Upon consideration of the matters, it was thought best, before ruling thereon, first to place the same in the hands of the Church Council of the Reformed congregation for the purpose of Consideration and a report. Also, upon another petition submitted by the General leaseholder of the Cape cool wines, Sebastiaan Rothman, in the following words: To the Honorable, the Respected Johannes Isaac Rhenus, Administrator of the Cape of Good Hope and its dependencies, etc. etc., together with the Honorable Council of Policy. Honorable, Respected Sir, Honorable, Respected Sirs, It is with all most submissive respect and proper deference that the undersigned, general leaseholder of the Cape cool wines, Sebastiaan Rothman, most reverently makes known to Your Honors How he, the Suppliant, during his aforementioned Wine Lease, to his heartfelt grief, has had to content himself with the very lowest sales, as a result of which the suppliant was not only left with a considerable quantity of wines, but furthermore had to suffer enormous damage, whereby he, the suppliant, became unable to satisfy his lease payments to the Honorable Company at the proper times, as became apparent in the month of February last, and which then also resulted in notable prejudice to the suppliant who at that time was a man who, according to a modest valuation, possessed well over f 150000. in consequence of which, in execution of the judgment of the Honorable Council of Justice, a portion of the suppliant's effects and movable property The 2090 2091. It was resolved, before taking any final decision thereon, to demand of him a specific list of the effects which can be pledged by him for the Company's security. was sold publicly, in which the suppliant, due to the currently prevailing lack of money etc., lost well over a sum of f 24000. That now, the time having approached at which the suppliant must pay the second or last installment of his aforementioned lease money, the suppliant finds himself, for the aforementioned alleged reasons, once again unable properly to pay the Honorable Company in full at this time. Wherefore the suppliant in order to prevent having to suffer once again a loss of about f 24 to 30000, to the ruin of his household takes the liberty to turn to Your Honors with all submissiveness, humbly requesting that it may be Your Honors' most favorable pleasure graciously to grant the suppliant the amount of the last installment of his aforementioned lease money, not only under Sufficient Suretyship Likewise understood, before proceeding to any final decision concerning the same, first to have the suppliant state specifically which goods, and principally how much wine according to his drawn-up Inventory he still has left on hand, to serve as security for the Capital, but under a special mortgage of all the suppliant's goods, Actions, and Credits, which, according to the average Valuation made by the Citizens Jan Jacob Schreuder and Joseph Pero, amount to well over a sum of f 75000 and of which the suppliant, if required, could furnish Your Honors with a specific List, to be held at half a percent per month and to be paid off in installments of f 5 to 6000 with Interest, or otherwise as Your Honors shall deem proper. Then, since the Lords Commissioners General have seen fit to refer the disposition on a written petition of the Lieutenant at Sea, Bernardus Zibee, to this Council, his request made therein to be written off the payroll and to remain here has been rejected. As in the same manner the applications made by the former Cornet of the Swellendam Burgher Militia, C: M: Sederblad, for the ownership of the Company's post the Vischhoek. The Chief Surgeon Mader certifies that upon examination of the said Zibee, nothing could be discovered of the illness pretended by him. which he owes to the Honourable Company for the last term of his promised lease money, and wishes to retain at interest. to be able to bind, as well as who shall moreover intervene for him as sureties. But, whereas regarding a certain petition presented to the Lords Commissioners General by the Lieutenant at Sea, Bernardus Libel, who remained behind here on account of indisposition from the ship Buiten Verwagting, but handed over by Their High Honours to this Council to dispose thereof, and wherein, pretending to be subject to attacks of convulsions which would render him incapable of properly performing his service, he requests to be written off the payroll, in order to be allowed to remain in this Colony on that footing until his recovery; a written declaration, granted by the Chief Surgeon Johan Gottlieb Mader, who had examined and inspected the petitioner by order of the aforesaid Lord Officer Commanding, was produced by the Lord Officer Commanding, from which it appears from the said declaration that he bears all the outward appearance of a healthy person, without showing the least sign of that ailment mentioned above, so that there is every reason to doubt the truth of his allegation; it has therefore been resolved not only to decline the request of the aforesaid petitioner to be allowed to remain here off the payroll, but also to instruct the Master of the Equippage, as he is instructed hereby, to assign him on the first presenting opportunity to an outgoing ship, in order to proceed with the same on his voyage to Batavia. And whereas the former Cornet of the Swellendam Burgher Militia, Christiaan Martin Sederblad, has also submitted a written petition, tending to have the Company's post the Vischhoek, situated between Muysenburg and the Baayfals, together with Kalkbaay situated in its proximity, on loan against payment of recognition, or else by valuation for a round sum in ownership, or also to obtain permission to stay there occasionally for the period of 10 to 12 days, in order to fish for entertainment and domestic use, all under such conditions as are more fully described in the aforesaid petition; but regarding the loan or sale of that place the difficulty arises that, because of the abovementioned militating objections against it, the High Governing Lords Majors have not yet disposed on the representations made by this Council regarding the same and other places, and one thus dares not in any way anticipate their supreme decisions in that regard; whilst also against the latter part of the petitioner's request several inconveniences and objections militate, which ought to restrain the Council from consenting thereto; it is therefore also resolved on this petition to reject the same, as is done hereby. Yet Isaac Visagie Isaacsz was granted permission, when leave is granted thereto by the Lord Officer Commanding, to have a place bequeathed to him by his grandmother transferred into his name, on which, however, the Lord's right of the 40th penny must then be paid. Some other submitted petitions having further been disposed of, whereas on the other hand diverse other petitioners, against whose requests no objections arose, were granted the requests more fully described in their petitions; then, with regard to the request of the Burgher Isaac Visagie Isaacsz, to be allowed to have a certain loan place named the Lange Rivier, situated across the Oliphants Rivier, transferred into his name, on condition of paying to the joint estate of his late grandmother-by-marriage the Widow Hendrik Krugel a sum of fifteen hundred Guilders, for which the homestead was allotted to him by inheritance by the aforesaid Widow Krugel, and at the same time to be excused from the payment of the Lord's Right of the 40th penny; no objections regarding the first point having occurred to the Council, but the same having likewise been unable to agree to the latter; it is therefore resolved, concerning the transfer of the aforesaid place, to leave the disposition thereof, according to custom, deferred to the Lord Officer Commanding, but likewise to decline the remission of the 40th penny of the Lord's right.

2096 2097. First, to the Captain of the third Company of Burgher Infantry here, Johannes Gie, his discharge was granted. Likewise, to the former Burgher Councillor H: O: Eksteen, permission was granted for the emancipation of a female slave. And to the widow Jurgen Wolfgang Spengler, the consent of this Government was also granted for the manumission of two slaves. It was deemed fit to authorize the church council here to nominate and propose, together with the minister Manger, another deacon for Graaff-Reinet, in place of the person of And: Pretorius, who was found not to possess the necessary requirements for it. Furthermore, upon an incoming letter from the Landdrost Woeke, wherein he makes the aforementioned request. for the reasons mentioned, the following was permitted; namely: To the Captain of the third Company of Burgher Infantry here, Johannes Gie, on account of his continuous indisposition, his discharge with retention of rank from the aforementioned service; To the former Burgher Councillor Hendrik Oostwald Eksteen, to be permitted to release from slave servitude a certain slave belonging to him named Louisa of the Cape, provided he pays the 50 Rds fixed thereon to the Poor Box of the Reformed Church, and provides security that the aforementioned person to be freed shall not become a charge upon the Diaconate within the period of twenty years; and To Johanna Mosterd, widow of the late Burgher Fire Master Jurgen Wolfgang Spengler, to likewise be permitted on the same conditions to emancipate two female slaves named Steintje of the Cape and her child named Sara Johanna Cornelia of the Cape. After these matters, there was read a letter written to this Government by the Landdrost of the Colony of Graaff-Reinet, Maurits Herman Otto Woeke. And since he therein also requests, among other things, that whereas the person of Andries Pretorius, who was recently elected from the presented nomination of the aforementioned Cape church council as deacon for the congregation at Graaff-Reinet, can neither read nor write, and also to this day has made no public confession of faith, someone else may therefore be appointed in his place; it was, having considered how very easily the church council, in spite of all possible inquiries and investigations into the qualities of the people who are reputed to be the most suitable among the inhabitants in the remote districts, could have erred in this matter, because many of these rural inhabitants of the best name and reputation come up to this Capital very seldom, and some even no more than once in their life, so that one is thereby not well in a position to judge their persons otherwise than by reports, resolved without entering into any reflections regarding what happened for this time, simply to instruct the aforementioned church council at this Capital, as it is instructed hereby, to immediately rectify the matter together with and alongside the minister Manger stationed at Graaff-Reinet, whom they shall expressly co-opt for that purpose, by nominating a double list of other persons possessing the necessary requirements, and proposing them to this Council, in order that therefrom, to fill the place of the above-mentioned Pretorius, whose appointment shall be considered not to have occurred, a second deacon for Graaff-Reinet may be chosen. Kirsten, and the former Bookkeeper of the Orphan Chamber, Petrus Johannes de Wit, show how there was handed to them by the Secretary of Your Honorable Assembly a certain Extract concerning the matters of the Company's small vessel the Helena Louisa, which they the undersigned careened and brought into open water in the year 1790; for which Extract they hereby express their obliged thanks to Your Honors. However, since the Extract begins with paragraph 49 and after 2 and 3 lines ends with an etcetera, and subsequently continues with 155, from which it is clearly to be supposed that in such an interval something must or can be found which has relation to them or to the affairs of the brig. They therefore most respectfully take the liberty to turn to Your Honors with the most humble request that the said Secretary be authorized also to deliver to the undersigned the contents of those paragraphs, for which reason they trust that this request will be favorably granted by Your Honors. The undersigned find themselves all the more compelled to this, as they believe, reasonable request, considering that during the time that the disputes regarding the payment of the agreed moneys were sent to Europe, the Independent Fiscal Van Lynden van Blitterwyk, who has departed from here, was pleased to involve the first-signed in a lawsuit that is in all respects disgraceful for him as well as his family. That the undersigned, being associated in one and the same matter, regard this lawsuit as brought against both of them together, and since this lawsuit, after the said Fiscal had succumbed before the Council of Justice here, has been sent on appeal to Batavia, they therefore judge a full Extract to be indispensably necessary in order to transmit it to the Honorable Council of Justice of Batavia Castle. A request having been made by petition by the attorneys of the Governor Van de Graaff that His Honor might enjoy the effect of the favorable decision taken by the Lords Masters regarding the income of him, the Governor, Thus it is considered, on the one hand, that the motives upon which the aforesaid petitioners base their request have appeared to the Council to be of such a nature that they in every way deserve reflection, while on the other hand the contents of the broken-off passages may actually serve to be of such use to the first petitioner in the further prosecution of his lawsuit; so that the Judge may be informed how the High Authorities themselves have wished to view and assess the conduct maintained by the Equipment Master on the occasion of the examination of the defects found on the keel of the aforesaid vessel, from which properly arose the case that gave occasion to the repatriated Fiscal Van Lynden to involve the first petitioner in legal proceedings ex officio, and this could serve for information in the further and final judgment of that case. For all of this, it was therefore decided to defer to the petitioners' request, and consequently to have a full Extract delivered to them from the repeatedly mentioned letter of Their Right Excellencies of 22 December of last year, as the Secretary of this Council is hereby authorized and ordered to do, so that they may thus enjoy all the effect of the decision taken concerning them by the highest-mentioned Authorities. 2106 2107: And the Lords Commissioners General, not being pleased to make any alteration in that disposition, the aforesaid revenues shall therefore be handed over to the said attorneys, retaining nevertheless half of the subsistence allowance arising from the proceeds of the wines. Thus it has been resolved that, since the Lords Commissioners General—to whom communication of the said petition had been made, with an added request to know how far the petitioners' prayer could be deferred to, given that the Council had already, shortly after the departure of the Lord Governor Van de Graaff, assigned to the Lord Commander certain articles belonging to the said revenues (as being employed more in the service of the Company's own establishment than for the household of the Chief Commanders themselves)—have been pleased to declare hereupon that, as the disposition concerning the disbursement of the Governor's wages and revenues had emanated from the Assembly of the Seventeen themselves, Their High Honours therefore did not wish to make any alteration or change herein, but would nonetheless take into consideration at a more convenient time the equity that the Lord Commander be properly enabled to make good the expenses, which were found to be of the utmost necessity for upholding the prestige of the post of Chief Commander, the exercise of the functions of which had been entrusted to him; therefore, the said wage and further revenues due to the aforesaid Governor Van de Graaff shall be handed over to his attorneys, it being well understood, after there shall have been deducted from it, to remain in the Company's treasury, half of the subsistence allowance arising from the proceeds of the wines; while, in addition, the articles supplied from the Company's warehouses shall only be calculated and delivered in kind until the ultimate of April last, from which date payment for them shall have to be made in money, according to the emolument list determined at that time; it being understood in the meantime that until it shall have been otherwise ordered by the Lords Commissioners General, 2108 2109 upon the special order of the well-mentioned Lords, to cause him to enjoy what has been assigned to His Honour from those revenues. Yesterday evening the Honorable Acting Governor having received a letter addressed to this Council by the High Honorable Gentlemen Commissioners General under date of the day before yesterday to accompany an Extract from their High Honors' resolutions taken on that same date with regard to the direction and housekeeping in the Hospital here, reading that Extract as follows. Thursday 30 August 1792 upon inquiry all present Thursday the ƒ 8 2114 2115 being the finding of the housekeeping in the Hospital during the inspection made yesterday in person by the Commissioners General, as well as noting that not only is it very far from being observed in the sick wards and other rooms that cleanliness which ought to have a place therein and could at least rightfully be expected on account of the excessive number of servants attached to the Hospital and assigned to the service thereof, but also that in particular those provision rooms and other rooms which are under the more immediate management of the Chief Sick Father or Caterer Johan Daniel Disandt, through the extreme filthiness and confusion which reigns therein, abundantly prove the incapacity of the aforementioned Johan Daniel Disandt for this office. And considered being the necessity that these disorders, which even the presence of the Commissioners General has not been able to cause to cease, be checked and redressed by prompt corrections. Thus, after deliberation, it was approved and agreed to condemn the first Chief Surgeon Johannes Leuwer, who by general supervision over all the servants without distinction ought to care for the preservation of good order and the maintenance of purity and cleanliness in all parts of the household, on account of his negligence in the observation of his Post, hereby to a fine of Six months' wages for the benefit of the Company, with a serious recommendation to see to it that as soon as possible, and at the latest within fourteen days, the housekeeping in the Hospital in general, and primarily also what concerns purity and cleanliness, be brought to a proper footing to the satisfaction of the Commissioners General, on pain of, in default thereof or whenever in future in the maintenance of good order among all the Servants of the Hospital do P

Hospital, and concerning everything regarding purity and cleanliness, should anything be found to have been neglected, he as first Chief Surgeon shall be held accountable for it, and as incompetent, be dismissed from his said post and sent up to the Netherlands. That furthermore the Chief Sick-Father or provender master Johan Daniel Desandt, on account of his aforesaid shameful neglect of duty, shall be demoted to Junior Sick-Father, as he is demoted thereto by this document, with a stern warning that if he does not acquit himself properly in that office, he will without the least connivance, as a useless and harmful subject, be sent up to the Netherlands; and that the regents of the Hospital shall be ordered to nominate a capable person to the Commissioners-General at the very earliest opportunity for the fulfillment of the office of Chief Sick-Father or provender master. That lastly, to the aforesaid Regents shall be made known the displeasure of the Commissioners-General on account of the aforesaid disorders in the housekeeping of the Hospital, and it be recommended to them henceforth to pay more careful attention thereto, with further orders to have all the servants of the Hospital appear before them in a meeting convened expressly for that purpose, and to recommend to them in the most earnest manner and with the most efficacious urging reasons that each in his capacity discharge his post with all faithfulness, zeal, and accuracy. Thus the undersigned, in the absence of Captain Voltelen, proceeded directly on board the aforementioned vessel, and its rigging, according to the statement of the skipper, was good and in proper order, the ship only needing to be caulked, since, also according to the statement of the same skipper, it pumps 16 inches in the watch in stormy weather, but is pumped dry to 9 inches in 30 strokes, the reason for pumping dry so quickly being that the ship is sharp aft and sits by the stern, having never had so much water in it that water reached the forward pump, and the ship makes 16 to 17 inches in 24 hours in fair weather. The defect on that ship is that the cargo of Pepper gets to the pumps in such a manner that they have been forced to lift the pumps and, according to the skipper's statement, bail out the water, because at times it was impossible to pump due to the quantity of pepper that fouled the pumps. To answer the second section of the commission, the first and third undersigned, Wm. Udemans and A. I Steffers, are of the opinion that all the bulk pepper ought to be unloaded, put into bags, and cleanly swept up, and the same thrown back into the hold. The second signer, N Acker, maintains that one ought to unload the ship as far as the pepper lies, in order to scoop up all the pepper that may perhaps have come to lie between the side and the cargo, to recaulk the side, and subsequently to reload in the customary manner. The skipper Van Rossum advises unloading the stern down to the pepper bag, whereupon one will be able to see whether further unloading is necessary. The undersigned Equipage Master Cornelisz, in whose presence this commission was carried out, is, under favorable correction, of the opinion that in order to prevent all averages between here and Europe, which might sometimes be significant, the safest way would be to scoop up and unload the pepper, and further to remove the cargo from the ship down to the bottom layer, as far as the pepper has lain along the hold, which occupies the stern or almost half of the ship, in order to collect all the pepper as much as possible, to prevent giving any cause to attribute that one could have done it at a Dutch factory with less expense, rather than that the ship, springing a leak due to storm, would be forced to incur great expenses in foreign ports, 2124 2125 and the Gentlemen Commissioners General having conformed with the accompanying opinion of the skipper of that bottom, L: W: van Rossum. The Master of the Dispensary Van Reede Van Oudtshoorn, having submitted hereafter the following memorial containing a request for authorization to purchase, on account of the lack of a sufficient quantity of rice and sugar in the Company's warehouses, the necessary quantity thereof in order to maintain the daily provisions from it, and also to be able to deliver to the authorized representatives of Governor Van de Graaff that which was granted to His Honour in kind of the same articles by the resolution of the 28th of this month. The undersigned Dispensier, having had according to the books at the beginning of this month still to account for 23633 lb of rice, had to distribute from this, both to the ships and to various posts, and indeed to such posts where the ration of rice could not be issued in flour, 17950 lb, which thus reduced the stock of 23633 lb to 5683 lb. Since Your Right Honours have now taken the decision to have the emoluments of Governor Van de Graaff distributed in kind up to ultimo April last, the undersigned finds himself compelled, in order to comply with that decision, to request from Your Right Honours the authorization for the purchase of 20317 lb of rice, both to serve to deliver the 15000 lb of rice due to the aforementioned Governor, and to be able to make from it the provisions of 2136 2137. a further 11000 lb, which will have to take place on the first of September next for the Hospital, Robben Island, the Slave Lodge, etc. And whereas among the aforementioned emoluments fifty pounds of candy sugar, of which no remainder is on hand, will also have to be delivered in kind, the undersigned furthermore requests from Your Right Honours the necessary permission for the purchase thereof. 2144 2145 of their High Nobilities the Lords Commissioners-General over Dutch India and Cabo de Goede Hoop, taken in the Castle de Goede Hoop, on Friday the 31st of August 1742: Read is the petition of Iohan Daniel Disandt, stating that as a result of the displeasure conceived by their High Nobilities over the filth and dirtiness found in the Hospital, the petitioner was dismissed from his office as first chief sick-father and demoted to that of junior sick-father, whereby not only the petitioner, but even his currently heavily pregnant wife were plunged into the most distressed and miserable circumstances, facing nothing but poverty and want; that the petitioner begged their High Nobilities for forgiveness and wished to present to them the dire, distressed condition of his poor wife. That an unfortunate moment for the petitioner had certainly made him appear guiltier in the eyes of their High Nobilities than he, without excusing himself completely, actually was. That while cleaning her room, his wife had been overcome by a sudden fit, of which disorders and confusions had been the consequence, and that, to complete the petitioner's misfortune, his slaves upon the entrance of their High Nobilities had forgotten their duty, leaving the slops of the backyard, which had been soiled by the scrubbing of the kitchen, standing, and thereby increasing the irregularities. Wherefore the petitioner in this distressed condition of his takes refuge in the philanthropic and generous disposition of their High Nobilities, most humbly requesting that it might please their High Nobilities graciously to help an unfortunate man who promised improvement and would seek to erase his former faults through a strict and close observance of his duty, and to restore him to his former post of sick-father, and thereby save an entire family from its 2146 2147 downfall and ruin; while the petitioner would not only remain grateful to their High Nobilities for this favor for life, but would pray to God the Rewarder of all good things that He might take their High Nobilities into His protection, and reward them for that goodness and mercy which their High Nobilities would have shown to the suppliant petitioner. Whereupon, after deliberation and having obtained the information from the Lord Commander of this government, it was approved and understood that although the circumstances alleged by the petitioner to make his conduct appear less punishable are by no means sufficient for that purpose, since the Company's interests ought never to be neglected on account of the domestic circumstances of its servants, nevertheless, in this singular case, upon his demonstrated regret and promises made henceforth to conduct himself with more zeal and attentiveness in the service of the Company, out of special grace to remit and pardon his committed neglect of duty, as the same is hereby remitted and pardoned him, the petitioner being therefore hereby restored to his former post of chief sick-father or victualer with the wages and emoluments appertaining thereto; with a serious recommendation, however, to make himself worthy of this demonstrated high favor through a more than ordinary zeal and application and faithful performance of his office, upon which the Regents of the Hospital are ordered to pay particular attention, and thereby to prevent the actual enforcement of the penalty mentioned in the resolution taken on the 28th of this month with respect to the petitioner, and which in that respect is expressly maintained. After this, the Right Honorable Commander made known that, as necessity required the painting of the buildings both here in the Castle and in the Company's Garden, His Honor, before having this carried out, had requested from the master painter Jan Janse Oostendorp a statement of the paints, oil, and paintbrushes required for this purpose, and had received from the said painter both of the memoranda verified by the overseer of the Artisans' Quarter and inserted below. Resolution to charge all emoluments paid out in cash to the servants since 1 May to the account of ordinary rations. Whereupon it was approved and agreed to have the paints, oil, and brushes specified in those memoranda provided, but at the same time to enjoin the overseer of the Artisans' Quarter to watch with all vigilance that no more paint or oil for the painting of the aforementioned buildings be taken from the Company's Trade Warehouse than is required for that purpose, and that it is used for no other ends than those for which it is provided; the said overseer being obligated, when the aforementioned buildings have been painted, to report thereof to this Council, in order to enable the same to appoint such commissioners for the examination of the work as it shall see fit. Subsequently, it having been made known by the Right Honorable Commander that until the last day of April past, some of the emoluments that were provided to the Company's qualified and some minor servants were debited in part to the account of Ordinary Rations, and in part to that of Ordinary Expenses, but that the distributions in kind having ceased, and a beginning having been made on the first of May to pay the same entirely in cash, it would not be possible to book the same separately as before, with the request that this might be provided for; it was therefore thought best to authorize the trade bookkeeper Casparus van Baerten, as he is authorized hereby, to charge all the emoluments which, in accordance with the regulation made thereof, have been paid out since the first of May and shall henceforth be paid out, to the account of Ordinary Rations. Since the regulation regarding the matter of hunting, established by the successively promulgated Placards of 3 September 1771 and 25 May 1774 against the wanton destruction of the Lord's game and fowl, is daily violated, and it is daily experienced that since the discharge of the gamekeepers here, the insolence in destroying the game increases more and more, so much so that even Hottentots and slaves make themselves guilty thereof, and it thus becomes necessary that provision be made therein; it is therefore resolved to appoint the Gentleman Colonel Gordon as Chief Huntsman, and to have delivered into His Honour's hands all the aforesaid Placards, with the authorization and request to revise them with all attention, and, with such additions as His Honour shall deem proper, to draft therefrom and submit to this Council for approval a Placard by which one might trust to be able to prevent and check the customary abuses in that matter; His Honour having to take into account therein that each of the Gentlemen Members of the Council shall have the liberty to keep a gamekeeper at his own expense and without any burden to the Honourable Company. On this occasion it was also brought to the knowledge of the Council by the Gentleman Acting Governor that His Honour was daily importuned by residents living along the Bergrivier to obtain permission to shoot hippopotamuses that frequent the said river, under the pretext that their cornfields were damaged by those animals; that His Honour had nonetheless rejected all those requests, but that it was nevertheless very likely that now and then, without having any permission, the residents along that river came to shoot some of those beasts or to kill them in some other manner; so it is resolved, in order to prevent this, to renew all orders whereby the shooting of hippopotamuses without having obtained written consent from the Chief Rulers is forbidden; in which renewal it shall also be established that no one shall be allowed to make a request to obtain that license, except in case he shall be able to prove that these animals frequent the rivers in such numbers that, without causing fright among them, harm to the residents would be feared to arise; and finally, that the fines against violators of that order stipulated in the prevailing general placard of 11 October 1740 shall be doubled, and thus set for the first time at rd=s 50:—, for the second at rd=s 100:—, and for the third time at rd=s 200:—, to be distributed according to custom. Lastly, it was made known by the Gentlemen Gordon and van Reede van Oudtshoorn, in Their Honours' capacity as commissioners over Robben Island, that the Captain-Lieutenant Engineer Louis Michel Thiebault had informed Their Honours that, however much he had exerted himself to finish the necessary work on the fortifications with the convicts present within the time appointed for the stay of those people at this capital place, this had become impossible due to the substantial repairs that had to be made to many of those works, and that it nevertheless was of the utmost importance to protect all the works from deterioration during the suitable season; for which reason, therefore, in order to enable the aforementioned Thiebault to do so, it is resolved by the Council not to send the convicts present, who have been employed and used on the fortification works, back to Robben Island at the end of this current month pursuant to the Resolution of this board of 13 March last, but on the contrary to retain them to be continuously employed on the public works for as long as this Council shall find it expedient and advisable. The Brewer of the Cape malt beer and the respective lessees of the retail of wines and strong liquors, both in this Cape district and in the outer districts, having submitted a request by petition, pursuant to the conditions under which the leasing took place on the 31st of the just expired month of August, to be allowed to retail and tap their beverages from the houses specified by them and by the persons named therein, this has been granted to them in the following manner, namely: To the brewer of the Cape malt beer Dirk Gijsbertus van Reenen, to have his beer sold by Johannes Hannosius, Leendert Huibrecht, Johannes Schreuder, Pieter Erson, Jan Papendorp. To Jan Luijten, lessee of the retail of Dutch wines and beers, to have these beverages tapped by Fredrik Kannemeijer, and To Hendrik Mattfeld, lessee of the second, third, and fourth parcels of the Cape brandies, to have this liquor retailed by Carel Goor, Huibert Veldhuizen, Jan Kannemeijer, Pieter van Hake, Johannes Visage, and by himself. Notice thereof shall be given to the fiscal, with orders to ensure that no other or more persons are used as tapsters than those presently permitted. The Commissioners-General having obtained information that many persons make use of offensive expressions against the authorities in public writings, having decreed the alongside mentioned publication against this. Since 53,000 pieces of grey bricks still happen to be on hand, 8,150 pieces thereof have been granted to the overseer of the timber warehouse at his request against payment. To Johannes Paulus Eksteen, lessee of the retail of liquors at Rondeboschje and False Bay, to have the same sold and tapped at the following places, namely: from two huts to be constructed at the Salt River on the land of the Honourable Company; from a small house at Drie Koppen, situated on his own land; at the former post of the Honourable Company, De Schuur; at Muizenburg, and in False Bay. Of all of this, the necessary notice shall be given to the ad interim Fiscal Mr. Jacob Pieter Deneijs, with the recommendation to watch carefully that no persons or other places are employed and used by the brewer as well as the respective lessees for the retailing, peddling, and tapping of beers, wines, and strong liquors other than those described hereinbefore, without the said brewer or lessees having obtained permission for that purpose from this Council. The Junior Merchant and Overseer of the Honourable Company's timber warehouse, Pieter Diederik Boonacker, having made a request by petition to be assisted for his use from the timber warehouse with 8,150 grey bricks, it has been approved and understood, since a remainder of over 53,000 will remain thereof, to let the requested quantity of 8,150 be issued to him, provided that the amount thereof, calculated according to the orders, is first paid by him into the treasury of the Honourable Company. The aforesaid publication shall be announced tomorrow at nine o'clock in the forenoon, and further posted everywhere: shall forfeit for the first time a fine of fifty rix-dollars, to be divided accordingly, and in addition be arbitrarily corrected according to the urgency of the case; for the second time a fine of two hundred rix-dollars, to be divided as above, besides a similar arbitrary correction; and making themselves guilty thereof again or for the third time, shall forfeit a fine of five hundred rix-dollars, to be divided in the same manner, and shall be banished forever from this colony and the jurisdiction thereof. We further expressly charge and command the Council of Justice and the Fiscal of this government to see to it that this our publication is punctually observed and complied with, and to enforce it and cause it to be enforced, proceeding and causing proceedings to be taken against the violators thereof without connivance, favor, dissimulation, or compromise, for we have found such to be proper for the common welfare. And the Lord Commander, having also shared the alongside-mentioned provisional arrangements with the Gentlemen Members of the Council upon communicating those letters, devised by his Honor for a speedy and safe return of the said vessel: It is resolved to approve in all respects that which has been performed by the aforementioned Lord Commander in this matter, and consequently to await the appearance of that ship at this roadstead before doing anything else or further concerning the same. Next was read a missive from the Lords Commissioners-General written on the 1st of this month, serving to accompany two extracts from their High Mightinesses' resolutions of that same date, containing their High Mightinesses' dispositions on a certain petition presented to their High Mightinesses by Johan Fredrik Herwich, as Lessee of the excise on Cape malt beer, as well as a memorial presented by the Military Captain-Lieutenant of the Regiment of Wurtemberg, J. C. F. van Hughel. And whereas it appears therefrom that the Lords Commissioners-General, upon the information requested and obtained in this regard from this Council, have not granted the requests of the said Herwich, but have turned them down, expressing their utmost displeasure at the intemperate expressions used by the said petitioner in the aforementioned petition, with orders to carefully avoid such conduct in the future on pain of more severe correction. However, their High Mightinesses have on the other hand, upon the representations of the said Captain-Lieutenant van Hughel, approved and agreed, in consideration that a part of the Regiment of Wurtemberg is currently on Ceylon, to confirm the resolution taken by this Council to retain here a Captain-Lieutenant, a Lieutenant, four sergeants, four corporals, and a surgeon, in order to supervise the passing recruits of the said regiment, and furthermore to send the aforementioned memorial together with the Council's report on it to the Assembly of Seventeen, so that their Honorable High Mightinesses may decide upon it as they shall deem proper. 2176 2177 One shall therefore strictly comply therewith, while as far as the aforementioned van Hughel is concerned, an extract of this resolution shall be handed to him to serve for his guidance. The Council thereby receiving communication that their High Mightinesses have not only declined the request of certain inhabitants to be exempted from the payment of the ferry tolls, but have also earnestly ordered them to make prompt payment thereof. In order to take proper care for the execution of the aforementioned disposition, the debtors shall be granted a term until the ultimate of November next, after which those who remain in arrears will be prosecuted at law. Reading of a second missive from the Lords Commissioners-General. With orders to the Lord Director and the rest of the council, with respect to the remaining points contained in the aforementioned memorial, to leave the sick on the present footing until the intention of the Assembly of XVII regarding this matter has been learned from them. And in order to notify the aforementioned Captain-Lieutenant von Hughel of all this as far as necessary, it was resolved to respectfully let all the foregoing serve for information and guidance, and while awaiting the further orders of the High and Noble Lords XVII regarding the points appearing in the memorial of Captain-Lieutenant von Hughel which have been referred to their final decision, in the meantime to have an authenticated extract of all that has been adopted above from the resolutions of the Lords Commissioners-General (insofar as it concerns him) delivered to the said Captain-Lieutenant von Hughel to conduct himself accordingly. After this was also read another missive from the aforementioned Lords Commissioners-General of the 3rd of this month, likewise accompanying an extract from their High Mightinesses' resolutions taken on the same day regarding a report submitted by the Landdrost and Heemraden of Zwellendam in accordance with and in fulfillment of their High Mightinesses' requisition, concerning a request submitted to their aforementioned High Mightinesses by certain inhabitants of the said colony, tending to be relieved from the payment of the ordinary ferry toll. And from that extract having also appeared that the Lords Commissioners-General also declined this request and ordered the petitioners to comply without delay with the orders already repeatedly given for the payment of their overdue ferry tolls. Having proceeded after all this to the resumption of the highly honored dispatch of the Gentlemen of the High Indian Government dated 24 February of this year, brought here on the 11th of June following with the ship Catharina Johanna, containing various points that require disposition or reply, it was resolved thereupon, after attentive consideration of matters: that passing over in silence everything that is only meant to serve the Council for information and notification, the freedom will be taken in respectful reply to the same letter to initially inform their Honorable Nobilities with regard to their remarks that it seems strange that the Company's slaves should not be capable of works for which those of private persons can be used.
