2668. 2669. Their High Mightinesses have been pleased to determine that henceforth no letters of freedom may be granted by the government here without the prior knowledge of the Assembly of 17. This Government was explicitly reserved the right to take those granted freedom back into service at any time at their former rank and pay and to send them away from here, whenever needed or if their conduct should not be proper; nevertheless, a prevailing notion exists here among the inhabitants as though no use could be made of that right without it involving a hardship for those regarding whom it was exercised; and however unfounded this notion may be, it is nevertheless preferable to eliminate, as much as possible, the occasion for such instances, and thereby to prevent the bringing forward of imaginary grievances, wherewith the Assembly of Seventeen has at times been troubled on that account. And that the Assembly of Seventeen has at all times been of the opinion that one ought to be extremely sparing with the granting of burgher freedom to people, as is abundantly evident from the manifold recommendations of the said Assembly made in that regard from time to time to this Council; With which, for the more complete execution of this intention that accords so well with the interests of the Company and the benefit of this Colony, Their High Mightinesses also declare to have seen fit to determine that henceforth no letters of freedom may be granted by this Government without prior knowledge of the Assembly of Seventeen, or of Their High Mightinesses themselves during Their High Mightinesses' presence here; but that when one shall believe in particular cases that this or that person here ought to be granted burgher freedom, the Council shall be obligated to make a proposal to that effect to the aforementioned Assembly, adding the reasons that come into consideration with them for doing so; it remaining nevertheless free to this Government, in individual cases and when there are grounds to do so, to permit Servants of the Honorable Company to remain here for a time under written-off pay, whereby Their High Mightinesses consider that the enjoyment of burgher privileges is provided for just as well as by the granting of burgher freedom, without being subject to the inconveniences cited herebefore, should one see fit to draw such persons back into service and to send them away from here. Whilst Their High Mightinesses, disposing on these grounds also of that part of the Letter of this Council of 7 September last, whereby the same made known to Their High Mightinesses that a number of persons, who had to be dismissed from their positions due to the abolition of the establishment of the Company's Stable as well as otherwise, were provisionally placed under written-off pay, and that further arrangements regarding these people were respectfully referred to the further arrangements of Their High Mightinesses, declare to have approved the aforesaid actions of the Council, and out of consideration of the particular circumstances of this matter, to authorize this Government to allow the aforementioned Persons, named more fully on the List sent to Their High Mightinesses alongside the aforesaid Letter, to continue to remain here under written-off pay; yet so that, since the number of persons finding themselves here on that footing, already very considerable in itself, will thereby increase substantially further, this Council shall continually have to contemplate means to reduce the same without burden to the Company, to which end the sending to the Indies of such persons who have not yet served out their contract, or who 2670. 2671. leaving freedom nevertheless to the Government to grant permission in individual cases to servants on written-off pay to remain here. 2672. 2673. And that there shall annually be supplied to the Assembly of Seventeen a specific list of the persons who, in the last expired year, have thus been placed on written-off wages. To prevent such persons from wandering about this Colony in an arbitrary manner, as currently occurs only too frequently, so that in the end hardly any trace of their whereabouts can be found, such provisions concerning this matter will have to be observed as Their High Honours have been pleased to prescribe. In order to carry out and cause to be carried out strictly in all respects the highly respected orders of the Lords Commissioners General concerning these aforementioned provisions, extracts of both the above-mentioned final passages will be handed to the Council Members Lesueur and van Reede van Oudtshoorn, as commissioners appointed to conduct, together with and alongside the Pay Bookkeeper on the 31st of this month, the muster of the Company's servants residing in this Government who have been discharged and placed on written-off wages, so that they may regulate themselves accordingly. Likewise, a similar extract will be supplied to the aforementioned Pay Bookkeeper, with orders to the same, as he Pay Bookkeeper is hereby ordered, to compile annually as of the last of June and submit to this Council such a specific list of the persons placed on written-off wages in the last expired year, as Their High Honours have, as just stated, been pleased to ordain, which must successively be transmitted to the Illustrious Assembly of Seventeen; whilst, moreover, it shall be and remain established for the future: Firstly, that anyone who desires to be placed on written-off wages shall be required to address himself by petition to this Council, appending thereto a certificate from the superior under whom he last served, stating the period of time he has served the Company and what his conduct has been, in order to ascertain whether this merits any consideration by us and whether the reasons he adduces for leaving the Company's service are sufficient. Secondly, that the person placed on written-off wages shall always be noted on the report of the officer or master under whom he fell, in this manner: N: N: under suspension of wages lives with the Burgher N: N: Thirdly, that in order to enable the officer or master properly to do this, the person written off from wages shall be obliged to report to him every month and state where he resides, and in case he should live far inland, to do so every three months by letter; and Fourthly, that every year as of the last of June, upon drawing up the general muster roll and the statement of the active men present at each post, the persons placed on written-off wages must be reported, with an indication of where they are located. 2674. 2675. Whilst the mustering out of seamen on the ships must, for the aforementioned reasons, henceforth be carried out by the Equipagemeester, the manner of placing crew on the Company's ships and the mustering thereof having further drawn the attention of the Lords Commissioners General, as it is also necessary for the strict fulfillment of the express desire of the Assembly of Seventeen for the speedy dispatch of the ships.

ships of the utmost importance, that this matter be treated with the greatest possible order, and it having appeared to Their Right Nobles regarding this that the placement of crews in this Government has largely been delegated to the Pay Bookkeeper, a practice which possibly in earlier times, when the Company had enough people and mortality in Batavia was lower, may have had no adverse consequences for the Company, but which according to the judgment of Their Right Nobles at present, since the shortage of people in Batavia is so great, and makes a double vigilance here over the continuous dispatch of all able-bodied crewmen utterly necessary, could much more serviceably and usefully for the Company, just as is customary in other establishments of the Company, be assigned to the Master of Equipage, because the Master of Equipage, knowing the charter and rigging of the ships, accurately knows how to judge with how many crew each ship can proceed on its voyage, and how many crewmen in pressing cases (as at present) can be placed upon the outbound ships for dispatch, that he also knows the worth of the sailors, and thus is in a position to give to each vessel an equal number of helmsmen, experienced sailors, and boys, and thus to distribute the people on the most equal footing and to the greatest benefit across all the vessels, of all of which the Pay Bookkeeper is ignorant, which exposes him to mistakes. That the manner in which the musterings of the ships presently take place consists of the Master of Equipage bringing a list of such ships as can be mustered within 6 to 8 days; whereupon a muster note is also written out and carried around by a messenger to everyone who has any relation thereto; but that it happens all too often, and the prevailing south-easterly winds here are not always the sole or principal causes thereof, that the ship commanders fall behind in readying their vessels, bringing water, firewood, and rations on board; which then often must take place after the mustering; and results in persons sometimes reporting themselves after the mustering as incapacitated and being sent as such to the hospital; that frequently there are among them those who have been placed upon the ships here, and whose accounts have sometimes already been enclosed and sent to Batavia, while the wage-earner remained here; and that after the mustering of the ships, persons obtain permission from their officers to go ashore; while it frequently happens that after the departure of the vessels, persons appear who let their ships sail, and thus, due to the absence of the original muster roll and further ship papers, must be entered into the pay books by an open account. Wherefore Their Right Nobles, without prejudice to such disposition whereby They have already effectively observed and provided that no occasion can be given on the part of the ship commanders for the delay of the ships, with a similar objective and to promote good order regarding the matter of mustering, have been pleased to prescribe a fixed guideline for this Council for the future: Thus it is resolved, in order dutifully to carry out this directive of the Lords Commissioners-General as well, that henceforth regarding the matter of mustering, the following order must be observed, namely: Firstly, that the Master of Equipage shall give notice to the Commander-in-Chief when, barring unforeseen accidents, a ship or ships can be mustered eight days thereafter. Secondly, that notice thereof shall immediately be given by the Commander-in-Chief to the heads of the offices or those who have any connection with the mustering, who shall then have to take care to be ready with their papers at the appointed time. Thirdly, that the placement of people henceforth being delegated to the Master of Equipage, he shall be obliged, eight days before the mustering, to send a nominal roll of such persons as are placed upon the ship or ships to the Pay Bookkeeper, in order to be able to settle and close the muster rolls and accounts in time, and to report to the Trade Bookkeeper the number of crewmen with which the ship or ships are to depart, in order to draw up the ration list accordingly. Fourthly, that the ships projected for mustering having water, firewood, rations, and all necessities on board and lying ready to sail, the Master of Equipage shall make a report thereof to the Commander-in-Chief, who then subsequently must have commissioners from the Council of Justice notified to muster the ship or ships. Fifthly, that at this mustering everyone without distinction shall have to be present, and after the mustering no one shall be permitted to go ashore from on board, except upon obtained permission from the Master of Equipage, who shall not be permitted to grant the same except in case of absolute necessity, and shall be bound to report thereof immediately to the Commander-in-Chief; furthermore, the commanders of the ships shall be responsible for such persons as remain behind from their vessels.

Through which arrangement many irregularities that presently take place with the muster rolls and accounts by sending people ashore and leaving men behind will be prevented, while thereby the papers and dispatches of the ships can also be kept in readiness at the offices, and, extraordinary incidents excepted, be delivered to the authorities a few hours after the mustering; which ships can then go to sea with the first good opportunity, this shall also, as is done hereby, be prescribed for strict observance and compliance to all and everyone who has any relation to the work of mustering and the dispatches of the ships. Lastly, it having also come to the attention of the Lords Commissioners-General that the Company's seafaring personnel here are sent from the hospital as convalescents to the Line, and are brought there directly under the orders of the Captain of Engineers, and Their Right Honorables consequently having deemed it necessary for the maintenance of good order that a regulation also be drafted for that administration, in which, among other things, such points would deserve to be taken into consideration as Their High Honors were pleased to state item by item in their aforesaid very venerated letter to this Council, which entirely tend to enable one immediately at a glance to perceive how many convalescents are on hand to be placed on the outward-bound and returning ships, as well as upon the arrival of the Company's vessels on which one would wish to embark men, to give a prompt dispatch to the mustering: 2684. 2685. Whereupon it was resolved to deliver the said citation to the Council of Justice here for execution, together with an extract hereof, in order that the reply, once received, may immediately be sent off to the above-mentioned Mr. Gregory. Gregory, Resident of His Prussian Majesty in Amsterdam, and served to accompany another missive, as well as an associated citation upon a certain Joachim Christoffel Schultze, currently residing at Zwellendam with Heemraad Stein as schoolmaster, addressed to this Government from Stendal under date of 26 April of this year by the President, Director, and Councilors appointed by the Royal Prussian High Court of the Old Mark, in which the said Court kindly requests the Council to be so good as to cause the aforesaid citation to be served upon the said Schultze, and to transmit the reply thereto as soon as possible; so taking into consideration the friendly representations made to this Council regarding the aforesaid matter, and deeming it proper to defer to them in this regard, it was accordingly resolved to supply the aforesaid citation to the Council of Justice of this Government, and to order them to execute it promptly while transmitting an extract of this resolution; and once the reply to the said citation has been received, it must immediately be submitted by the aforesaid Council of Justice to this Government, so that it may be forwarded to the above-mentioned Mr. Resident Gregorij at the first available opportunity that shall present itself thereafter. Furthermore, if this field were granted as a farm to him, Munnik, they, the neighbours, would then according to ancient custom be placed under the obligation to cede to the said Munnik half of their pastureland, of which they declared they could not spare the very least; that besides this, the distances of their freehold farms happened to be so close to this farm requested by him, Munnik, that he, Munnik, would need no more than a quarter of an hour to reach the lands measured out to them and held in their ownership with his livestock. And that finally, during the time when the country folk transport their wines and grains up to the Cape, and unyoke with fully 50 wagons at the Klippe-kloof in the Kalbaskraal, no other field than this remains as a thoroughfare for the beasts used for the transport of those products, especially for those who come to unyoke at the Kalbaskraal, who would otherwise be forced to drive their beasts through the cornfields of their neighbours; and on account of which cited reasons, they, the neighbours, had collectively made known that they would be most severely disadvantaged by the granting of this farm to the said Munnik. After which, they, the committee members, had caused the frequently mentioned neighbours to state the distances that existed between this farm requested by Munnik and their freehold farms, and had then found that from Captain-Lieutenant Gousdz the distance was 40, from Louw 32, from Nieuwkerk 38, from Batenhorst 44 minutes, and from Slabbert one hour's walk. To all of which presented matters the former Heemraad Munnik had replied: that this land requested by him yielded neither enough grass nor water to be able to graze and water the livestock of the neighbours upon it; that it was true he would have to make use of half of the pastures of the said neighbours, but he could not understand why such was not also refused by one neighbour to another, wherefore he considered this to be mere envy; and that Captain-Lieutenant Gousch, apart from this pasture, had enough land upon which he could graze his livestock. Against which objections the collective neighbours brought forward that, concerning the reasons alleged by Munnik that on this farm requested by him there was neither enough grass nor water for the grazing and watering of their livestock, they had to declare, firstly, that they did not need water for watering their livestock, since enough of it was to be had on their freehold farms; and secondly, that this field yielded young reed and other kinds of grass, however little, to be able to serve as feed for their livestock, whereas otherwise, if they had to miss this outspan and grazing route, they would, especially in the winter season, have to graze their livestock upon their cornfields; against which the repeatedly mentioned Munnik was able to bring forward nothing. After which they, the committee members, had asked him, Munnik, what recognition fee, beyond the ordinary annual rent, he would be willing to pay to the Honourable Company for this farm; whereupon he had declared a sum of 1000 Rds. But against which declaration the collective neighbours had most urgently come to request that they implore Your Right Honourable Worships on their behalf that, in case this farm should be granted to him, Munnik, for that sum, they might have the right of pre-emption, being prepared to pay that sum to the Honourable Company, with the declaration that necessity had forced them to make this offer on account of the disadvantage that would be caused to them in case this, their only outspan and passage route, were granted to another, and that this request was furthermore made with no other purpose than to be able to enjoy the freedom of an outspan and passage route for themselves and the other country folk. And they, the committee members, have finally declared to the Commissioners that they found the sum stated by the frequently mentioned Munnik for the value of the farm requested by him to be far too high, and far exceeding its value. In accordance with the proposals made therein, the requested lands shall be granted in ownership to the aforementioned petitioners under certain conditions. 8 October 1792, below which, in my presence, signed: J. F. Deneys. Thus, since it now appears from that report that no objections arise against the granting of such portions or parcels of land as requested by Carel Benedict Smekenbekker, the Burgher Johan Jurgen Stadler, and the Fire Master Johan Michiel Elzer, it is now resolved to grant the cession of the said lands or parcels of land to the aforementioned persons for the following sums at which the aforementioned Commissioners have valued them, namely: To Carel Benedict Smekenbekker, two morgen and one hundred thirty-two square roods, situated east of the Windberg, on the Zwarte River, for one hundred rixdollars; To Jan Jurgen Stadler, one morgen and ten square roods, situated under the aforementioned Windberg, for eighty rixdollars; and To Johan Michiel Elzer, three morgen net, situated between the so-called Graauwe Heuvel and the Takhalsvalley near the so-called Vlakte, for one hundred rixdollars; Under these conditions, however, that the aforesaid Smekenbekker shall not be permitted to request any more land, whether in ownership or in quitrent, toward the side of the Burgher Serventyn or toward that of the Widow van Schoor, and that he must also leave the roads running alongside free and unobstructed; and that the Fire Master Elzer must strictly adhere to the arrangements established by the Placaat of 2 December 1791 regarding the pasture, and consequently shall not be permitted to move with his cattle toward the side of the Dunes, but 2718. 2719. shall only be permitted to drive and graze the same on and over the field where this requested land happens to be situated. Yet whereas, with regard to the land which the former Heemraad Gerhardus Hendrik Munnik has requested in loan ownership, several objections have been raised and representations made by the neighbours living around there, being the Captain Lieutenant of the Burgher militia Johannes Stephanus Gousch, the Burghers Adriaan Louw Az., Hugo van Nieuwkerk, and Martin Slabbert Iz., together with the authorized representative of Gerrit Hendrik Batenhorst, as appears more fully from the above report of the Commissioners, which moved the Commissioners to refer the decision to this Council as to whether the same land could and should be granted to the said Munnik for the offered sum of one thousand rixdollars; so, considering that what was raised by the aforementioned neighbours against the granting of that land on account of the disadvantage which would thereby be caused to them indeed merits some reflection, but it is no less true that they cannot reasonably claim to continue using a tract of field large enough to establish an independent farm of 60 morgen thereon, consisting entirely of the Company's land, and for which, besides the aforementioned sum of one thousand rixdollars to be paid at once, the said Munnik has further offered an annual recognition of twenty-four rixdollars, without indemnifying the Honourable Company in this regard; it is therefore resolved that in this matter the requested preference shall indeed be granted to the aforesaid Gousch, Louw, van Nieuwkerk, Slabbert, and the authorized representatives of Badenhorst, as it is granted to them by these presents, provided 2720. 2721. they jointly, just as was offered by the aforementioned Munnik, pay to the Honourable Company, besides the annual recognition of twenty-four rixdollars for the ownership of that land, the offered recognition of one thousand rixdollars; but that they shall also be set and assigned a period of two months calculated from the date hereof, within which they shall be bound at the latest to pay the last-mentioned sum into the Company's treasury; and should this term expire without the actual payment having been made in the meantime, the said neighbours shall have forfeited the preference granted to them, and the aforesaid land shall then be ceded on the above-mentioned conditions to the so often mentioned Munnik, provided he immediately, at least within the course of two other months, performs the payment of the recognition of one thousand rixdollars, and subsequently prompt payment annually of the recognition of 24 rixdollars. The undersigned Merchant in the service of the Honorable Company and Fiscal pro interim of this Government, Mr Jacob Pieter Deneys, has the honor to show to Your Right Honorable and Right Honorable Gentlemen with all due respect: That by the highly revered resolution of the Council dated 18 September last, there having been placed into the hands of the representing Officer by reason of his office a certain formal complaint presented to Your Right Honorable and Right Honorable Gentlemen, as well as the Honorable Council of Policy, by the Landdrost of the Colony of Graaff-Reinet, Moritz Herman Otto Woeke, who is currently present in this place, against the Secretary of that Colony, Honoratius Christiaan David Maynier; together with a letter from Graaff-Reinet addressed to Your Right Honorable and Right Honorable Gentlemen, written by the same Landdrost to the same effect under date of 10 October of the preceding year; he, the representing Officer by reason of his office, upon examination of both these documents, has found that not the slightest proof has been attached to them from which the aforesaid complaints could be justified, and thereby judged whether and to what extent Secretary Maynier can be considered guilty of the acts charged against him therein. That the representing Officer by reason of his office, in order to comply with that resolution as quickly as possible and make a beginning with that investigation, therefore summoned the aforementioned Landdrost Woeke to appear before him and demanded from him such documents and evidence as might serve to productively investigate the accusations brought against Secretary Maynier; whereupon the undersigned, to his very 2724. 2725. For which reasons the representing Officer by reason of his office turns to Your Right Honorable and Right Honorable Gentlemen, humbly imploring that it may please Your Right Honorable Gentlemen to order the aforementioned Landdrost Woeke to deliver to the undersigned as soon as possible all such documents and evidence as may serve to prove the accusations brought against Secretary Maynier, or at least and in any event to provide the representing Officer by reason of his office with a specific list of all persons and matters that might be of any service to him in this investigation, so that he may thereby be enabled to properly comply with the highly revered orders of Your Right Honorable Gentlemen. with the Master Shipwright Mijndert van Eijk, to go on board that ship, and there, before the Equipage Master of this Government, Cornelis Cornelisz, in the presence of the provisionally appointed Commander, Ian Driwes, and all the other Officers, to examine with all possible accuracy both the damages found on that vessel and whether the same could be repaired so that the said vessel could be put in a condition to undertake the voyage from here to the Netherlands. In compliance with the aforementioned highly respected orders, the undersigned went on board on the 16th of this current month of October, but could not then carry out an accurate examination before a part of the sheathing had been stripped off, and some plank ends of the wales in the bow had been chopped out, for which the Equipage Master would first request permission from Your Honourable Worships. Having obtained permission for this, and after several openings had been made in the bow and the sheathing was partly stripped off, the undersigned, in the indisposition of Captain Udemans, went on board again today, the 19th of October, and found: Most of the timbers in the bow dry-rotted and decayed, such that neither nails nor bolts could hold fast in them, and with the rolling of the ship the wales in the bow, as well as the hawse pieces, slid back and forth; also, upon inspection in the hold forward in the bow on the starboard side, there was a piece that was very bad and rotten, as well as several both bands forward in the bow and beams in the hold that had much play with the rolling of the ship. Subsequently, the ship was bored into the stem and found to be dry-rotted, and was also bored into in the hold, where almost all the timbers were dry-rotted and decayed; also, 14 knees were broken off, both at the heels and at the throats, and 5 beams broken. On the grounds of their findings upon this examination, the undersigned are of the opinion that this vessel cannot be repaired, especially not here, in such a manner that any goods can be loaded and dispatched in the same with security, since even the frames are so rotten and decayed that no firmness can be found in them, as previously stated, for nails and bolts to hold, whereby all repairs to that ship would be in vain. The undersigned hope hereby to have complied with the highly esteemed orders of Your Honourable Worships, and let this serve as a dutiful report. 2740. 2741. It was resolved to order the Master of Equipage to have the defects stated in that report repaired as quickly as possible. A request having been made by petition by the Captain and Supercargo of the French Ship Polimpe to exchange some goods here against products of this country, used, because it was necessary to reeve for needs, and to use wooldings of the spars—it thus appears to them that this ship needs to be supplied for rigging with: Two iron hawsers of 8 inches for main and fore braces, Two of 6 inches for mizzen braces, Two of the same for foretop lifts and reef-tackle pennants, Four to five wheel hawsers for buntlines for the courses and topsails. It appears that this vessel is indeed suffering from very considerable defects, but that once these defects are remedied in such manner and form as specifically and distinctly stated in that report, the same ship will then be able to go to sea again. 2742. 2743. However, regarding the permission to sell some European goods brought here by them from France with the said vessel and described more fully in the aforesaid petition, and to export in payment thereof such products of the country of which the export is not forbidden, together with an additional quantity of eighty thousand pounds or 445 muds of wheat, which should serve to replace the weight of the smith's coals on board the more cited vessel for ballasting: Having deliberated upon this and taken into consideration that, apart from the present lack of various indispensable European necessities required both for agriculture and trades, no objection can exist against the importation of such items, but that on the contrary it is of the utmost importance to carefully counter and prevent the importation of those things which would only serve to further promote and cultivate a luxury or excess that has brought this country to the brink of its ruin: Therefore, after the Honorable Acting Governor took the pleasure and approval of the Lords Commissioners-General, it was agreed to grant and permit the aforementioned Captain and Supercargo Sevene and Rigault, as they are hereby granted and permitted, to bring ashore from the items listed in their aforesaid petition for sale here only the following, namely: coal, bar iron, nails, oil, sail twine, writing paper and pens; and in payment thereof to be permitted to purchase and transport on board the undermentioned products of this country, namely: butter, wine, salted meat, dried fruits, hides, leather, candles, tallow, and brandy; 2744. 2745. 2746. 2747. to conduct strict searches into the theft, presumably committed on that vessel, of 58 pieces of superfine Pulicat handkerchiefs, which were found missing upon unloading from a package numbered 240, in which one hundred pieces ought to have been, the humble undersigned, on the 30th of September, or the day after receiving the aforementioned honored Resolution, went on board the aforementioned flute ship and in an unexpected manner and with the greatest possible precision had everything inspected that could in any way be considered within sight, and also had all persons questioned who had been present at the unloading, without them nonetheless having been able, after all this, to discover anything from which one could with reason conclude that the aforementioned theft was committed during the presence of the said vessel at this Government. As proof of which shortage of European crew during the loading at Batavia, the said Heksteede on the 8th of this month handed over to the undersigned the declaration attached hereto. For which reason the Captain-Lieutenant A. It having been brought to the attention of the Gentlemen Commissioners-General that on some of the Company's ships which touch at False Bay during the bad monsoon and take in their required water there, proper direction is not maintained whereby they might obtain the same in a speedy manner, and at the same time the good order that ought to take place therein is neglected; And Their High Mightinesses consequently desiring that provision shall be made herein, and the Same accordingly having seen fit to write to this Council by Missive of yesterday, received today, to make the necessary provisions regarding this, and to that end to order the commanders of the ships that, as soon as their vessels under command shall be properly moored, their first task must also be to bring the empty water casks ashore as quickly as possible, to have them filled, and without delay to convey them back on board; as well as to ensure that with the vessels employed for fetching water there shall always be present an Officer, assisted by a Cooper, so that in case any repair or maintenance to the casks is needed, they may effect the same immediately; Thus it has been resolved to inform the Resident of the aforementioned False Bay of this disposition and desire of Their High Mightinesses by Extract hereof, with the added order to see to it and ensure that the Officers of the Company's Ships who shall arrive in the frequently mentioned Bay in the future strictly comply with the aforesaid regulations regarding the fetching of water; for which purpose, in order properly to enable the said Officers, immediately upon their arrival in the Roads, the required notice of what is aforesaid shall be given in writing to the same by the more-cited Resident for their guidance. The undersigned, Merchant in the service of the Honourable Company and pro interim Fiscal of this Government, Mr. Jacob Pieter de Neys, in whose presence the master and other officers of the Dutch private ship the Drie Gebroeders, stranded in Simon's Bay on 2 June last, were examined before the Gentlemen Delegates from the Honourable Council of Justice here, pursuant to a written commission issued to them under date of 20 August last, by maritime experts expressly appointed for that purpose, and the reasons to which the unfortunate stranding of the aforementioned vessel is to be attributed were investigated with the utmost precision; having duly executed the charge entrusted to him thereby, he takes the liberty herewith respectfully and dutifully to present to Your Right Honourable and Respected Sir and Honourable and Respected Sirs the interrogatories answered in this regard by them; from which responses, as well as from the declaration of the Examiners, your Excellencies will be pleased to observe that the unfortunate stranding of the aforementioned vessel was by no means to be attributed to the malice or any wrong conduct of the aforementioned officers, but solely to an accidental misfortune that could in no way be avoided; and as consequently no action in case of misconduct can be instituted against the same persons by the undersigned ex officio, he only takes the liberty to let these serve as accompaniment to the aforementioned question points answered before the Gentlemen Delegates, and has the honour to sign this, as /below stood:/ Right Honourable and Respected Sir, and Honourable and Respected Sirs! /:lower:/ Your Right Honourable and Respected Sirs' very humble servant /:was signed:/ J. 2772. 2773. by the abovementioned interim Fiscal, the examinees were presented with the following two points of inquiry drafted by them alongside the aforesaid Equipment Master, just as the examinees thereupon gave such replies in their defense as are noted alongside each question. Article 1. What the examinees did when, on 2 June of this year, lying 1/2 mile from the Roman Rock outside Simon's Bay, they had weighed anchor! Answer. That they had then lowered the shallops before the bow and set sail, in order to come between the Roman Rock and the Noah's Ark through into Simon's Bay, but that, having arrived between those two rocks, they had caught the wind from ahead; which incident had forced them to anchor with standing sails, but that in the meantime the anchor had not held, notwithstanding that sufficient slack of the cable had been veered out. Article 2. Why the examinees, when the cast anchor would not hold, did not let go a second anchor! Answer. That, through the strong drift of the ship and the heavy swell and current, they had been unable to do so, as they foresaw that, by reason of the shallowness on which they already found themselves with the aforesaid vessel, they would have run the danger of striking against their own anchor. Upon which questions and answers the examiners declared that it has appeared to them most clearly, both from the answers given by the examinees themselves and from the journal kept on the said vessel, 2774. 2775. that the stranding of the repeatedly mentioned ship can by no means be attributed to inactivity, or any wrongful course of action from which the least neglect of duty could be deduced, but was caused solely by an accidental misfortune, which was by no means to be avoided, while they, the examiners, further testify that the examinees kept a very exact journal and not only acted strictly according to the Instructions of the Honorable Company throughout the voyage, but also, especially in the aforesaid accident, did everything for the preservation of the ship that their duty dictated, and that they according to good seamanship were able and obliged to do to that end. The undersigned examiners testifying to have investigated all the foregoing to the best of their knowledge and understanding, just as the examinees declared to have answered the questions put to them in truth; being prepared to confirm the one and the other further, if required. Thus interrogated and answered at Cape of Good Hope, the 15th of October 1792, before the Gentlemen Ryno Johannes van der Riet and Abraham Fleck, Members from the Honorable Worshipful Council of Justice aforesaid, who have duly signed the minute of this alongside the examiners, the examinees, and me, sworn Clerk. It having appeared that that accident is not to be attributed to any neglect of duty of the said ship's authorities, so that no action could be instituted against them, it is on that account resolved, since it now appears clearly, both from that report itself and from the interrogatories annexed thereto, answered by the skipper Jan Roelofze de Groot and other officers of that vessel before commissioned members from the Council of Justice, to which reference was made in the said report of the Fiscal, as well as from the declaration made by the examiners, that the aforesaid accident which befell the said vessel is by no means to be attributed to any neglect of duty on the part of those authorities, on which account therefore no action in case of misconduct could be instituted against them, that one shall accordingly confine oneself to initially giving the required communication of the aforesaid gathered information and the just-mentioned report of the Fiscal containing the result thereof to Their High Honors, the Gentlemen Commissioners General present here, and subsequently to furnish in all reverence authentic copies of this one and the other to the High Governing Masters in the Fatherland, in order that such use may be made thereof as shall be found to be necessary and proper.
