist has deemed it his duty to bring the aforesaid inconveniences, which he in his capacity is bound to foresee, to the knowledge of Your Right Honorable and Honorable; with the respectful request that Your Right Honorable and Honorable may be pleased to devise such measures in this matter as they shall judge capable of preventing the aforesaid difficulties, and enabling the memorialist to commence with effect the necessary proceedings against Major de Sandol Roy, for which he is otherwise in readiness. resolution of 15 November of this year expressly qualified to observe the office of Fiscal in this matter, declared it to be true: That the Appearer, having arrived here in the year 1790, stayed for some time in the Hospital due to illness, and subsequently came to the Corps Pepinieres under the command of Major Simon Chevalier de Sandol Roy, under whom he served for the period of four months; being immediately provided by the said Major with a bed, bolster, and blanket, as well as a uniform, which bed, as well as his uniform, the Appearer retained when he was mustered out onto the Honourable Company's ship de Geregtigheid; while he, the Appearer, during that service of four months received for service pay on one occasion 4 Rds and once again 2 Schellingen. Declaring nothing more, the Appearer gives as reasons for his knowledge as stated in the text, being prepared to confirm the above by oath if required. Appeared before the undersigned commissioned Members from the Honourable Council of Justice of this Government, the Cannonier Johannes Schraaf, of competent age, who, at the requisition of the Adjunct Fiscal Mr Johannes Andreas Truter, as by the Honourable Political Council by resolution of the 15 November of this year expressly qualified to observe the office of Fiscal in this matter, declared it to be true: That when the Appearer arrived here in the month of September 1789, he was placed under the Corps Pepinieres, and having performed 2 months of service with the same, obtained a work pass to labour as a blacksmith, while subsequently the Major of the same Corps Pepinieres, Simon Chevalier de Sandol Roy, having noticed that the Appearer was properly versed in his aforesaid trade, proposed to him to set up a blacksmith's shop for the Appearer, equipped with all the necessary tools, in which the Appearer would work with as many workmen as he required, and submit monthly to the said Major an account of earned wages, which would then be paid to him. That the Appearer having then also accepted that proposal, accordingly set to work, and after the expiration of the first month submitted his account amounting to 54 Rixdollars; with which the aforementioned Major not being content, paid only 18 Rds on that account, from which sum the Appearer, having had to pay 10 Rixdollars to his workmen and 6 Rds for the pass money, kept only 2 Rds for himself; wherefore the Appearer, being convinced that what he was left with was not sufficient to make a living, addressed himself in this regard to his frequently mentioned Chief, who thereupon made it known that the profits which the Appearer enjoyed were still too much, and he would therefore enter into another agreement with him, consisting of this: that he would give the Appearer one Rixdollar weekly, the Appearer moreover being exempt from pass money and receiving the necessary food free from the barracks, besides retaining his Company's salary, with the threat that if the Appearer was not satisfied with this arrangement, he would then have to remain in the barracks, whereby the Appearer out of necessity complied with that proposal; the Appearer meanwhile also having received a costly uniform for which he had had to pay 28 Rds. That furthermore, when the Appearer arrived here from the Fatherland, the uniform he brought with him was not taken from him, but he retained the same; just as he also, when he transferred from the abovementioned Corps to the Artillery, retained his straw mattress, which had been provided to him a few months after his arrival at this place by the repeatedly mentioned Major, and which, as he presumes, was charged to the account of the uniform. Colonel Gordon, having attentively read the representation submitted at the last meeting of the 17th of February by the Deputy Fiscal, Mr. J. A. Truter, with his official proceedings in the ordered investigation into the case of Captain Sandol regarding the pépinières, to which the Deputy Fiscal attached eight statements obtained by him from some of those pépinières, and which even alone most clearly demonstrate the highly punishable and scandalous conduct (now reinforced by three new statements) maintained by him, the Captain, toward those pépinières; so can he, the Colonel, not sufficiently express his surprise at that representation and the conduct maintained by the Deputy Fiscal in this so-called investigation; firstly, that Mr. Truter, as appears from his first two obtained statements (since the statements and other documents already submitted by him, the Colonel, were so clear and plain), obtained them only on the 12th of December 1791, thus about a month after the received order and documents, after which the third statement was obtained on the 13th of December, and the fourth, fifth, sixth, and seventh on the 15th of December, and finally the last statement on the 10th of January 1792, thus this one again about a month after the first ones. If one therefore only looks upon that unlawful handling of affairs, and that the representation of him, the Deputy, which he submitted on the 17th of February last, thus five weeks after the last obtained statements, a good three months after the investigation ordered to him, when read through, will make this conduct of his in this matter stand out most conspicuously. Also, all statements contain that the pépinières complain that they were underfed and mistreated; thus it could be clearly seen at once from the first statements of December, besides from the letter of complaint sent to this government by the High Government of India for a sharp investigation, together with the statements and other documents submitted by him, the Colonel, whether the case was military or not, and the Deputy Fiscal should not have delayed and acted in such an excessively conspicuous manner with such an important case and finally submitted such a representation, when the matter had already been commenced for more than two months. And that he, the Colonel, therefore follows this his note and remarks to his previous ones of the 3rd of February last, and can take no satisfaction at all in this: with the request that the same may be transmitted both to the High Indian Government and to the Lords Masters for his exoneration. And after Mr. Gordon had retired from the meeting, deliberations were held with all possible attention, both regarding the representation of the Deputy Fiscal and the statements attached thereto, and regarding the note submitted by the aforementioned Mr. Gordon, and regarding the representation itself it was taken into consideration that when the Council, by resolution of the 28th of October last, had entrusted the strict and thorough investigation of the complaints made in writing by some pépinières at Batavia regarding the ill-treatment maintained toward them here by Major de Sandol-Roy, and sent hither to that end by the High Indian Government, to the Ad Interim Fiscal, Mr. Jacob Pieter Deneys, and further, when he excused himself from it on account of his kinship with the said Sandol Roi, by resolution of the 15th of November last mandated it to the Deputy Fiscal Truter, the Council doubted whether the accusations against Major de Sandol Roy contained in the aforementioned complaint had to be considered as pure military offenses or not, and in that doubt deemed it should preferably entrust the investigation ordered by the High Indian Government to the Fiscal's Office, because the said Sandol Roy, as the accused in this, could and must safely presuppose in the same all the neutrality and impartiality required for such a delicate investigation. But since from the representation of the Deputy Fiscal Truter it is now fully established that the facts appearing in the complaint received from Batavia, by the obtained statements, have further been found to belong among pure military offenses, as having been committed by Major de Sandol Roy in his capacity as a military officer, and that cases of that nature ought also to be investigated by military officers, especially in places where a court-martial is granted to them. While regarding the demonstrated displeasure that the investigation of this matter was delayed for so long, not to be lacking, but on the contrary to make every effort that this government is able to satisfy it, it was resolved to place the aforesaid complaint, as well as the depositions gathered and submitted by the Adjunct Fiscal Truter, after authentic copies of these latter shall have been taken, into the hands of the military court martial, in order according to what appears therein to conduct the ordered investigation and at the same time to examine closely all the documents which have been submitted with respect to those complaints by Mr. Gordon, together with all the depositions attached by the Adjunct Fiscal to his representation, in order, if anything should yet be lacking in the latter, to provide the necessary amplification thereto, with the provision that in order to place the court martial properly in a position to conduct the required investigation, all the documents handed over to him, as well as the complaint itself signed at Batavia, must be delivered to them by the frequently mentioned Adjunct Fiscal against a proper receipt. Upon a written document submitted here by the Burgher Military Council regarding a petition presented by the signalmen of the Cape district, the following was resolved: Signalmen under this end shall devise and put into effect all such suitable means by which the required signal cannons can be transported from here to the Siqueniers Cloof, the place of Cathryn Coopman, the Witzenberg, and the Bokkekraal; as well as concerning the transport of the chambers which are presently at the Witzenberg and Bokkekraal to the places of the aforementioned Charles Marais and Widow Marais, in order to be provisionally installed there as signal cannons, in such manner as has been indicated by Captain Lieutenant Rutz. Likewise, the aforementioned Landdrost and Military Officers shall be authorized to attempt to transport one of the forthcoming signal cannons, of 6 to 8 lbs, from there to the Potteberg, for which, according to the information provided by Captain Lieutenant Rutz, there will be sufficient opportunity, the more so because several residents have shown themselves ready and willing to lend a helping hand thereto; whilst at the same time the necessary signalmen shall be appointed by them, and they shall order the officers who are sent annually to inspect the signal cannons to check whether the said cannons are properly tarred, in order to report thereon to their principals, and these in turn to this Council. 514, 515 and Honorable regarding the positions appearing therein to have to serve with a report and considerations, they now take the liberty to set down here in this regard. That the undersigned, being ignorant on what foundation the signatories of the aforementioned document, among whom are included those who are merely heirs, and others again who live in their parents' house and do not come to possess any land in ownership whatsoever, after having given an account of the damage and nuisance which they would continuously suffer from the cattle of their neighbors living on this side of the Berg River, have been able to insist on a request to be maintained in their old possession and right, and that the said Berg River may remain as before and again be established as a boundary, as it allegedly was according to old custom between them and their aforesaid neighbors; whereas nevertheless a portion of the residents of the places under the districts of Drakenstein and the Paarl, as well as situated on this side of the said river, according to the testimony of elderly and expert people, have driven their cattle through the said river to pasture since time immemorial; moreover, it would cause difficulty to consider the said Berg River as such a boundary in the future, given that the same river is divided into two, three, and more branches in different places, is also almost annually washed away by flooding, and changes its course; while some places situated on this side furthermore, as it appears superficially to the undersigned, are so situated that their owners, lacking pasture on the other side, will not be able to maintain a sufficient number of cattle in a proper condition to transport their annual harvest of products, both to the main settlement and elsewhere, so that such residents might easily be given reason and occasion 516 517 to bring in some grievances to Your Honorable Nobilities and Honorable, in the footsteps of the aforesaid signatories, and thereby interrupt and disturb Your Most Esteemed in Your manifold and more weighty occupations. The 520, 521 The undersigned Pay Bookkeeper, having been ordered by Your Worshipful Honors by resolution of the 29th of November 1791 to fulfill the desire of the High Commanding Lords Majors by transmitting the brief strength return of the Artillery and statement of the Seafarers and other servants at the Line, and also to state the reasons why at the time the express orders of their Honorable High Worships were only partially complied with, whereupon I have the honor to report with due respect that upon receipt of this most revered order from Your Worshipful Honors, I directly made all possible inquiry and search; having received the transmission of the brief strength return of the National Battalion by the High Commanding Lords and Masters according to an extract communicated to the undersigned from their dispatch of the 4th of January 1791, and finding no evidence of its dispatch at the pay office, I betook myself to the secretariat of Your Worshipful Honors and requested the Secretary to inquire and look up by whom the aforementioned brief strength return of the Battalion had been dispatched, and upon inquiry it appeared that the same had been drawn up and signed by the Commandant and Commander-in-Chief of the Company's troops here, the Honorable and Valiant Colonel Gordon; furthermore, that the transmission hereof originated from paragraph 535 of the dispatch of the High Honorable Lords Seventeen dated 2 January 1782, this in all respect annexed in copy, the form of which their Honorable High Worships made mention, not brought here with the same vessel, but with another ship, and having been shown to the humble subscriber; from which it was apparent that it was a copy of a general strength return of the garrison at India's capital drawn up as of the last of June 1786, showing not only the number of officers 522, and common soldiers, but even at which posts and watches they are distributed, and signed by the Noble Brigadier Colmont, that the number mentioned in the categories was capable of performing expeditions and watches; the undersigned, in his capacity as Pay Bookkeeper, possessing not the least knowledge as to which services the servants of the Honorable Company are employed by their commanders and whether they are capable thereof, takes the liberty to submit to Your Worshipful Honors with due respect, that while the transmitted form indicated where the military personnel were stationed and whether they were capable of the services of the Company, it is to be expected that the desire of their Honorable High Worships is also to have a similar statement of the Artillery, the seafaring personnel, and the Line, and the respectful subscriber, /:underneath stood:/ Doing which, etc. /:was signed:/ C. Likewise, upon the requests made for this by petition, granted to the burgher van Helsdingen the export of 1100 lb of flour and 2 muids of barley. As well as to Anthonij Watering permitted the export of 1200 lb of flour. Reading of a petition from the Captain-Lieutenant J. W. Lutgens submitted for the ownership of a small piece of land. Resolution to have the same examined by Commissioners from the Council of Justice. Thus it is resolved to have the provisions stated in the aforesaid lists which are in the Honourable Company's warehouses supplied to his Honour according to the orders, while his Honour may have purchased such as are not on hand, in order to receive the amounts thereof from the Company's treasury upon written warrant; but before supplying the requested equipment goods, the Master of Equipage will have to verify whether the same can be spared without fear of inconvenience to the Honourable Company's ships. The burgher Johannes Guillaume van Helsdingen having requested by petition to be allowed to ship on board the French private ship L'Ilustre Suffren 1100 lb of flour and two muids of barley as provisions for its crew, this has accordingly been granted to him; but in view of a similar request by Anthony Watering, managing owner of the present French ship Jean Bart, to be allowed to ship 10,000 lb of flour, it has been resolved to permit him only the export of 1200 lb of flour. With due respect shows the undersigned, Ryno Johannes van der Riet: That the petitioner, at public auction in the latter part of the past year, bid in a house and yard situated in this Table Valley on the Keizersgracht for the sum of ƒ77500 Indian valuation, having belonged to the now deceased former Burgher Councillor, Mr. Jan Myndert Cruywagen; That, whereas the public sale of the aforesaid house took place in three installments or terms, namely the first in cash to the sum of ƒ25834 and the two latter to the sum of ƒ51666, each one year after the other, or two years after the date of the sale, and the petitioner has made an arrangement with the gentlemen executors of that estate to pay the entire purchase price of ƒ77500 in bonds, with deduction of the customary 9 per cent, thus the real purchase price, as the deduction of the two latter installments amounts to ƒ4650, is instead of ƒ77500 only ƒ72850, and for which latter sum that house shall also be transferred to the petitioner; The petitioner therefore takes the liberty to turn to your Right Honourable and Honourable Sirs with the humble request whether your Right Honourable Sirs would be pleased to permit him, the petitioner, to pay the customary Lord's Right into the Company's treasury not upon ƒ77500, but upon ƒ72850. Likewise on his request made in this regard Honorable, Respectable and Esteemed Sirs: Your humble servant Johannes Fredrik Kirsten, titular merchant and member of the Honorable Council of Justice of this Government, Shows that the petitioner is married to the widow of the burgher Martinus Melk, to whom she was married in community of property, and thus through his death has come into possession, among other immovable properties, of the farms situated along the Berg River; That the petitioner's wife had begotten in marriage with the said Melk an only son, whereon shortly after his death a lawsuit was initiated here by the Orphan Chamber concerning a certain testamentary deed that was executed by the said Melk together with his wife shortly before his death, specifically with regard to her estate and the paternal inheritance of her said son; That as a consequence of this, and in order to determine the true inheritance of that child, they were obliged to sell the entire estate publicly, on which occasion the petitioner became the buyer of the above-mentioned farms situated along the Berg River for the sum of f 5500; That according to local custom no conveyance of these farms can take place before it is shown that the Lord's right on the purchase price has been paid to the Honorable Company; And since the petitioner in the strictest sense cannot be considered otherwise than to have been brought by an accidental circumstance into the necessity of having to buy in his own property, and thus to have fallen into the condition of those who, according to ancient custom, are placed under the direct obligation of having to pay the Lord's right due thereon for purchased immovable property; so he respectfully turns to Your Honorable, Respectable and Esteemed Sirs with a humble petition graciously to excuse him, for the reasons stated, from the payment of the 40th penny. After reading of which, in consideration that the petitioner has found himself, entirely without his own fault, in the necessity of buying in the property of his wife with whom he is married in community of property, and the same property cannot well be regarded as having changed masters, it was resolved to exempt him from the ordinary payment of the Lord's right on the farms purchased by him from the joint estate of his wife and her first husband, the burgher Martinus Melk.
