Thus, upon the proposal of the aforementioned Lord Commander, it has been approved to make the adjoining provisions regarding this matter. from one time to another, and thus delay for months, indeed sometimes for years, and then again, notwithstanding all admonitions, remain entirely in default of acquitting themselves in this regard toward the Company; with an added urgent request that this might be provided for in an appropriate manner for the future; and the aforementioned Lord Commander, having requested and obtained the approval and required authorization concerning this from the Lords Commissioners-General, having today brought to the consideration of the other Gentlemen Members of the Council on the aforementioned subject whether, in order to cut off all means and practices by which one might wish further to frustrate the Company of its lawful revenues and cause a shortfall in the same, it would not be best to establish now and for all time that, counting from today, no goods unloaded for the account of private individuals as freight on the Company's own or hired ships shall be delivered to the holders of the bills of lading here, unless they shall first and beforehand have paid the aforementioned import duty, and in proof thereof have obtained from the aforementioned Fiscal a written receipt or certificate, in order to show that certificate upon collecting their goods from aboard to the ship's officers in proof of satisfaction, and without which exhibition the said officers shall not be permitted to release the said goods, no, but they must remain in the vessels in which they were brought, until, with respect to the ships destined for Batavia, a period of fourteen days shall have expired, within which term at the latest the payment must be made and the aforementioned goods must be discharged, so that in default thereof they shall subsequently be brought ashore on the Company's behalf, stored in its warehouses, and sold at public auction, in order that subsequently the proceeds, after deduction of the import duty and all further costs and charges, shall be handed over to the holder of the bill of lading or the owner of those goods. And to give notice thereof to the public by advertisement, while providing extracts to those whom it concerns. While furthermore, because the Lords Commissioners-General have been pleased to grant to Captain Moser from the proceeds of his goods confiscated in the past year a sum of 300 rixdollars. Thus it has been unanimously resolved upon the aforementioned proposals not only to adopt gladly the abovementioned proposal of the more well-mentioned Lord Commander and to convert it into a Resolution of this Council, as is done hereby, but also furthermore resolved to give the required notice of this decision immediately to the public by proclamation and the affixing of an explicit advertisement for their information and guidance; an extract hereof shall in the meantime be provided to the Master of Equipage Cornelis Cornelisz, in order duly to inform the officers of the ships that come to bring any freight goods here of these regulations, to ensure that these are strictly observed and complied with by them on board; and a similar extract to the pro-interim Fiscal Mr. Jacob Pieter Deneys, with the recommendation to ensure that henceforth no goods are brought ashore and delivered to the owners or holders of the bills of lading thereof, except those for which, in the aforementioned manner, the payment of the import duty for the Honorable Company shall have been performed to him, the Fiscal. The aforementioned Lord Commander having on this occasion also communicated to the Council the contents of a dispatch from the Lords Commissioners-General dated the 22nd of this month, received this morning, accompanying an extract from Their High Noble Honours' Resolutions taken under the aforementioned date upon the considerations which this Council had the honor to submit to the said Their High Noble Honours on the previous day pursuant to their requisition of 29 October on the petition of the Commander of the Company's packet boat the Vlyt, François Moser; and it having appeared from the contents of that extract that Their High Noble Honours, upon the urgent prayer of the said Moser that it might graciously please them to grant him some compensation for damages on account of the goods confiscated in the past year by order of the High Indian Government, brought by him with his aforementioned packet boat under his command for his account from Batavia into False Bay, have resolved, out of special indulgence in this singular case, that there shall be refunded to the said Moser a sum of three hundred rixdollars from the proceeds of his aforementioned confiscated and sold goods, and the penalty incurred by him remitted to that extent; so it has also been further understood to give effect to this disposition of the Lords Commissioners-General. It is understood to cause the necessary warrant on the Cashier for the delivery of that sum to be prepared. by ordering the Trade Transfer Officer Casparus van Eerten immediately to prepare the necessary warrant on the Lord Cashier for the payment of the aforementioned sum of 300 rixdollars, while in the meantime the said Lord Cashier is likewise hereby authorized for the delivery of that sum. was signed: J. Monday the 26th of November 1792 In the forenoon, extraordinary meeting All present Upon opening and reading a dispatch from the Lords Commissioners-General, it appeared that their High Honours have been pleased to grant to the inhabitants a free navigation and trade along the east coast of Africa, and further to India. After the Lord Commander had made known that this extraordinary meeting of the Council was convened by express order of the Lords Commissioners-General to take cognizance of the contents of a dispatch sent in by their High Honours this morning, immediately after being seated, proceeding to the opening and reading of the aforesaid highly respected dispatch, it was granted to the Council to perceive from that honoring letter dated 21st November 1792 that the Lords Commissioners-General, after mature consideration of the ample reflections supplied to their High Honours alongside the Council's respectful letter of the 12th of last month, October, upon their High Honours' requisition of the 13th of July preceding concerning the granting of a private navigation and trade along the east coast of Africa and further to India, and after having attended to all that seemed to their High Honours to require further consideration in this matter, have seen fit to grant the inhabitants of this Colony a general freedom thereto, under such limitations and on such a footing, however, as their High Honours have been pleased to express in the placat enacted by them under the aforesaid date and received by this Council alongside the aforesaid highly respected letter. That their High Honours furthermore are satisfied with the reasons cited by this Council to 3070. 3071. With their High Honours' desire that the engagements entered into by the Honourable Company with the inhabitants regarding their trade in Mossel and Plettenberg Bays shall be regarded as annulled. And that it is left to the Council's judgment whether it would not be better to rent out the Honourable Company's warehouses and buildings located in those bays, on or beside the aforementioned conditions. relinquish the navigation and trade conducted on the Company's behalf to Mossel and Plettenberg Bays, and therefore desire that the aforesaid navigation and trade be immediately discontinued, and that the inhabitants of both aforesaid bays be informed as speedily as possible that the engagements entered into with them for the delivery of grain and timber are, by virtue of the reservations contained therein, regarded as annulled; yet that it shall deserve the special attention of this Council how and on what footing the Company will be able to enjoy the greatest profit from the timber forests situated in and around Plettenberg Bay, provided in any case care is taken that those forests are kept in good condition through annual replantings. That as regards the Council's proposal to sell the buildings located in those bays, their High Honours have to remark that, both by reason of the moneyless circumstances of this Colony and because, in their High Honours' opinion, such a purchase could suit only very few persons, their High Honours cannot have much expectation thereof, and therefore judge it preferable, as soon as any trade establishes itself at Mossel Bay or if interested parties should present themselves earlier, to rent out the buildings situated there on condition that the tenant maintains the same in proper repair, and that the buildings in Plettenberg Bay be dealt with in the same manner, unless the Council might deem it better to grant the use thereof, provided under the same conditions regarding repairs, to

Furthermore, to appoint suitable persons as postholders in all the inhabited bays to guard against the conduct of all illicit trade, as well as that Their High Noble Lordships, having now judged it advisable to abandon all slave trade on the Company's behalf, most permanent vessels in this government can consequently be dispensed with. For this reason, henceforth only a small vessel shall be maintained to transport goods and provisions back and forth to False Bay to the buyers of the parcels of timber, should one proceed to sell the standing timber in the forests in such a manner, as this might perhaps have much influence on the demand for the same. That it will furthermore be necessary that by this Council, in each of the inhabited bays under the jurisdiction of the Company situated around this remote corner where there are no postholders, a competent and suitable person be authorized to look after the Company's interests regarding this private navigation and trade, wherefore Their High Noble Lordships also authorize this Council to effect this as soon as possible and with the least burden to the Company's finances, as well as to bring into effect, by means of a suitable publication for that purpose, the measures proposed by the aforesaid Council's missive directed to their same Lordships, in order to prevent all trade between the inhabitants residing in and around those bays and foreign ships, as well as to ensure that both the Company's and foreign ships arriving there are provided with necessities under sufficient precautions against all prohibited trade. That since Their High Noble Lordships have now judged it advisable to abandon completely the slave trade on the Company's behalf, and that all permanent vessels, therefore most permanent vessels in this government can be dispensed with and a single vessel of a small charter will be sufficient to visit the surrounding bays from time to time in order to help maintain good order there and compliance with the enacted laws and regulations, of which vessel use can then also be made to transport the necessary goods to False Bay and from there back here, though their same Lordships reserve to themselves the making of further and final provisions regarding this. 3074. 3075. this all being accompanied by the forms of the passports and sea letters for the ships that will be used for free navigation and trade. While at the same time, to the Council's sensible regret, it appears that displeasure has been conceived by Their High Noble Lordships that the orders of the Gentlemen Commissaries-General regarding the laying of a customs duty on the import and export of all kinds of articles have not been fulfilled. Item of 2 placards prohibiting the import of goods with foreign ships and the export of Indian products. That Their High Noble Lordships accompany their aforesaid missive with the forms of the passports and sea letters for the ships that will be used for private navigation and trade, as they have been enacted by Their High Noble Lordships, recommending the Council to watch carefully over the accountability of the aforesaid passports, as well as the filling in of the date thereof written out entirely in the hand of the Secretary of Policy at the time, in accordance with the orders set by the aforesaid placard. That Their High Noble Lordships have further judged it necessary to provide against the import of goods with foreign ships, as well as against the export of Indian products, to which end two placards were enacted by their same Lordships accompanying Their High Noble Lordships' so often cited missive, so that the necessary execution may be given to their contents by this Council. It has also appeared to the Council, though to its sensible regret, from the further contents of the said communication, that it had extremely surprised the Gentlemen Commissaries-General to learn from the Council's missive of 13 July last that, whereas the Assembly of Seventeen had already in its very communication of 23 October 1789 very explicitly ordered to place a customs duty of 5 per cent on incoming goods for the benefit of the Company, as well as on the export of the above-mentioned goods mentioned in that same missive.

3076. 3077. But that the Council, on its own authority and solely upon the remonstrances of the Fiscal Van Lynden, stayed the execution thereof. And after the departure of the aforementioned Fiscal Van Lynden, it was merely satisfied with granting an authorization to the interim Fiscal to proceed with the collection of the duty on incoming goods on the old footing. mentioned Articles a specified duty thereon, and to farm out the collection thereof among the revenue resources, with authorization to make and establish the necessary Regulations in that regard, arranged as far as possible to prevent all frauds, stayed the execution of those orders on its own authority, and indeed on the grounds of the remonstrance of the Independent Fiscal Van Lynden, which they had not even been able to examine properly; whereas according to the judgment which Their High Nobilities please to pronounce thereon, it would in any case have been much more proper to await the sentiments and orders of the Assembly of the Seventeen on that matter, and in the meantime to proceed with the execution of their very clear and positive orders, rather than, as has now occurred, to subordinate that execution, without the slightest conviction of necessity, to the private opinion of one of their servants, even without the Council having been able properly to investigate the merits thereof; and this all the more so, since the execution of those orders could not in the least prejudice the interests of the aforementioned Independent Fiscal, should the merits of his claim later be recognized. That it appeared equally strange to Their High Nobilities that, when the obstacles to the execution of those orders were removed by the departure of the Independent Fiscal Van Lynden, this Council, instead of proceeding therewith and establishing the collection of the aforementioned duties in a binding manner by a clear and explicit Law, goods for the benefit of the Honorable Company, on the contrary contented itself with authorizing the interim Fiscal to proceed with the collection of the (never legalized) livelihood of the Fiscal, consisting without in 3078. 3079. All of which has given rise to much unpleasantness. Although by a publication issued on the date of 20 March 1791, some attempt was made to remedy this. Their High Mightinesses having thereby found themselves obliged, at the request of Member of the Court of Justice De Wet, to declare that the goods brought in with the ship the Geertruij and Petronella, for reasons besides those mentioned, are not subject to any import duty. in 5 percent on incoming goods, to the end that whatever should be collected by him on that account should subsequently be accounted for to the benefit of the Company. That a natural consequence of this highly irregular course of action was that the collection of the said resource could not take place with sufficient effect, and several inhabitants remained under the confusion that the collection thereof continued to occur in an arbitrary manner by the fiscal for his own profit; wherefore it is not to be wondered at that some of them, especially after the events which were taking place in this Government at that very time, refused to comply therewith. That this Council did subsequently attempt to remedy this by a Publication dated 20 March 1791, but that, if Their High Nobilities wished to analyze the contents of that piece, they would have to begin by asking on what grounds the Council could have declared therein that everyone as before was, and remained, held and obliged to pay the import duty here collected under the name of customs to the Honorable Company, since it was certain that until that moment no such import duty had ever been lawfully introduced for the benefit of the Company, nor collected by virtue of a properly enacted law. Their High Mightinesses furthermore expressing their displeasure that, notwithstanding the very positive orders of the Gentlemen 17, the interim Fiscal was permitted to collect the export duty for himself. could withstand the principles of a sound and equitable administration, have consequently placed Their High Mightinesses under the obligation to decide upon that part of the request submitted to them by petition by the Member of Justice Hendrik Justinus de Wet, to the end that they might be pleased to declare that the goods brought here on freight with the ship de Geertruida Petronella are not subject to impost, as those goods were brought before the date of the Council's aforesaid Publication, in such a manner that in this singular case, and without any consequence being allowed to be drawn therefrom, no import duty will be demanded for the benefit of the Honorable Company from the aforesaid private goods brought here in the month of February last with the aforesaid ship de Geertruy en Petronella, for special reasons; whilst they, upon the report supplied by this Council concerning the aforesaid request in their Missive of 23 August last to Their High Mightinesses, were pleased further to observe, that neither the presumption of the intention of the Assembly of 17 to effect the collection of customs duties all the more fully through the permission to ship goods on freight, nor the Council's good opinion that the inhabitants would also cheerfully pay that tax and not call the Company's authority to collect the same into the slightest doubt, were sufficient to establish a general obligation, but that what was required for that purpose was a clear law enacted and promulgated in due form, whereby that obligation was imposed upon everyone and clearly defined. That Their High Mightinesses are no less surprised to see the collection of those duties described by the Council in the said Resolution as a revenue lawfully acquired by the Fiscals for themselves and their successors in office; whereas they have nevertheless been unable to discover that, with the sole exception of the 16 stivers for every 100 lb of flour, that levy was ever brought to the knowledge of the Assembly of 17 as a revenue of the Fiscals, let alone was legitimized or ratified by them; wherefore the same came under the same aspect as the arbitrary levy introduced by the Fiscals at the time of percentages on goods being imported, and the arguments appearing in this Resolution happen to be little in keeping with those made by this Council on other occasions concerning these revenues of the Fiscal, while also the doubt appearing therein regarding the intention of the Assembly of 17 in relation to the collection of those export duties is completely removed by the very clear content of their aforementioned

For which reasons Their High Excellencies have also resolved to grant to the fiscals provisionally, for the period of three years, an annual gratuity of 3000 rixdollars. And in order to cause the collection to take place on a regulated footing, as well as at the same time to guard against all illicit trade with the officers of the Company's ships, they have likewise enacted two proclamations, the strict observance of which is most earnestly recommended to this Council. the letter of instructions of 23 October 1789 on this matter was completely contradicted. That, therefore, in order nevertheless to secure the execution thereof, with orders to this Council to also, Their High Excellencies have thought fit to instruct the Council to cause the export duties also to be collected and accounted for to the benefit of the Company, calculated from the beginning of the current book-year. However, that just as it is equitable that a Fiscal in this Government should enjoy an income proportionate to the character and difficulty of the post he occupies, and as it has appeared to Their High Excellencies from the information gathered by them regarding this, as well as from the contents of the Council's aforementioned Resolution, that the revenues which will remain to him, now that both the export and import duties are collected for the benefit of the Company, are not sufficient for this purpose, the aforementioned Their High Excellencies have thought fit to grant provisionally, for the period of three years, to the Fiscals in this Government, or those who shall act in the aforementioned post, an annual gratuity of three thousand rixdollars, likewise commencing with the beginning of this book-year, in the confidence that afterwards the income of this post, with due vigilance, both by virtue of the permitted private navigation and trade as well as otherwise, will have been able to increase in such a manner that the same will then no longer need to be continued. That, for the reasons cited above, Their High Excellencies have therefore also deemed it necessary to make provision for a lawful and regular collection of the aforementioned import and export duties, and to that end have enacted such Proclamation as they have been pleased to think fit to transmit to this Council alongside Their High Excellencies' aforementioned dispatch presently being handled, for the purpose stated in the same Proclamation; to which end also serves another proclamation against the conducting of illicit trade with the Officers of the Company's ships, in the confidence that the Council will no less than Their High Excellencies fathom the urgent necessity of the strict observance of its contents. 3086. 3087. While in order to effectively detect and prevent all illicit trade in the roads, two small vessels, provided with the necessary Company slaves, have been granted to the fiscal. And that, now that everything relating to trade, as well as the collection of the import and export duties in this Colony, has been placed on a firm footing by the aforementioned laws and Regulations, this Council will now be able, and therefore must also proceed, effectively, in compliance with the orders already received long ago from the Assembly of the Seventeen, to farm out that collection; yet that Their High Excellencies are nevertheless of the opinion that it would be advisable on the Company's part to continue with the collection of the import duty of 10 rixdollars on each slave imported, as this can take place with complete effect without the least encumbrance, which is why this should therefore not be included under the aforementioned farming out. and Plettenberg Bays to demand their considerations and report as to how the intention of the Lords Commissioners General can best be fulfilled. First, the necessary proclamation shall be drafted to prevent all foreign trade with the inhabitants in and around the aforementioned bays. received and hereinbefore more fully specified placards and publications, as well as such of the foregoing dispositions and arrangements as ought to be brought to the knowledge of the public. That in the meantime, simultaneously, the Commissioners over the Mossel and Plettenberg Bays shall be required, as they are hereby required, to serve this Council with their considerations and report by what means the greatest benefit may be derived from the timber forests situated around Plettenberg Bay, and whether it might not be taken into consideration to sell the timber standing therein annually by parcels, or proportionate to the interest that shall be observed for it, provided care is taken that those forests are properly maintained through annual new plantings, and also whether, in order to make these parcels to be sold more convenient to the interested buyers, it would not be more advisable to cede the timber sheds and other buildings in Plettenberg Bay, in so far as they can be spared and applied to such an end, to the buyers of those parcels for their use rather than to lease them, and finally, how, with the least expense to the Company in the aforesaid bays and others where there are no Postholders, suitable persons might best be qualified and appointed, in conformity with the intention of the Lords Commissioners General, to look after the Company's interests there, both with respect to the now-granted free navigation and trade and otherwise. That in the meantime there shall immediately be drafted, and further submitted to the Council for approval, the required proclamation for the prevention of all trade between the inhabitants residing in and around those bays and ships of foreign nations that might call at the same bays. And for such persons as shall be appointed as Postholders in the cited bays, the necessary instructions shall be drafted. Also, the order with respect to the issuing of passports for private vessels shall be punctually observed. That subsequently, the persons mentioned hereinbefore, who are to be qualified to look after the Company's interests in those bays where there are no Postholders, having been named and appointed, the necessary instructions for them shall be drafted and established, with the insertion of such orders as shall be required to ensure that both the Company's and foreign ships arriving there are provided with the absolute necessities, under sufficient precautions against all prohibited trade, just as those orders already exist with respect to the officers who command the military detachments stationed in the Mossel and Plettenberg Bays. 3100. 3101. Likewise, an extract shall be delivered to the Master of Equipage concerning the prohibition of bringing goods ashore with vessels from the shipyard without the consent of the Fiscal. As well as to the Resident, Mr. Brand, concerning the aforementioned qualification granted to him by Their Excellencies the Commissioners-General to prevent all prohibited trade. Item to the present interim Fiscal Deneys and the Fiscals in office from time to time, regarding the order of Their Excellencies to maintain oversight so that they continuously and with zeal guard against the conduct of unauthorized trade. of the Honorable Company, at the choice of the said Fiscal, to be surrendered to the same, in order to be left at his disposal in the manner described hereinbefore: That further, to the end that the just-cited Master of Equipage as well as his subordinates shall not remain ignorant that, under the same fines and penalties as are enacted on this matter by the laws and placards against each and everyone, no goods of whatever nature may be brought ashore with the vessels of the Shipyard without the special permission of the Fiscal, required notice thereof shall be given by extract to the said Master of Equipage for his information, and in like manner to the said Fiscal to the end that he uphold this order. That likewise, similar information shall be given to the Fiscal and to the Resident of False Bay, Mr. Christoffel Brand, of the qualification and authority granted by the Lords Commissioners-General to the latter, to exercise and execute, on the footing determined by Their Excellencies and described hereinbefore, the same direction and authority to prevent all forbidden trade in False Bay as appertains to the aforementioned Fiscal. From which it has appeared to the council that the cargo of the said small ship was brought ashore at St. Helena and partly sold, without any contagion of smallpox having been discovered either there or among the crew. Thus it was resolved now to admit that small ship here and to proceed with its voyage to Mauritius with the necessary refreshments. While it is also understood that Captain L: Runke, commanding the ship Regt door Zee, shall be furnished with the necessary ship's stores for his vessel. — Further, after reading a report submitted by the gentlemen Le Sueur and Van Reede van Oudtshoorn. And since the Governor was pleased on this occasion to produce the report of the condition in which the outward-bound ship Regt door Zee, which arrived here on the 23rd of this month, finds itself, containing also the requisition of necessities for that vessel, with notification that His Honour, upon receipt of this report, had granted permission to Captain Luur Runken, who commands the aforesaid ship, for the period of five days determined by the Commissioners-General, to stay ashore for the arrangement of his private affairs; the well-mentioned Governor having been thanked for the aforesaid communication, it was resolved on His Honour's proposal to place an extract from the aforementioned report, insofar as it contains the petition for required ship's stores, into the hands of the Equippage Master of this Government, with authorization to provide thereon everything he shall deem necessary; meanwhile, the missing provisions and beverages must also be completed in proportion to the strength of the crew with which the said ship shall proceed on its voyage from here, in order that by so doing that keel may be put in a state of departure again as soon as possible. With due respect, the undersigned admitted Attorney, as special proxy of the Burgher Stephanus François Joubert, makes known: How the petitioner's principal was compelled, finding himself aggrieved by a certain survey conducted by the sworn Land Surveyor, Sr. I. W. Wernich, in the presence of the Landdrost, Mr. Hendrik Lodewyk Bletterman, and the Honorable Delegated Heemraden, and by the sentence pronounced thereupon on the date of 3 September last, to appeal to the Honorable Council of Justice of this Government. That the petitioner in his said capacity, having submitted on the appointed day to the said Council his request for the adjudication of a Judicial Commission, their Honors, with regard to that part requesting that in the event of an appeal the principal petitioner's place be resurveyed by the Artillery Officer Mr. Fredericy in the presence of the aforementioned ordinary Land Surveyor, were pleased to refer the petitioner to the Honorable Council of Policy, as appears from the Extract of the last ordinary court day, appended hereto. Missive and Extract from the Resolutions of the Lords Commissioners-General of the 28th of this month, from which it appears that they have deemed proper to send the Ensign of the military here, Amman, back to Europe as a useless subject, with discontinued pay. Thursday, the 29th of November 1792. All being present upon the roll-call. The Meeting of the Seventeen, having been pleased to inform this Government by their most esteemed letter of the 17th of May 1792 for its information, that the former sergeant in the Jaeger Company of the garrison here, Johan Anthon Amman, was to return here in order to serve as a titular Officer with the national Battalion until he could effectively step into an actual vacancy as ensign upon the first occasion; however, regarding the aforementioned person, a Missive dated the 28th of this month having been received today from the Lords Commissioners-General, accompanying an Extract from Their High Honours' Resolutions of that same date, stating that, upon information received that the said Amman is known here as a very bad subject, as has also further appeared to Their High Honours in a satisfactory manner from six statements granted by Colonel Gordon, Major de Lille, Captain of Artillery Kemper, Military Lieutenant Frans Mulder, together with and alongside Ensign Stephanus Hendriks, the Auditor of this garrison Gabriel Exter, and the soldier George Christoph Meyer, all of which statements are found annexed to the aforementioned Extract, they have thought fit that the aforementioned Johan Anthonij Amman, having abused and surprised the Meeting of the Seventeen, shall be sent back to Europe as a useless subject with discontinued pay at the first opportunity that presents itself after his arrival here. 3126. 3127. Whereupon it was resolved to place an extract of this decision in the hands of the bookkeeper Matthiessen for his information. After reading a report by naval experts who examined the topgallant mast of the ship the Constitutie, it was decided to authorize the Master of the Equipage to provide the said vessel with a new fore-topgallant mast. Thus, upon the roll-call made by order of the Lord Commander to the other Lords Members of the Council, it was decided that, in order to give the necessary execution to the aforementioned resolution, the requisite notice of the above-mentioned decision of the Lords Commissioners-General regarding the said Amman shall be given to both Colonel Gordon and to the paymaster of this Government for their respective information and guidance. And whereas a report has now also been received from the Captains at Sea, Klaas Keuken and Jan Drewis, who, upon the information received by the Lord Commander that some defects presented themselves on the fore-topgallant mast of the return ship the Constitutie lying in the roadstead, were commissioned by the well-mentioned Lord Commander to accurately inspect the aforementioned defects, assisted by the Master Shipwright, in the presence of the Master of the Equipage, and also in the presence of the Commanding Officer on the said vessel the Constitutie, submitted on this undertaking of theirs; from which report of the aforementioned naval and shipbuilding experts it appears that the said fore-topgallant mast, being broken clean in two, has thus become entirely unfit for any further service; it has therefore also been necessary on this occasion to decide to authorize the aforementioned Master of the Equipage, as he is hereby authorized, to cause the more-mentioned return ship the Constitutie to be provided with a new fore-topgallant mast. A proposal having been made by Captain Vaillant by letter to cede back to the Company 12 barrels of pork at the same price, out of the 23 barrels of pork ceded to his Honour at Batavia. Vaillant for the service of the Country's Frigate of War the Zephir under his Honour's command, as well as made by the Commander of the Company's ship the Castor and the skipper of the private vessel the Geertruy en Petronella, Louis Willem van Rossum, for these their aforementioned keels, to the end of issuing upon the same requisitions to the aforesaid Mr Vaillant everything that can be spared from the stores without own inconvenience, and to Commander Smitskam as well as skipper Van Rossum only the necessary items in order to properly enable their aforesaid vessels to undertake the voyage to the Netherlands. But whereas by the well-mentioned Captain Vaillant, by a letter addressed to the Commander which His Honour communicated to the other Members of the Council, the proposal was also made to cede back to the Company at the same price 12 barrels of the 23 barrels of pork containing together 8000 lb, which on the Company's behalf at Batavia had been ceded to his Honour for f 2176:-, which were found to be in excess of the provisions both of the aforesaid Frigate of War the Zephir and of the ship the Havik, recommended by the Right Honourable Mr Verheull under the orders of him, Mr Vaillant; then against this proposal of the said Mr Vaillant arose the objection and difficulty that by this acceptance one would risk seeing either this pork or other pork from the own stock spoil before having been able to be issued or consumed, seeing that upon the authorisation and order recently received from the Commissioners General for this purpose, already so much meat and pork has been cured and stored in the warehouses of the Honourable Company that one will be able to supply amply with this stock until the Company's 3130. 3132 It was thought fit, for the aforementioned reasons, to thank His Honour for this kind offer. Permission having been requested by A Watering, owner of the small French vessel Laimable Josephine, to bring some goods ashore. Thereupon, with the approval of the Commissioners General, he was permitted to disembark and sell the adjacent items, as they do not serve to feed luxury. the month of April of the coming year 1793. It was therefore, in order not to expose the Company unnecessarily to damages, resolved accordingly not to profit from this offer of the frequently mentioned Captain Vaillant, but on the contrary to have his Honour politely thanked therefor in the name of this Council by the sworn clerk, stating the aforesaid reasons. Further having been disposed upon some petitions submitted and added to the aforesaid documents, the petition of Anthony Van Watering, Owner of the private French vessel Laimable Josephine mentioned the day before yesterday, was initially read by the aforesaid Members of the Council, containing a request that freedom might be granted to him to disembark from the cargo of his aforesaid vessel, in order to be sold here, the following merchandise, namely: nails, snuff tobacco, olive oil, English steel goods, chintz and lining chintz, as well as shawl- and Coast cloths, matting rolls, marble stones, and porcelain dishes and plates, etc., writing paper, and finally some barrels of red wine; and that it might further be permitted to him to receive in return for the amount thereof, in order subsequently to be transported from here, the following local produce, such as: Cape Wines of various sorts Cape Brandy Wheat Flour Butter Tallow and Dried Fruits Whereupon it was understood that, whereas the Commissioners General, to whom the Commander had presented the aforesaid Request before submitting it for decision, in order to learn Their High Honours' pleasure thereon,

While one is waiting with respect for the final disposition of the Lords Commissioners General upon the draft conditions presented to Their High Mightinesses for approval, according to which the delivery of the bread for the Company's administration at this principal place should be contracted out, it having been taken into consideration that it might fit into Their High Mightinesses' general plan of simplification and reduction of administration in this Government if on this occasion the bread, flour, and biscuit which the Company comes to need in False Bay were at the same time contracted out in the same manner. It was furthermore resolved to inform their High Right Honours of the obligations under which the supplier of bread at this place will need to be placed with regard to the consumption in Baaijfals. In the cited Baayfals, he appears to be of the opinion that such a contracting out of the supply of the required bread, flour, and rusk in the said bay would be subject to many inconveniences, while in his view, the matter being well considered, no substantial or noteworthy savings can arise from it by which these inconveniences could be compensated, and it is consequently possible that the aforementioned considerations of the former resident will deter the Lords Commissioners-General from proceeding to the proposed contracting out of the supply of the required bread, etc., in Baayfals; in which case it will be necessary to ensure that the required quantity of flour for the bakery there is procured yearly in sufficient measure; it is therefore further resolved that one shall at the same time inform their High Honours that in such a case, by extension and alteration of the contract conditions, the suppliers of bread at this place will need to be placed under the obligation to have the required flour for the establishment of Baaysals and for the benefit of the ships to land there, up to a quantity of one thousand mudden, ground at the mill being relinquished to him, and this against a deduction of 8 sts. for each mud of his promised contract sum, in order to be ready yearly by the month of April for transport to Baayfals; for the storage of which flour, in the aforementioned case, the lofts situated above the Trade Warehouse could then also be cleared and assigned, provided the aforementioned their High Honours please grant the necessary authorization to this Council to have an open, free communication made from outside to the same lofts by having a double wooden staircase constructed. 3140. 3141. From the Lords Commissioners-General, whereby they have granted remission of punishment to the Captain-Lieutenant of the ship Meermin, de Baer, on account of taking over 5 picols of coffee from the ship Macasser. Staircase, while the transport of the grain destined for grinding from the warehouses to the mill, and of the flour from the aforementioned mill back to these lofts during the period that the contract shall still continue under which the carting of wagonloads for the service of the Honourable Company was contracted out, will be able to take place without any increase in expenses, precisely in the same manner as currently occurs through the contractor Baarendse, with whom the Company has an agreement in that regard without limitation of the number of loads that must be carted. 3152. 3153. Whereby it was also communicated that the statement of the required articles for the establishment of a printing house will be handed over to the meeting of the XVII. And what changes will have to be made in the conditions for the leasing of the plots of the Company's Garden. Their High Excellencies' constituents, in order if possible to effect a notable reduction in the clerical work mentioned therein as far as the Netherlands is concerned, therefore, in order to be fully enabled to do so, desire to learn further what the work concerning the correspondence with the Netherlands, Batavia, Ceylon, and other offices actually consists of, in order to be able to investigate whether that too might not be susceptible to reduction. That meanwhile Their High Excellencies had seen fit to exempt the Council from dispatching to Batavia the two sets of criminal proceedings conducted against Company servants, with their annexes, provided however that copies of the sentences pronounced against the condemned are sent thither, in order that the necessary use thereof may be made there; Just as their aforesaid High Excellencies further authorize this Council to omit henceforth from the journals the itemized list of expenses under the end of August, as well as the names of the Company's bondsmen among the outstanding debts before and after. That their aforesaid High Excellencies also fully approve the drafted terms of the conditions for the leasing of the plots in the Company's Garden being used for vegetable cultivation, having only to observe in this regard that Their High Excellencies find no mention made therein of the required vegetables for the convalescents at the Line, which however it appears to Their High Excellencies ought to be included under the contracting of the vegetables; whereby Their High Excellencies have gladly wished to take favorable regard of the request made by the Honorable Commander, that in the aforesaid conditions of lease it might also be stipulated that the water for the watering of the horses must continue to flow down to the Company's stable just as before; that likewise as before, both by day and by night, the necessary water must flow to the fountain before the Governor's residence in the Garden, without the tenants of the plots being permitted to divert it from this its course, or to hold it up; and that finally the strips of land under the perimeter wall that separates this Garden from the Grave Street and from the garden of the burgher Johannes Franke, calculated from the aforesaid house downwards as far as the gardener's dwelling and upwards as far as the innermost perimeter wall of the menagerie, with everything that is planted and set thereon, shall remain at the free disposal of the Governor, or whoever shall at the time hold authority in this government; wherefore Their High Excellencies then also desire that the necessary provisions be inserted into the aforesaid conditions in conformity therewith, after which the public lease may take place as soon as possible. That Their High Excellencies further authorize the Council to cause the necessary partition to be made in the dwelling destined for the tenants of the aforesaid plots, and to employ as overseer in the garden the current master at his present earned wage of f. 25 per month, provided that upon his departure or decease he be replaced by another at the wage of f. 12 per month, and to grant to the said overseer as a residence the room in front of the garden which is separated from the slave lodge, and previously served as a guardhouse, all according to the Council's own proposal.
