The aforementioned Kolver answered thereto: that, since those sailors in their declaration all speak on one and the same matter with premeditated arguments and are convicted of untruths therein by seven consonant witnesses, this rightly causes one to presume a cabal, believing the ringleader thereof to be the Sub-Lieutenant Hendrik Franke at whose requisition that declaration was given, a subject well-suited to be able to form such a plot of people who are subordinate to him; That furthermore this Franke, having well perceived that if he acted personally against the defendant, the costs would then fall upon his own head, for that reason rather, as a Casus pro Amico, sought to induce the Lord Plaintiff through an untruthful denunciation to attempt legal proceedings; and that furthermore the aforesaid Sub-Lieutenant Franke, by virtue of the contents of the declarations obtained against him, being a person who has long since abandoned the character of a man, would moreover on account of conduct be culpable sooner than the defendant in this matter. The said Kolver further requesting that the officer should state in what manner His Honour obtained the declaration produced by him, and that His Honour may be enjoined to name the accuser. Whereupon the said E. Truter gave to understand that this demand was not only very improper, but even insulting to the fiscal office, on which account he requested that the Council be pleased to take this into consideration. Finally, a request was also made by the said Kolver for a copy of the aforesaid memorial in order to serve his interests thereon, or that otherwise this writing, which ought to be considered as a triplique and thus judged contrary to what has been ordained by the statutory laws of Dutch India concerning the manner of proceeding, may be returned to the officer; And after it was brought forward against this by the said adjunct Fiscal that, since this writing did not belong to the principal case, the request of the defendant therefore ran completely contrary to the rules of practice, the said Kolver finally declared that, however much the officer had now, without summoning him, Kolver, or his principal thereto in the ordinary manner, renounced further productions by a memorial and thus in an irregular manner, he nevertheless now, leaving the case to the judgment of this Council, also renounced and requested short and summary justice. Tuesday the 12th of July 1791: On the occasion that the Council was assembled today to make the nomination of two members of this assembly from the burgher side, pursuant to the notification of the Honorable Council of Policy of the 4th of this month, it was also made known by the Honorable President that Captain Lieutenant Jan Breugeman, whose lawsuit with the Fiscal office has now already been circulated among the respective members, had been to His Honor and requested whether this matter might finally be brought to a speedy conclusion; as he had already had to remain here out of service for such a long time, and also spend that time in the bitterest poverty: That His Honor, having examined the pieces and muniments submitted in that case to this Council, had found that the trial was not at all in a state for adjudication, but on the contrary suffered from various defects, as the statement produced by the Plaintiff ex officio was not only not executed upon requisition of the [illegible] Extract from the Criminal Court Roll held at Cape of Good Hope, on [illegible] Taxation of the Company's Territorial garrisons in the Government of the Cape of Good Hope drawn up by Commissioners from the Council of Justice with the assistance of the Captain of Artillery and superintendent over the Craftsmen's Quarter George Coenraad Kuchler and the Captain Engineer Louis Michiel [illegible] Copy A. 488 [illegible] 489 Plaintiff ex officio, but moreover is a copy of a private statement, signed upon the requisition of D. Schrik and H. Franken, both sub-lieutenants on the ship the Helena Louisa, and that there are also still some statements among the documents produced by the Defendant which, due to the absence of the deponents, could not be sworn to: That His Honor had therefore instructed the said Breugeman to make his request in the Council today, in order that such regard might then be given to it as should be deemed proper. Whereafter the said Breugeman, having been called in, again insisted that the Council might please proceed to the judgment of his case, testifying that he found himself until now in the most oppressive poverty and could obtain absolutely no further subsistence: Wherefore, in consideration of these urgent circumstances, it being approved to terminate the aforementioned proceedings definitively; the Council, after ripe deliberation and consideration of all that merited reflection hereon and could move Their Honors, doing justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, has dismissed the claim made and conclusion reached by the Plaintiff ex officio on and against the Defendant Jan Breugeman on the date of 14 October 1790, sentencing however the Defendant Jan Breugeman to the costs. Furthermore, the Assistant Willem Folisor, who served the Defendant as Attorney in this trial, shall be reprimanded on account of various offensive expressions used by him with respect to the Officer, with a serious warning to conduct himself with restraint in that regard in the future, and always, in the handling of his cases before this court, to keep the respect due to the officer of justice strictly in mind with all circumspection; so that the Council will not be forced to counter his audacious behavior by other means than verbal reproaches. In dutiful compliance herewith, the undersigned will have the honour to inform Your Right Honourable and Honourable Sirs that the ship 't Slot Capelle, having arrived in Simons Bay on the 27th of May 1790, was found to be lacking: 1 new foretopmast with its cross-trees, and 4 studdingsail booms, which had to be prepared for it. That the small vessel de Zeenimph, having had to anchor in the outer roadstead on the 1st of June due to contrary winds, was only able to anchor at the ordinary berth in Simons Bay on the 3rd thereafter; that this vessel subsequently required: 1 crossjack yard 1 main topsail yard 1 fore topgallant yard 1 jib-boom, and 4 studdingsail booms. That, in addition, seven new sails had to be manufactured at the Cape for this vessel; that considerable repairs also had to be carried out on both ships, as they arrived leaking heavily; that from the ship 't Slot Capelle there had to be unloaded some lasts of rice and wax candles brought for this Government, and the ordnance and ammunition goods partly sent back from Batavia and supplied to the Orange Battalion; that nevertheless and notwithstanding all this, the undersigned put both aforementioned vessels in a state to be mustered on the 22nd of June and to pursue their voyage from here, and gave notice thereof by dispatch dated the 16th of the said month to the Lord Governor van de Graaff. Repairs continuously made to it in the past year, already a part of the southwestern side has collapsed. 27th: The so-called Milk Shed behind the Company's Garden is in passable condition, but the aviaries are falling into decay, while the adjoining perimeter walls of the aforementioned Garden itself are unfinished on two sides and, on the side of the Gravenstraat, are found propped up with buttresses against the threatened collapse. 28th: The Pottery, though old, is nevertheless in such a state that with some repairs to the roof ridge as well as the doors and windows, it can still serve for a long time for the purpose for which it is used. 29th: The Company's Water Mill, formerly called the Gortmolen, is indeed a new building, but nevertheless in great danger of collapsing due to some significant subsidence of the foundation on the main side where the water wheel is located; on which account measures will have to be taken against this immediately, both by setting the water wheel further backwards and by giving support and stability to the foundations by placing a vault over the watercourse. 30th: The other old Company's Mill, on the other hand, is very old and bad and practically irreparable. 31st: The Military Corps de Garde or Guardhouses in Roggebaai, at the foot of the Duivelsberg, at the entrance of the Company's Garden, and at the stone quarries, all recently newly built and, depending on the use that is currently made of them, in reasonably good condition. 32nd: The Corn and Wine Warehouses next to the Lutheran church, through the repairs recently done to them and the propping up of the lofts, are in such a state that they need nothing else except, on occasion, some gutters to prevent the pouring of rainwater onto the stairs. 33rd: The Justice Hall, as well as the dwelling of the provost, likewise the quarters of the servants of justice and the Caffres, and the prisons, all built a few years ago, yet poorly maintained and for the most part even more poorly inhabited, on which account they require repairs not only to the flat roofs and walls, but also to the woodwork. 34th: The Equipage Yard and Warehouses, through the general rotting and decay of the beams, planks, and laths, both of the flat roofs and the lofts, and the heavy water seepages, cracks, and further defects in the walls, are completely irreparable, for which reason they, except for the house of the Equipage Master himself, which if necessary can still remain standing for some time, will have to be completely rebuilt. 35th: The Boatswain's and Quartermaster's Dwellings, together with the Sailmaker's warehouse, are in the same state as those aforementioned quarters of the provost. 20 Provost marshal and further servants of Justice, that is to say indeed, not old but in a more or less dilapidated state due to the omission of the proper repairs, so that it will have to be brought into a better condition with difficulty and expense. 36 The Artisans Quarter, although not in a better state than the Equipment Yard, is nevertheless in such a state that the workshops and dwellings of which it is composed can still be used for some time, but eventually the entire building will have to be completely rebuilt. 37 The three grain storehouses adjoining each other situated on the beach are good and strong, but most of the wooden windows and water gutters are defective, and furthermore a beam has broken which will need to be replaced immediately by another. 38 The four adjacent Wine Cellars, on the contrary, are in such a poor state that the two standing closest to the Beach can no longer be repaired, for which reason they should only be kept as much as possible in their present situation until an opportunity arises to have them completely rebuilt; however, the first or largest bordering the street, if provided with a new roof, could if necessary still serve for some time, however dangerous it is in every respect to continue using thatched roofs over buildings of such great importance as these cellars are, the walls of which, moreover, are only raised to a very slight height from the ground. However unfavorable this description may be, a small room will nevertheless have to be constructed in the cellars situated closest to the sea, since the overseer of the Cooperage, at the time when the other cellars are delivered to the contractor for the supply of wines for the Company's administration according to the terms of the tender, will immediately have to reside there to carry out what concerns his administration. 39 The Cooperage situated opposite the aforementioned cellar is very old and poor, but can if necessary still serve for what it is employed for, provided that the doors and windows as well as the roof are renewed and the flat roof that leaks here and there is repaired. 40 The Timber Magazine, though not without defects, is nevertheless in a better state than the Cooperage, only requiring some window frames and shutters that are broken or rotted to be replaced with new ones, and in addition some minor repairs to be made to the plastering of the walls as well as the flat roof. Copy Valuation of the Company's territorial holdings, which appear in the report of Colonel Gilquin and are not recorded in the Trade Books, valued in the following manner, namely: Specification of all such: 1st Division 1: The Castle of Good Hope, consisting of five bastions, with its gate, sally port, envelope, two ravelins with their counterscarps as well as that of the envelope, furthermore the Battery Imhoff facing the sea, which forms a part of this envelope, and all the profile walls, gates, sally ports, etc., in Holland currency at ƒ 400000:-:- 2: The Line, running along the seashore from the Battery Imhoff to Fort Knokke, at ƒ 30000:-:- 3: Fort Knokke, consisting of a star redoubt, likewise for the said reasons, being [illegible], the valuation is only ƒ 20000:-:- 4: The Intermediate Battery, [illegible] 5: The Line between Fort Knokke and the place named Zonnebloem, made of redoubt and earthwork thrown up in haste during the last war. 6: The Battery Gordon, at the foot of the Duivelsberg. 7: The temporary works in Hout Bay, in the Kloof between Table Mountain and Lion's Head, and between Klipkuilen and [illegible], thrown up during the last war. No. 9 and to comply with their orders in this matter. Among these concerns, the first and most notable was the difficulty regarding what should be understood by territorial possessions; namely, whether one should understand by this, besides the buildings and works erected and laid out on behalf of the Honorable Company, also the lands situated within the magistracy of the Honorable Company here, or whether one ought to regard these lands (as most members of the meeting of Commissioners are of the opinion) in themselves as the property of the state or the generality, and therefore, in the valuation of the Honorable Company's possessions, take nothing else into computation than solely the value of the erected buildings and constructed works, in so far as these were deemed subject to estimation. And whereas the decision on this point naturally had to have the utmost influence on the valuation to be made, it was deemed necessary to ascertain hereupon the respected pleasure of the Gentlemen Commissioners-General, which having been undertaken by the aforementioned President, the outcome thereof was that Their High Noble Excellencies declared that the valuation, regarding the buildings, the Commissioners were to arrange the valuation according to what would now be required for the erection thereof, after deduction however of their age and defects or the dilapidations discovered therein, in so far as these could also be deemed susceptible to a reasonable estimation; while, with respect to the country estates, yards, or lands appropriated and laid out by the Honorable Company for its service, it should be done in proportion to what it was thought they would yield individually in a private sale under present circumstances of the times, and consequently not only to the value of the buildings respectively constructed thereon, but also of the land itself, which could serve for private use, and the utility that is derived therefrom. Furthermore, the Commissioners found themselves not a little at a loss with respect to making the valuation of the fortification works, as being something of which they must in all sincerity declare to have absolutely no knowledge, but regarding which they believed (subject to respectful correction) that they could not otherwise comply with Your Honorable and Noble Excellencies' intention than by abiding by the judgment of Captains Kuchler and Thibault, who were assigned to them by Your Honorable and Noble Excellencies for assistance; who then also, in the presence of the Commissioners, gave the valuation thereof piece by piece as accurately as possible. Keeping all of this carefully in view, the Commissioners, together with the Captains Kuchler and Thibault assigned to them for assistance, proceeded to make the valuation in such manner and form as the specific lists, which they have the honor to present respectfully annexed hereto to Your Honorable and Noble Excellencies, set forth more fully; and in which they, in order to observe all thoroughness, maintained this order, that they brought the said territorial possessions of the Honorable Company under the following five classes or divisions, namely: 1 Fortifications which appear in the report of Colonel Gilquin, the cost of which is not recorded in the trade books. 2 Buildings likewise listed by Colonel Gilquin in his aforementioned report, which are not found calculated in the trade books. 3 Buildings, gardens, outposts, and places that neither appear in the report of the aforementioned Gilquin, nor of which any mention is made in the trade books. 4 Fortifications, on the other hand, entered by the frequently mentioned Gilquin in his report, the imaginary cost of which is accounted for in the trade books. 5 Buildings and places which, with respect to the first mentioned, appear in the report of Colonel Gilquin and are to be found in the trade books. This work was probably sufficient for the purposes envisioned at the time of its construction, but could not now long resist a powerful, well-disciplined European enemy, both on account of its outdated and disadvantageous construction, and because it is too small and is dominated by the foot of Devil's Peak. 2nd.
