Whereas given the impossibility of presenting within the term determined by the government. 1 prolongation of time it has been thought proper to extend the said term by another month, and consequently to extend it until the ultimate of this month. Upon the request made by petition of Captain Droop, to be permitted to deposit a sum of 6000 ducatoons by preference into the Honorable Company's Treasury The College of Landdrost and Heemraden at Zwellendam shall be notified by missive and directed Onkruyt having made known by petition, former Landdrost of Zwellendam Constant van Nult Onkruyd, that his manifold domestic affairs place him in the absolute impossibility, without causing significant prejudice and disadvantage to his large family and personal interests, of proceeding in person from here thither to the aforesaid drostdy of Zwellendam, within the term of one month determined by resolution of 31 January last, calculated from the said date, in order to account for his administration of the Colony's Treasury held during the years 1786, 87, and 88, to the College of Landdrost and Heemraden, and in consideration of his urgent plea annexed thereto for a suitable prolongation of time, it has been thought proper to extend the said term, within which the accounting by him Onkruid ought to have taken place, now by another month and consequently to extend it until the ultimate of this month of March, in the firm assumption and certain confidence that the petitioner will at the latest by the expiration of it discharge his obligation in this matter in a satisfactory manner, and of this occurred change notice shall be given by missive to the above cited College, and the same shall at the same time be directed to concert with the often-mentioned Onkruid in good time when he might best present himself at the drostdy of Zwellendam, in order to find the respective members convoked there, for the speedy settlement of matters and to prevent him from being needlessly and for a long time drawn away from attending to his domestic affairs. Furthermore, on the petition below of Jan Jobst Droop, commanding the ship Castor lying in the roadstead, it was presented in the following words: 540. 541. Honorable Worshipful Lord! Shows with due respect your Honorable Worships' humble servant Jan Jobst Droop, Captain of the Company's ship Castor lying in the roadstead: That the petitioner, together with his Captain-Lieutenant, has had discharged on freight in the aforesaid ship Castor 11 chests and cases with European goods to the amount of 16000 guilders Holland currency, with the intention that, upon the same being disposed of here, to count the money resulting therefrom by preference into the treasury of the Honorable Company according to the terms of the Honorable Company, in order to be remitted to Europe. That the petitioner, therefore, in this supposition, together with his said Captain-Lieutenant, had recorded in the treasury of the Honorable Company a sum of 6000 ducatoons, in the firm assumption that that sum would be accepted by preference and remitted to Europe; but that the petitioner, to his deep regret, has had to find that of the aforesaid sum he, with his Captain-Lieutenant, has not been allowed to deposit more than an amount of 660 ducatoons. That the petitioner, through this slight deposit into the treasury, is rendered unable to satisfy his creditors, who will surely not fail, upon his return to Europe, to hold him to account for it, whereby the petitioner would undoubtedly find himself placed in an unpleasant predicament in case he could not satisfy them, and perhaps thereby have to sacrifice his entire fortune; for these will not let themselves be satisfied with words, but will hold that the petitioner, pursuant to the conditions of the Honorable Company, ought to have remitted that money by means of deposit into the treasury. And the consequences that the same have brought to the attention of the Government, as well as those of the other country churches; it has been further approved, with regard to the currently resumed accounts of the aforementioned Drakenstein church in particular; that the same accounts shall be returned to the church council there, with orders to rectify them and to arrange them in such a manner that one will be able to see at a glance the credit balance or the total debt of the poor fund. To which end a specially prepared model will be dispatched to the frequently cited church council, according to which they will have to regulate themselves both now and in the future. And whereas, upon the submission of the statement of accounts of the Orphan Chamber inserted herebefore, it was also made known to the Council by Mr. Le Sueur, as President of the Orphan Masters, that His Honour, having deemed it necessary to make a communication to the aforementioned Board on the occasion when the members collectively, both outgoing and newly incoming, were to examine the books in order to proceed with the transfer of the Chamber accordingly, concerning the Memorial presented at this table by the Governor, Mr. van de Graaff, on 24 June of last year, and according to which His Honour desired that a commission should be dispatched in order to execute the points contained therein; the said members, being extremely sensitive to the insinuations of misconduct and improper administration in the handling of the affairs of the orphans entrusted to their care, which they believed to reside so palpably therein, had unanimously requested and demanded of him, in his capacity as President of that Board, to declare to this Council that, however much they were convinced in their own minds that they had always, as far as was in their power, watched over the scrupulous promotion 570, 571, and to solicit that such a commission as aforementioned might be decreed by the Governor. Upon all of which it was resolved that, however much this Council is also convinced that the Orphan Masters have acquitted themselves of their oath and duty to the utmost of their ability, this commission by members from this Council shall take effect, and promotion of the interests of the orphans, of which the continuous credit and growth of the Chamber provided the most eloquent proof, they were nevertheless always ready to lay their actions open to everyone, and to that end to open their mouths, and most humbly solicited the Council that it might please them to decree a commission from the midst of this assembly, to which account and reckoning of the state of the Orphan Chamber and its dependencies may again be rendered by the Orphan Masters; so it is that, however much one is fully convinced that the Orphan Masters have always acquitted themselves in a conscientious manner to the utmost of their ability of their oath and duty, and that such a commission as the repatriated Governor, Mr. van de Graaff, has ordered, or as is now solicited by the Orphan Masters themselves, is consequently superfluous in itself; yet, considering the necessity that even the mere shadow of suspicion regarding the conduct of the Orphan Masters that might be elicited in the public mind from such an investigation as stated above to have been ordered by the Governor, Mr. van de Graaff, should be cleared away, so as to restore general confidence in the said Board, it was indeed resolved to give effect to such a commission of members from this Council for the revision and examination of the administration of the Orphan Chamber; but it was also approved, in consideration of the manifold occupations with which not only the Council in general, but also each member in particular is burdened, as well as on account of the present weakness of the Council, currently consisting of only four members, who, besides conducting the affairs and administration of the Chamber, if necessary, for [illegible] of the affairs of the Chamber which by the public [illegible] solicited their 16

572 573 The aforementioned Council for the present not permitting any members from their midst to serve on such a commission, it was at the same time resolved to suspend the matter until a better opportunity, the commissioners having urged that the publication of the placcaat concerning collateral successions be revoked again and that the copies thereof should not be posted. Touching their administrations and the daily occupations which by their nature must be demanded of members of the government, and also being hindered by having to distribute among one another the execution of most orders and commissions received in recent days both from the fatherland and from Batavia, whereby they are not yet in a position to serve on such a commission, which in itself is needless, it was resolved to leave the said commission postponed until the aforementioned stated occupations of both the Council and the individual members will conveniently permit them to attend to it. Meanwhile, it having been communicated by the well-reputed Lord Acting Governor to the other gentlemen members of the Council that, when on last Friday the placcaat for levying the tax on legacies and collateral successions was published, as the same had been decreed by this Council adapted to the local constitution of this country, the very next morning very early all the members of the Council of Justice who sit on the Board of Commissioners on behalf of the burghers had presented themselves before His Honour, and had insisted so emphatically and earnestly not only on not posting the prepared copies of the aforesaid placcaat, but also on the revoking of its publication, that His Honour, apprehending the consequences which the said burgher commissioners had caused His Honour to fear if their wish were not deferred to, and seeing all his efforts to disabuse the aforementioned commissioners, and with them also a multitude of other people ill-informed regarding the nature of the aforesaid tax, prove fruitless, had found himself compelled 574 575 And that His Honour, besides the aforementioned reasons, had found himself compelled to promise the commissioners to bring the matter to deliberation today, and had caused the posting of those placcaats to be suspended for so long. The undersigned had, some time ago, the honor to present to Your Honors a specific list of the grains which he received from the postholder in Saldanha Bay, Jacob Stofberg, who had been authorized to survey what each farmer would be willing to deliver to the Honorable Company in the said bay, both in wheat and in barley. The intention of this Council having been, to load into the said ship De Verwagting. On that occasion it having appeared most clearly that the statement amounted to 990 mudden of wheat and 150 mudden of barley, Your Honors thought it best thereupon, in consideration of the harvest, which in the year just past turned out to be none too abundant, and since by rejecting this offer one would certainly be less able to meet the Batavia requisition for the year 1792, to have both fetched from there, namely the wheat by the ship De Verwagting, to serve in anticipation of the expected Indies demand, and the barley by one of the country's boats, with the intention to have a portion of the required groats for the ships manufactured from it.

to leave open such space as would be sufficient to take in the stated quantity, yes, even somewhat more, this has consequently been the cause that merely One Thousand Muddens of Wheat were shipped in the same here, and for the rest that ship was ballasted to such an extent that it could undertake the voyage to the Saldanha Bay with peace of mind. It therefore caused no small wonder to the undersigned when he learned yesterday from the letter and further documents sent to him for perusal from the Assistant Horak, as commissioner for the receipt and shipping of the grains in the aforesaid Bay, that the laden quantity amounted to only 780 muddens of Wheat, and the received barley turned out to yield only half of what was stated in that regard. This has prompted the undersigned to investigate to what this deficit ought to be attributed, and it then appeared to him that, the first statement having been 990 muddens of Wheat and 150 muddens of barley, a further statement, as evidenced by the excess delivered by some and also by others who were not included in the first statement at all, must have been made to the aforementioned Horak, of Two Hundred and ten muddens of wheat, which, added together, amounts to Twelve Hundred muddens of Wheat net and 150 muddens of barley: that of that quantity only 710 muddens of Wheat and 80 muddens of barley having been delivered, the following thus remained in default of the entire statement, namely: Jacob Laubscher - - - - 200 muds Wheat, 50 muds barley, exactly the amount of the stated quantity. The aforesaid Persons, notwithstanding their statement made, surely on account of the high prices currently given here at the main settlement for the grain, having already had to be brought hither or still intending to do so, or to bring the same into this year's trade, the undersigned, whether this latter might still happen to exist, in the capacity of Dispencier would humbly request Your Right Honourable, that this lesser amount or that delivered not at all by them, brought towards the Cape for the fixed price of 22 2/3 Rixdollars the freight, may be seized at the patrol guard for the Honourable Company, or else, Right Honourable and Respected Sirs, that Your Right Honourable will please devise such other measures regarding this matter whereby one may be assured of not seeing oneself brought into the unpleasant necessity of having a ship, which had been dispatched expressly to the said Bay to collect Wheat, return from there empty-handed: While, upon the indication of the frequently mentioned Horak that, except for 100 muddens, the ship De Verwagting would have been fully laden, the undersigned also implores that the reason for this, as such was by no means the intention of the council, may be given by the Equipment Master. Thus, to provide herein, it was resolved to demand from the Equipagemeester the reasons why that ship could not have taken in more wheat, had the same been at hand; in order then, by virtue of the express prohibition issued, to be able to seize the same for the profit of the Honorable Company; and that the Gentlemen of the High Indian Government be informed thereof, in order to be able to have it investigated whether any wheat for private parties was indeed loaded into that hold; the same defaulting suppliers, enticed by the price of grain that has since risen so greatly, have broken their engagement with the Company with the aim of bringing the said grain to market and profiting from the high price, all to the considerable prejudice of the Company. To initiate a military court-martial at the Cape of Good Hope, submitted in all deference to the Honorable, Worshipful Acting Governor Iohannes Isaak Rhenius, together with the further Honorable, Worshipful Political Council of this Government. Honorable, Worshipful Sir, Honorable, Worshipful Gentlemen. The undersigned Major in the service of the Honorable Company, having learned that a resolution has been adopted by your Honorable Worships whereby certain vehement complaints and accusations of Colonel Gordon, Commander of the Militia here, combined with certain imputations of some soldiers among the Pepinieres, have been placed in the hands of the Military Auditor to initiate proceedings against the undersigned before the Military Court-Martial here; Far be it from the undersigned to bring forward provisionally anything whatsoever in his defense, and with this he will not trouble the precious attention of your Honorable Worships, seeing that the accusations laid to his charge are considered to be of such nature that they ought to be submitted to a judicial investigation, whereby the undersigned will thus be afforded the opportunity to defend himself, and thus to be able to justify his conduct before the entire public. He has therefore considered it necessary at present to bring his legitimate grievances on this matter under the perceptive eye of your Honorable Worships, so that his rightful case may only be seen placed in the hands of judges who are both competent and impartial enough to pass judgment upon it. Yet, Honorable, Worshipful Gentlemen, saving all respect and deference for the president and members who may be ordered here to hold a court-martial over the undersigned, the undersigned must declare that the same can neither be considered competent nor impartial enough to judge over the undersigned in the capacity of judges. Wherefore the undersigned, saving your reverence, hereby challenges them in that capacity in the most solemn manner. The reasons for this challenge lie in the following: First, regarding the incompetence: in this respect, even van Hasselt says in his instruction on the holding of a court-martial in the garrisons of the state of the United Netherlands, page 70: Here it should also be noted in a word that no members in which the Military Court-Martial here is situated to deliver a verdict on the undersigned, that the establishment of a court-martial here has not yet been properly approved or confirmed by the Lords Masters; and moreover, that the same cannot be composed otherwise than of one to 2 staff officers, and for the rest Captains and subaltern officers, whereas all military laws teach that a staff officer can be judged by none other than staff officers, ought to be ordered to a court-martial who are lower in rank than the one who is placed on trial; for the jurisdiction involves a power over the one who is put on trial; now it would indeed be contradictory to exercise power over someone who is higher in power; this would therefore not be reconcilable with the subordination that ought to be observed to the utmost among military men. Second, regarding the suspicion: it will suffice only to leave to the equitable judgment of your Honorable Worships whether the undersigned (this be said, however, always saving all respect) can place in the court-martial to be appointed that peace of mind which, in a civilized society, each individual must feel toward the one who shall judge over him as judge. Moreover, your Honorable Worships will still be very well informed that, at the incorporation of the undersigned as Captain in the Battalion here, the Gentlemen Officers of that time, considering themselves prejudiced thereby, appointed deputies from their society. Indeed, it is fully known to your Honorable Worships with what animosity Colonel Gordon has continually been prejudiced against the undersigned, and how much His Honor has for a long time on all occasions demonstrated his unyielding inclination to persecute the undersigned, and to show that the total ruin of the undersigned would provide His Honor with substantial satisfaction.

That I have a pending lawsuit with the judge, as with a private person. Section 12. That he is my mortal enemy, being severe toward me in everything. Some go further and maintain that the defendant may recuse the judge who formerly was his enemy, notwithstanding the reconciliation between both of them that followed thereupon; but with good reason the defendant may recuse the judge who has threatened to wish to harm him. Section 13. That the judge is overly familiar with my adverse party, and bears great favor toward him. And if he is a commensal, of the jurisdiction of my adverse party or of my enemy as being a vassal, or that my party is under his territory, force, and dominion. The aforementioned van Hasselt, in his instruction on holding a court-martial in our Republic, further says in Section 34: because according to law and sound reason it must be a settled matter that all partiality must be banished from all courts, and nothing harsher can be devised for a party than to have to litigate before a suspect judge and to let him judge and render a verdict, it must especially be noted that no officers are admitted 618, 619 as members in a court-martial to be held who for this or that valid reason are suspect, that is, behave as partial; in this matter, someone is considered biased and consequently suspect who favors, or seems to wish to favor, one more than the other. The undersigned by no means wishes to evade the judicial investigation of his case; on the contrary, he feels very well and is fully convinced that the same must serve to justify his conduct and bring his innocence to light. 620, 621 He has also never failed to answer properly the questions put to him by a commission expressly decreed to investigate his case; he only desires and expects, however, from your right honorable justice, that he may see himself judged by competent and neutral judges in this matter.
