The Lord President, having asked the Officer what he had to charge against the said Citizen Lodewijk Beck, answered and said, that during the firing, it was said to him, the Officer, by Corporal Bandjes, be careful, Sir, someone is loading from a powder horn there, without naming anyone, upon which Citizen Lodewyk Beck immediately turned around and sharply said to Corporal Bandjes, it is none of your business, and who ordered you to look after that, whereafter I, the Officer, immediately took the floor and told him, Beck, that no one had ordered Corporal Bandjes, but that it was his duty to do so, and I ordered him to desist from it, in order to prevent all disasters that might result from it, both for the defendant himself and for his fellow citizens; whereupon he answered very hot-headedly, careful, Sir, and I ordered him, Beck, for the second time, telling him that I had no need to use caution, whereupon the defendant said to him for the second time, careful, Sir, then I ordered him to be quiet, that we would speak to each other further, upon which he remained silent until we came below on the Square by the Guardhouse, and I then gently took him by his coat and said, come, Beck, now you must go to the Captain, then he answered me, must is compulsion and crying is children's song; whereupon I asked him, what? is must compulsion and crying children's song, he answered me again, must is compulsion and crying children's song, and she can do nothing to me, and if she wants to have me, you can send me the Messenger; whereupon I made a Report to my Captain of what occurred, requesting satisfaction; The said Citizen Beck, having heard the accusations brought against him, and being asked by the Lord President what he had to bring against this; so the defendant, being drunk, was very indecent and brought forward nothing but confused and virtually meaningless excuses, and said, Mr. Gie must first leave the meeting before I will speak, the said Officer then stepped out of the meeting, into another separate room, although it was not yet so far that the meeting would deliberate on the accusation laid to the charge of him, the defendant; whereupon the said Citizen Bek in no way denied what had occurred, both with regard to the powder horn, and concerning Corporal Bandjes, and the words spoken against his Officer, but added thereto, that the Officer had said to him, the defendant, here he had pulled him by the chest on his coat, so that it was torn thereby, pretending at the same time not to have known that there would be firing, and therefore had sent home for powder, whereupon the said Powder Horn was sent to him. The defendant standing outside, the aforementioned Officer was called inside and having taken his place, the Lord President presented to him, the Officer, the accusations that he, Beck, had brought against him, the Officer, whereupon the said Officer entirely denied this assertion of the said Beck, declaring that he well knew what was due to a Citizen and how one ought to treat them. Proceeding to the deliberation hereof, Second Lieutenant Gie first absented himself from the meeting, and went again to the abovementioned room, at which time the Council judged that the defendant had gravely offended against his Officer and the meeting was moreover insulted that he, the defendant, had dared to undertake to appear here before the Lord President and further Members being drunk, and the Council, after ripe consideration, in order to preserve good order and to prevent further brutalities, has decided to sentence the defendant Lodewyjk Beck to be placed in the Citizen Gaol for eight days on water and bread, and subsequently to ask forgiveness from his Officer, the Second Lieutenant Gie, in the presence of the Guard; Upon the execution of this sentence passed against him, the said Beck, whose bad character has likewise already many times become known, behaved very brutally, refusing to submit himself thereto, so that the council was forced to have him transported from the meeting room to the said Citizen Gaol by some Men of the guard, on which occasion he behaved very brutally with scolding and raging, saying to the sergeant of the Guard Bouwmeester that he was not worthy to wear the uniform, asking, who made you sergeant, he who made you it will have to answer for it on the last day, and it shall be damned if she can get me arrested with the dismissed Hottentots, for I will fist them so that they will have their pleasure of it, and to the Corporal of the guard Bandjes, saying in passing, he too wears a sidearm, but it is not due to him, and to Corporal Cornelis de Kok who was present off duty, he who made you Corporal will not be able to answer for it before God, for the reason that you are worse than my shoe, and to four men of the guard, that he did not want to have anything to do with black Boys or Hottentots, all of which named persons have addressed themselves with complaints to this meeting in this regard. From which, to the scandal of the public, the insolent and punishable conduct maintained by the burgher L: Bek toward that College and other burghers has become apparent. Consequently, it is resolved to place the said Bek into the hands of the Fiscal Office in order to proceed accordingly. Administrator and the Honorable Council of Policy, and to leave the rest to the disposition of their Honors. Below stood: Agrees. Was signed: C. P. Slotsboo, secretary. Thus, whereas from the contents of both the aforementioned documents it has appeared, to the extraordinary annoyance and dismay of this Council, that the said Council of War, provoked by the unprecedentedly insolent and most highly punishable conduct of the burgher Lodewijk Bek in showing a marked contempt for a College before which he found himself summoned to give an account of offenses committed in the burgher service, and the cognizance and punishment of which fell within its jurisdiction; as well as demonstrated by insulting, scolding, and applying abusive expressions and names to and against various non-commissioned officers and militia members on guard duty on that occasion, judged it necessary to bring the incident concerning the said Lodewyk Beck to the attention of this Council on the aforesaid day, to the end that such measures be taken in this regard as deemed appropriate for the maintenance of the respect owed by burghers in matters concerning the service to the Council of War, and at the same time that the petulance of the aforementioned Beck may be suitably reprimanded as an example to other such dangerous subjects; it is therefore resolved to place the said burgher Beck, as is done hereby, into the hands of the acting Fiscal of this Government, Mr. Jacob Pieter Deneys, with orders to the aforesaid Fiscal immediately to proceed against him according to the utmost rigor of the laws. It is, in addition to the said reasons, resolved provisionally to suspend the payment of the purchase price of the goods brought here by him with that vessel. The acting fiscal Deneijs having handed over to the Administrator the extraction from the Civil Court Roll mentioned here beside. It being considered that these proceedings might eventually be followed by the confiscation of all such goods as were loaded for the account of the aforementioned Wehmyer on the said ship Macasser, and are more fully described in the resolution of 12 October last, as well as 30 ditto thereafter; it was approved and understood provisionally to suspend the payment, ordered in the last-mentioned resolution, of the purchase price of those articles from the mentioned goods which were seized and taken over for the benefit of the Honorable Company. General Lessee Sebastiaan Rothman, in settlement of the first installment or half of his lease monies owed to the Honorable Company, concerning which the judicial sale took place on 30 June and 6 July last, and according to which account the first installment of those lease monies in the amount of Rds 15000: — shall be satisfied in this manner: 1. With the mortgage bond of Citizen Godfried Fredrik Smitsdorf, for the two final installments of the purchase monies of the judicially liquidated house and plot, these installments amounting to f 11332: or Rds 3777: 16: — From which is deducted the interest running before the maturity of the installments, as they fall due only on the ultimate of July 1793/4: 339: 46. So that this mortgage bond still remains in real value: 3437: 18. 2. And in cash monies: f 11562: 30. Totalling as above: Rds 15000: — This account having been further examined by the Council and found to be in order, it was simultaneously made known by the Secretary, as sequestrator, that he found himself unable to bring into the Company's treasury at present the full amount of Rds 11562: 30: — in cash specified in that account, because, apart from the auction monies still in arrears on account of the aforesaid sale, which according to a specific list submitted by him at the same time amount to Rds 4581: 24: — which he nonetheless believed he would be able to collect shortly, he has nevertheless had to take legal action against Citizen Godfried Fredrik Smitsdorff, who bid in the house and plot sold from the estate of the mentioned Rothman in three installments for the sum of f 17000: —, both for the payment of the first installment amounting to Rds 1889: 16, and for a sum of Rds 645: 36 which the said Smitsdorff, having purchased movable goods there, remained indebted for and which is included in the aforementioned Rds 11562: 30: —, so that he is now even forced, as neither the mentioned Smitsdorff nor those who stood as sureties for him are able to provide cash due to the prevailing scarcity of money, to sell the same house again by execution; requesting therefore that it may please the Council to instruct him how to conduct himself in this matter as sequestrator. With an urgent request to obtain the Council's approval for the arrangement made therein. Whereupon, having deliberated and taken into consideration the incidental circumstances that occur in this matter, and which thus make it impossible for now to pay into the Company's treasury the above-mentioned first installment and auction monies charged to Smitsdorff, amounting together to a sum of Rds 2535: 4: —, it was resolved to authorize the Secretary to transfer provisionally into the Company's treasury, on an order to be requested according to custom from the Honorable and Worshipful Lord Commander, the sum of Rds 9027: 26 in reduction of the aforesaid sum of Rds 11562: 30, and to pay the remainder of the cash as soon as the aforesaid execution against Smitsdorff shall have been completed. And furthermore, Mr. Jacob Pieter Deneys, the pro-interim Fiscal, who in this matter has directed the execution of Lessee Rothman as officer, was instructed to request the approval of the Honorable and Worshipful Lord Commander and the Honorable and Worshipful Council of Policy for the aforesaid provisional arrangement made. And the said ad-interim Fiscal, pursuant to and in fulfillment of what was assigned to him at the end of the aforesaid disposition, having moreover most urgently requested the said Lord Commander that, through His Honor's favorable intercession with this Council, the approval of the resolution described more fully therein might be effected; So it is, upon the favorable proposal of the aforementioned Lord Commander, and Concurred. Thus, for the plausible reasons upon which the Council of Justice has come to base its disposition in this matter, it has been agreed to approve the manner in which it will be brought forth from the proceeds of the goods of the general leaseholder Rothman. While the Lord Commander is requested to issue the necessary warrant to the cashier in the meantime to receive the adjacent sum from the sequestrator. Submitted by the Commissioners from the Council of Justice, to ensure that the payment of what the Company has yet to claim from the said Rothman by way of remainder shall take place promptly. Before being able to do this with solid grounds, the Commissioners appointed two members from among themselves to go and inspect the aforesaid piece of land; but shortly after this commission was assigned to them, they reported that as soon as it had appeared to them from the Extract Resolution roughly where this land requested by him, Hoffman, was situated, they had immediately felt within themselves the impossibility of being able to deliver a report in favor of him, Hoffman, since the granting of the same as well as of other parts of land thereabouts, and generally situated on the Leeuwenbil, must always tend to the notable disadvantage of the public; with which views the Commissioners must fully conform, since after all not only the country people who come toward the Cape with their produce, but also the inhabitants of this settlement itself have no other than merely this field left for the grazing of their cattle. That meanwhile, since it appears from the further contents of that report that the granting of the piece of land requested in ownership by the sub-lieutenant of the Burgher militia Matthiam Hofman, more fully described in the Council's resolution taken under the 7th of September last, as well as in general that of all other parts of land situated at the Leeuwenberg, would always tend to the noticeable disadvantage of the public, considering that not only the country people who come toward the Cape with their produce, but also the inhabitants of this district itself have nothing other than merely this field left for the grazing of their cattle, therefore, neither this nor any other piece of land situated at the Leeuwenberg toward the seashore shall now or ever in the future be granted to anyone, whoever he may be. And that lastly, for the reasons presented for it, having approved the arrangement provisionally drafted by Commissioners to have the fire engines always maintained in good condition against payment of a specified sum of sixty rixdollars a year by the burgher Johannes Visscher and in case of his indisposition or absence by his son, as he also possesses the required skills for this, and to be able to be used immediately upon the discovery of fire with the greatest effect, the Commissioners shall consequently be authorized, as they are hereby authorized, to conclude the agreement to be made by them in this regard with the aforementioned Visscher, and to bring it to completion as soon as possible, so that in case of unexpected fire accidents the beneficial effect thereof may be experienced. And whereas from a missive written on the 5th of this month by the Board of Landdrost and Heemraden of Stellenbosch and Drakenstein to this Government, which was furthermore read aloud, it has appeared that in compliance with the Council's decisions taken under dates of the 27th of April and the 27th of August of the current year, the piece of land requested in ownership by the burgher Stephanus Jacobse situated behind the Stexe Rivier around the Bokke Rivier having been inspected by commissioners from the aforesaid Board, as well as the strip of land cultivated and planted by the former Heemraad Gerhardus Hendrik Munnik, and likewise requested to be measured into his residence situated near the first river, the same commissioners have found that both could be granted without prejudice to anyone. 3004. 3005. It was resolved to grant the requested pieces of land in ownership to the applicants mentioned beside against payment of the recognitions determined therefor. The Lord Gezaghebber has declared thereupon that the documents required for the summoning of the person of Joachim Fredrik Schultze, named in that representation, were not found in the envelope of the missive which served as the cover for the summons received. Wherefore it was resolved by the council to have the writ of summons of the aforementioned Schultze served as it stands. And the Lord Gezaghebber with regard to the annexes relative to the summons upon the person of Joachim Fredrik Schultze, of which broader mention was made in the aforementioned representation, having been pleased to declare that at the opening of the missives, written hither both by Mr. Gregory, agent of the King of Prussia at Amsterdam, and by His Majesty's court of justice at Stendal, and dealt with by resolution of the 25th of the recently passed month of October, which opening took place in the presence of the Lords Commissioners-General, because the strange superscription of those letters had given rise to the suspicion that they might at times be addressed to Their High Right Noblenesses themselves, the aforementioned documents were not found in the envelope of the latter-mentioned missive, which, enclosed under flying seal in the first-mentioned letter, had arrived. Thus, since from this declaration of the well-mentioned Lord Gezaghebber there now appears not only the reason why the cited attachments could not be forwarded to the Council of Justice alongside the summons to which they pertain, on the occasion when under the aforesaid 25th of October this latter-mentioned document was sent to them to make the required use thereof, but also the impossibility in which one still finds oneself to supply the aforesaid documents to the aforementioned Council on account of this absence, it was therefore deemed best and consequently resolved to now authorize the aforementioned Council of Justice, as it is authorized hereby, to have the above-described writ of summons served against the aforementioned Schultze, as it stands, in itself, devoid of the annexes to which reference is made therein. And Their High Right Honourables having pleased to order the following changes in that regard, it being entirely improper that the determination of time and hour has been left to Commissioners from the Council of Justice, as the proceedings of these Commissioners can much rather allow them to attend at such time and hour as the manifold duties attached to the Fiscal Office permit the Officer to use for that purpose, than to demand that he should accommodate himself in attending commissions to determinations that might hinder him in the execution of the remaining parts of his office; that the Fiscals must also be considered to be of higher rank than the Commissioners from the Council of Justice, and the latter could or should therefore not feel aggrieved by leaving the aforesaid determination to the Fiscal; that although the commissions are decreed to be executed in the presence of the Fiscal, it cannot be inferred from this that the Fiscals serve to assist the commission, since the said commissions are conducted in their presence in order to watch over the High Authority and the interests of the Company; that this Council should therefore always, both on this and on all other occasions, endeavor to maintain and uphold more and more the respect and authority of the Fiscal, to which the respect and power of the government are so closely linked and through which its orders and resolutions must obtain their effect; and that Their High Right Honourables therefore desired that henceforth, whenever a resolution is sent or a letter written by this Council to Commissioners from the Council of Justice from which the appointment of a commission in the presence of the Fiscal can or must result, an extract or copy of such resolution or letter shall at the same time be sent or delivered by the Council to the Fiscal to serve for his information; that the President and Members of the aforementioned College shall subsequently decree such a commission, but the determination of the day, hour, and place of meeting shall be left to the Fiscal, in consultation with the first Member of the aforesaid commission, who shall be obliged to go in person to the Fiscal to give notice of the appointment of the commission, provided however that the commission shall proceed within fourteen days after the appointment, unless there should be lawful hindrances, of which the Lord Governor or Commander must then be informed; with the further desire that notice of this order of Their High Right Honourables shall be given by extract hereof to Commissioners from the Council of Justice and to the Fiscal, to serve respectively for their guidance and information. Also: to what extent Their High Mightinesses, upon the petition presented regarding this by the Master of Equippage Cornelissen, have been pleased to permit him to trade in equipment and other goods. the goods which the ship's officers and crews import for their own account are stipulated in the aforementioned dispatch of Their High Mightinesses, and that consequently the facilities to which this Council was authorized by the aforementioned dispatch must also entirely cease with regard to these ordered goods as soon as the Council receives word that at Batavia and Ceylon, the authorities of the returning ships have been warned that henceforth the penalties against the conveyance of unbranded and unpermitted goods here locally will be executed strictly and to the letter without any excuse or connivance, with the added order to apply the same thereafter to all ordered goods as well, along with an interdiction that thereafter, whether with or without authorization of the Judge, no compromise whatsoever may ever be entered into in this regard. Furthermore, Their High Mightinesses having deliberated on the contents of three letters written to Them by this Council under the 9th of this current month, containing the considerations and reports requested by Their High Mightinesses on various requests made to Them by petitions respectively submitted by the Master of Equippage Cornelis Cornelisz, the former Burgher Captain Albertus Van der Poel, the Church Council of the Reformed Congregation here, and by Aletta Elsje Deneijs, widow of the late Town Major of this garrison Jan Arnoud Bleumer, Their High Mightinesses had seen fit to dispose thereon in such manner that, namely, the aforementioned Master of Equippage shall be permitted to sell the equippage goods purchased by him before the prohibition against the conducting of trade by Company servants in matters belonging to their administration, contained in the dispatch of the Meeting of the Seventeen of 31 December 1788, came to his knowledge, and which are still in his possession, in such manner as he shall see fit, subject however to the stipulations proposed by the Council to Their High Mightinesses in this matter; while furthermore the aforementioned orders of the Meeting of the Seventeen, with respect both to him and to all other servants in this Government, remain in full force, and also with respect to the Master of Equippage here, the prohibition contained in circular orders of the High Government of the Indies dated 23 November 1791 against the conducting of any private trade with the ship's officers shall remain in effect; though otherwise he shall be free to make use of those same liberties to conduct trade that are permitted to all inhabitants of this Colony. While furthermore it was understood by Their High Mightinesses regarding the request of the Church Council of the Reformed Congregation to transmit the request for a change in the nominations of Church Council members to the Meeting of Seventeen for the purpose of a decision. Granted qualification to the Council to compensate the widow of the Town Major Bleumer for the gratuity of 25 Rds until the day that her said husband actually ceased to perform his duties in that post. Their High Mightinesses having granted the said widow one year's postponement for the restitution of the adjacent mentioned monies, provided she provides sufficient surety. That the petition of the Church Council of the Reformed Congregation here, containing a request to be exempted henceforth from presenting a double-nominated number of persons to this Council from which to elect deacons annually, and that the complete election of Church Council members might be left to them, together with the Council's considerations supplied thereon to Their High Mightinesses, shall be brought by the very same to the knowledge of the Meeting of XVII, in order for it to be disposed of by Their Most Noble High Mightinesses. Le Sueur and van Reede Van Oudtshoorn, as holding the commission to investigate which of the servants present in this Government on lighter duty and reduced pay are in the circumstances to be sent away from here, with qualification and request that, assisted by the said pay bookkeeper Matthiessen, they examine to what extent and under what conditions one could and should grant the requests of those people, and subsequently to also pay that same regard in the proposals still to be made concerning such persons who are to present themselves before Their Honours before the end of this and the coming month, if Their Honours shall find them to fall under similar conditions as these; after which examination, a copy of that report having been taken, the original shall be respectfully returned to Their High Noble Honours. To the adjacent mentioned persons who have been maimed in the Company's service, the compensation money according to the 22nd article determined by the Articles of War. To the Lieutenant and Adjutant of the Stellenbosch Burgher Dragoons Willem Wium, a piece of land in ownership measuring one morgen, situated near the village of Stellenbosch; provided that this land, which upon an inspection conducted by the Landdrost and Heemraden, as appears from the extract from their resolution taken on 3 September of this year, can be granted without prejudice to anyone, shall be surveyed and charted at the earliest opportunity by the sworn surveyor in the presence of the aforementioned Heemraden, and subsequently immediately ditched or fenced in, and furthermore under this special condition that not only shall the said Wium pay to the Honorable Company as a recognition for the same land the sum of forty-five Cape guilders, at which it was valued by the aforementioned Landdrost and Heemraden, but also that neither he, Wium, nor the subsequent occupants thereof shall be permitted to keep any cattle upon the same, or cause the least hindrance to the villagers in their usual freedom and pasturage. To the Burgher Pieter van Aerde, who on the 24th of the recently passed month of September bought at public auction from the estate of his late father the buildings and improvements of the loan farm named Lange Valley, and this for a sum of f 9700, whereof the 40th penny would have had to be paid to the Honorable Company, remission of the payment of that lord's due on the said purchase price, in consideration of the fact that the possession of these buildings and improvements with the lease of the farm devolves through this purchase in the descending line from the father to the son. To the Assistant Sailmaker Gerhard Muller, as well as the Sailors Andries Erikse Rondekwist and Pieter Bertz, of whom, as appears from the certificates issued in this regard by the ship's officers and annexed to the petitions of these people, the first lost his right hand through the discharge of a cannon on board the ship Teylingen, and the second likewise lost his right arm through the ramming home of a cartridge into a piece of artillery on the ship Pollux, in which some fire had remained behind from a previous shot, while the last mentioned, having climbed onto the yard on the aforementioned vessel Teylingen upon orders received for that purpose, fell from the forecastle tackle, by which fall his right hip was dislocated and he sustained a hernia, all of which accidents were sustained in the service of the Honorable Company, maiming the said persons for all their lives, as appears from the certificates issued in this regard by Chief Surgeon Mader: the compensation money for such injuries determined by the 22nd article of the Articles of War; to which end, regarding the sum that ought to be validated to the last-mentioned petitioner, both Chief Surgeons of this hospital shall be required, as they are hereby required, after conducting an examination of the petitioner, to submit a conscientious estimate to the Council of how the infirmities sustained by him and cited above ought to be taxed and valued in proportion to other maimings. 3048. 3049. Whereas, on the other hand, the petition of the Vice President of Commissioners for Civil and Marriage Affairs, Jan Meynderts Cruijwagen, was presented, tending toward obtaining permission to practice the whale fishery along the coasts and, to that end, to be allowed to construct a shed for the boiling down and storage of the train oil to be produced therefrom up to a certain quantity in the Kalkbaaij situated between Muysenburg and Baay Fals, being a location where one can arrive with small vessels for most of the year; it was deemed best first to demand thereon the considerations and the report of the Resident of Baay Fals, Christoffel Brand; which report having been received, and it being evident to the Council therefrom whether and under what conditions and precautions the request of the aforesaid Cruywagen may be granted, a further and final decision shall then be made thereon. While with respect to two other petitions submitted by the Bookkeeper and sworn Land Surveyor Johannes Willem Wernich, and the sailor placed on reduced pay Lucas Vander Schyff, the first containing a request for the Council's favorable recommendation to the Commissioners General that it may please Their High Nobles to cast a favorable reflection on the solicitations made by him with the support of this Council to the Illustrious Assembly of the Seventeen toward obtaining the effective capacity and salary of Junior Merchant, on which solicitation no disposition has yet been received, and the other application for final discharge from the Company's service and to be favored with the Burgher right of this place; it was approved and consequently resolved that, considering that the first-mentioned petitioner has made himself worthy of the Council's particular attention through a diligent and careful discharge of his duties, especially in the various surveys and drawings of maps which have had to be done and made by him for some time on the occasion of the sales that have been held of the Company's country properties, as well as buildings and gardens situated in and around this place, and that the second petitioner is not only a native of this country, but has also, since the year 1780 when he was placed on reduced pay, always conducted himself peaceably and quietly, both of the aforesaid petitioners' solicitations shall be favorably recommended to the aforementioned Commissioners General.
