896. 897. our office and duty command us to request of Your Right Honourable and Honourable Sirs Your powerful protection, with firm confidence that Your Right Honourable and Honourable Sirs, as always, will also now in this matter show yourselves not only to be fathers of the fatherland, but also foster-fathers of the church. Your Right Honourable and Honourable Sirs are aware how in all congregations church dues on account of a deceased person are contributed by the surviving relatives, namely 6 rixdollars when a body is buried in state in the churchyard, and 2 rixdollars and 2 schellings when a deceased person is buried at the place where he died, serving as a suitable small branch of existence for the maintenance of the church. Yet however reasonable such a fund, however small the contribution is, by far the majority of the subordinates in the Colony of Zwellendam and Graaf Reinet belonging under this congregation clash against this as always, notwithstanding that already in the year 1776 the overseers of this congregation requested and also obtained the same protection from the Right Honourable Government, in so far as and at that time by high authority notices were affixed by the then Landdrost J: F: Ments by renewal, in order to constrain the unwilling to pay, which then helped somewhat. Right Honourable Sirs: this is now 20 years ago. And as proof that our complaint in this matter is not unfounded, we take the liberty of presenting to Your Right Honourable Lord Commander and Honourable Sirs herewith a list of over 500 deceased persons by whom this church has remained deprived of those customary revenues, with all most humble request whether it might graciously please Your Right Honourable and Honourable Sirs to cause such measures to be put into effect whereby each and every person, whether residing here, whether under Zwellendam, or whether under Graaffe Rynet, may be obligated to make payment. And whereas it has graciously pleased Your Right Honourable and Honourable Sirs, by means of a public reading on the Lord's Day and stately divine service there in Graeffe Rynet, also to be conducive thereto, and at that time collections will likely also be taken there, just as in Zwellendam, which 898. 899. Which directives thereupon, both to the Landdrosts and Heemraden in the respective outer districts, and to the said Church Council itself, shall which collection monies have also been granted to our church as a small fund, we therefore simultaneously take the liberty with all due respect to inquire whether Your Right Honours have already made any disposition regarding that matter; if so, it goes without saying that we, even though it might have turned out less favourably for our church, shall obediently acquiesce therein. But if no arrangements should have been made regarding this yet, we take the liberty to solicit a favourable disposition for the church of Waveren, under which the respective Colony of Graafse Reinet hitherto remains subject just as that of Swellendam; it is true that people there live in the prospect of once being dispatched to form a separate congregation through obtaining a permanent minister etc., to which end also already laid [illegible] who have also already lived here for years in that same prospect, but of which collection monies we nevertheless through favourable provisions enjoy the benefit up to the present day. Thus it has been judged that no better means could be embraced for this than to write to and authorise the Landdrosts and Heemraden in the respective outer districts, by affixing notices, seriously to warn and exhort the inhabitants of the same districts, each in their own, to pay and satisfy the church dues of those for whom they, from whatever relation, owe the payment thereof, within a certain suitable time determined for that purpose, to the church of the aforementioned Land of Waveren. 900. 901. Right Honorable Sir, Honorable Sirs. Landdrost and Heemraden of Stellenbosch and Drakenstein, having submitted the following petition regarding the arrears of milling dues. To satisfy, or else to those who shall be qualified thereto by the said Church Council, on pain that after the expiration of the aforementioned appointed time, those who remain in default with the payment shall be compelled thereto by legal means and ways, in which case the said Church Council shall also be empowered to qualify someone in each District, in order to employ before the aforementioned respective Colleges of Landdrost and Heemraden the judicial means of constraint against such debtors who have remained negligent. Wherefore it has then also been resolved to send out the said notice at the earliest opportunity in the aforementioned manner. Against which, after reading the following petition submitted by Landdrost and Heemraden of Stellenbosch and Drakenstein: To the Right Honorable Sir, Johannes Isaac Rhenius, Governor of the Government of the Cape of Good Hope, with the jurisdiction thereof, etc., etc., etc., together with the Honorable Council of Policy there. Respectfully show the undersigned Landdrost and Heemraden of Stellenbosch and Drakenstein: How in the month of June of the past year 1786, at the request of the then Drakenstein miller Godfried Hesselaar, by the memorialists, among other things by affixing notices to all residents of this Colony who were indebted and in arrears to the said Hesselaar for milling or mill dues, warning had been given that they must satisfy and pay the said arrears before the end of the following month of December, without the said miller being obliged to take any further trouble to collect these monies, and in order that he would thus also be enabled to pay his agreed lease monies in due time and properly; on behalf of the owners and inhabitants of the places situated at the 24 Rivers, in the memorialists' meeting of the month of September thereafter, a certain petition was produced, wherein the petitioners, having set forth some reasons for which it would be impossible for them to make use of the aforementioned mill, further 902. 903. had requested to be released from the tax resting upon them to pay something annually to the miller there; the memorialists, considering that the petitioners, on account of the reasons alleged in the aforementioned petition, insofar as the same were found acceptable in comparison to other less wealthy residents living on this side of the 24 Rivers, who make use of their own mills and yet are obliged to pay sixteen and more rixdollars annually to the miller, are only bound to pay two rixdollars each for their household, however heavy it might be, have rejected their request by the marginal decree granted on the aforementioned petition. That the said inhabitants of the places situated at the 24 Rivers, twenty-four in number, through the citizen Frans Abraham Christiaansen as the attorney of the said Hesselaar, to satisfy their outstanding mill dues, each to the sum of six rixdollars, were summoned for April 5 of the past year 1790 before the memorialists' ordinary meeting, which due to the absence of the first undersigned Landdrost was then postponed for eight days, and not having appeared in the month of June thereafter, when they were cited once again to purge their default and to hear the demand and conclusion for the payment of their aforementioned arrears, they made known to the memorialists by a letter addressed to them that, on account of the plowing season which was the means of their livelihood, they found themselves unable to travel from home; furthermore, for their defense, they submitted that they could not appear on the first summons for the aforementioned April 5, since they had been informed that there would be no meeting on that date; that regarding the claim, they appeal to the aforementioned petition presented by them to the memorialists under date of September 9, 1786, to the contents of which they still refer, and that, since no action had been initiated against them since, they had to trust that it had been decided on that petition to deny the miller's unlawful money claim, further requesting that the plaintiff's claim, as being wrongly made, might be denied, and that he be interdicted from troubling them any further regarding this,

no longer to trouble them, and also condemned in all incurred costs, with the further addition that, in case the petitioners should not be inclined to this, they, just like the miller, might then be permitted to appear in the person of an authorized representative in order to attend to and execute this matter further here. To which aforesaid letter the petitioners briefly replied in answer that the reasons alleged by the defendants for their failure to appear upon the summonses issued on behalf of the miller Hesselaar did not merit any reflection, considering that their absence of two to three days would not have noticeably delayed agriculture, or specifically plowing, assuming that most of them could have left behind, if not a wife, at least another capable person to let that necessary work proceed; just as they, when informed that the meeting in the month of April was postponed and would not be held on the ordinary appointed day, ought also to have inquired, either from others or at such places where notices had usually and also in this regard been affixed in time, as to when this gathering had been set, in order then to have been able to defend themselves against the aforesaid claim, which they called unfounded; that furthermore, on the mentioned request dated 9 September 1786 presented by the defendants to the petitioners, an endorsement having been granted stating: Landdrost and Heemraden dismiss the request for reasons; if the defendants might have been ignorant of this decision, which is however difficult to suppose, they ought to have informed themselves in good time in this regard, and they then, although in the meantime no action had been initiated, would not have held such a favorable conviction regarding themselves, namely that the petitioners would have decided to deny the miller's unlawful money claim; and that finally, as of old, it was solely permitted to millers and ferrymen to appear in the person of an authorized representative, and the petitioners, consistently adhering to the aforesaid decision as well as the arrangement made and established with regard to the millers, granted to the repeatedly mentioned plaintiff in his capacity, upon his request, the second default and a third citation against the defendants for the 5th of the upcoming month of July, while in the event of non-appearance on such citation, proceedings would be taken against them according to the style customary here. That upon this third summons issued by the plaintiff in his capacity in the just-mentioned month of July, only one of all the aforesaid defendants appeared, and upon the fourth citation issued for greater caution in the meeting of the following month of August, two persons appeared; and since they were unable to present sufficient and satisfactory reasons of excuse, they, as well as all others who continued in absence, were condemned by the petitioners to the payment of the claimed sum of six rixdollars each, with costs; whereupon the defendants present having paid immediately, the petitioners subsequently also caused the others to obtain notice of this judgment. That the said Christiaansen, in his aforesaid capacity, having made known to the petitioners in their meeting of the month of February last that seventeen persons among the aforesaid defendants, of whom he simultaneously produced a list, had remained in default of complying with the aforementioned judgments rendered against them, with the request that execution of those judgments might be ordered against those who remained in default; the petitioners, before acceding to the petitioner's request, in order to spare costs and the defaulting parties, urged them once more in a friendly manner by a written notice of 7 February last to comply with the aforesaid judgments within the time of two months, calculated from the just-mentioned date; but far from this having achieved the intended effect, the defendants, not caring in the least about this, have on the contrary shown themselves still unwilling to comply with all the aforesaid; wherefore the petitioners, upon the further application made today by the said Christiaansen that the mentioned judgments might be brought to execution, on the one hand in consideration of the heavy costs that would be caused for the defaulting parties upon ordering a commission for the said purpose, and on the other hand in consideration of the necessity that the petitioner's request be fulfilled so that the judgments rendered here are not rendered completely illusory, have seen fit to turn in all respect to your Right Honorable and Honorable, as they are doing by these presents, with a very humble request that it may please your Right Honorable and Honorable

Right Honorable Sir The undersigned finds himself compelled, on account of the state of affairs with the Bushmen Hottentots, to report to Your Right Honor that the aforementioned nation is currently raging horribly and intruding everywhere in troops among the inhabitants; and notwithstanding the continual commandos, almost no district is free from them, where they do not steal, rob, and murder, as on the 27th of January of this year at the place of Casper Laboscagne behind the Bruintjes Hoogte along the Leeuwen River in broad daylight they attacked the place by storm: the burghers Casper Laboscagne and Pieter Van Wijk, together with a young son of the aforementioned Laboscagne and seven slaves were dreadfully murdered, the wife of the aforementioned Van Wyk was inflicted with many stabs from assagais and beaten with stones to such an extent that she is presently still without hope of recovery; they subsequently attacked several more places but were fortunately driven off, having robbed a herd of oxen from Willem Van der Vyver and sixty cattle of various kinds from Cornelis Bezuydenhout, retreating with them with the greatest haste back to their hiding places. The Lieutenant Carolus Johannes Tregard pursued them as quickly as possible with some men, yet could not overtake those robbers; he shall, however, if the horses remain able, pursue them into their caves and attack them there. The undersigned immediately, upon the received news, ordered three Field-Sergeants to search for those robbers with their men, but that such turned out poorly because of the prevailing horse mortality. The rapacious and murderous nation has also raged dreadfully on this side of the Bruintjes Hoogte along the Vogel River, having in the absence of Jan Michiel Combrink attacked his place, burned and completely ruined all buildings, deprived two slaves of their lives, and taken away a herd of livestock; from there, at the place of Daniel Erasmus, they murdered two slaves and stole cattle; at Christoffel Lotter's they stormed the place and the dwelling house, so that he and his people could barely retreat into the house, but having been repulsed they robbed 60 to 70 calves; and from all sides one receives bad news; behind the Sneeuwberg at the place of Rudolph Brits and Pieter Venter the Lieutenant they have 918. 919. they have also stormed the places, but having been beaten back, they stole horses, cattle, and sheep, and at the aforementioned Brits' stabbed the oxen to death before the plow and put him to flight because he had no firearm with him; and thus it goes in many places where the people are destitute of firearms, powder, and lead. The circumstances and tribulations are increased in proportion to the severe fever sickness raging among the Hottentots and the horse sickness; because of this, those robbers find no sufficient resistance, and thus their undertakings succeed, whereby their courage is all the more inflamed, which is further supported by the deserting Hottentots who point out the opportunities to them. Recently, about an hour from this Drostdy, the Bushmen Hottentots robbed sixteen hundred sheep belonging to Andries Adriaan Smit, who is present here, and murdered the herdsman, whereupon the undersigned in haste could detach no more than five men, who also recaptured that flock of sheep except for two hundred that the robbers had stabbed to death. And within a month as many as twenty herdsmen have been murdered; on the other hand, things are beginning to become somewhat quieter on the Sneeuwberg; some commandos, having engaged with the aforementioned Bushmen, have met with good success, so that in three attacks they killed as many as three hundred men and took one hundred captive; as soon as the horse sickness ceases, one shall take to the field with all possible force against those savages with large commandos; however, for these expeditions a good quantity of powder and lead must first be on hand, the undersigned requesting that Your Right Honor may be pleased to grant an order for two thousand lb of gunpowder, four thousand lb of lead, and one thousand flints, so that such can be received and brought hither when the inhabitants travel toward the Cape; the request to be made by the council of war will be presented further to Your Right Honor and the Council. Weapons in hand, they make violent demands for everything they want to have, which must also be given to them, usually taking whatever they please in places where the men are not at home, and making themselves masters of the farm, house, and goods. The war council has charged Cornet Huxter with the commission to see to it that the Caffres are made to depart amicably. They wander in troops all over this colony, causing the inhabitants to suffer much harassment, and although the undersigned ordered these wanderers to be driven away, pursuant to a request made to the undersigned in this regard by the Caffre Captain Sambe, there are always some people to be found who wish to show a mistaken mercy toward them and thereby only help increase the nuisance. Among these is included the secretary Maijer, who showed his whim against the orders of the undersigned, although this makes him accountable, it may well turn out badly for him before he expects it. As long as the inhabitants must be on their guard against the Caffres, one cannot use these men for the commandos against the Bushmen Hottentots, and for that reason one cannot curb them with sufficient force in their insolence. It indeed confirms the necessity that one must vigorously resist the daily increasing wantonness, robbery, and murderous lust of the marauding Bushmen Hottentots. Although not only official duties, but also private domestic matters urge him to come to the Cape, this cannot possibly take place at present because of the circumstances of the colony, the poor condition of the draft animals owing to severe drought, and the dying of the horses, to set out alone on an unsafe road. From which Your Honorable Worships will be able to see not only the pressing burdens that the inhabitants of this Colony have already borne for years up to the present, but also the impossibility of being able to pay the recognition fees for the loan places, or that most of them will be totally ruined; that notwithstanding the heavy pressing burdens, the inhabitants are still willing to bear them if they might be and remain exempted from the recognition fees, for as long as and until the time that peace, security, and the complete use of their places shall have been brought about, and that on the Honorable Company's part the necessary powder and lead for the commandos may be provided, this having to be regarded as the means whereby the Honorable Company would, in the subject case, be brought the least burden; that in case the inhabitants should remain under the obligation to have to pay the recognition, they being unable to bear the required costs for the commandos, then in such case those costs could be borne on the Honorable Company's part, and the inhabitants thereby be accommodated in the continuous daily damage to be suffered; that the undersigned indeed believe that through continuous commandos that predatory Nation could be weakened and their insolence curbed, but never, with whatever force resisted, could it be eradicated; in consideration of this point, the undersigned trust that Your Honorable Worships will not be pleased to fall into the notion as if the inhabitants had not properly observed their utmost duty to counter the insolence of the mentioned Bushmen Hottentots, nor wishing to observe further, such being to be discerned from the commandos and reports always carried out; And now, thus to better attain good success in weakening that predatory and murderous Nation, the undersigned very humbly request that it may favorably please Your Honorable Worships to order the Landdrosts and War Councils of the Colony of Stellenbosch and Swellendam that the same (as having, as well as these inhabitants, an interest in destroying the more-mentioned Bushmen) may also exert their best efforts to help subdue the more-mentioned Nation, and that the first-mentioned march their men behind the last-mentioned across the Swarteberg into the Coup fields and the Roggeveld, and that the same, at the request and written notice of the undersigned at the time then determined, do not withdraw from rendering all possible assistance; because otherwise the Bushmen Hottentots would be able to flee safely from one region to the other, and this Colony would always have to be the object of their robberies and tormenting circumstances, but being attacked continuously on all sides and regions at once, 926. 927. Remarks made upon this by the same. — And resolution to send the mentioned order to the respective Landdrosts and Heemraden in what was proposed. this would be a principal means to weaken those robbers in such a manner that they could cause little or no damage to the inhabitants, but rather that peace could be brought. — Lastly, the undersigned also believe they can propose as a means to destroy this often-mentioned Nation, if from the Honorable Company's side, for every captured Bushman Hottentot delivered towards the Cape, twenty and thirty rixdollars were paid as a bounty, and the same were subsequently sent from here abroad to other regions, many of the inhabitants in particular would be encouraged to apply all possible effort and diligence, in order thereby to see somewhat compensated the damage suffered at their places during the time of commando. 932. 933. is convinced that however much the petitioner has made every possible effort to counter the smuggling trade of the military and sailors, he has nevertheless discovered, to his heartfelt grief and enormous damage to himself and his family, that this smuggling trade, combined with the authority of the Fiscal Office, is unable to prevent this, however vigilant one may be, so it is and remains an undeniable truth that as long as the military and sailors retain that privilege, the general lease must necessarily suffer astonishing damage, since the petitioner could demonstrate and prove that a soldier or sailor purchases three, four, indeed five half Aams of wine in a month—a quantity that he does not need for his own use and also cannot pay for from his modest income, so that from this the natural conclusion must be drawn that it is being used for smuggling, and even if it happens that such a smuggler is once caught and taken in the act, then the petitioner finds nothing else as compensation for damages but that such a smuggler is corrected with a few blows of a cane. It is true, Right Honorable Gentlemen, that the petitioner was informed that the military and the sailors had the freedom to buy their needed wine from private wine merchants, but never could he have imagined that there would be such heavy smuggling with it, and indeed such that however active the officer may be, one cannot prevent this evil. No small contribution has also been made to the notable damage of the petitioner by the freedom granted to the brewer, instead of four beer houses that were formerly granted to him, to now have eight taphouses in operation, striving directly against the lease conditions of the brewer. After the reading of which and attentive deliberation upon the same, it was resolved to place the said writing in the hands of the Ad-interim Fiscal Mr. Jacob Pieter Deneys, in order to investigate the truth of what is brought forward therein, so that the Petitioner, as lessee, may be properly maintained in all respects in his acquired privileges according to the direction of the lease conditions; while the Council, out of consideration for the present scarcity of money, and especially by reason of the circumstances in which the Petitioner finds himself, accepts his offer to pay the half or first term of the leased lease monies, already fallen due on the ultimo of February last, on the ultimo of April next coming, provided that within the time of twice twenty-four hours he provide such sufficient surety for the fulfillment of this offer, to the satisfaction of this Council, whereby the same may hold itself assured that the petitioner or his sureties shall promptly perform the payment on the appointed day; of which the aforementioned ad-interim Fiscal shall be given the necessary notice to serve for his information. Information by the Master of Equipage Cornelisz, in compliance with the Council's resolution of the 13th of this month, whereby he was required to report whether the equipage goods requested by the former Heemraad Gerhardus Munnik—for the advancement of his projected undertaking to raise the sunken wreck of the ship Middelburgh in Saldanha Bay—happen to be at hand with the Honorable Company, and could be provided on loan to the said Munnik without noticeable objections, in the manner as follows, having served with a Report: To the Right Honorable Sir Johannes Isaac Rhenius, Senior Merchant and Commander of Cabo de Goede Hoop and the jurisdiction thereof, together with the Honorable Council of Policy. The undersigned Master of Equipage, having been ordered by a Political Council resolution of the 13th of this current month of March to serve the aforementioned Council with a Report whether the equipage goods requested on loan in a petition by the former Heemraad of Stellenbosch and Drakenstyn, Gerhardus Munnik, happen to be at hand with the Honorable Company, and whether one could yield the same on loan to the petitioner without notable objections; So the undersigned has the honor, in order to comply with the aforementioned orders, to inform Your Right Honorable and Most Honorable Sirs that spars or mast-timbers that can serve for a sheerleg are indeed at hand, if only the undersigned might know how long and thick they are required for the present. Four- and three-sheave large blocks or pulleys are not at hand, only blocks of 3 and 2 sheaves that are used for the careening of ships and mast-timbers. The ropes or cable ropes that belong to such kind of blocks are at hand. Grapnels of the kind that serve for the country's boats and pinnaces are also at hand, but the Company has only two flatboats, and the same are indispensable in Table Bay. As to what concerns the lending of such goods as these aforementioned, may it please Your Right Honorable and Most Honorable Sirs to keep in mind that this cannot happen without undergoing more or less deterioration, but ought, under favorable correction, to be provided upon warrant and accordingly to be written off in the books, since after use one can by no means take in the goods as new, and also cannot provide them again as such, but they would have to be sold by public auction to the notable disadvantage of the Company. The undersigned takes the liberty of bringing forward these remarks, because the aforementioned petitioner has obligated himself to restore the goods given to him on loan after having used the same. The undersigned believes to have complied with Your Right Honorable and Most Honorable Sirs' much respected intention, and lets this serve as a humble report. 940. 941. Nevertheless under certain conditions as are described hereafter. The Trade and Pay Books of the past year having been audited and found to be in order with the reports belonging thereto, the same equipage goods, after being appraised by the sea captains Van Veerden and Udemans, shall only be delivered under the express condition that, if the aforesaid equipage master should raise objections after their use to taking them back into his administration against a proper appraisal, he, Mannik, will then be obliged to retain them, or have them sold at public auction, in order to make up the deficit from his private purse for any lower yield than that for which the said items were appraised. That also not only one-third of all that shall come both out of and from the wreck shall, pursuant to the offer of the petitioner himself, be for the benefit of the Honorable Company (for which, on its part, besides the furnished equipage goods and permission to make use of the sloops and vessels lying in the said Saldanha Bay for the aforesaid operation, in the event of success, it will additionally bear the rightful one-third share of the expenses to be incurred in the same undertaking); but also that as soon as the same ship shall appear above water, immediate notice thereof must be given to this Government so that it might dispatch its express commissioners, who, armed with such orders as the Company's interest shall require, are to be given to him, to be present at the unloading of the goods still inside the same; and that finally, before the delivery of the aforesaid requisitioned equipage goods, sufficient security to the satisfaction of this Council shall be provided by the petitioner, both for their value and for any damages that might befall the cited vessels of the Honorable Company lying in Saldanha Bay and surrendered for use. After which, the Trade and Pay Books of this Government for the past financial year were audited with all attention, along with and in addition to the reports of the members of the Council appointed to examine the same, the Messrs. Mr. Jacobus Johannes Le Sueur and Willem Ferdinand van Reede van Oudtshoorn, from which it has become evident that in the said trade books not only do all items of expenditures and write-offs agree with the warrants issued on that account, but also that no write-offs were made apart from these; as well as that the pay books were kept in accordance with the order of the Honorable Company, the payment of the servants was properly distributed, and the deductions thereof were written off in the trade books in such manner as is specifically shown in the report thereof; and lastly that the estate accounts of the Honorable Company's deceased servants, whose inheritances were administered and sold by the Pay Bookkeeper as curator ad lites, having also been properly examined, it was found that the registration and calculation thereof was made according to the 942. 943. the same shall be supplied both to the Fatherland and to the Gentlemen of the High Indian Government. Whereupon the said person, not without showing a great deal of regret, declared that he could not comprehend to what that great difference was to be attributed, while he could solemnly assure that he had always taken the utmost care in the handling of his wines and had always been accustomed to deliver the best thereof to the Honourable Company; and that, in order to give some assurance thereof to this government, he requested the undersigned to be pleased to take charge of two samples of wine, both Red and White Constantia, of the same assortment as is now about to be sent to the Fatherland, and to offer the same to Your Honourable Worships on his behalf, in case it might please Your Honourable Worships to examine them to see to what extent he had complied with that duty. In order to dutifully fulfill this and to enable Your Honors to judge what those provisions have consisted of up to the present date, and how much the same, calculated separately for each servant, would yield monthly in money, they have therefore thought it best to form the specific statement accompanying this, with the addition of the calculation of those provisions and a summary of the amount that the same, calculated for the qualified servants currently serving in this Government and a few other persons, would amount to; to which the undersigned, in order to observe the utmost brevity herein, referring themselves, then only add here the market prices of the domestic products, which they have determined as follows, namely: the leaguer of wine at 40 rixdollars a muid of wheat at 3 rixdollars barley at 1 rixdollar 24 stuivers one hundred pounds of biscuit at 4 rixdollars one hundred pounds of kidney fat at 10 rixdollars a live sheep at 2 rixdollars prices which Your Honors, when one considers the turnover of those articles averaged over five years, will find are by no means taken too high. However, since some question might well arise among Your Honors as to why the undersigned have not considered the spices, as having to be imported from abroad, as such, but on the contrary have placed them in the aforementioned specific statement among the domestic products, they will have the honor to supply Your Honors with the following reasons in that regard: that if the spices were calculated at 25 percent above the net purchase price, this price would by far not be sufficient to provide oneself with that item; that the same being obtainable here nowhere else than solely in the magazines of the Honorable Company, the sale thereof there does not take place with a 25 percent advance, but with an increase of well over 2000 percent on average; and that therefore, there being an always fixed price, the undersigned also deemed it necessary to classify this article among those in respect of which the market price was required of them.
