J. V. Reede van Oudshoorn and C. van Eerten was undersigned: Thus it is now deemed best, in accordance with the orders of the High Governing Gentlemen Majors contained by way of their Despatch of the 31st of March of the past year, provisionally and subject to further approval from their Right Honorable Worships, to terminate with the end of April next all distributions both of local and of European and Indian articles, which until now have been granted both to the Honorable Company's qualified personnel and to a few lesser servants, in order to allow them to enjoy in lieu thereof monthly the monetary equivalent determined in the aforementioned lists, which will thus commence on the first of May next, to be continued therewith for as long until the intention of the High Governing Lords and Masters concerning this shall have been received; what regarding this further, by extract hereof, the Trade Transfer Officer shall be ordered to prepare the required warrants for the aforementioned payment, and there shall be delivered into his hands a copy of the said report and the lists designated therewith, in order to govern himself accordingly, both now and for the future to ensure that any emoluments specified in those lists, or the indemnifications which the Illustrious Assembly of Seventeen was pleased to grant solely to the members presently comprising this Assembly, shall in the future not be enjoyed by their successors —. 974. 975. Both from Regents of the Hospital and the Equipage Master, their considerations being requested whether the ordinary distributions of rations to common seafaring men could be replaced by monetary allowances. — Thereupon the following report was submitted by the Regents of the Hospital. — By the aforementioned resolution of this Table of the 20th of January last, there also having been requested from both the Regents of the Hospital and from the Equipage Master Cornelis Cornelisz. their considerations whether and to what extent the ordinary distributions of rations to common seafaring men could be replaced by certain allowances in money, the following report was submitted by the Regents of the Hospital in satisfaction of that resolution: To the Honorable Worshipful Johannes Isaac Rhenius, Governor of the Government of the Cape of Good Hope and the dependencies thereof, etc. etc. etc., together with the Honorable Worshipful Council of Policy. Honorable Worshipful Sirs: Your Honors having been pleased to demand of the undersigned Regents of the Hospital to examine and to submit to Your Honors to what extent the customary distributions of rations to disabled persons happening to be in that house from time to time, instead of distributing them in kind, could be replaced by a certain allowance in money: having maturely considered everything, the same have deemed it necessary to bring to Your Worships' attention that daily experience shows that most patients, as soon as they reach the slightest state of recovery, despite all appropriate precautions can hardly be kept from their customary debauchery and dissolute way of life; without doubt they would also make a very improper use of that allowance in money and, instead of providing themselves with such refreshments, would constantly indulge to excess in drink and other excesses, for which all too much opportunity presents itself in this country, whereby not only many misfortunes would be caused, but even the salutary purpose for which they are cared for in the Hospital would be noticeably frustrated; no less

976. 977. What from the same, as well as from the following report of the Equipagemeester, has appeared to the Council. Less difficulty would present itself if that change took place concerning the convalescents on the Line, when those people were provided, above their wages, with the customary rations in tela, since the motives used with regard to the hospital staff can also be made applicable to these. Regents would thus, subject to correction of judgment, be of the opinion that for the benefit of all these people and to prevent many misfortunes, which are otherwise to be foreseen, it would be more advisable to have the provisions of rations also made to them on the old footing. And from that, as well as the report submitted by the Equipagemeester inserted below, And thereby by some 978. 979. to continue provisionally with the provision of the customary rations. by some allowances in money, he has therefore the honor, in dutiful compliance therewith, to submit his sentiments in that regard to the favorable correction of Your Right Honorable and Honorable Sirs, being of report: That at a post such as the Equipage wharf where the personnel is permanently stationed, modest board money can be provided for the same, when the money is received by a trusted man, as there by the Boatswain, and board is provided to the personnel for it; but as with the country's boats which must continuously navigate, and with others who are occasionally commanded, whether at accidents such as shipwrecks or otherwise where they might be needed, and thus cannot be at a fixed place for board, but would have to provide for themselves from their received board money, it could in my opinion not be done with safety, while upon receiving good months, experience teaches that the sailors in general do not know how to make good use of money, and it is well to be expected that they would often remain without food because that board money would have been spent on drink, if the same were given to their own disposal, and one would be duped in the execution of the Honorable Company's service. The undersigned thinks hereby to have fulfilled Your Right Honorable Sirs' honored intention, and lets this serve for a humble report. /was below:/ Cape of Good Hope, the 7th of April 1792. /signed/ C: Cornelisz. It having appeared not only the impossibility to replace the rations being provided to most common seafarers with some allowances in money, but also the disadvantage which could result therefrom both for the service of the Honorable Company and for those seafarers themselves. 982. 983. the master of the shipwrights here, Meijndert van Eijk, in the presence of the Master of Naval Equipment of this Government, Cornelis Cornelisz, to examine accurately the defects that may be found on the main topmast of the Ceylon return ship Christophori Columbus: so have the undersigned, in pursuance of those orders, performed this, and in the presence of the Captain of the said vessel found the aforementioned main topmast to be broken straight off at the cap, wherefore the ship Christophorus Columbus will necessarily have to be provided with a new main topmast. Believing hereby to have complied with your Honourable Worships' highly honoured orders, the undersigned let this serve as a humble report. Cape of Good Hope, the first of April 1792. 988. 989. with the Commander thereof, the Right Honorable Severe Sir Staring, with the request that he would provisionally not accept the said Jacob Heijdler on board ship, since he, the ex officio exhibiter, was busy gathering some evidence against him to present the same to Your Right Honorable and Honorable Lordships, in order to dispose concerning this matter in such a manner as Your Right Honorable and Honorable Lordships might deem proper and necessary, which was also accepted by His Right Honorable, and whereof the ex officio exhibiter has also not failed to give the Right Honorable Master Commander due verbal notice and communication in due time. That the ex officio exhibiter, having very coincidentally learned that the said frigate of war Thetis is to undertake the voyage to Europe within a few days, therefore also takes the liberty to respectfully present to Your Right Honorable and Honorable Lordships, under littera A, B, C, & D, four pieces of obtained, though as yet unrecollected, declarations and evidence concerning the accusations appearing in the aforementioned representation of the Burgher Council of War, to the charge of the often named burgher Iacob Steijdler, so that Your Right Honorable and Honorable Lordships might thereby be able to judge what is of these accusations, and what must be effected and is required in this matter for the preservation of peace and good order in this Colony, as well as to give the ex officio exhibiter further such orders and commands as may please Your Right Honorable and Honorable Lordships, or otherwise to permit the Burgher Iacob Steydler to allow himself to be enlisted into the service of the Country and to embark as such; whereby the Colony, under respectful correction nevertheless, would be liberated in a very facile and imperceptible manner from a quarrelsome and restless subject. It was resolved, after reading thereof, as it has appeared from the also submitted declarations gathered by the aforementioned ad interim Fiscal, that the Burgher Iacob Steedler, about whose conduct the Burgher Council of War had so highly complained, actually is guilty of the excesses charged against him to such an extent that it would be of the greatest importance for the peace and tranquility of this Colony if a correction, in every way proportioned to the nature of the committed offense, were applied to him in order to curb other similar insolent and dangerous subjects, currently for the present not only to decline the proposal of the aforementioned ad interim Fiscal Deneijs to grant permission to the said Steedler to be allowed to enlist in the Country's service so that the Colony might in that way be liberated from him, but also immediately after the rising of the meeting to have the First Sworn Clerk Goetz enjoin him, the Fiscal, in the name of this Government, to watch carefully against the escape of the said Stijdler, whereby he might evade his well-deserved punishment, and at the same time to have the Secretary of this Council provide the Right Honorable Severe Sir Staring, Commander of the Country's vessels present, with the necessary information concerning the person of the just-cited Stijdler, accompanied by an urgent request not to accept him either with His Honor himself or on any of the other vessels under His Honor's command; while, in order to be able to dispose finally in this matter, the aforementioned representation shall be taken into circular reading by the respective Honorable Members for further consideration, and the aforementioned Fiscal shall meanwhile be ordered to [illegible] the aforementioned gathered declarations, which for that purpose must be returned to him, at the earliest opportunity.

Upon an incoming report from the Resident, Mr. Brand, concerning the painting of the Company's Buildings, and the required repairs to the Pier in False Bay. to have recollated and sworn in order to subsequently and immediately thereafter submit them again to this Council. Meanwhile having also been read the following Memorial presented by Mr. Brandt, Resident of False Bay, by way of a Report regarding the insufficiency of the oil supplied for the painting of the Company's buildings standing in the said Bay, and the necessary required repairs to the Pier there: To the Right Honourable Sir J: I: Rhenius, Senior Merchant and Acting Governor of the Government of the Cape of Good Hope and its dependencies, etc., etc., together with the Honourable Council Members there. Right Honourable Sir and Honourable Sirs. Whereas the undersigned Resident in Simons Bay, upon having the Honourable Company's buildings here painted, has found that with one half-aam of linseed oil and 200 lb. of coarse paint, which was supplied in the month of September last for that purpose as well as for the painting of the repaired doors and windows, the first-mentioned item is not sufficient, as well as that the three outermost or hook beams of the Pier have been entirely eaten through by the worm, for which reason the outermost or front part of the aforesaid Pier is in danger of unexpectedly collapsing and being completely washed away by heavy and high seas; so he takes the liberty of dutifully informing your Right Honourable Sir and Honours of all this, and at the same time that for its repair, etc., there will necessarily be required another half-aam of linseed oil, together with 3 pieces of teak beams of 12 to 14 inches thick, or else three pieces of pile-driving beams of the aforesaid thickness, as this may please to be ordered by your Right Honourable Sir and Honours in the least costly manner. For which one and other, as stated in the same Memorial, there was required another half-aam of linseed oil, together with three teak beams of 12 to 14 inches or else as many pile-driving posts, it has therefore, in view of the absolute necessity that both the painting of the buildings and the repairs to the Pier take place in time, had to be decided to have the aforesaid required items supplied for the said purpose; wherefore the respective administrators whom it concerns are then also hereby qualified and ordered to deliver the mentioned half-aam of linseed oil and the three teak beams of 12 to 14 inches or pile-driving posts. And since there was subsequently produced a Letter submitted by the Landdrost of Swellendam, Anthonij Alexander Faure, wherein an account is given in the following manner of the reasons why, when the former Landdrost of that Colony, Constant van Nult Onkruijt, according to the order of this Government on the 27th of the just departed month of March, presented himself at the drostdy there, no settlement could be reached in affairs concerning the accountability required from him, Onkruijt, regarding the administration of the Colony's Treasury held by him in the years 1786, 1787, and 1788. However, as I understood the impossibility of summoning here within the period of fourteen days the acting Heemraden who live far away, particularly Messrs. Cornelis Muller, Petrus and Salomon Ferreira (the latter two of whom Mr. Onkruid had specially requested to be present here, and of whom the last-mentioned resides on his farm, located three weeks from here): I immediately informed Mr. Onkruid the following day by missive of the impossibility thereof, with the report that if His Honor would be pleased to be present here by the 20th of June next (the ordinary monthly meeting), I would then arrange the combined meeting; which, however, had the unfortunate consequence that, said missive not having been received in time, His Honor arrived here yesterday in vain for the settlement of affairs. Mr. Onkruid having subsequently proposed to me to draft in the meantime, in the presence of the secretary, a provisional Cash Account, and then to produce the same at the next meeting to await the approval of the Heemraden (since, according to his statement, it was utterly impossible for His Honor to make another journey here for the settlement of affairs), I was nevertheless unable to enter into this in any way, in order not to be solely responsible in this regard. By the Lord of Reede of Oudtshoorn an account of postage fees received in the past month was submitted. By Commissioners from the Council of Justice, being a report on the establishment of a pound and the abolition of the rattle watches, and the appointment of another night watch. It was agreed to have its amount of 166 Rds 45 stivers received into the Company's small treasury by warrant. under the eyes of the Government work will have to be done on rectifying and settling the questionable account, for which the frequently mentioned Landdrost Faure, with the transmission of an extract of this, shall be ordered to bring along with him hither all accounts, receipts, and further papers that will be required in this matter, in order to come to a final settlement of affairs. Meanwhile, there being submitted by the Lord van Rheede van Oudtshoorn in His Honor's capacity as Commissioner over the Post Office a specific account of the postage monies received during the course of the recently passed month from the said office for the delivered letters, both for the Fatherland and the Indies, brought here by the successively arrived ships, totaling an amount of One hundred sixty-six Rixdollars and forty-five stivers: it was thus agreed to have the aforementioned sum of 166 Rixdollars 45 stivers received into the Company's small treasury by warrant. Further, there having been submitted by Commissioners from the Council of Justice the report demanded of them on 24 February last regarding the manner in which a pound and a dwelling for the overseer to be appointed over it could best be erected at the expense of the Colony's Treasury; which report, wherein at the same time a report was made by the said Commissioners with the submission of a draft instruction concerning the abolition of the present rattle watches and the appointment of other night watches in their place, was found upon reading to be of the following content: To the Right Honorable Johannes Isaac Rhenius, Governor of this Government, together with the Honorable Council of Policy: Right Honorable Lord and Honorable Lords. It pleased Your Right Honorable and Honorable Lords by honored resolution of 24 February of this year to direct Commissioners from the Council of Justice to form and propose to Your Right Honorable and Honorable Lords a plan according to which a pound with an associated dwelling for an overseer could be erected at the expense of the Colony's Treasury, and at the same time to specify what land would best be suited and situated for this purpose, and in what manner both the costs of that pound and the maintenance of the overseer could best be provided for by making a regulation of what should daily be paid by their owners for each horse or other animal, in order thereby to enable Your Right Honorable and Honorable Lords to decide finally upon this. Commissioners therefore have the honor to present to Your Right Honorable and Honorable Lords: That no better plan has occurred to Commissioners than to erect the aforesaid pound behind the little house where the bath attendant presently keeps his residence, so that, the said pound having been erected there, the said bath attendant may have supervision over it, for which he would receive 7½ stivers for each beast or horse that would be brought therein, being half of what the inhabitants are bound to pay for bringing their cattle or horses into and out of the said pound, in order thus to let the other half accrue to the benefit of the Burgher Treasury, so that in time the expenses as well as the maintenance of the aforesaid pound can be met from it. what means should be employed in order to succeed in this with hope of success, and it appeared to the Commissioners on that occasion that nothing better could be devised than to invite those people, under a pay of Ten Rixdollars per month, to be employed for that service under the name of Watchmen, in which the Commissioners, to their particular pleasure, have succeeded so fortunately that sixteen Persons from the burgher class, known to the Commissioners as sober and capable People, have offered themselves to perform the aforementioned service, for which persons the Commissioners have accordingly drafted a proper Instruction, which they take the liberty to present hereby to your Right Worships and Worships, and from which your Right Worships and Worships, if you please, will be able to perceive what their work actually ought to be, and in what aspect they will be regarded. Of the aforementioned watchmen, eight Persons shall keep watch in the early night or from 10 to 12 o'clock, and the remaining eight in the late night or from 12 o'clock until the beating of the drum in the morning. Article 3. Those of the watchmen who have had the watch one day in the early night shall the following day keep the watch in the late night, so as to continue this every night. Article 4. In consequence of the aforesaid, the aforementioned watchmen shall make the rounds at the customary hours and at every street corner call out the hour that has passed, likewise at the door of each Member of the Commissioners, so that they, the watchmen, can be heard and the Commissioners can be assured that they properly perform their duty, and that no neglect occurs in that regard. Article 5. To the repeatedly mentioned watchmen the freedom shall be granted to ask any Person, whoever he may be, whom they encounter on the street after 10 o'clock, who he is; and in case the aforementioned Watchmen might not recognize such Person or Persons as those whom they claim to be, the said watchmen shall likewise have the freedom to escort such persons home; in order, if it should be found that those persons did not belong there, to bring them to the Burgher Watch, to the end that they be kept there until the following day. Article 6. As often as the aforementioned watchmen might encounter any common People on the street after the aforementioned appointed time, they shall, after having noted down the names of those People, transport them to their designated place. Article 7. In case it might happen that danger is discovered in the streets or that the watchmen are attacked: then such Watchmen in whose district this shall happen to occur must give a shot signal to the other watchmen who then find themselves in the other districts, and those watchmen shall in that case be required immediately to proceed to that Place where the shot was fired, to the end of being able to assist their comrades. Upon the discovery of Fire, the repeatedly mentioned watchmen shall be required to proceed directly to the Burgher Watch to make it known there, under the continuous crying of Fire, Fire, as also knocking at every house that they shall pass, so that help may come quickly. A voluminous petition submitted by the ad interim Fiscal having been presented by the Commander. The aforementioned ship De Verwachting, having been dispatched thither solely upon their urging and calculations that, pursuant to their promise, it could be cleared with the projected quantity of wheat, it is understood that these same reports, in accordance with what was written to the Gentlemen of the High Indian Government, are now also to be transmitted in authenticated copy to Batavia, so that they may be of service there in investigating to what extent any private wheat might have been loaded to the prejudice of the Company's interest and of the often-mentioned vessel De Verwachting. Just as it has also been deemed proper to have the three-monthly daily register of the aforesaid Equipage Master, also submitted by him on this occasion, sent in the same manner to the recently mentioned headquarters. That the presenter, having received this reply, did not fail to give the necessary notice of his action to your Honors and Right Honorables by a written statement on 19 Iulij, with the addition of the aforementioned reply just as it had been handed over to the presenter by the court messenger, in order that your Honors and Right Honorables might perceive therefrom the offer made by the repeatedly mentioned attorneys to the presenter, namely of wishing to consign two aldermen’s recognizances to the amount of f 60,000:- under special mortgage on the house and grounds well and lawfully sold by the Heere van Lijnden; the presenter at that time having also inserted this offer literally into his aforementioned statement, with a very respectful request that your Honors and Right Honorables would be pleased to qualify him to accept the offer made, or otherwise to give such orders and make such provisions regarding this as they should deem appropriate. That this intention of your Honors and Right Honorables having come to the knowledge of the presenter, he first demanded anew the posting of unlimited surety from the attorneys by legal notification, and having received an unsatisfactory answer to this, according to the report annexed hereto under Letter D, he subsequently set to work the necessary investigations to ascertain whether all the goods, cash, etc. left behind by the Heere van Lijnden remained in the custody of his attorneys, or whether any of it was held by strangers; whereupon it became apparent to him that the Heer van Lynden, already before his departure from here, had sold his houses and some movable goods to the titular merchant Constant van Nult Onkruijt, and that the purchase price thereof, to the amount of f 80,000:-, had not yet been paid by the latter, while the attorneys were busy turning the remaining left-behind movable goods into money by public sale. That in the meantime, the wife of the aforementioned repatriated Lord Independent Fiscal, in her capacity as one of the general proxies of her husband, having first obtained leave to take legal action, presented to the roll a citation against the member of this Council, the Worshipful Lord William Ferdinand van Rheede van Oudtshoorn, in order to hear requested relief from the lapse of time and the undue interjection of appeal on account of a certain ruling of the well-mentioned Council of Justice, whereby the conveyance of the house and grounds sold by her husband to the above-mentioned titular Merchant Constant van Nult Onkruijt was declared null and void until such time as proper security should have been posted by the same. On the same day, or on the 4th of August last, after the decreeing of the aforementioned attachment in the Council of Justice, there was produced by the Right Worshipful President your Right Worships' and Worships' esteemed missive dated 3rd of August prior, whereby the Council of Justice, for the reasons recounted in the said missive, is ordered to cancel and erase the aforementioned citation presented to the roll by the wife of the Lord van Lijnden upon and against the Lord van Reede van Oudtshoorn. That the Council of Justice, having believed that it could not comply with the said order, at least not without having first submitted to your Right Worships and Worships the grounds of the members' conscientious scruples and having implored your further disposition thereon, addressed itself on that account to your Right Worships and Worships on the 19th of the said month of August for the aforementioned purpose, with the result that your Right Worships and Worships, on the 27th of the past month of September, replied that since all proceedings in the aforementioned matter were to cease, they consequently desired that the aforementioned presentation to the roll by the wife of the Lord van Lijnden against the well-mentioned Lord van Oudtshoorn should immediately be erased and cancelled. Consent obtained from the ad interim Fiscal Jacob Pieter Deheijs by the Honorable Administrator; to also be allowed to include, under the requested seizure of the estate of the Lord of Lynden, the purchase monies of the aforementioned houses and plots, with the further declaration that His Honor had never given any consent to the seizing of those purchase monies, but had understood that the seizure had only been requested on the monies arising from the movable goods turned into cash at public auction by the authorized representatives of the Lord of Lynden; and it having appeared to us at the same time from that extract that Your Honors, on the same day, against our so properly manifested intention, had decreed that the aforementioned seizure, said by the aforementioned ad interim Fiscal to be on the monies resulting from the confirmed sale of the aforesaid houses and plots, so we have not been able to wonder enough how Your Honors, on the following 19th of August, could have presented to us objections by which Your Honors said to be restrained from being able to proceed to the immediate expunging and cancelling of the summons issued against the Lord of Reede of Oudtshoorn, and which compelled Your Honors to have to request our further orders regarding this; whereas Your Honors, however, in the meantime, by the aforesaid decreeing of the seizure on the 4th of August, had already legalized the conveyance of the said houses more than 14 days earlier and, as a consequence thereof, had also confirmed the purchase thereof, and by doing so had annulled the resolution adopted by Your Honors, on account of which the authorized representatives of the Lord of Lynden had thought to be able to involve the Lord of Reede of Oudtshoorn in an appeal, whereby consequently by Your Honors in the matter in question a final ruling was made anew such that, 1040. 1046. whereby the causes for the appeal having been entirely removed, thus the aforementioned citation also lapsed of its own accord. 1044. 1045. traced from all sides where and under whom any property or money was held that belonged in ownership to the Lord of Lynden, or to which he had any other right. In vain would one wish to object against this that the purchase had to be considered null and void, and that therefore no purchase money under van Nult Onkruijt could be seized, because through the annulment of the conveyance the sale could also have no effect and thus suffered from nullity. For firstly, the wife of the Lord of Lynden had at the time of the attachment already obtained veniam agendi against the Lord of Reede of Oudtshoorn, and therefore already came at that time in opposition against the ruling whereby the effect of the aforesaid conveyance was suspended. From this opposition, if the opponent had triumphed in Batavia, the natural consequence would have been that the attachment, in case it had been placed on the houses as being placed wrongly on someone else's property, would collapse of itself, and thus the sale and the conveyance had to be considered valid ab initio, without the Memorialist meanwhile being able to prevent that acts were committed regarding the purchase price whereby the Company was entirely deprived thereof. But secondly, Right Honorable Sir and Honorable Sirs, circumstances appeared in the ruling itself which made the petitioner fear that the attorneys of the Independent Fiscal, even if they did not appeal, would take advantage of the exception of nullity, consequently receive the purchase money from the buyer of the house, and further remit these moneys to Europe as not being included under the attachment, whereby the entire security for the Honorable Company would have been fully three-fourths less than it currently is. The Petitioner is all the more pleased to have acted so prudently in this, 1046. 1047. since Your Right Honorable and Honorable Sirs yourselves, in your respected rescript of the 27th of September last, indicate not obscurely that the aforesaid ruling of the Court of Justice, whereby the questionable conveyance is declared null and void, suffers from nullity, being, as Your Right Honorable and Honorable Sirs say, passed without prior proceedings or summons, which latter alone makes a judgment so null and void that no appeal is necessary to render it without any force and effect. This is taught, besides all other legal scholars consulted by the petitioner on this: by Pieter Vromans, De Foro Competenti, Book 4, Chapter 8, paragraph 54 and Book 3, Chapter 1, paragraph 4. Added to all this was that, even if the ruling of the Honorable Court of Justice were everywhere declared legal, new disputes would again have been at hand, because the buyer could have maintained that, since at the time of the contract no impediments had taken place which either made the Lord of Lynden himself incompetent to contract, or could be said to affect the matter in such a way that the alienation thereof had to be considered forbidden, see Monsieur A. de Rochefort, Civil Laws, page mihi 127, Number 1; and also after entering into the purchase, nothing had happened between the contracting parties whereby the contract could be considered broken, the same Rochefort, pages 136-143; that, says the Memorialist, on that account the house had to be ceded by preference to the buyer, who, as soon as the consent regarding price and property was interposed, had obtained an actio venditi for delivery, and whose right had thus arisen earlier than that of the Honorable Company, in whose name the attachment—which moreover never gave preference—would only later have been placed. And this assertion, even if it were nowhere adopted, would meanwhile not have failed to call the security of the Company's interests into question and might perhaps even have been the cause that the Lords Masters, judging 1048. 1049. judging that the revenues were taken by the repatriated Lord Independent Fiscal contrary to their highest orders, and thus ought to be restituted, would have this restitution made by servants who never received anything of the revenues, perhaps also partly by the petitioner, in case he had exposed the precious interests of his High Commanding Lords and Masters to uncertainty. From what the Memorialist has taken the liberty to present up to this point, it is clearly evident that placing the attachment on the houses was subject to difficulty, the consequence of which could very easily have been extremely disadvantageous to the Honorable Company, without promising any advantage with good reason in any case, whereas on the contrary, attaching the purchase money, whereby the contract concluded between the Lord of Lynden and Constant van Nult Onkruijt remained unblemished, could be done entirely without dispute, but also provided a double security; as the house then ran for the account of the said Onkruijt, and the same remained meanwhile liable for the entire sum of ƒ 80,000, under special mortgage of the sold houses. The attachment on the purchase money could moreover very conveniently take place, because not only did the buyer hold the conveyance to be legal, but even the Honorable Court of Justice, by the condition added to the annulment of the conveyance, manifested most clearly that in case the value of the sold houses had, at the time of the annulment, been substituted in the place of the same houses, the conveyance would never have been annulled, which opinion of the aforementioned Court has been confirmed by the decreeing of the attachment on the purchase money. Let this be enough to demonstrate that the steps taken by the Memorialist were lawful and prudent.

1056. 1057. stopped the conveyance; it was the duty of the petitioner to examine where greater security lay, whether in attaching the purchase moneys or rather in seizing the sold houses, and finding, as has been shown before, that the greatest security lay in the former, it was notoriously the petitioner's duty not to attach the houses, but rather the purchase moneys, so that, even if one holds the decree of 20 June to be lawful, the petitioner can nevertheless never be accused of having acted against it, the less so as he has never been able to bring himself to suppose in the Council of Justice any other objective in the subject matter than the faithful preservation of the Company's interests. — From this and that it follows naturally at the same time that the petitioner could not have acted otherwise without neglecting the precious interests of his superiors, and that it is therefore not to be presumed that he requested the consent of the Honorable Ruler for anything other than attaching the purchase moneys, both of the sold houses and the other movable goods; especially since, if the attachment had only been requested on the moneys arising from the movable goods monetized at public auction by the proxies of the Lord of Lijnden, as the Honorable Ruler seems to have understood, the petitioner would have made himself utterly liable in the event that the decree of 20 July had been declared null and void, whether on appeal or by the pleading of the exception of nullity, for in such a case, as has already been shown above, the security for the Honorable Company could very easily have become three-quarters less than it is at present. — The petitioner, moreover, as he watched over the interests of his lords and masters in good faith to the best of his knowledge and understanding, had no need to pretend to a consent which could not well or properly have been refused to him in the subject matter, acting in the public interest, unless a better and more certain means could have been suggested to him to be utilized in the execution of the order given to the petitioner by Your Honors: Therefore, since the petitioner, besides the demonstrated necessity of his observed conduct, is also completely convinced that he requested and also obtained consent from the Honorable Ruler for the attachment of the purchase moneys without the least dissimulation, he cannot conclude anything else from the statement contained in Your Honors' esteemed rescript of 27 September last, that no consent was ever granted for it, other than that in granting consent to the attachment, which usually occurs without deep examination, that part of the petitioner's request which aimed at the purchase moneys of the sold houses escaped the attention of the Honorable Ruler: - However, much as the petitioner is not accustomed to view the actions of his fellow human beings, especially of his rulers, from an unfavorable perspective, and on that account very willingly trusts that the Honorable Ruler misunderstood the petitioner; nevertheless, this by no means removes the harmful impressions that must naturally arise in the minds of those who are not in a position or are unable to observe the petitioner's conduct from up close, by calling into doubt the obtained consent or making it appear as merely alleged; nor could late posterity, finding the petitioner depicted in such unfavorable colors in the retroacta of this Honorable Assembly, fail to regard him as an unfaithful servant, and perhaps even to mark him as the cause of unpleasantries, of which in the meantime only some effects have fallen to his share. The petitioner will not enter into an examination here as to whether, by the attachment of the purchase moneys, the proceedings against the Lord of Reede van Oudtshoorn must be deemed to cease; it is enough that the petitioner in his conduct has always pursued the true interest of his lords and masters; it being in any case, as he respectfully trusts, impossible to demand of him that, in order to keep lawsuits alive, he neglect the security of his rulers. Boijsen. - Answer to the notice served upon us ex officio by Court Messenger Carel Ewald Ziervogel in the name of Mr. Jacob Pieter Deneijs, Fiscal ad interim here, that we are prepared to consign a sum of eighty thousand guilders, Indian valuation, consisting of two mortgage bonds passed for the benefit of the principal party served, under special mortgage of the house and land duly and lawfully sold by him, until such time and while the Lords Masters shall have made the necessary determinations concerning the revenues enjoyed by our Lord Principal: - While we nevertheless consent to the consignment, insofar as it concerns the judgments of the Honorable Council of Justice both here and in Batavia, solely under this term and condition: that it shall be left to the judgment and decision of the Lords Masters whether and to what extent a Fiscal is bound to bear any costs in lawsuits conducted by him ex officio and thus to maintain the rights of the sovereign authority, to which ruling we hereby respectfully refer ourselves. We consider ourselves all the more obliged to this condition because our principal is of the opinion, under correction of judgment, that when an officer of justice is not condemned to pay the costs from his private purse as a penalty for recklessly conducted proceedings, but is only ordered to pay the costs generally in his official capacity, such costs ought then to be charged to the country on whose behalf the action was taken. Trusting that with this generous offer we have adequately responded to the amicable steps of the served party, and thus prevented those unpleasant prosecutions which the serving party declares he would otherwise have to undertake. Honorable Sirs! which was refused by the said Independent Governor, and to the representatives of the said Independent Fiscal, being his wife Johanna Elisabeth Helt, and the already cited van Rijneveld and Truter, not only for the still missing bail bond of 5000 Rds:, but also in the matter of customs and other revenues, as well as in the matter of judgments rendered both by the Council of Justice here and on appeal by the Honorable Council of Justice of the Castle Batavia. The Officer dares, with all due respect, to submit to Your Honorable and Right Worships whether it would not be sufficient enough to demand from the abovementioned attorneys of the repatriated Right Honorable Gentleman Governor, in order to prevent thereby all scandal and clamor as much as possible, an inventory of such goods as have been left behind by him here, and that they bind themselves upon their word of honor to keep in their possession and not to remit such monies as might proceed from the sale thereof, whether privately or at public auction, until such time as the Right Honorable and Most Respected Ruling Lords and Masters shall have decided upon this point in question, or else to furnish the humble subscriber with such further orders concerning this matter as Your Honorable and Right Worships shall deem necessary. And since the attorneys of the repatriated Independent Fiscal van Lijnden, upon the requisition of the undersigned Officer, have offered to deposit an amount of Eighty Thousand Guilders Indian currency, consisting of two mortgage deeds passed in favor of their principal under special mortgage of the house and lot legally and rightfully sold by him, likewise until such time as the Lords and Masters shall have decided upon these matters, he therefore beseeches to be authorized and supported by Your Honorable and Right Worships as to whether he should accept that offer and be content therewith, or else to give him such orders and make such provision regarding this as Your Honorable and Right Worships shall deem proper. The proposal made by the ad interim fiscal in that memorial regarding the property of the repatriated Lord Governor having been deliberated upon, it was decided etc. However, regarding the proposal to accept from the attorneys of Mr. van Lijnden, in place of the required bail bond, the two mortgage deeds amounting together to Eighty Thousand Guilders, it was resolved not to be able or permitted to accede to this, since it is impossible to determine how large the bail bond that Mr. van Lijnden ought to have provided should have been; and it was therefore decided to direct the ad interim fiscal by extract hereof to strictly comply with what was demanded of him concerning this by resolution of this table of 29 June last, as being based on the orders enacted by the High Government of the Indies, and so often amplified and repeated; all of which orders, if they cannot be found among the extracts belonging to the fiscal's office, copies in due form shall be handed to him to serve for his information, and to make such use thereof as the duties attached to the office of fiscal come to require. Honourable Respected Sir, petitioner, versus 1st Miss Johanna Elisabeth Helt, together with the secretary of the Honourable Respected Council of Justice of this Government, Willem Stephanus van Rijneveld, and the adjunct fiscal, Mr Johannes Andreas Truter, in their capacity as general attorneys of the said Mr van Lijnden. 2nd The vendue master of this Government, Mr Cornelis van Aerssen. 3rd The Titular Merchant and former Landdrost of the Swellendam Colony, Constant van Nult Onkruijd; defendants, the first-mentioned in their aforesaid capacity to hear requested the decreeing of, and the latter two to obey, such attachment as the petitioner, with the prior consent of the Honourable Respected Acting Governor Johannes Isaac Rhenius, has caused to be laid: I. Upon all the vendue moneys remaining in the hands of the vendue master and now also defendant, Mr Cornelis van Aerssen. II. Upon the moneys of the house and erf privately sold by the said Mr van Lijnden to the co-defendant Constant van Nult Onkruijd, and certain furniture remaining under the said Onkruijd, to the amount of 80,000 guilders. III. Upon all the further goods, effects, cash, credits, and whatever more belongs to the said Mr van Lijnden, and remaining under the first-mentioned three defendants in their aforesaid capacity. To the end that, if necessary, there may be recovered from this, not only, according to the contents of the resolutions mentioned beforehand, the missing security of 5,008 ducatoons, together with such sum of money as the Honourable Company shall be found to be entitled to regarding the customs and other revenues which Mr van Lijnden has claimed to be attached to the office of the fiscal, if restitution thereof ought to be made to the Honourable Company; but also to be able to find and recover from this, in any case according to the contents of the respective judgments, the costs of the lawsuits conducted by the said Mr van Lijnden both here in the first instance and on appeal in Batavia. Honourable Sirs, For the first three defendants in their capacity as attorneys of the repatriated independent fiscal, Mr Johan Nicolaas van Lijnden, answering, I declare that whereas Mr van Lijnden has always been inspired with those noble sentiments, properly and fully to secure all those who might sustain even the slightest appearance of a claim against him, his attorneys therefore, in accordance with the intention of their principal, in the presentation already made by them, namely to consign the sum of eighty thousand guilders in bottomry bonds, and if necessary to add all the moneys remaining with the vendue master, thus together amounting to upwards of one hundred thousand guilders Cape valuation, all this, however, under this proviso and condition, that it shall be left deferred to the judgment and decision of the Gentlemen Directors of the Honourable Company, whether and to what extent Mr van Lynden shall be obliged to pay the costs of the lawsuits in which his Honour was adjudged ex officio, and thus to observe the rights of the sovereign authority; shall be found proper and serviceable for the adequate indemnification of the Honourable Company and other interested parties. 1076. 1077. But in the unexpected event of a refusal of this generous offer, the same declare, under benefit thereof, that in case of condemnation they will obey the attachment, in so far as any goods, effects, or moneys are remaining under each of them respectively; under respectful protest, however, against all costs, damages, and interests already had and suffered or yet to be had and suffered by this attachment, with reservation for their principal to make use of his good right regarding this, as and where it belongs.
