having been properly conducted by the Council of Justice, and their findings having produced the report inserted above, this Government would certainly not be able to communicate their report to Their High Nobilities without the utmost emotion and alarm, were it not entirely convinced and assured that from the prevailing scarcity in this place not the slightest fear of want can arise, since in the present year-season a large portion of the grain of the latest harvest must still be brought Capewards, and would certainly already have been partly conveyed hither, had the grain-growing inhabitants not had particular reasons for not yet commencing that conveyance. However, the aforesaid scarcity of wheat in this Cape settlement, as was just stated, must be attributed solely to the disinclination of the grain-growing inhabitants, which disinclination owes its origin to the representations made on behalf of the said inhabitants by the Burgher Councilors to this Council concerning the inability in which the farmers find themselves to comply with the obligation imposed upon them since the year 1790 to pay, on all grains and legumes transported by them Capewards, the tithe in cash at the passing of the patrol guard, without distinction as to whether they are delivered to the Honorable Company or to private individuals, with a request that this Government might provide relief therein and make a reduction, concerning which, according to the resolution taken under the date of 27 March last, no other measure could be taken (since the so very much desired arrival of Their High Nobilities was already expected daily at that time) than merely to leave it to the option of the grain-growing inhabitants to pay the tithe either in money or in kind, while the decision upon their request to obtain a reduction in that tax was respectfully deferred to Their High Nobilities, so that undoubtedly the hope that a favorable regard will be bestowed upon this in their favor by the very same has, since the adoption of the just-cited resolution until the present day, restrained the farmers from bringing Capewards the substantial stock of wheat which they still have in their barns. That, since the Government would deviate from what Their High Nobilities have been pleased to demand of it if it were to proceed to a more detailed exposition of the reasons that caused the said representations and an assessment of their validity or baselessness, it will therefore confine itself solely to proposing to Their High Nobilities such a measure by means of which the present pressing scarcity of wheat in this place could provisionally be remedied. And that, with that objective, it will be respectfully proposed to the most highly mentioned Their High Nobilities that, since at the meeting of 27 July a precise statement was also demanded from Mr. Dispenser van Rheede Van Oudtshoorn of the stock of wheat found under that date in the magazines of the Honorable Company, with the addition of the period for how long the ordinary provisions of bread and flour could be maintained therewith, and it has appeared from a note produced today in the Council by the aforementioned Mr. Dispenser that the balance at the end of the aforementioned month of July was 9012 mudden, of which 4650 mudden would be required for ordinary consumption from the first of this month to the end of December of this year, calculated according to what was consumed and supplied in the latest eleven months, so that if no more than the 2448 mudden already supplied were to be delivered toward the Batavia requisition amounting to 11000 mudden, nothing more

1900. 1901 While furthermore respectfully awaiting Their High Excellencies' dispositions upon that reply. were sent away, the remainder of wheat at the new harvest or by the end of December would still be 4400 to 4500 mudden, and could suffice for five months, or until the end of May of the coming year. This Council, therefore, could propose no other or better means of provision than to have supplied from this stock out of the Company's magazines to each of the burgher bakers as much wheat as, according to his own declaration made to the Commissioners from the Council of Justice, he is short of, so that, added to his own small stock, he may properly continue his trade for the convenience of the public for a month and a half; provided that he binds himself under proper surety to restore the wheat thus received to the Honorable Company at the latest by primo December next, on pain that those who may remain negligent therein, besides the restitution or payment for the grain, shall also forfeit a fine of one thousand guilders, Indian valuation, of which 2/3 shall be applied to the benefit of the Honorable Company and 1/3 to the benefit of the Burgher Treasury. By which means this Government flatters itself that the opportunity can be given to the grain-growing inhabitants to await the respected decision of Their High Excellencies upon their submitted grievances and the requests resulting therefrom, without causing any hindrance in the delivery of their required wheat, or exposing the inhabitants of this settlement to any scarcity of the aforesaid so indispensable food. Therefore, not only will the liberty be taken humbly to request Their High Excellencies to authorize this Government for the proposed delivery of wheat from the Company's stock to the bakers, or to honor it in this regard with such other orders as Their High Excellencies shall deem best advised, but also this authorization and order of Their High Excellencies shall dutifully 1902 1903:- And meanwhile, there shall be transferred into the Company's treasury the postage received during the past month for the delivered letters. with the contractor of the wagon freight, which must be driven for the account of the Honorable Company, over the loading of those wagons, requiring a fixed cynosure. The continuous difficulties. Likewise, upon the notification of the Honorable Ruling Commander that the continuous difficulties His Honor constantly had regarding the loading of the wagons that are freighted by the contractor with the Company's goods and thus sent to False Bay or elsewhere; and whereas the aforementioned Ruling Commander subsequently also came to submit the following representation by the Scholarchen, absolutely required that a fixed determination be made of the quantity, weight, or volume of the goods with which the wagons shall henceforth need to be loaded to be counted as one load, as the difference in opinions in this regard between the said contractor and the bookkeeper of the Company's slaughterhouse, who is qualified and instructed properly to inspect the said wagons prior to their departure, gave rise to those difficulties; The said determination enacted. 1904 1905 submitted by the Scholarchs of this city, tending to a request to obtain such further elucidation from the Council regarding the resolution of 16 March of this year concerning the establishment of a public school as was described more broadly in the aforementioned memorial. To the Right Honorable Johannes Isaac Rhenius, Governor of this Government, together with the Honorable Council of Policy. Right Honorable Sir! Honorable Sirs! The undersigned have received the excerpt from Your Right Honorable resolution taken in Council on 16 March of this year, whereby it has favorably pleased Your Right Honorable to grant the establishment of a Latin and French school, as well as the improvement of the school system more generally, according to the plan which they had the honor to submit to Your Right Honorable. The Scholarchs would have already endeavored to make an immediate start with collecting the funds subscribed for that purpose, had a difficulty not arisen of which they believe they are obliged to inform Your Right Honorable. It relates to the direction of the schools: those who participate in the provision of the funds believe that from the beginning, at the subscription, they regarded it as a tacit condition that no change would take place in this respect, but that the governance over the same would remain in the hands of those to whom it has hitherto been entrusted; but the dispute which previously took place in this regard with the Right Honorable Governor Van de Graaff caused many to fear this, who therefore flatly refused to provide their contribution. This difficulty is now raised de novo, because Your Right Honorable was pleased to explain at the end of the said extract as follows: reserving meanwhile to the Council, when the aforesaid institution shall have been brought into operation and experience shall have shown to what improvements it is susceptible and what changes will be necessary to effect those improvements, to then make such further dispositions in this regard as the circumstances and the nature of the arising matters shall require, under which it is thought that a change in the governance itself might also easily be included. 5906 1907 Reasons why the Scholarchs take the liberty to turn to Your Right Honorable with a humble request that it may favorably please Your Right Honorable to grant some further elucidation in this respect, so that, having obtained the intention of the Council in this regard, they may be able to give the necessary information to the subscribers to the fund for their reassurance in accordance with the same. And concluding herewith, the undersigned have the honor to be, with sentiments of true high esteem, underneath stood: Your Right Honorable very humble servants, the Scholarchs of this City, and in their name and by order, was signed: Chr: Heck, scribe. in the margin: Cape of Good Hope, 30 July 1792. 1908 1909 Resolved to withdraw the reservation occurring in the resolution of this Council dated 16 March of this year, and now to enact that regarding the governance of the public school to be established, no changes may be made in due time except with the consent of the Government. Meanwhile, the request of the Regents of the Hospital for some small amount of timber for the use of that House has been granted to them. Thus, since upon reading the aforementioned memorial and upon further consideration of the matter it has appeared that the reservation mentioned in the resolution of 16 March of this year might give rise to interpretations running contrary to the intention of the Government and the aim intended by the aforesaid reservation, consisting solely therein that the schools to be established shall at all times be governed to the greatest benefit of the inhabitants; it is therefore approved, in order to prevent all such erroneous interpretations which might serve to delay once again the progress of this useful matter, to withdraw the aforesaid reservation, as the same is hereby withdrawn, and instead thereof to determine and enact, as is hereby enacted and determined, that in the governance of the aforesaid school and everything relating thereto, no changes deviating from the plan mentioned in the aforesaid resolution may be made except with the prior knowledge and upon obtained express consent of this Government. The repeatedly mentioned resolution of 16 March last remaining otherwise in full force. On the other hand, upon the application of the gentlemen Regents of the Hospital, it is approved to furnish from the Company's timber store for the use of that House 30 pieces of pine planks of 20 feet in length and 1¼ inches thick, as well as 2 pieces of pine laths of the same 20 feet length and of the thickness of 2½ inches, in order to prepare therefrom the required rails and planks for the convenience of the sick in five sick wards, together making a length of 1557 feet, as well as four shutters and two half doors of latticework in order to be able to bring better air into the aforesaid wards. Thus, in conformity therewith, it was resolved that, in dutiful compliance with the aforesaid most respected order of the most mentioned Gentlemen Commissioners-General, no more wheat shall be shipped to Batavia until Their Right Honors' further order, and that an extract of this resolution shall be issued to Mr. Dispenser van Rheede van Oudtshoorn for his information. Which shall be dutifully complied with. At the first occurring occasion that... the collecting and distributing of interest, the manner of administration regarding other effects belonging to orphans, as well as the certainty to demonstrate this at all times, the method of accounting and justification to orphans who attain their majority, and the acquitting and indemnifying of the Orphan Chamber, as well as making a specific inventory, both of the funds belonging to unknown orphans and of moneys belonging separately to the Orphan Chamber, and the administration conducted over them; furthermore likewise to review and investigate all parts of the administration and liquidation relating to deceased estates, the collection of vendue moneys, the fees of the President and Members, together with the fees and salaries of the Secretary and subordinates, as well as the sureties posted by the Secretary and Messenger for their offices; in order, after all this, together with the Orphan Masters, to revise and examine the Instruction of the Orphan Chamber, to alter and amplify it as the changes of times and circumstances require, to the end that, after the information that the Commissioners-General together with this government shall have taken from the findings and the report on all these matters, it may be further amended and established if necessary. Meanwhile, an order shall be notified to the Englishman to leave the Colony. Writing of Master de Groot of De Drie Gebroeders, Ian Roelofs de Groot, from whom, by resolution of 31 July last, a categorical declaration was required as to how far he would or would not consider it advisable to employ the proposed means, and to expend the costs required for that purpose, in order to bring the defects found in his aforesaid vessel above water so that they may be examined; having today submitted on that subject the following writing: To the Right Honorable Johannes Isaac Rhenius, Governor of this Government, together with the Honorable Council of Policy. Right Honorable Sir, Honorable Sirs, Your Right Honorables and Honorable Sirs having been pleased to place into the hands of the undersigned, Jan Roelofs de Groot, master of the ship De Drie Gebroeders lying stranded in Baals Bay, pursuant to the resolution of the Council of Policy of 31 July last, a copy of the report submitted to your esteemed assembly by a commission of nautical and shipbuilding experts, who had been appointed by Your Right Honorables and Honorable Sirs to inspect carefully the situation of the aforementioned ship De Drie Gebroeders and to state the means by which the defects manifesting themselves on the same might be repaired; in order that the undersigned might declare thereupon, in the name of the insurers and owners of his aforesaid vessel, whether, in the uncertainty regarding the state in which the ship finds itself under water, he considers it advisable to have the proposed means carried out, and consequently also to expend the heavy costs required for that purpose to bring the bottom, where it is determined that the principal defects are located, above water, in order subsequently to inspect and examine the defects themselves; or whether, in his 1920 1921 opinion, the present state of affairs is such that it would be more in accordance with the interest of the stakeholders to abandon all costly attempts, of which not only the outcome is uncertain, but the consequence may also sometimes prove to be entirely fruitless. Thus, the undersigned has the honor, in compliance with that honored order, to declare: That the costs which, in the petitioner's opinion, would have to be incurred to perform the aforementioned repair would run too high for the undersigned to be able to justify them to his insurers and owners. Now, whereas the said Munnik, long before he proceeded to request the cited place in loan property in the manner aforesaid, had made every attempt to be permitted to graze the same on the ordinary recognition as a cattle place, but has always been thwarted therein by the neighbours under the pretext that they would be prejudiced thereby, and the Honourable Company has already frequently on that pretext had to forgo the benefits which would have been brought to it by the grant of various portions of uncultivated and waste land, belonging to it in ownership and situated under the district of the Cape, still unusable; it is therefore, in order to put an end to this once and for all and no longer to sacrifice the Company's interest to the grudge and jealousy of a few private individuals whose interest it is that whole fields, to which they have not the least claim, remain uncultivated and useless, approved and resolved that henceforth, whenever any dispute should arise between the applicant and the owners or occupiers of the places situated in those environs regarding the grant of one or other place situated under this Cape district concerning the feasibility or unfeasibility thereof, an inspection in person of such a place itself shall have to be made in the vicinity of this principal place by Commissioners from the Council of Justice, at the expense of the party found in the wrong, directly by order of the Lord Commander-in-Chief at the time; while they, the commission having been assigned to them, in the too remote regions, may use for that purpose such Field Wardens and Field Corporals, assisted by witnesses, as shall be judged most capable and most disinterested, who then also, with one another, will have to submit their reports under offer of oath to their Commissioners as their principals; through which arrangement it is trusted that very many more lands will be seen turned to the benefit of the Company and a multitude of needy inhabitants.

Thus it is—in order immediately to give full effect to their High Nobilities' aforementioned disposition in its entire context—provisionally approved and accordingly also resolved to furnish directly the necessary extracts of all the above, both to the Dispenser, Mr. van Rheede van Oudtshoorn, and the Commissioners from the Council of Justice, as well as to the ad-interim Fiscal, Mr. Jacob Pieter Deneys, insofar as it concerns each of them, to serve for their information and to be promptly and strictly observed in all respects, as each of them in his department is hereby granted the necessary authorization. And because the said Mr. Dispenser, both due to the additional provisions of salt which had to be made to the arriving and departing ships, and through the neglect committed in also failing to report the salt for the servants of Justice, the criminal prisoners who are fed at the expense of the Honourable Company, and the flagmen, which has always been provided to them on behalf of the Company, being unable to make the calculated quantity last until the end of the present financial year, has on that account likewise come to request permission to purchase the shortfall against the stipulated prices from the lessees of the salt pans, it has further had to be resolved to consent to this as well, provided that for the service of the prisons and for the servants of Justice, both now and for the future, the quantity does not exceed 12 mudden, and the ration of this item for the flagmen remains fixed at one mud per year. After these matters, the report below was produced to the table concerning the defects with which the homeward-bound ship the Catharina Johanna, which departed from False Bay on 13 July of this year, returned here to the roadstead, submitted to the Governor by such a commission of naval and shipbuilding experts as His Honour had seen fit to commission for its examination. To the Right Honourable Sir Johannes Isaac Thenius, Governor of this Government. Right Honourable Sir, Your Right Honour having expressly pleased to commission the undersigned, Equippagie Master Cornelis Cornelisz, together with the Captains at Sea Christiaan van Veerden and Jan Arnoud Voltelen, in order, assisted by the Master of the Shipwrights Meyndert van Eyk, to proceed on board the Batavia homeward-bound ship the Catharina Johanna, which departed from False Bay on 13 July last and arrived at this roadstead very much distressed in the night between the 8th and 9th of this current month, in order to inspect and record exactly what defects and damages may have forced the officers of that vessel not only to turn back from their projected voyage, but also, contrary to the orders of the Honourable Company, to enter this Cape roadstead in this winter season. Thus, the undersigned, pursuant to the aforementioned very respected orders, proceeded this morning on board the aforementioned vessel and found the following defects: The stem above the water, as far down as one can see, is loose, and it was stated by the ship's officers to have worked back and forth at sea between two and [illegible] inches. Having taken in much less Wheat in Mosselbaaij than was stated that little keel could be loaded with, and the same having on that account been inspected by order of Their High Nobilities the Commissioners-General. The Lord Commander now submits the report of the commissioners regarding their findings. actual condition of this Vessel will be more accurately informed. And then considered, as has been said hereinbefore, in the meantime one shall proceed with bringing on Shore of the brig Helena Louisa the wet Coffee bales and other damaged goods, in order to be opened, the bad sorted from the good, subsequently dried, and finally repacked and stowed away again, and Their High Nobilities having expressed in this regard their desire to be that the supervision over that work, which by the aforementioned resolution of the 11th of this month was mandated to the Junior Merchant Adriaan Vincent Bergh, alongside the ordinary commissioners Kuuhl and Fasscher, should be entrusted to one of the Gentlemen Council Members, it is likewise understood, in compliance with Their High Nobilities' desire, to request and commission thereto, as is hereby requested and commissioned the Lord Cellar Master Le Sueur, with authorization granted to His Honour to arrange and cause to be executed in this regard all such measures as he shall judge advisable and find proper for the furtherance of the Master's service and Interest. The aforementioned Lord Commander having further pleased to inform the Council that the Lords Commissioners-General, upon receiving information that the little brig Helena Louisa, which returned here from Mosselbaay on the 9th of this month, as has been said hereinbefore, has loaded only 1260 Mudden of wheat, whereas in the design of that little keel its hold was estimated to be able to contain a quantity of 1500 to 1600 Mudden of Grain, had been pleased to order immediately an exact survey and inspection to take place of the state of the aforesaid Hold of that Keel, and whether besides the Company's Wheat any other private Wheat might also have been loaded into it. Your Honourable Worship having yesterday been pleased expressly to commission the undersigned Master Attendant and Captains at sea, by order of the High Noble Lords Commissioners-General, to proceed on board the little brig Helena Louisa lying in the roadstead, and in the presence of the ad interim fiscal Mr Jacob Pieter Deneys, to survey exactly whether and to what extent the said little vessel is fully loaded with wheat, as well as what the causes are why in the same, instead of 1500 to 1600 Mudden of Wheat for which the capacity of that Ship was calculated, only 1260 mudden could be stowed, with orders to make a report in writing of the findings to Your Honourable Worship; - So the undersigned have the Honour to report to Your Honourable Worship: That they this morning, with and alongside the undersigned deputy fiscal Mr Johannes Andreas Truter, proceeded on board the aforementioned little Brig, and there in the presence of the said deputy Fiscal, pursuant to the received order, accurately surveyed everything, and then found that the draft marks of the ship stood at 13 Feet aft and 12 Feet forward, and that these marks were almost a fourth of a foot underwater, so that no more could have been stowed in the ship without overloading the same. That, although the bulkheads had been moved further out in such manner that the usual storage place for water had also been used for the loading of the wheat, this space nevertheless could not have been used for this purpose, because the ship would then have been overloaded and come to lie too deep; That the undersigned therefore, under respectful correction, are of the opinion that the reason why the aforementioned small brig was not loaded with that quantity of wheat which, according to the measurement of the master of the shipwrights, could have been stowed in the same, may perhaps lie in the fact that this small vessel is uncommonly sharp in the hold, while otherwise, according to the measurement provided by the aforementioned Master Carpenter, the prescribed quantity of 1500 to 1600 mudden of wheat could conveniently be laden into this vessel. Yet that Their High Excellencies, having not seen fit to acquiesce in that report, had furthermore ordered him, the Lord Commander, as was also immediately effected by His Honor, to enjoin the aforementioned Fiscal to keep close supervision during the unloading of that small vessel, to ensure that no other wheat than that brought for the account of the Honorable Company was unloaded therefrom, in order that subsequently, when the entire contents of the bill of lading shall have been discharged and stored in the warehouses, a further inspection may be made for any private wheat or other products that might be found in that small vessel, and with which the same might have been encumbered. Furthermore, it having been seen from a memorandum submitted by the Equipage Master that the stairs at the jetty, upon inspection, were found to be so old and bad that, in order to put the same back into serviceable condition, approximately the same costs would have to be applied as are required to have a completely new one manufactured, seeing that for the repair of the first are required 2 teak planks of 3 inches, and the timber specified for the latter amounts to no more than 3 similar planks; it was therefore, upon consideration that in this state of affairs the repairing of the old stairs would not square with the Company's interest, as notoriously bound to result continuously in new repairs, resolved to have the same simply demolished, and in its place to have an entirely new staircase prepared, to which end it was agreed to have handed out from the Company's timber warehouse to the aforementioned Equipage Master the aforesaid 3 pieces of teak planks. It was thereupon resolved to grant the requested authorization to the same, to collect for the free black man Abraham Van de Caab the reward assigned to him for the discovery of the apprehended thieves and murderers. A voluntary subscription of most of the residents of this settlement was added, making up the previously promised reward of 1000 Rds, among whom the petitioner also happens to be, and so he takes the liberty herewith to turn to Your Honorable Worships with the humble request to obtain the necessary authorization to distribute the aforesaid promised reward of Rds 1000 to the free black man Abraham Van de Caab, to which he was declared entitled by resolution of the 2nd of this month of August, and that Your Honorable Worships may further be pleased to assist the petitioner in collecting and gathering the said sum from the respective subscribers by assigning him one of the messengers posted to this Government.
