2778. 2779. against the person of Smit of Dilburg and the settlement entered into with him, having taken the trouble to investigate the same, and thus to trace and examine the aforesaid odious matter in its entire context and true state of affairs. In the Council And having subsequently had to endure the palpable displeasure of receiving on the subject, the day before yesterday the 28th of this month, an express dispatch from the Most Noble, their Right Excellencies, written on the 27th of the same month prior; whereby their Right Excellencies, after having succinctly set forth their most high findings in this matter, express their astonishment that this government, in this case, wherein the Council of Justice, persuaded by the fallacious arguments used for that purpose by the Independent Fiscal, Johan Nicolaas Steeven van Lynden van Blitterswyk, has so palpably exceeded its power, has made no use of the power entrusted to it to oppose and stop such actions; and furthermore, after mature and very earnest consideration of this matter, of which their Right Excellencies say that it were to be wished that the past records of a body such as the Council of Justice in this government had never produced any such example: declare the ruling of the Council of Justice of this government dated 2 April 1789, containing authorization for the aforesaid Independent Fiscal van Lynden to reach a settlement with the person of Jan Smit of Dilburg regarding the confinement of five consecutive years on Robben Island imposed upon him by sentence of 22 November 1787, as well as the deed of settlement itself, mentioned in the minutes of the said Council of the 6th of April following, to be in themselves null and void, with the order that all that has occurred in this regard in the minutes of the Council of Justice shall be struck out and this ruling of their Right Excellencies entered in the margin thereof. Also, that by the authorized representatives of the said Fiscal there shall be refunded to the person of J. Smit everything that was received from him on account of the said settlement. Thus it was resolved to give the necessary notification to the Council of Justice by an extract of this resolution. 2780. 2781. untenable, with the accompanying order that the same shall therefore be struck out in the minutes of the aforesaid Council under both those dates, and this ruling of their Right Excellencies noted in the margin thereof. That furthermore, by the Independent Fiscal of this government, Mr. Johan Nicolaas Steeven van Lynden, there shall be refunded to the person of Jan Smit of Dilburg, his authorized agents, or heirs, all that was received by him on account of the aforesaid settlement; and in view of the impossibility of fulfilling the sentence of the Council of Justice insofar as the aforementioned Smit was thereby condemned to a confinement of five consecutive years on Robben Island; that the aforementioned Smit of Dilburg shall immediately be brought to Robben Island, to remain confined there until the expiration of the aforesaid confinement, which will be at the end of five consecutive years, counting from the day of the pronunciation of the often-mentioned sentence, and that the further contents of the same sentence, concerning the banishment of the aforesaid Smit of Dilburg for the duration of his life from this country and the jurisdiction thereof, shall subsequently be strictly executed, and that after the expiration of his confinement on Robben Island, the said Smit shall be banished from this country and the jurisdiction thereof; in order that this matter may thereby be settled, while their Right Excellencies shall give notice thereof to the High Government of India, to the end that the original documents belonging to the aforesaid proceedings may be sent back here by them: thus it was resolved to give the required notification of all the aforesaid to the Council of Justice aforesaid by an extract of this resolution, in order to enable them to carry it out to the letter.

Reading of a report submitted by the Church Council of the Reformed congregation concerning the petition presented to this Council by the Church Council of the Lutheran congregation. proper compliance with the aforesaid orders of the Lords Commissioners-General (the prompt execution whereof in its entire context is hereby most seriously recommended and assigned to them) to be able to ensure, and further, for their further and complete information, to have attached thereto an authenticated copy of the very revered missive of their said High Mightinesses, so that, it being evident to them thereby how through their transgression in this matter the laws have been impeded in their operation, justice compromised in its esteem, and the high authority violated in its power, they—as they are also hereby most emphatically recommended to do upon express command of their said High Mightinesses and in the names of the very same—shall take careful heed for the future to guard against similar acts, and to watch over the enforcement of justice and the preservation of the High Authority with such care and attention as their duty demands of them, and as they may hereafter one day answer for before a Higher Judge. Right Honorable Sir and Honorable Sirs! To the Right Honorable Sir, Johannes Isaac Rhenius, Governor of this Government, together with the Honorable Council of Policy. The Church Council of the Reformed congregation, pursuant to and in compliance with what was required of it by the Resolution of the 28th of August past, having submitted its Report and Considerations on the Petition presented on the same day by the Church Council of the Lutheran congregation; and the aforesaid Report, upon reading, having been found to be of the following tenor: To 2784 2785. A certain petition having been placed into the hands of the Reformed Church Council of this town pursuant to Your Right Honorable's revered resolution of the 28th of August past, which was presented to Your Right Honorable by the Church Council of the Lutheran congregation, in order to serve with considerations and advice thereon. In dutiful compliance with that resolution, the Church Council of the Reformed congregation has the honor respectfully to submit to Your Right Honorable that it appears to it that the request made in the aforementioned petition by the Church Council adhering to the Augsburg Confession rests upon a foundation that is very loose, and can give not the least stability to that which is built upon it. For they seem to assume as indisputable that they, as well as we, have the freedom to accept as members of their congregation those who have been released from slavery, and that is precisely something whereof we not only doubt, but maintain on good grounds that they thereby violate the conditions upon which the free exercise of their religion was granted to them in this Colony, and far exceed the boundaries marked out for them. When this privilege, which they now enjoy so undisturbed, was favorably granted to them, it was the explicit wish of our Right Honorable Grand Worshipful Lords Masters, the Assembly of Seventeen, that they should enjoy this privilege on the same footing and under the same stipulations as their co-religionists in Batavia, whereto the successive Resolutions of the High Indian Government were also delivered to them early on for information and observance, and they were repeatedly instructed to conduct themselves strictly according to the same. 2786. 2787. Now these Resolutions of the High Indian Government expressly forbid those of the Augsburg Confession to make proselytes outside the households of the confessors of Lutheranism, according to the resolution of the 6th of December 1754, and further confirmed upon the remonstrance made against it by the Church Council in Batavia by resolution of the Governor-General and Council of the Dutch East Indies, by Resolution of the 31st of December 1754, wherein it is stated in so many words—that with regard to the prohibition against making proselytes, the Government fully persists in what was resolved on the 6th of this month, until such time as regarding that delicate and fundamentally contested point the decision of the Lord Superiors shall have been obtained; whereafter there also followed the decision of the Lord Superiors, which completely approved and ratified the Resolution of the Lords of the High Table, as appears from the content of the Missive from the Mother Country, dated the 4th of October 1756, wherein Their Right Honorable Grand Worships express themselves on that subject as follows: "There remains only the dispute between the Reformed and Lutheran Church Councils, concerning which we shall now mention for the information of the said Church Council that, after examination and consideration of all the submitted Memoranda and Reports, having found no reasons to make any change in Your Right Honorable's resolution of the 31st of December, since not the least prejudice or detriment has thereby been caused to the freedom of religion or any other privileges that we have granted to those of the Augsburg Confession, we consequently conform with Your Right Honorable's aforementioned resolution of the 31st of December."

aforesaid, and recommend the last-mentioned Church Council not only to conduct themselves accordingly with due obedience, etc., etc. That now the baptizing and the admitting to membership of such persons who, whether freeborn or having been serfs, have lived outside Christendom, belongs to the making of proselytes, is so clear and plain that it would be superfluous to seek to substantiate it further. And even if one wished to consider the serfs of those who profess the Augsburg Confession, in a broad sense, as belonging to their households, this nevertheless ceases as soon as they are set at liberty; they then no longer belong to their households and therefore belong to a class from which the making of proselytes is forbidden to the Lutheran Church Council, this being a privilege of the predominant religion, in which indeed there is not the slightest hardship or appearance of coercion of conscience, the more so since we trust that the Lutheran Church Council will not readily wish to maintain that this sort of proselytes, from a true conviction of mind and after impartial examinations of the truth, would choose the confession of one rather than the other Protestant church communion. Nor could one, to assert the contrary, appeal to a convention made between us and the Lutheran Church Council, by the second article of which the admitting of manumitted serfs as members seems to be granted to them; for the entire force of this apparent proof lapses when one notes that this convention was concluded on 23 Jan 1781, and thus at a time when the successive orders and resolutions of the High Indian Government taken on that subject were still unknown to us, of which no copy was delivered to us until 24 October 1782. But it goes without saying that a convention established between two private Church Councils cannot possibly invalidate the decisions enacted by the High Government and approved and confirmed by the Gentlemen Majors, which have been prescribed to both Church Councils for observance. Equally unfounded is the second request which those of the Augsburg Confession present to Your Right Worships, when they seek to withdraw themselves from providing maintenance to those who, being old and indigent, declare that they adhere to the Lutheran religion and therefore apply to them for alimony, solely on the ground that they can produce no attestation. But who does not know that most of that sort of people came out either as soldiers or sailors, which kind generally, upon their departure from Europe, give little thought to providing themselves with a church attestation, and who subsequently also lack the opportunity to obtain the same? And what motives would these people have, if it were not true, for giving themselves out here in this country as Lutheran rather than Reformed? Could it sometimes be because those of the Lutheran congregation are accustomed to provide for their poor more generously than we provide for ours? This, we trust, no one will dare to maintain, and an investigation can endure much; but moreover, was the Lutheran Church Council also so scrupulous when they formed a list of their contributing members, so as to place no one upon it other than those who could show an attestation? We doubt very much whether they will be able or willing to declare this in good conscience. Or do those who are regarded as contributing members of the congregation deserve more credit than those whose indigent circumstances disable them from giving anything, but rather necessity compels to apply to them for charitable gifts? The ungenerous, we had almost said the ungrateful, nature of this part of the request of the Lutheran Church Council grieves us, since they seem to have completely forgotten how our congregation, for so many years before those of the Augsburg Confession had obtained the public exercise of their religion, maintained their poor on the same footing and with the same charitable generosity as our own. For which and other reasons, not now cited from fear of not abusing Your Right Worships' attention by extensive deductions, we believe we may respectfully supplicate on good grounds that it may favorably please Your Right Worships to reject both the one and the other request of the Church Council of the congregation adhering to the Augsburg Confession, and seriously to enjoin them to content themselves with the free exercise of their religion granted to them, without wishing to make an infringement, in a more or less covert manner, upon the equitable prerogatives of the ruling religion, or seeking to draw to themselves any of our Diaconate revenues, or

will only be able to entice interested parties to an acceptable bid, and that for the security of the promised total purchase monies, two sufficient sureties to the satisfaction of this Government shall be furnished immediately by the buyer, provided furthermore that, either by himself or by his aforesaid sureties, a sufficient mortgage must be provided for the last three installments; that the aforesaid ships are also sold in their large and small extent, as the Helena Louiza of them is lying in this Roads and the Zeenimph in the Baayfals, together with all the goods entered on the inventory, as and in that state in which they are found, without wanting to be held liable in any way for the greater or lesser size of the ship, lengths, thickness, and qualities of the tools, or whether the sails might be bitten by rats, or if other defects arise in any item, since every interested party shall have the freedom immediately after the posting of the advertisements daily, up to the moment of the sale, to take proper inspection of everything; That the conveyance shall be executed upon the satisfaction of the first installment of the purchase monies, which must be accomplished within the period of six weeks at the latest, counting from the day of the sale, as free property against free money, but the ship, with all that is sold with it, immediately after the sale remains lying at the profit and loss of the buyer, and this under the obligation of the buyer and sureties of their persons and property according to law. That further the buyer shall be obligated to take over the ship, with all that is sold with it, at the first order of the Gentleman Commander from such a commission of Sea Captains as shall be nominated and appointed by His Honour for that purpose; and finally, that whenever the buyer should not find himself in a position for lack of crew to man the ship at the earliest opportunity, upon his request the necessary orders shall be issued by the well-aforementioned Commander to allow to remain thereon for the period of eight days a non-commissioned officer and as many sailors as shall be necessary to guard the ship for that long, provided the same are supplied during that intervening time by the buyer with the necessary sustenance. That subsequently a copy of these conditions along with the inventory shall be placed for reading with the first Messenger of this Council, Johannes de Clercq, which conditions and inventory the interested parties there will and may not only read and examine, but if desired also copy for their speculation; that the public sale of the Helena Louisa being determined, as the same is determined by these presents, for coming Tuesday the 6th instant, and that of the Zeenimph on Friday the 9th thereafter, the same sale shall occur before the full Council by ascending and descending bid; the opening bid of the first-mentioned vessel will be done on a premium of fifteen silver Ducatons, and that of the last-mentioned vessel on a premium of 6 like Ducatons, which the Gentleman Cashier is qualified by these presents to pay out for that purpose. And that finally, the sale having taken effect, the conveyance and transfer of both of the same vessels to the respective buyers shall be executed by two Members to be deputed from this Council; which Members shall be requested therewith, as they are requested by these presents, to supervise and ensure that, simultaneously when receiving the aforesaid conveyance, there shall be executed by the mentioned buyers on behalf of the Honourable Company the acknowledgments of debt in the form of aldermen's deeds on written stamped paper of such size as is customary to use in proportion to the promised sums for fixed assets. According to the extract of this. having taken note of the considerations supplied by this Government on date 16th of the present month on the same request to their aforementioned High Nobilities, have seen fit to grant to the aforementioned Pehrsen his request to be permitted to continue making use of the aforementioned four shallops for whale fishing with small vessels, without it being understood that he has thereby contravened the contents of the 2nd Article of the Regulations on the fishery with small craft in Table Bay and False Bay, with authority granted to this Council, in accordance with their proposal made by the aforementioned dispatch of the 16th of this month, to alter the 5th Article of the same Regulations in such manner as was further presented therein; And that their aforementioned High Nobilities, to remove the difficulty that has presented itself in the execution of the 35th Article of the general Edict regarding the carcasses of dead fish, have furthermore been pleased to decree that those who shall carry out the whale fishery pursuant to the same Edict may suffice by having the carcasses of dead fish towed outside the Bays, without being obliged to cause them to sink, as appears from the Publication enacted thereof and likewise annexed to the aforementioned dispatch; while by all this, the further requests made by the aforementioned Pehrsen in his aforementioned petition are held to be lapsed: So it is understood that initially the Fiscal's office will be informed of this disposal of their High Nobilities, of which the petitioner has already been directly informed by their High Nobilities, by Extract of this, notice shall be given to the ad interim Fiscal, Mr. Jacob Pieter Deneys, in order to serve for his information and guidance; that furthermore, immediately regarding the contents of the fifth article of the Regulations on the whale fishery with small vessels, both here 2842. 2844. With further approval of the Council's decision taken on a petition submitted by various cattle-breeding inhabitants to be exempt from the payment of their due recognition moneys on their loan places. it appeared; that since from the respectful letters which this Council had taken the liberty to address to Their High Mightinesses on the 16th previously, together with the attached separate advice of Colonel Gordon, it had become evident to the same that they were unanimously of the opinion that the Landdrost of Graaff Reinet, Mauritz Herman Otto Woeke, was entirely unsuitable for that post, well-mentioned Their High Mightinesses had therefore judged it advisable to qualify this Government to discharge him, Woeke, from that office, as soon as there should be an opportunity to replace him with a suitable person for that purpose, for which, however, the Secretary of the same Colony, Maynier, could not come into consideration, on account of the numerous and very serious accusations also brought against him, at least not so long as he should not have completely cleared himself of the same accusations; wherefore Their High Mightinesses then also approve the decision taken by this Council, whereby the ad interim Fiscal is ordered to conduct the required investigation into those accusations; and that the most honorable Lords Commissioners-General had further seen fit to also approve the Council's resolution taken on the 13th of September of the past year on a petition of some residents of the aforesaid Colony of Graaff Reinet, tending to be exempt from paying the due recognition moneys on the cattle places held by them on loan, being of the same opinion as this Government that the outcome of the measures taken against the robbery and murder by the Bushmen Hottentots ought to be awaited before deciding on the aforesaid petition. Wherefore Their more-mentioned High Mightinesses at the same time left it to the Council, when that outcome should be known, to then act in that regard in such a manner as would most accord with equity and a lawful observance of the Company's interests. 2848. Wherefore with regard to that petition in the future, such use will be made of Their Honors' granted qualification as the circumstances of matters shall come to require. And in the meantime proceed to the discharge of the said Landdrost Woeke as well as to the refilling of the office of Landdrost. Your Right Honorable and Honorable Sirs having been pleased to charge the undersigned members of the Council of Policy with the commission to cause to appear before them all Company servants discharged from pay and relieved of duty, in order, assisted by the Pay Bookkeeper Clement Matthiessen, to review and nominate from among them those persons who could conveniently be taken back into service, so that those who have not served out their contracted term may be forwarded to Batavia; while those whose contract might be found to have expired could successively be employed to man both the currently present and the still expected return ships; Thus, insofar as concerns those who have resided under the Cape district and presented themselves before the commission the day before yesterday and yesterday, the undersigned have separated the men therefrom and formed those lists from them which the latter now have the honor to offer herewith to Your Right Honorable Sirs. Furthermore, since at this general muster there have also appeared before the eyes of the undersigned people who, owing to advanced age and physical defects, are totally incapable of performing any further service for the Company, as can be seen from the lists No. 2, 5, 8, 11; as well as those who are married here and may also be regarded as necessary subjects in the Colony, as appears from the lists No. 1, 4, 7, and 10; the undersigned therefore take the liberty to submit for the consideration of Your Right Honorable Sirs whether it would not be in accordance with equity and with the Company's interest that, on behalf of the Government, it be proposed to Their High Excellencies the High Honorable Commissioners-General that the persons rendered totally incapable of performing any service through advanced age and physical defects be placed generally off the payroll without their being required to pay anything for their further residence here; and the remainder, namely the married and subjects necessary for the Colony, besides all likewise being placed under discharged pay, be additionally charged with the payment of such amounts in proportion to their performed services as the undersigned have further and distinctly determined and stated in the aforesaid lists No. 1, 4, 7, 10. As the undersigned have appointed all the persons who have already presented themselves to appear further before them tomorrow, in order to make known to them the decision of Your Right Honorable Sirs upon obtained approval of Their High Excellencies the High Honorable Commissioners-General and upon the proposals made to that end by the undersigned; the undersigned therefore request, if possible, to be provided and honored today with a further resolution in that regard. It is in expectation of the same that the undersigned meanwhile conclude this their report herewith, letting it otherwise serve as proof of their proceedings. 2856. 2857. regarding those recalled into service, they shall be placed on the Line and there credited with their wages, board money, and rations starting on 15 December next, to be forwarded both to the Fatherland and to the Indies. But on the other hand, those who find themselves noted on Lists No. 2, 5, 8, and 11 as being people from whom the Company, on account of their advanced age or physical corruptions, can no longer draw any benefit, and likewise those who are mentioned on Lists Nos. 4, 7, and 10, who are either married here or must be regarded as useful subjects for the Colony, are all together to be placed on discharged pay. With this distinction, however: that whereas this favor is granted gratis to the aforementioned aged and crippled on account of their incapacity to perform any service, the remaining persons named on the four last-mentioned Lists, under penalty of otherwise being deprived of the effect of this disposition and also being recalled into service and sent away, shall have to raise and pay to the Honorable Company within the space of one month dating from today, for its indemnification, a certain recognition fee. For those who, before being discharged from pay or levied, had served out their bound term, this shall be in the amount of such sum as they would have enjoyed in the space of four months according to the rate of pay for which each of them last served, and for those who had not served out their bound term, One Hundred and Fifty Guilders Holland Courant, alongside two similar months of pay as just mentioned. Following which, the care and supervision over the aforementioned persons recalled into service, whose wages, board money, and rations shall then also have to begin to take course anew, reckoning from the 15th of December, was in the first place committed to the Regents of the Line, and under Their Honors subsequently to the Captain Engineer Thibault. 2858. 2859. On the other hand, the discharged persons, provided that within the space of one month they pay the recognition fees imposed on them, shall be left to themselves. Meanwhile, regarding those who have been out on loan, before they may make use of this liberty, there shall first have to be paid what they are in arrears for neglecting the extension of their levy. Provided that they observe the stipulations imposed on them by the Honorable Commissioners-General and ordered, arrested, and established by the Council's resolution of the 27th of October last, of which an ordinance written on a stamp of 48 sts. shall be issued to each of them for their information, and provided that they pay the recognition fee imposed on them within the time of one Month determined hereinbefore, all those placed on discharged pay shall be and remain left to themselves, in order that, having returned from where they presented themselves, they may again pursue their profession, trade, or craft as before, and sustain themselves thereby. However, seeing that through the neglect committed for some time properly to request again, after the expiration of each year, the extension of the obtained permission for the levy of the Company's servants, and on that occasion to have the ordinance required for that purpose and likewise the contract executed between the borrower and the person levied renewed, most of the aforementioned persons, insofar as they had been out on loan, are several years in arrears regarding the stamp duty due to the Honorable Company for the aforementioned matter; and it is certain that if on this occasion one were not concerned with ensuring the payment of these arrears, the said arrears would then surely be completely lost to the Company; it is likewise resolved that before the persons who had been thus levied shall be sent away from here, or rather be allowed to devote themselves to their former profession as was just said, the aforementioned arrears shall have to be paid completely, either by themselves or by the person with whom they have been out on loan.

2860. 2861. and should the satisfaction of the aforementioned recognition not take place within the term of one month, a report thereof shall be made. Meanwhile, the receipt and accounting of the frequently cited recognition shall be carried out by the pay bookkeeper, and this settlement, as well as that of any Company servants, must be observed besides the aforementioned. To which end the servants at the political secretariat shall be ordered to pay attention thereto, and in case the actual performance of those arrears should not occur within the aforesaid time of one month, stipulated for the payment of the recognition described hereinbefore, then to submit a report thereof, so that this Council may further dispose in this regard as shall be found proper; while furthermore it has been approved and established that from now on, whenever on the terms and conditions described more fully in the hereinbefore cited Resolution of 27th October last the release of any Company servant shall be granted, there shall be handed to both the person who is leased out and the person into whose service he enters, to each a copy of the orders and stipulations enacted on this point, written on 24 sts stamped paper. The Pay Bookkeeper is hereby qualified and ordered to receive, from all such persons as are obligated in the aforesaid manner to make any payments to the Honourable Company for obtaining permission to remain here with written-off pay, such monies as each of them shall have to pay according to the provisions stipulated hereby, in order, upon the expiration of the fixed term, subsequently to submit a general and specific list thereof to this Council, in order then to transfer the same monies into the treasury of the Honourable Company upon written warrant of the Lord Commander. Meanwhile, into the Company's small cash fund shall also be received the postage monies collected during the past month for the delivered letters. And finally, upon a submitted account of the postage monies that were collected in the recently expired month of October for the delivered letters brought here from the Motherland, and from which it appears that during the same month of October a sum of Eight Rixdollars and forty-four Stivers was received, it was decided to have the aforesaid amount of 8 rd-s and 44 stivers transferred into the Company's treasury. Upon the communication thereof being made to the Council, the same was not only fully approved, but it was also decided to observe all such precautionary measures against the infection as were observed regarding the ship L'aimable Josephine. The former Burgher Councillor shall, under observation of the alongside-mentioned conditions and stipulations, be permitted to provide the required refreshments and other necessities. Then, as it is necessary that the said vessel be brought into a condition to proceed on its voyage as soon as possible, very dreaded children's disease might be concealed, having immediately prevented all communication between the said French vessel and the shore, as well as with the other ships lying in the roads, by posting a fire watch and establishing the other usual orders; Thus, upon the communication of the aforesaid measures put into effect to prevent the transmission of both the aforementioned ailments as much as possible, given by order of the often-mentioned Lord Commander to the other gentlemen members, it was understood by the same to approve in every respect that which was performed in this matter by the just-mentioned Lord Commander. Since that keel at the bidding did not yield more than the meager sum of ƒ 10000: His Honour, being qualified and instructed as mentioned aside by the Lords Commissioners General, The same was put up again, and was held back by the Lord Commander at the knockdown for ƒ 14000:-, as it was not able to fetch that amount. — Tuesday the 6th of November 1792, in the morning, all present. Today being the day appointed by resolution of the 31st of October last for the public sale of the Company's brigantine vessel the Helena Louisa, and the interested buyers having therefore assembled before the Council Chamber, immediately after the resumption of the resolutions taken from the 28th ultimo up to and including the 3rd of this month, the doors of the aforementioned Council Chamber were opened and the conditions of sale were read at the entrance thereof. — The ship being thereupon auctioned at the bidding, and the Burgher Fire Master Jan Casper Loos remaining the buyer of the same for the meager sum of ten thousand Guilders, it pleased the Lord Commander to report this in person to the Lords Commissioners General, and to request their highest orders as to how low one might allow the said keel to go down at the knockdown. The aforementioned Lord Commander, having carried out the aforesaid commission which His Honour had kindly taken upon himself, returned to the Council armed with Their High Honours' orders, and the previously cited vessel being then put up once again and knocked down to the sum of fourteen thousand Guilders, the same was withheld at the aforementioned price by His Honour, and the assembled interested buyers were thanked and dismissed until next Friday the 9th of this month, when the Zeenimph will also be offered for sale. After which the doors were closed again, and the aforementioned Lord Commander informed the remaining Gentlemen Members that he had received instructions from the Lords Commissioners General that, once the knockdown came down to ƒ 14000:-, he was to stop it and withhold the ship for the Honourable Company, as had now been done. — 2874. 2875. Disposition of the Lords Commissioners General on the requests of the Landdrosts of Stellenbosch and Swellendam for an improvement of the indemnity granted to them for the maintenance of the horses of their subordinate orderly riders. And the Lord Commander was thereupon greatly thanked for the aforesaid communication made, and it was likewise resolved to await in all deference such further disposition as Their High Honours shall see fit to take regarding the so often mentioned vessel the Helena Louisa. 2876. 2877. thereby leaving to the option of the one of Zwellendam the use of the place called the diptka, without payment of recognition fee with retention of the present allowance in money, or indeed the usufruct of the aforementioned hospital without the aforementioned allowance. And if he should prefer the deptka with the monetary compensation, then Stellenbosch the preservation of the rd: 275: – or the usufruct of the aforementioned place the hospital. With orders that, in case the choice of neither of these landdrosts should settle upon the use of the hospital, to rent out the same place publicly to the highest bidder, provided he declares himself on this matter within fourteen days after this disposition of Their High Excellencies shall have come to his knowledge, that either to him, besides the rds 275: - annually without recognition fee, is left the use of the place the Deptka, or that to him is given the use of the Place the Hospital, provided that in the latter case he waives both the aforesaid sum of Rd=s 275:— annually and the remission of the recognition fee of the aforesaid place the diptka; while the choice to be made by the aforesaid Landdrost subsequently must serve as a cynosure for all his successors in time, and consequently whether the place the Diptka with an annual compensation of Rd=s 275:— or the place the hospital without any monetary compensation shall forever be attached to the Landdrostship of Zwellendam. And Their High Excellencies having also been pleased to determine that if the aforementioned Landdrost Faure might prefer the enjoyment of the Rd=s 275:— with the use of the place the diptka, also leaving to the choice of the one currently enjoyed by him, then likewise it shall be left to the choice of the Landdrost of Stellenbosch and Drakenstein /:provided he also declares himself within the period of Fourteen days:/ either to continue enjoying the Rds 275:- a year assigned to him, or to have the use of the aforesaid place the hospital, provided in the latter case he waives the aforementioned allowance in money, and that furthermore the choice to be made in this shall also serve as a fixed cynosure for those who in time shall hold the post of Landdrost of Stellenbosch and Drakenstein. And with regard to the measures taken by this Council to reduce certain posts and offices, having received the approval of the Gentlemen Commissioners-General, upon promotion or discharge of the first sworn clerk Goetz the post of shopkeeper shall be amortized and the payments in small coin shall be assigned to the examiner of salaries on such terms as this Council shall deem most advantageous for the Honorable Company, for which the same is in that case authorized. It has been understood that, in order to proceed according to order in this matter, it shall immediately be required by letter from the Landdrost of Zwellendam Anthonij Alexander Faure to decide on the choice to be made within the aforesaid set period of Fourteen days after receipt of the Council's letter to him, and to send in his reply thereto; the receipt of which will then be awaited before doing anything further or more in this matter.
