Whereupon it was decided to increase the fortification workers with six more men of the Honorable Company, and to add to them another 20 slaves. because of the different works they are obliged to do. I have often been obliged to take sailors or non-commissioned officers of the line to supervise them, but the people having no knowledge of earthworks and turfing, I have not been able to require of them the same work as that of men intended for this purpose. These considerations make me take the liberty to observe to you, Governor, that the rainy season approaching, and the destroyed repairs necessarily having to be done promptly as well as the alterations to be made at Fort Cnoque and other parts, I need six more men and 20 blacks from the Lodge to accelerate these works. I have employed the greatest economy in my works, and particularly in the number of individuals, but circumstances compel me to ask you, Governor, to multiply them, because, if they are not, I cannot be responsible for the breaches that are accessible to the enemy, if I lack the people to close them. I have in vain demanded that all the convicts be employed on the works; too many of them remain at the bank and at their quarters, and my orders have not been served to these effects. Allow me to observe to you further, Governor, that the master mason has only 13 rixdollars for all payment per month, whereas Schoonhuyzen had 23 of them. He has already declared to me his wish to return among the masons because he can neither live nor subsist on this modest sum, and this is entirely true. The corporal does not have the pay that is due to him, as well as the fortification workers, who ought to be paid like the soldiers of the garrison or, to express myself better, like military personnel, and the rigor of their work deserves it; moreover, the establishment for the service of the Place is not fixed. I have the honor to be with the most profound respect, Governor, your very humble and very obedient servant, L. M. Thibault, Captain Engineer. At the Line, the 25th of August 1793. Thus, after deliberation on account of the necessity that the defects found on the fortifications be repaired as quickly as possible, it was approved and understood to increase the number of fortification workers, currently consisting of 4 men who have thus far been assigned to the Line, with another 6 men, and to add to them another twenty slaves of the Company. Furthermore, regarding what service pay the aforesaid fortification workers shall receive, and for what reasons the request to grant the Master Mason 10 rixdollars per month was rejected. All the fortification workers shall receive the same service pay as is enjoyed by the artillerymen in this Government according to the resolution of May, for as long as they shall enjoy it. But in regard to the request made by the said Thibault in that writing, to grant the Master of the Masons an increase of pay and emoluments of 10 rixdollars per month, it was decided not to enter into the said request as being contrary to the established orders, but to reject it as is done herewith. Furthermore was read the following petition of the free black woman Amelia of Batavia. The free black woman Amelia of Batavia having submitted a petition. To the Honorable Johannes Isaac Rhenius, Acting Governor, together with the Honorable Council of Policy of this Government. Honorable Sir and Honorable Gentlemen. Amelia of Batavia, manumitted slave, respectfully makes known: How the late Mr. Ronnekamp, by last will and testament, desired, among other things, that to his slave Mentor of the Cape, on account of the faithful services rendered to him, the executors of his testament would grant the freedom immediately after his decease to choose with whom he would wish to reside, who would then be obliged to contribute to the estate as much as the same would be appraised at according to equity. The aforesaid Mentor, by virtue of that favorable provision, has requested the petitioner, as his wife, to pay to the estate the appraised sum of 250 rixdollars, with the plea that she would then be pleased, with the permission of Your Honors, to set him at liberty. And whereas the petitioner, notwithstanding the impoverished situation in which she finds herself, has paid the said sum for him and wishes gladly to fulfill his desire, she therefore turns respectfully to Your Honors, with the humble prayer to be pleased to permit her to emancipate the said slave Mentor, and on account of her impoverished situation graciously to excuse her from paying the sum of 50 rixdollars stipulated for the manumission of slaves to the Poor Fund of the Diaconate, since she, the petitioner, is entirely prepared, to the satisfaction of the said Poor Fund of the Reformed Church, to provide sufficient surety that he shall never become a burden to its funds, nor request any maintenance from the same. Condition to permit her to emancipate While on the petition presented by the Heemraad at Stellenbosch Myburg it was resolved under [illegible]: thus after deliberation it was approved and understood to permit the said Amelia to release the slave Mentor of the Cape from his servitude and to set him into freedom, provided that she first produces sufficient proof that the sum of 250 rds mentioned in her petition has been paid by her to the Orphan Chamber for the account of the estate of the late Titular Merchant Tobias Christiaan Ronnenkamp, while her further request to remain exempt from the customary payment to the Reformed Church Poor Fund is declined and rejected. Furthermore, the following petition, submitted to this Council by the Heemraad at Stellenbosch Philippus Albertus Meiburg, was read, running: To the Honorable Johannes Isaac Rhenius, Commander at Cabo de Goede Hoop and its jurisdiction etc. etc. etc., together with the Honorable Council of Policy of this Government. Honorable Sir and Honorable Gentlemen: The undersigned petitioner shows with due reverence and all submission, most respectfully: that he, the petitioner, in the beginning of the past year 1792 bought at public auction a certain building standing on the land called the Kluitjes Kraal, situated at the ford of the Breede River in the Land van Waveren; which land was in earlier times granted by the Government to the burgher G. Hk Catenbrink under such servitudes as are stipulated therein; and for the reason that after that time various complaints and grievances successively came in regarding the disorderly conduct of the aforementioned Cattenbrink, in violation of the respected orders of the Government, it was revoked and the building sold with authorization by the Landdrost and Heemraden. That since this land serves greatly for the convenience of the traveling country- and fieldman with their oxen and wagons, with its convenient location at the aforementioned ford. Thus it is that the undersigned turns to Your Honors with the most humble request that it may please Your Honors to grant in ownership to the undersigned petitioner the aforesaid land to its size and breadth as the diagram and title deed made thereof will show, under such servitudes and stipulations as are already determined on the aforesaid land or similar lands, or might yet be imposed; while the petitioner can assure Your Honors in good conscience that the intention of this his request is solely to let the said land and building be used, under the favorable approval of Your Honors, for the greatest convenience of passing wagons and people, in order to let live there one or two poor people who practice their trade, with such obligation to always satisfy the highly revered order of Your Honors, that not the slightest complaints will come in; the undersigned petitioner trusting that Your Honors will find no difficulty in this request of the petitioner, which is deemed, with due correction, humane and reasonable. Furthermore, upon resumption having deliberated on the following petition of the dismissed Landdrost of Graaff-Reinet, Moritz Herman Otto Woeke: To the Honorable Johannes Isaac Rhenius, Commander of this Government and its jurisdiction etc. etc. etc., together with the Honorable Political Council. 472 473 to prove his status to be excused from those two years of arrears of recognitie; and since the petitioner could not make any use of the aforementioned place at that time, but had nevertheless bought the buildings and improvements of that place for one thousand rixdollars, which he would have had to abandon, he therefore requested to be allowed to sell the buildings and improvements and that the aforementioned place remain registered in the petitioner's name without the petitioner being bound to pay any recognitie; and the most honorable Lord Governor also condescended thereto, and ordered the first sworn clerk, Mr. Horak, to make a note thereof in the ordinance book. That the petitioner recently having inspected the ordinance books found no record, and gave notice thereof to the Right Honorable Mr. de Wet; And since the petitioner, as is known to Your Right Honorable and Worshipful Lordships, having resided at Graaff-Reinet for seven years past, has not been able to make use of the frequently mentioned place, he therefore turns to Your Right Honorable and Worshipful Lordships, with a humble request that Your Right Honorable and Worshipful Lordships may be pleased to excuse the petitioner from the arrears of recognitie money for the reasons mentioned above, and nevertheless permit the petitioner, on account of his distressed circumstances, to sell the buildings and improvements of the repeatedly mentioned place for his own benefit, in order that such money may also be applied to the satisfaction of the creditors of the petitioner's insolvent estate. Otto Woeke It is, both in consideration of the groundlessness of the reasons alleged by the petitioner, and because he proves nothing of what has been put forward, approved and resolved to decline his request and reject it, as the same is hereby declined and rejected; and accordingly, when the buildings and improvements of the place Krabbe Fontyn are sold for the account of the insolvent estate of the petitioner, the arrears of recognitie money must be paid from its proceeds by preference. Subsequently, upon the humble request made in that regard, 474 475 And to grant to the burgher Dirk Verweij a piece of arable land on perpetual lease. Having been pleased to communicate that His Honor had observed from the resolution of 31 August last what commission had been assigned to the messenger of Drakenstein, and that His Honor was of the opinion that the former secretary of Graaffe Reinet, Wagener, would be better suited for the execution of this commission; proposing the said Wagener as a man of ability and tact to carry out this commission. Upon the request made by the burgher Dirk Verweij, there was granted to him on perpetual lease a piece of arable land situated adjacent to his residence called De Brakke Kuil lying in the Koelbergen, and that for the term of fifteen years, subject to the payment of the recognitie established thereon of twenty-four stuivers for each morgen per year. After all this had been thus transacted, the Honorable Lord Commissioner communicated to the Council that His Honor, upon reviewing the decisions taken at this meeting, had observed how by resolution of 31 August last the messenger of the colony of Drakenstein, Adam Keyzer, had been commissioned to relieve the inhabitants who earn their living by cattle farming from the confusion into which they were allegedly brought according to the complaints of the contracted butchers, as if the privileged burgher butchers were not subject to the same obligation as the contracted butchers, namely to facilitate the inhabitants in paying their arrears of recognitie money and in being able to pay the same recognitie properly henceforth; That however much His Honor also remained convinced of the difficulty of finding, for a commission so fatiguing and unpleasant, someone on whose competence, loyalty, and zeal one could safely rely in the execution thereof, His Honor, on the other hand, was deeply impressed by the absolute necessity to provide therein and to dispatch for the execution of the commission a person from whose skill and tact one will be able to expect a good outcome thereof; And that His Honor, informed that the attorney Jan Jacob Fredrik Wagener, formerly a bookkeeper in the service of the Company and secretary of the colony of Graaff-Reinet, possessed all the qualifications required to execute the aforesaid commission, deemed it proper to propose to the Council that the said Wagener be employed for the aforesaid commission; Whereupon it was unanimously resolved to alter the decision of this board of 31 August last to such an extent that, instead of the messenger of Drakenstein, Adam Keyzer, there shall be dispatched for the aforesaid purposes the said former bookkeeper and secretary of the colony of Graaff-Reinet, Jan Jacob Fredrik Wagener, for whom the Honorable Lord Commissioner will arrange suitable means, framed by the High and Honorable Lords Commissioners-General themselves, to achieve the aforesaid ends.

Reading of a letter from the Right Honorable Commissioners General dated 31 August last to this Council, together with an extract of a resolution taken by them on the same date, reading as follows: by means of these demands after having been signed by His Honor together with the Governor and the members of the Council presently in attendance, has been presented by His Honor to the Right Honorable Commissioners General, who have been pleased to charge themselves to ensure prompt and speedy satisfaction; the admitted Attorney Ian Iacob Fredrik Wagener, formerly Bookkeeper in the service of the Company and Secretary of the Colony of Graaff-Reinet, having requested the Honorable de Wet in his capacity as President of the Council of Justice that, during the inland expedition to which he was appointed by resolution of this board on the 4th of this month, he may be permitted to have the affairs which he would perform in his office as Attorney before the Council of Justice attended to by power of attorney by the person of Jan Alders; and this request having been brought to the knowledge of the Council by the Honorable de Wet, it is resolved to grant the same as it is granted hereby, the Honorable President and further Members of the Council of Justice consequently being authorized to admit the aforementioned Alders before their court in order to perform on behalf of the Attorney Wagner before the said court everything that he himself would be able or could do, until such time as the said Wagner shall have completed his commission and arrived at this main place. Saturday, 31 August 1793. Having deliberated on resumption upon the petition of Jacobus Arnoldus van Rheenen, requesting for reasons broadly alleged therein that the Commissioners General might be pleased to investigate the proceedings between the Petitioner and the Burgher Hendrik Oostwald Eksteen, first contested here before the Council of Justice of the Castle Batavia on appeal, and subsequently to dispose therein as the Commissioners General should deem proper, as mentioned under the Minutes of 3 August 1792; And it having appeared from the inquiries made in that regard by the Commissioners General that when, in the year 1784, proceedings were initiated by the aforesaid Hendrik Oostwald Eksteen against the Petitioner before the Council of Justice here regarding the purchase and sale of a certain piece of land situated at the Wynbergen, the said proceedings having been properly completed, the Petitioner by definitive sentence of the aforesaid Council dated 27 October 1785 was condemned to receive proper transfer and conveyance of the disputed piece of land, and to pay the purchase money amounting to thirty thousand Cape guilders with costs; That the petitioner having appealed this verdict to the Council of Justice of the Castle Batavia, the result thereof was that the said Council, by its sentence of 1 August 1787 rendered in case of appeal, confirmed the verdict of the first instance, with compensation of costs; That thereupon it was indeed indicated on the part of the petitioner as if he intended to pursue this case further in revision, and on that ground maintained that the verdict rendered against him in the first instance and confirmed in case of appeal ought for the present to remain without execution; but that since the petitioner had not been able to produce sufficient proof of having lodged the aforesaid revision, the Council of Justice, only by its disposition of 13 November 1788 upon his request made to that end, had granted him a stay of execution until the arrival of the first return ships; That in the meantime the petitioner remaining further in default of producing the required proof of the lodged revision, he was summoned on 5 March 1789 by the aforesaid Hendrik Oostwald Eksteen for satisfaction of the aforesaid verdict, whereupon, on the grounds of some private reports received by him mentioning that the aforesaid case had been brought into revision, some further delay was requested by the petitioner; and upon a further request by the aforesaid Eksteen that, in case this delay should be granted, the interest on the aforesaid purchase money should be paid to him, a further disposition was taken by the Council of Justice whereby the case was for the present suspended, and the petitioner was ordered to provide sufficient security for the prejudice that the repeatedly mentioned H: O:d Eksteen might thereby suffer.

would come to suffer, to be assessed by commissioners, and in the meantime immediately to pay off the interest according to the tenor of the ruling in the first instance. That the petitioner, having already complied with that decree so far as it concerns the payment of the interest, has furthermore seen fit to compromise on the principal matter with his opposing party, the aforementioned Mr. Hendrik Oostwald Ecksteen, so that on 15 February 1790, in the presence of commissioners from the Council of Justice, it was agreed between them that the petitioner, as forfeit money to compensate for calculated costs, would pay to the said Ecksteen a sum of nine thousand guilders, and furthermore pay all the costs incurred both here in the first instance and at Batavia in case of appeal or in revision; in return for which the aforementioned Ecksteen declared that he annulled the purchase of the piece of land in dispute, and thus took it back, and also remitted to the petitioner the interest of one year which he still had to claim from him on the purchase price in the sum of thirty thousand guilders; which agreement was approved in court on 18 February following by the Council of Justice, and the parties were ordered to comply strictly therewith. That not long thereafter, and indeed on 18 March 1790, the petitioner decided to have the repeatedly mentioned Mr. Hendrik Oostwald Eksteen summoned, in order to see served a petition regarding such interest as had been paid by him pursuant to the decree of 5 March 1780, and furthermore to submit a request in court tending chiefly to obtain restitution of the same interest in so far as it had already been paid by him; which request, however, as well as an appeal interposed thereon on 1 April 1791, was rejected by the said Council on the grounds of the aforementioned transaction. That finally on 7 July 1791 there was received by the Council of Justice here a writ of appeal obtained by the petitioner from the Council of Justice of the Castle of Batavia concerning the decree of 5 March 1780; whereupon, pursuant thereto, the petitioner's opposing party, Hendrik Oostwald Eksteen, having been properly summoned for a certain date, all the original documents were furthermore sent over to Batavia, while the petitioner, having addressed himself anew on 10 August 1791 to the Council of Justice here by request, petitioning that in compliance with the aforementioned writ his aforementioned opposing party might be enjoined to restore the interest received by him to the sum of 6061 guilders, the petitioner was referred to the Council of Justice of the Castle of Batavia. Jacobus Bester the Elder, requesting for reasons alleged in the aforesaid petition that it might please the Commissioners General to cast a compassionate eye upon the condition of the petitioner, and to remit to her the payment of nine years of overdue recognition money on the farm held in loan by the petitioner from the Company, more broadly mentioned under the minutes of 15 October 1792. And having also taken into further consideration the report of the Commander together with the Council of Policy on the aforesaid petition, dated 6 November 1792 and appearing under the minutes of the 8th following thereafter. It was taken into account that, according to the information mentioned in the aforesaid report, the petitioner and her aforesaid husband Jacobus Bester the Elder offered all help and assistance to the crew of the ships taken by the English in Saldanha Bay in the year 1781, accommodated the same and provided them with all necessary food, and this without having taken any payment or compensation for it. That, furthermore, the petitioner and her aforesaid husband Jacobus Bester the Elder find themselves in a very destitute state, caused by the fact that her said husband has been suffering from a wasting illness for a long time. From the received reports of the Equipment Master Jan Arnold Voltelen and the Chief Surgeon of this Government Johannes Leuver, who were commissioned to examine the 1000 mattresses and pillows, the manufacturing of which was publicly contracted out on 18 July last, it having appeared that those which were undertaken by the burgher Coenraad Meysler are perfectly according to the model; furthermore, that although those which were made by the burghers Auret, de Jong, Volstedt, and Berends are 1½ to 2 inches shorter than the model, they can nevertheless serve for the required purposes; and that of the 200 mattresses and 200 pillows undertaken by the burgher Berends, only 109 mattresses are filled with hair, and the remaining 91 as well as all 200 pillows with straw; it is resolved concerning these matters to let the contractors Meysler, Auret, de Jong, and Volstedt be paid the money agreed upon for their work, and likewise to the burgher Berends that which he has earned for the manufacturing of the 109 mattresses filled with hair, while the manufacturing wage for the remaining 91 mattresses and 200 pillows shall not be paid to him until he shall have stuffed the same with well-purified sheep's hair in accordance with the conditions; and furthermore the Commander is requested to have all the contractors who made the mattresses and pillows too short summoned before His Honor, in order to reproach them on behalf of this government for not complying in all respects with the conditions of the tender signed by them, with a serious threat that if they should violate the same again in the future in any case, not the slightest leniency will be shown to them.

The meeting, proceeding to resume this resolution, examined the carriages that might be considered as being kept in these districts solely for comfort and pleasure, and consequently subject to the imposition of the carriage money introduced by the Right Honorable Commissioners-General by proclamation. 508 509 The burghers George Willem Hoppe and Jan Michiel Holst having submitted requests to each be allowed to have in ownership a piece of land situated adjacent to their respective residences, it has been resolved to place the said requests into the hands of commissioners from the Council of Justice, in order to examine, in the presence of the Fiscal, whether the grant of the said piece of land would be prejudicial either to the Company or to the inhabitants, and if so, to then appraise how much each of the petitioners ought to pay to the Company as a recognition for that ownership, in order to serve the Council with a written report concerning both matters. The burghers Hoppe and Holst respectively having made a request for a small strip of land in ownership, placed into the hands of commissioners from the Council of Justice to examine and appraise the requested lands, while to the burgher Gabriel Rossouw, upon his request made thereto, a small strip of land has been granted in quitrent. Submitted draft instruction by the vendue master for the vendue messengers. Likewise, the burgher Gabriel Rossouw having requested by petition to be allowed to hold in quitrent a certain piece of land situated near the village of Stellenbosch, the grant of which, according to the extract resolution taken in the meeting of Landdrost and Heemraden attached to his petition, can be prejudicial to no one, it has been resolved to grant that request, and therefore to cede to the said Rossouw in quitrent the aforesaid piece of land measuring 6 morgen and 300 square roods, and this for the period of 15 consecutive years, upon payment of the customary recognition of 24 stivers for each morgen annually. The Honorable Commissioner granted the rank of Junior Merchant to the newly appointed Secretary of the Court of Commissioners of the Council of Justice, Daniel Petrus Haupt, next to the present Secretary of this Council, George Fredrik Goetz; and on his request made for that purpose, discharged him as Wing Adjutant of the Clerk Corps, retaining the rank in that corps due to him according to the quality and rank held by him in the Company's service, and in his place appointed as Wing Adjutant, with the effective quality of Ensign in the said Corps, the Notary Petrus Hendrik Faure; and furthermore, his Honor appointed as ordinary clerks to the Political Secretariat the Stewards Jurriaan Kemper and Barend van Beek, both at the salary of 20 guilders per month and under a new three-year contract, all taking effect today. Further, on the proposal of the Honorable Commissioner, it was resolved to unload from the ship Drechterland, which recently anchored in this roadstead from False Bay, three bales or cannisters of cinnamon, of which there is no stock in the Trade Warehouse, to be sold at retail to the inhabitants at the fixed price. And since there is little or no paper and window panes in stock in the Company's Trade Warehouse, the Warehouse Keeper Cornelis Cruywagen was finally authorized to purchase, in the most frugal manner, as much paper and window panes as will be required for necessary provisions. Goetz, sworn secretary. 516 517 Commission for the former Secretary of the Colony of Graaff-Reinet, Jan Jacob Fredrik Wagener, reading as follows: Abraham Josias Sluysken, Councillor of Dutch India, and Commissioner over the Government of the Cape of Good Hope and the dependencies thereof, etc., etc., etc., together with the Council, to all who shall see or hear this read, Greetings, make known: Whereas we have learned, to our utmost astonishment and dismay, that many of the inhabitants who maintain themselves by stock-farming are reluctant to sell their livestock to the Company's contracted butchers, and that this refusal is attributed, firstly, to the erroneous notions into which the said inhabitants have reportedly been led by malicious and peace-disturbing persons regarding the true meaning and spirit of the publication issued on 20 February of this year by the Most Honorable Commissioners-General over all Dutch India and the Cape of Good Hope concerning the collection of overdue recognition money on loan farms; and secondly, to the doubt as to whether the privileged burgher butchers, just like the butchers contracted with the Company, were placed under the obligation to likewise deduct a portion from the amount of the wethers, oxen, cows, and other slaughter livestock purchased by them or on their behalf, to be paid to the Company in settlement of what the sellers of that livestock owe the Company on the farms held by them on loan; And whereas we are willing to attribute the aforesaid refusal of the inhabitants to sell their livestock to the contracted butchers partly to the incorrect interpretations made of the aforesaid publication of the Most Honorable Commissioners-General, and partly to the limited opportunity which the inhabitants have had; we have also been unable to consider without emotion the disastrous consequences that these bad impressions might have, both for the interests of the Company and for the interests of all the inhabitants and residents of this Colony, since there would naturally arise from this a total shortage of meat at this capital place, a harmful surplus of livestock in the remote districts, and an ever-increasing growth of the debt attached to the farms of the stock-farming inhabitants, arising from the determination of so modest a recognition fee that none of the right-thinking inhabitants could in any way call its legitimacy into question.

inhabitants of the far-off districts have to take note of the ordinances and laws enacted and proclaimed for the common good, whereby their fairness and legitimacy ought to be recognized and praised by them, especially in the aforementioned publication of the Right Honourable Lords Commissioners-General, as containing solely fatherly arrangements to enable the inhabitants to fulfill their lawful obligations toward the Company in a very easy manner; and likewise concerning the misconception as if the privileged citizen butchers were not equally, like the contracted butchers, placed under the obligation to buy and receive from the inhabitants such horned cattle and sheep as they might be inclined to sell in order to pay their overdue recognition monies to the Company: so it is that we, in order to draw the aforementioned inhabitants who sustain themselves by cattle breeding out of the false delusion into which they might have been brought through ignorance or through the incitements of malicious, peace-disturbing, and self-interested persons, have thought fit to dispatch and commission, as is commissioned and dispatched by these open letters, the former bookkeeper and secretary of the Colony Graaff-Reinet, Jan Jacob Fredrik Wagener, with orders to proceed to wherever we have commanded him to go, to assure each and every one of the inhabitants who sustain themselves by cattle breeding that the arrangements devised by the Right Honourable Lords Commissioners-General and issued in their aforementioned publication, as well as those which the government of this Colony subsequently established, are solely intended to pave an easy way for the inhabitants to be able to pay their now due arrears and henceforth the payment of the regular recognition for their loan places; that both the privileged citizen butchers and the butchers under contract with the Company are placed under the obligation to facilitate all the inhabitants in fulfilling their obligations regarding the overdue and still current recognition monies; that in the collection and deduction of those arrears, all possible leniency will be exercised, since the Right Honourable Lords Commissioners-General, in their aforementioned publication, have not only determined that the inhabitants who are in arrears with recognition monies could suffice with paying the due recognition of the last year and two years of their overdue recognition, but also ordered the government to exercise all favorable consideration toward the less affluent persons; that consequently, toward those who find themselves unable to comply with that determination, all indulgence will be exercised, and that what will be deducted from them in payment of the due recognition will be proportionate to their lands and the quantity of cattle sold by them; that toward those who, through sufficient evidence, will be able to prove their absolute inability to meet their obligations, according to circumstances, not only the same considerations will be exercised as those which have been used hitherto, but also such others as the Honourable Lord Commissioner over this Government, by virtue of the high power and authority granted to his Honour, shall in due time find appropriate. Furthermore, to inquire in the most precise manner whether the refusal of the cattle-breeding inhabitants to sell cattle to the Company's contracted butchers is to be attributed to the aforesaid reasons, and if so, then investigating by whom or on whose behalf they were brought into such a false delusion, or whether other reasons or grievances gave occasion to that refusal, in order to take cognizance thereof, supported as much as possible with evidence or testimonies, and to make a proper written report thereof, so that we may find ourselves in a position, upon finding their fairness and legitimacy, to remove those grievances in such manner as we shall deem advisable. 522 523 For which taken trouble the Honorable Commissioner was politely thanked. Contracting of the required lime, of which the contractor has become, the same for twenty-four stuyvers the half aam. Likewise having proceeded to the contracting of the alongside mentioned materials. decreed by the High Noble Lords Commissioners-General in more of their High Nobilities' publication of the 20th of February of this year, and our arrangements resulting therefrom to facilitate to the residents the payment of their overdue recognition money, might remain obstinate in refusing to sell their livestock to the contracted or to the privileged citizen butchers, and likewise to satisfy from the proceeds thereof in time the annual recognition and a part of the overdue recognition of their loan places proportioned to their capacity, not only the buildings of their loan places and the livestock present there shall be sold by summary execution and without any form of process in order to recover the Company's rightful claims thereon, but also their loan tenure shall be revoked in order to be able to grant the places held by them to other obedient citizens, for we have found such to be fitting for the general good. Likewise having proceeded to the contracting, decreed by resolution of the 28th of August last, of such loads of quarry stone, ironstone, sand, clay, water, baked bricks, and other materials as shall be required for the repair or completion of the batteries and other fortifications situated along the shores of this capital place, Citizen Jan Jurgen Stadler has become the contractor thereof. 524 525 Citizen J. J. Stadler at fifteen stuyvers each load. A nautical commission expressly appointed for that purpose having submitted a report concerning the examination of the broken best bower cable of the ship Leiden, it was resolved to conform completely with the same. Thus he has remained the contractor thereof, and that at fifteen stuyvers each load without distinction that shall have to be transported by him. And furthermore, upon the request made by him in that regard, the supply of the ballast stone required for the aforesaid Company's ships was granted and ceded to the mentioned Stadler, and that at the said price of 35 stuyvers the load, for which up to now 24 stuyvers has been paid. Hereafter was read a report submitted by sea captains expressly commissioned for that purpose concerning the examination of the best bower cable of the ship Leiden broken on the 10th of this month, which report was found to be of the following content: To the Right Honorable and Stern Sir, Mr. A. The Pay Office Examiner Clemens Matthiessen Junior, pursuant to and in compliance with what was required of him by resolution of this Council of 2 November last, having submitted the following report to this Council. To the Right Honourable Master Abraham Josias Sluysken, Extraordinary Member of the Council of the Netherlands Indies and Commissioner of the Cape of Good Hope and its dependencies, together with the Right Honourable Governor and the Honourable Political Council. Right Honourable Sir, Right Honourable Sir, Honourable Sirs. By resolution of 2 November of the past year, the humble undersigned was authorized to receive such moneys as the Company servants struck off the payroll and loaned out, who appeared before the Honourable gentlemen Lesueur and Van Reede van Oudshoorn, are bound to pay for the obtained permission to reside in this Colony while struck off the payroll, with instructions to submit a general and specific list thereof, in order to transfer the collected moneys upon written warrant into the treasury of the Honourable Company; in dutiful compliance with this highly revered order, the undersigned has the honour to present herewith to Your Right Honourable, Right Honourable, and Honourable Sirs five lists numbered 1 to five, containing: No. 1, a specific statement of what those struck off the payroll have paid, with an indication of which persons have defaulted on payment, or have departed from here and are employed in the service of the Honourable Company, as well as those who have stated to the Honourable commissioners their defects whereby they are unfit for the service of the Honourable Company; received on this list: 2786 rixdollars 32. No. 2, a similar statement of the loaned servants who have paid: 3845 rixdollars. No. 3, containing such persons who arrived at the Cape after the conclusion of the commission, with the addition of the reasons why they were prevented from appearing at the proper time; received on this: 121 rixdollars 32. The humble petitioner respectfully requests that it may please Your Right Honourable, Right Honourable, and Honourable Sirs to authorize him to pay the moneys remaining in his hands as aforesaid into the Company's treasury, and that under the date of the last of August last, because the same properly belong to the financial year of 1792/93, while he awaits with due reverence the decision of the Honourable Company, of Your Right Honourable, Right Honourable, and Honourable Sirs as to how to deal with such persons who have defaulted on making payment. The lists under No. 4 and 5 contain the names of such persons who continue on the pay books as struck off the payroll and on loan and have not yet appeared to date; subject to favourable interpretation and humble submission to better judgment, the humble petitioner reflects whether it might not be well that these persons were once again, and indeed superfluously, summoned by name to report to the Fiscal's Office within a certain term to be determined and to state the reasons why they have not reported; and, in order to clear the pay books of persons who may no longer be alive, that the undersigned were authorized to close off on the pay books as missing all those who have not appeared before the last of August 1794; while it appears from the foregoing how difficult it is to get such persons together and to trace their whereabouts, the undersigned takes the liberty to propose to Your Right Honourable, Right Honourable, and Honourable Sirs with due respect, whether it would not be expedient and useful that an extract of the order of Their High Mightinesses and the Political Council resolution of 25 October 1792 regarding the striking off the payroll of Company servants be issued to the commanders of the respective corps, the Master of Equipage, Regents of the Hospital, and Officers of the Line for their information, with instructions to return those on struck-off payroll to the Pay Office every year as of the last of June in the same manner as the active personnel, commencing from the day of the aforesaid resolution; and that the undersigned were authorized to make an extract from the pay books of such persons who have since then been struck off the payroll to date, and to send a nominal roll to each of the aforesaid heads; that subsequently, regarding the loaned servants, the orders of Their High Mightinesses, the High and Mighty Commissioners-General, on the matter of loans be made known to the inhabitants of this Colony by proclamation, with instructions to renew this loan annually under penalty of the fine established for that purpose. 538 539 stem, two lodging knees, and on both sides between decks upon the beams, of which the knees in the hold are cracked, 10 to 12 knees had to be laid to restore the ship's structural strength again, that the doubling had to be demolished down to the water in order to reach the seams of the wales and hooks which would certainly be open, to caulk them properly and provide for them; that further the ceiling planking would have to be patched with pine boards in some places. The heavy costs of transporting the materials for such a capital repair made the council decide to order me to put that ship into such a state that it could come from False Bay to this place after the end of the bad season, in order to have that repair done here with more ease and less cost. Then, having been reported by the ship's officers that on this its last passage they had to pump much water, it pleased Your Right Honorable to order us, the undersigned, to make a further inspection on board that vessel in order to report to Your Right Honorable from what cause it would appear to us that the said ship has taken in so much water and what provisions are to be made in that regard. Pursuant to these so revered orders we have the honor to bring to Your Right Honorable's attention that, besides the already cited defects, some of which have already been repaired in False Bay, we have found none other than two heavy leaks on both sides between the chesstree and the fore-chains, about six feet below water, the water rushing into the ship with force as if through a sluice, not doubting that several more leaks will still present themselves below water; and since the ship is otherwise still in such condition that the Honorable Company could still have service from it, it is our collective opinion that in order to put that vessel back into a condition to be loaded and to undertake a voyage elsewhere, it must be careened; that the Captain-Lieutenant of the said ship reported to us that today at 12 o'clock noon the pump had been pumped dry at 7 inches, and that we have now, at about 4 o'clock, found 25 inches of water in it. Captain Van Veerden, being unable to be present at the execution of this commission due to indisposition. Voltelen. 540 541 After the reading of which, the Honorable Commissioner was pleased to communicate to the Council that His Honor had conferred with the Master of the Equipage about this, who, besides making the said declaration, provided a list, as follows below, of the materials that will be required to careen the aforementioned ship Drechterland. After the reading of which, it was communicated to the Council by the Honorable Commissioner that His Honor, after receipt of that report, had conferred with the Master of the Equipage, Jan Arnold Voltelen, about the means which, in his view, ought to be employed to enable the ship Drechterland, in accordance with the aforesaid report, by careening it, to be loaded and dispatched from here; that the said Master of the Equipage had thereupon indeed affirmed to His Honor the necessity of careening that vessel against a large ship, but also at the same time maintained that when the frigate ship De Meermin should be properly ballasted, the careening of the ship Drechterland could then be carried out therewith in Saldanha Bay and, barring unforeseen accidents, properly effected; but that before proceeding to the careening, the ship Drechterland necessarily had to be repaired at this roadstead, and that both for that repair and for the careening of the said vessel such materials and necessities are required as were specified by him, the Master of the Equipage, in the report submitted by him and inserted below.
