to urge the re-establishment of a combined ecclesiastical assembly here, considered in itself, appears to be inviting in every respect, having nothing less in view than to promote the welfare of God's church through a better and firmer bond among all the congregations in this Government that adhere to the Reformed Religion; nevertheless, several weighty objections, which ought to restrain the Council in this matter, present themselves against the erection and creation of such a combined assembly when one looks back upon the past and recalls what took place here in earlier days with such a combined ecclesiastical assembly, as it then, instead of limiting its activities within the boundaries prescribed to it, was able to allow itself to exceed those limitations so far as to enter into correspondence concerning the ecclesiastical affairs of this Government with the ecclesiastical Synod of South Holland without the prior knowledge of this Government, contrary to orders, usages, and customs, for which reason it was abolished, as well as on account of the heavy expenses incurred thereby, but most especially because in the said combined assembly matters of importance were seldom transacted, and on the contrary, such discrepancies continually arose among the respective members over trivial trifles that the same could only with difficulty be cleared away each time through the mediation of both the then political commissioner and the late Governor Tulbagh (of laudable memory), while it finally even came to the point that some of the ministers in the countryside absolutely refused to receive such an introduced ecclesiastical commission consisting of a minister and elder, as is among other things also mentioned in the above-mentioned memorial, which annually made the circuit to the outer churches to inspect and examine everything. For which reasons, and because one furthermore still has the very same cause for apprehension that moved this Council in the year 1778 respectfully to request the High-Commanding Lords and Masters that the aforesaid abolition of the frequently cited combined ecclesiastical assembly might continue to take effect—namely, that through its re-establishment a door would be opened to constant disputes and discords between the ministers and church council members of this Cape congregation and those from the outer districts, which, whatever the church council here might otherwise think of it, would undoubtedly all have to come before the Reverend Classis of Amsterdam for decision—it was therefore resolved to supersede and suspend the decision upon that memorial, and meanwhile to bring the same to the notice of the Lords Commissioners-General, so that they may resolve upon it themselves, or prescribe to the Council such a guideline in this regard as they shall deem proper. It has therefore been decided to suspend and defer the disposition on this memorial until a further occasion, and meanwhile to request the well-mentioned Lord Acting Governor, as His Honour is hereby requested, to be pleased to bring the same in the meantime to the notice of the Lords Commissioners-General, in order to give Their High Noblenesses, if it pleases them, the opportunity hereby to assume the disposition on the aforesaid memorial of the church council unto themselves, or else to prescribe to this Council such a guideline to take in its decisions on this subject as Their Highest Honours shall deem proper. 2366 2367. Their Honours the Commissioners General, upon the further information obtained regarding the unfitness of Captain K. Voet to be able to continue to exercise the command over the ship Hilverbeek, having seen fit to dismiss him therefrom. Pursuant to this disposition, that vessel shall have to be handed over tomorrow by the express commissioners mentioned alongside to Captain Jan Jobst Droop, appointed thereto, and to Captain-Lieutenant Bosschen. Thursday the 20 September 1792 In the evening, all being present upon inquiry. From further information obtained by their Honours the Commissioners General regarding the captain of the ship Hilverbeek, Klaas Voet, it having appeared to their Honours that he is utterly unfit to continue to exercise the command over that vessel, and their High Honours therefore, without prejudice to their further dispositions in his regard, having thought fit to relieve the same Voet as of today of the command of the aforesaid ship Hilverbeek, and to appoint in his stead over it Captain Jan Jobst Droop, as has come to appear from a letter just now sent in to this Council concerning that subject by the said Commissioners General; whereby their Honours furthermore leave it to this Council to perform all that which it shall judge to pertain to the proper takeover of that vessel with its appurtenances and belongings. Thus it is, in order to cause their High Honours' aforesaid dispositions to take effect with the utmost possible speed, upon an inquiry made by order of the Honourable Master Commander, thought fit and consequently resolved immediately to nominate and commission, as are nominated and commissioned hereby, the Captains at Sea Jan Arnoud Voltelen and Nicolaas Acker, in order that they, the weather permitting, betake themselves tomorrow morning with and alongside the Master of Equipage Cornelis Cornelisz on board the aforesaid ship Hilverbeek, lying ready to sail in the roadstead, so that in the presence of the aforesaid Master of Equipage the transfer of the said vessel with its appurtenances, according to the inventories and lists extant or to be drawn up thereof, shall be effected to Captain Jan Joost Droop, according to the orders of the Honourable Company, both for himself and in the name of its former captain Claas Voet, now relieved of his command, by the captain-lieutenant of that keel, Jan Hendrik Bosschen. And subsequently to betake themselves from there to the aforesaid vessel the Catharina Johanna, in order likewise to effect a proper transfer of that keel in the presence of the Master of Equipage from the aforesaid Droop to the commander of the snow-brig the Helena Louisa, Jan Drewis, whom it has been deemed advisable to place provisionally in command on the aforesaid vessel the Catharina Johanna in the stead of the aforesaid Droop. And the aforesaid Captains Voltelen and Acker, alongside the Master of Equipage, having discharged their aforesaid task, shall have to submit a written report of their proceedings to this Council. And since the Master Commander, having received the list of necessary equipage goods for the packet boat the Maria Louisa, which arrived here the day before yesterday, communicating to the other gentlemen members of the Council that his Honour had permitted the commander of that keel, Pieter Mosterd, to come ashore to attend to his affairs, has also been pleased on this occasion to show that list to the aforesaid gentlemen members of the Council, with the accompanying proposal to have the necessary goods supplied against it; it has also been agreed to place that list into the hands of the aforesaid Master of Equipage, and to authorize him thereby to supply what is absolutely necessary, as he is authorized thereto by these presents. Lastly, having been communicated in the same manner to the gentlemen members of the Council the report and annex inserted below, submitted by the Master of the Cellars Mr. Le Sueur. To the Honourable Master Johannes 2368 2369 Which commissioners subsequently shall also have to effect the transfer of the fluyt Catharina Johanna to the commander of the brigantine Helena Louisa, who provisionally shall take command over it. Meanwhile it has been accepted for communication that permission has been granted by the Master Commander to the commander of the packet boat Maria Louisa to be allowed to come ashore. Report from Mr. Lesueur containing a statement that the contraband and unpermitted goods have been brought ashore from the ship the Constitutie, and all stored in the Company's warehouses. After all this, a Request submitted by the pro interim Fiscal Mr. Jacob Pieter De neijs was read, containing a petition to be permitted, at the first occurring opportunity, to transmit among the Company's papers a humble petition addressed to their Right Excellencies, the Gentlemen of the High Indian Government at Batavia, concerning a certain claim which the petitioner believes he still has to demand from the Company to the amount of ƒ3913:13:8 as former secunde and cashier of the factory Palicol, on account of the 3 per cent on the linens sold in the Netherlands allocated by the Gentlemen Majores as a means of subsistence to the chiefs of the outer factories on the Coast of Coromandel. The undersigned therefore have the honor to inform your Right Honorable and Honorable Sirs: That the undersigned, having carefully examined the situation of the aforesaid land, have found that it is so situated that the land could be granted without disadvantage either to the Company's compulsory mills or to that of the neighbors, because the purpose of the aforesaid Lange is nothing other than solely to grind barley in the mill to be erected, and that the adjacent neighbors have respectively granted the attached letters of consent, from which it appears that they have nothing against the grant of the said land; provided that he, Lange, meanwhile remains obligated not to obstruct the flow of the water running alongside it, but to ensure it retains its free course to the Company's watermill. Yet notwithstanding that the Burgher Captain Pieter van Breda, as one of the neighbors, granted the said Lange a note stating that he had nothing against the grant of that land, he nevertheless declared to the undersigned during the examination that he would not permit the repeated Lange to use a portion of that land as belonging to him, and which the aforesaid Lange can by no means do without, unless the land which he came to request from your Right Honorable and Honorable Sirs, and which was assigned to commissioners for examination and appraisal, be appraised and ceded to him for a reasonable price. In the possibility that this theft may have been committed during the presence of the said vessel at this Government, the Fiscal shall be ordered to conduct a thorough search immediately. Petition submitted by L: W: v: Korsum, Skipper on the ship the Geertruy en Petronella. numbered 240, which was supposed to contain 100 pieces of superfine Pulicat handkerchiefs, has been cut open, in which upon examination no more than 42 pieces of those cloths were found, and the 58 remaining consequently must be presumed to have been stolen, it was on this occasion, in the uncertainty whether that theft might not have been committed during the presence of the said vessel at this Government, whereby there might still be a chance to discover whoever may have offended against this, and with him also to recover the same stolen pieces of handkerchiefs, also decided upon the proposal of the aforementioned Lord Administrator immediately to place the same depositions into the hands of the ad interim Fiscal Mr. Jacob Pieter Deneijs, and to enjoin the same, as he is hereby enjoined, to conduct the most careful searches immediately into the aforementioned theft committed on board the said ship the Catharina Johanna, and with the observance of his duty regarding the perpetrator to use all possible endeavors for the recovery of the aforementioned stolen 58 pieces of Pulicat handkerchiefs. Thus, after attentive reading of the aforementioned Despatch, and mature consideration of everything that could serve the matter, regarding the further points appearing in the same Despatch, it was resolved: That in order to inform the Public of their High Mightinesses' aforementioned favorable disposition the sooner the better, the Placaat enacted by the same regarding the aforementioned Whale Fishery shall have to be published and posted as soon as possible. While in the meantime the killing of seals on Vondeling Island, by order of the most highly aforementioned Lords Commissioners General on behalf of the Company, shall no longer be done, but the necessary train oil shall henceforth be purchased from private individuals. And the Council shall tomorrow attend in corps upon Their High Excellencies to solemnly thank the same for the favor shown to this Colony by granting the aforesaid fisheries. That also, in order to effect that such pupils of the Orphan Chamber, as well as young people maintained at the expense of the Diaconate, as are suited thereto, be brought to the private seafaring here, there shall be required, as is hereby required, the considerations in that regard both of the Orphan Chamber of this town and of the Reformed and Lutheran Church Councils of this capital, each in its own sphere. wish to pass over, in the firm confidence that the Council, convinced of the impropriety of what has passed, will be no less convinced of the responsibility to which it would expose itself for the future by defending, under whatever pretexts, similar illicit practices, or by turning a blind eye, or by failing to hold the Fiscals of this government to their duty in this regard, the Commissioners-General bringing thereby particularly to the attention of the Council the error of its conception, which has shone through more than once in the opinions supplied to their High Mightinesses, as if things that are detrimental to the Company's interests, or which they would not even be authorized to permit without having obtained authorization, or finally which are contrary to the spirit and intention of orders given in other respects, would be permitted because they are sometimes not expressly prohibited, and as if the absence of such an express prohibition would release them from their obligation to guard against them as faithful servants who properly take the Company's interests to heart; which their High Excellencies wish to have specially applied to the Council's citation that the export of rice, sugar, woodwork, and other goods at Batavia, nor also the import here, had not been prohibited; from which it could certainly never be deduced that the bringing of them here by the Company's return vessels could have taken place, as such is notoriously contrary to the Company's interests, as well as to the spirit of the existing orders issued against the overloading of ships and the conveyance of unpermitted or unbranded goods; and their High Mightinesses at the same time lamenting the almost open protection granted to this illicit trade in this government, the more so because the officers of the Company's ships have thereby been led into the idea that the existing provisions against it, and particularly the penalties enacted by the articles of war, are entirely without force and effect in this place, and that they are, as it were, even permitted to bring unbranded goods here and to carry on trade with them, as has already become most clearly evident to their High Mightinesses; which must make their High Excellencies hesitate to put those penalties into execution immediately from now on, not only because it can hardly be demanded of subordinates to maintain a strict observance of the laws when they see them openly neglected by their superiors, but also because the extension that most have given to that illicit trade would, in that case, expose them to total ruin, which again in another respect could be extremely detrimental to the Company's interests; on which considerations their High Excellencies then also declare to have approved and understood, firstly with respect to the unpermitted goods of the captain, captain-lieutenant, and chief surgeon of the ship Constitutie, stored in the Company's warehouses here in compliance with their High Mightinesses' instruction of the 11th of this month, to favorably remit to the same officers in this particular case the punishment and penalties incurred by them on account of the aforesaid prohibited trade, with this understanding nevertheless, that those goods which they would have been permitted to transport to the Netherlands on freight, included among them the woodwork and linens, shall be sold here at public auction, and the proceeds thereof delivered to them, after deduction of such freight and recognition for the benefit of the Honorable Company as would have had to be paid by them if the same goods had been transported by them on freight to the Netherlands and sold there at equal prices, and that those goods which belong to those articles of which the Company reserved for itself exclusively, and their High Mightinesses for that reason having had to limit themselves in their dispositions regarding the cited articles from the ship Constitutie to what is found described here alongside.

2442 2443 To which end, by providing an extract from this resolution, the Fiscal shall be pre-notified that he will be held to his duty in enforcing the Statutes against the trade in prohibited Goods; while, in the meantime, the seized Goods from the Constitutie must be sold by the Vendue Master in the presence of Mr. Le Sueur. To the Fiscal of this Government, Mr. Jacob Pieter Deneijs, so far as this concerns him in his official capacity, an Extract shall be provided to serve for the information and guidance of both himself and his successors at the time, whereby they shall at the same time be pre-notified, as they are hereby pre-notified and warned, that as the Council will be especially vigilant that henceforth not the slightest deviation shall occur from the orders established by the Lords Masters in the fatherland, Their High Excellencies the Lords Commissioners General mentioned above, or the Lords of the High Government of the Indies, and prescribed to this Government for observance, nor that the same be subjected to erroneous and forced interpretations in order to profit thereby as has occurred until now, the said fiscals consequently, upon discovery that they make use of any connivance with others regarding this or depart for themselves from the established provisions, whereby the aforesaid orders and dispositions of the superiors could once again be made illusory, shall be emphatically opposed and brought back to their obligation. 2446 2447: of the same regarding others has already taken place, before the same are also immediately put into execution in their regard, the Fiscal in general, and the Master of the Equipage in particular with relation to the boat crew, and other persons with whom he proceeds on board upon the arrival of ships, are expressly ordered to ensure that, in the first instances of the arrival of a return ship, no one, whoever he may be, shall have any communication or correspondence, either by word of mouth or by means of letter exchange, with the officers, passengers, and further crew of such a ship, and that no one else shall then cross over with him, the Master of the Equipage, into the said ship except those who properly belong to the health commission, who are hereby most expressly prohibited and forbidden, during their inspection (which, depending on the prevailing circumstances, must be brought to an end as briefly and quickly as possible), from entering into conversation about anything other than matters belonging to their aforesaid commission. Secondly, that the Lord Governor or Commander, immediately after the ship has come to anchor, shall, by the Master of the Equipage and with the same boat with which he proceeds on board with the health commission, summon to him the captain or whoever commands the vessel, and upon him being conducted directly from on board to His Honour by the aforementioned Master of the Equipage, shall put to him that there are reasons to assume with certainty that (as usual) there are on board, for the private account of him and other officers or persons belonging to the crew, unpermitted or unbranded goods, and shall further strictly interrogate him as to what these consist of, from whom and at what prices they were purchased, with the promise of impunity for him and 2448 2449 his fellow officers, according to the authorization granted for this purpose by the Lords Commissioners-General, in case they make that statement faithfully. Thirdly, that if the captain or commander refuses to comply straightforwardly with this requisition, the next officer shall immediately be summoned by means of the same Master of the Equipage, and the same shall be put and asked to him, while in the meantime, in order to ensure that he does not beforehand consult with the captain or commander, the said captain or commander shall be detained in the Castle, in such a place as the Lord Commander-in-Chief shall think fit to have designated for that purpose, and so forth with all the further officers. Fourthly, that once the aforesaid statement has been received and properly signed by the officers whom it concerns, upon the oath taken at the beginning of their service, notification thereof shall immediately be given by the Lord Governor or Commander in this Council; that subsequently the goods listed thereon shall at once be stored in the Company's warehouses and dealt with in the same manner as with the aforementioned goods which the Lords Commissioners-General discovered by similar searches to be on the ship Constitutie. Fifthly, that whenever there might be suspicion that the statements were not made in good faith, or also whenever it might be found that such was the case, and also in the event that the officers should deny that any unpermitted goods were on board, the ship shall have to be accurately searched by the Fiscal alongside commissioned members from the Council of Justice, and upon the discovery of fraud or an unfaithful statement, the guilty parties shall not only have forfeited the impunity promised to them by virtue of Their High Nobilities' aforesaid authorization, but the Fiscal of this government must also proceed against them immediately according to the strictness of the law. Sixthly, that from now on, the aforesaid Fiscal, as he is hereby most emphatically ordered to do, must supervise and watch that, from the Company's ships passing here, both outbound and returning, no goods are brought from on board or to shore that are unpermitted or unbranded.
