990: 991 with a proposal to the Council to proceed as soon as possible by public tender. With which the Council having concurred, on the 24th of the upcoming month of December. How this will be further handled. It was thereupon resolved to demand the Resident of False Bay, Christoffel Brand, to have that building erected. The aforementioned Honorable Commissioner having further been pleased to communicate the necessity of a small, minor building as a guardhouse for the artillerymen stationed there. Regarding the place where the same magazine could and should best be built, and having had that site staked out according to the plan drawn up by the Captain-Engineer Thibault mentioned herebefore, and therefore proposed to the Council to allow the construction of the said gunpowder magazine to proceed as soon as possible by public tender according to the said plan and on the site designated for that purpose; with which proposal the Council having concurred, this public tender is set for Tuesday the 24th of the upcoming month of December, and immediate notice thereof will be given to the public by the posting of placards, while in the meantime the conditions of the tender will be drafted as soon as possible in order to be approved in Council and made known to the interested parties for their perusal. On the occasion that the Honorable Commissioner found himself in False Bay, it was perceived by His Honor that there was a necessity that a small, minor building should be erected there, provided only with a door and two windows, to serve as a guardhouse for the detachment of artillerymen who ought continually to stay near the battery located there; thus, in consideration that this building will be of too little importance to have it constructed by public tender, it was approved and agreed to instruct the Resident of False Bay, Christoffel Brandt, to have that building or guardhouse, with a length of 24 feet and a width of 18 feet interior measurement, erected by Company craftsmen in the simplest and least expensive manner, with the beams and spars needed for this purpose to be cut from the Company forests. 992: 993 The Honorable Commissioner also having perceived the necessity that the stable at Muizenburg be provided with a door, a chimney, and the necessary mangers. For the aforementioned reasons, the said Mr. Brandt is furthermore authorized to provide for the one and the other. It being furthermore perceived by the Honorable Commissioners that the stable at Muizenburg, of which the plastering of the walls and the covering with thatch was publicly contracted and partly completed, is unprovided with a gate or door to close it, as well as a chimney, and likewise with mangers for the horses, all requirements which were found there before that stable burned down and are also necessary, indeed indispensable, when one would have to make the intended use of that building, namely to house and care for detachments of the Burger Cavalry there; that also, when the master of the Muizenburg post along with the fishermen who had been stationed there had been discharged, a quartermaster hitherto stationed at the lines had been placed there to keep watch over that post, and two sailors were assigned to him to make signals; thus, upon consideration of the necessity to make appropriate provision in these matters, it was resolved on the proposal of the Honorable Commissioner to further authorize Resident Brandt to provide the stable at Muizenburg with a wooden gate at the least possible expense, as well as to have a chimney and hearth built therein, and at the same time to have the necessary mangers made in one of the wings of that building which His Honor shall judge most suitable for feeding horses, with the wood needed for this purpose, insofar as having there

Communication from the Honorable Commissioner of the complaint made by the Dispatch Riders to his Honor about the difficult rides they must make without enjoying anything for it. can be used for that purpose must be chopped out of the forests, but the required planks will be provided from the inventory, while at the same time it was approved to appoint the quartermaster Joseph Vrouw, who is at Muijsenburgh, as Boss of that post at his earned wage of f18:—:– per month, and a new three-year contract, and he shall be placed under the obligation to operate the signals, without having anyone there for his assistance, wherefore both sailors assigned to Muijzenburgh shall be discharged from that post to be sent from there to the line. Subsequently, the response prepared by the Honorable Administrator in his capacity as Chief Administrator pursuant to and in fulfillment of the resolution of this table of the 3rd of October last, concerning the findings on the trade books of this Government from 1782/3 to 1784/5, having been resumed; so it was, after the said response had been approved in all respects, resolved to have the same placed in the margin of the findings received, and to send the same thus to Batavia by the first available shipping opportunity, with the humble request that, since the errors from which the compensations imposed by the aforementioned findings arose have mostly been clarified in the response, their High Mightinesses, the Lords of the Supreme Indian Government, will also be highly pleased graciously to exempt this Government therefrom, the more so as most of those errors, as well as the irregular write-offs, occurred years ago and were committed by ministers or servants who have long since departed from here; while the aforementioned Supreme Indian Government will at the same time be respectfully assured that henceforth watch will be kept with all attention and zeal that the aforementioned orders and commands are strictly observed and followed, both in the write-offs and in all other respects concerning the governance and management of this Government. errors Then concerning this matter, the following accountability having been submitted by the Master of the Cellars, Mr. Lesueur. and the 8th of this current month, the valuation of two strips of land requested in ownership by the citizens Georg Willem Hoppe and Jan Michiel Holtz having been demanded from Commissioners from the Council of Justice, as well as the nomination of ward masters to fill the places of the ward masters Christiaan Kemper, Sebastiaan Valentijn van Reenen, and Pieter de Hoogh discharged by the last-mentioned resolution, the following notice has been submitted by that Board in compliance with both these matters, together with a report drawn up by its delegates concerning the conditions under which the aforementioned strips of land could be granted in ownership to the respective petitioners, all reading as follows. Honorable Sir and Respected Gentlemen, The undersigned having been commissioned by resolution of this Board of 23 September last to examine and value, pursuant to the order by Council of Policy resolution of the 10th of the month just mentioned, certain two strips of land requested by the citizens George Willem Hoppe and Jan Michiel Holts respectively from the Honorable Council of Policy by petition, the undersigned have the honor to report that, in pursuance thereof and in the presence of the Deputy Fiscal of this Government, they have examined both requested strips of land and found that the same can be granted to the petitioners without prejudice to anyone, and therefore have valued and determined the recognition fee for their acquisition as follows hereafter: To Johan Michiel Holst, a strip of land of a width of 50 feet for a sum of Rds 150, provided that the alignment shall be made even with the street behind the outer canal, as yet unnamed. To George Willem Hoppe, a piece of land of a size of 31 square rods and 900 feet for Rds 250, provided that the alignment must be made even with his house and rental houses; That the ditch over which the new bridge shall be made, from the house of the citizen Van Brat up to the old sluice, must be cleared and enclosed with small walls by him, Hoppe; That the old sluice opposite the Stable Street must remain standing, with a passage for the raising and lowering of the same, while both that one and the new sluice and bridge to be made must be provided at the expense of him, Hoppe; and lastly, That the new bridge and sluice, 12 feet wider than the old one, shall be made and placed at his expense opposite the blind street. After reading these documents, it was initially resolved to fully conform with the report submitted to the Commissioners by the delegates concerning the examination and valuation of the strips of land requested by the burghers George Willem Hoppe and Jan Michiel Holst, respectively; consequently, the said report shall be converted into a resolution of this Council, as the same is converted hereby, and the requested land measuring 31 square rods and 90 square feet is ceded in ownership to the first-mentioned of the petitioners against payment of a recognition fee of 250 rixdollars, and the ownership of the piece of land measuring 50 square feet is likewise granted to the last-mentioned against payment of 150 rixdollars; and further under such conditions and servitudes as have been determined and specified by the Commissioners; while, moreover, from the nomination of ward masters made by the Commissioners from the Council of Justice, the following appointments have been made, namely: In Ward No. 16: Andries Heijse In Ward No. 19: Carel Bestendig Over all the gardens situated on the other side of the water- and barley mills: Hermanus ter Hoeve On this occasion, taking into reconsideration a report addressed to this government by the Commissioners from the Council of Justice under date of the first of March of this year, accompanying the Instructions drawn up by them for the Building Surveyor of this town, the said Instructions were found to be of the following content: Instructions for the Building Surveyor for the prevention of all disorders and irregularities that are customary to occur in the building of houses, as well as the questions and disputes arising therefrom. Article 1 No one shall be permitted, whenever he tears down a house, to lay the foundations before he has called the Building Surveyor to it and the foundation has been aligned by the said Building Surveyor. Article 2 Just as no one, after having laid the foundations in conformity with such alignment, shall be permitted to proceed with the building before the Building Surveyor has once again been called to it, in order to come and see whether his designated alignment has been properly followed in the laying of the foundations; on pain, as in the previous articles, of forfeiting ten rixdollars for the benefit of the burgher treasury should he fail herein, and such persons shall moreover be obliged to relay and rebuild those foundations at their own expense. Article 3 Whosoever wishes to make his foundation lower or deeper than his neighbor's foundations for his intended building, shall be obliged to secure his neighbor's house from the outside with props as well as otherwise to the satisfaction of the Building Surveyor, on pain of arbitrary correction, and still be obliged to compensate for the damage that his neighbor has come to suffer thereby. Article 4 Henceforth, no houses or stoops, whether they have projecting steps or not, may be raised or rebuilt without the Building Surveyor having first been called for it and an inspection having been made by him, likewise on pain of forfeiting three rixdollars for the benefit as aforesaid. Article 5 Likewise, no sewers may be made from the houses into the streets, nor along the streets to the gutters, without the Building Surveyor having indicated the direction thereof, and also, the excavation of what was at hand having been done, no greater height or slope may be given to the said streets than that which shall have been determined by the Building Surveyor, on pain of forfeiting five rixdollars for the benefit of the said burgher treasury. Article 6 The Building Surveyor, being called to the inspection mentioned hereinbefore, shall have one rixdollar for each time. Article 7 No one shall insult the Building Surveyor in the matter of his office with words or deeds, on pain of arbitrary correction. And now, after deliberation on the said Instructions, it was approved and understood to adopt and enact the same in their entirety, as is done hereby; and at the same time it was decided to appoint as Building Surveyor the sworn land surveyor Jan Willem Wernich, and this upon the oath taken by him as a land surveyor to the country and the Company; consequently, the necessary notice shall be given to the public both of the appointment of the Building Surveyor and of the Instructions drafted and enacted for him by publication and affixing of placards. Please communicate to the Honorable Lord Commissioner regarding the Which doing &c. /was signed:/ W C V Reede van Oudtshoorn Thus, after the various points appearing therein had been deliberated upon with all attention, it was decided to allow the epidemic building of the Hospital, which had been designated for the storage of Wheat for the Company, but was recently cleared and appropriated in order to serve upon the arrival of auxiliary troops as Barracks for the same, to be used once again for the storage of Wheat; accordingly, the Gun racks, Bedsteads, Mattresses &c. found in that building shall be stored in some other apartments of the new Hospital until such time as they shall be required either for Auxiliary troops or otherwise for the benefit of the Company. Then, regarding the second point of the aforementioned petition, the second point having been seen, it was communicated by the Honorable Lord Commissioner that, His Honor having learned that a warehouse formerly used to store barley had been granted by the Lord Commander to the Citizen Arend van Wielligh, as contractor for the supply of Bread-flour and biscuit for the benefit of the Company, for the storage of flour, he had ordered the said van Wielligh that he would have to vacate that warehouse; but that the latter had represented to His Honor not only how difficult but also how costly it would be for him to have to transport, at his own expense, to another warehouse, all the flour which he had stored in the said warehouse and from time to time had to supply to the Company's ships and servants; with an urgent request to be permitted to retain the warehouse granted to him for the storage of flour for that purpose, and offering to grant to the Company, for the storage of Barley instead of that Building, a warehouse belonging to him, much more spacious and larger than that of the Company; and that His Honor, having found this request and offer of the said van Wielligh reasonable, had consented thereto; wherefore the Lord van Reede van Oudtshoorn shall have to place and store the Barley, which will be purchased by His Honor for the account of the Company, in the Warehouse granted for that purpose by the repeatedly mentioned van Wielligh, and the latter shall keep in use the warehouse permitted to him for the storage of flour until the flour currently inside it shall have been supplied by him. At which time that building shall again have to serve for the storage of Barley or for such other purposes as shall be deemed serviceable and necessary. — Furthermore, pursuant to the request of the Lord van Reede van Oudtshoorn, an advance of a sum of Two thousand Rixdollars shall be made to His Honor from the Company's Treasury upon written warrant from the Honorable Lord Commissioner, to be employed by His Honor for the purchase of Barley; for which sum His Honor shall be debited in the trade books, in order to be credited for its cost and cleared on this Account when the required quantity of Barley shall have been purchased by His Honor and an account thereof rendered; all other requests made therein having been granted in their entirety. And whereas necessity requires that at the Company's Grain storehouses there be a suitable apartment for the administrator of those storehouses, from which he can issue receipts for the delivered Grains to the farmers, and at the same time store the books and papers relating to that administration; it is in this regard deemed best, and consequently decided, to authorize the Lord van Reede van Oudtshoorn to have constructed for the account of the Company, at the least possible expense by private individuals, in one of the passages in front of the Company's corn storehouses standing on the beach, such a small room wherein His Honor will be able to perform the clerical work of the administration of the corn storehouses. To order Commissioners from the Council of Justice to have that land surveyed and appraised, as likewise resolved, the aforementioned Commissioners and examination of a certain strip of land in this Table Valley requested in ownership by the Burgher Sub-Lieutenant Nelson. The petition of the Burgher Kramer, likewise for a strip of land situated at Drakenstein, granting of the requested plot having prevented the rent entirely from ceasing, it was thereupon resolved to enjoin and order Commissioners from the Council of Justice, as they are hereby ordered, to have the same plot surveyed in their presence by the sworn land surveyor, and subsequently to appraise how much should be paid to the Company by the said Kersten for thus obtaining ownership, in order to serve the Council with a report thereon. The Sub-Lieutenant of the Burgher Militia, Coenraad Nelson, having submitted a request by petition for the ownership of a piece of land measuring 5 morgen 531 square roods, situated in this Table Valley near the garden occupied by him, it was agreed to place the same petition likewise into the hands of Commissioners from the Council of Justice, with orders and command to examine accurately whether the granting of that land could be prejudicial to the Company's interests or to those of private individuals, and if not, to determine the conditions upon which the same could be ceded to the petitioner, as well as how much ought to be paid by him for this to the Company as a recognition fee. The Burgher Jan George Kramer having likewise submitted a request by petition to be allowed to hold in ownership a strip of land measuring 2½ morgen, situated adjacent to his residence under the district of Drakenstein, it was agreed to place that petition into the hands of the Landdrost and Heemraden of Stellenbosch and Drakenstein, with orders to examine with all accuracy and to report to the Council whether that granting of land can take place without doing prejudice to the Company's interests or to any of the inhabitants, and if so, then also to state how much ought to be paid for it to the Company as an acknowledgment. Right Honorable Highly Esteemed Sir and Esteemed Sirs, The Orphan Masters of this place respectfully submit: That, as the petitioners are not able before the closing of the Chamber's books of this current year to draw up a complete report on what has been devised and carried out by them in accordance with and in fulfillment of the highly respected orders of the Commissioners-General regarding the affairs of the Orphan Chamber, they have meanwhile had to proceed with the liquidation of various estates that have devolved to the Orphan Chamber for settlement. On which occasion, however, regarding the salaries of the Orphan Masters, Article 53 of the Instructions enacted for the Orphan Chamber by the aforementioned Commissioners-General should immediately be brought into practice, whereby the fortieth penny was granted to the petitioners. That, since it has pleased Their Right Honors, by their revered directive of 26 February last, as shown by the extract annexed hereto, to grant to the Orphan Masters here, in equality with what the Orphan Masters in Batavia enjoy, out of what comes in for the wards, the 40th penny, 1078 1079 the petitioners, owing to the doubts that have arisen among them regarding the determination of in what manner and from what precisely that salary should be calculated, have therefore deemed it best to investigate how this matter was handled by the Orphan Masters in Batavia, in order to serve as a guide for them in this regard, as far as necessary. That the petitioners, from the accounts sent over here from time to time by the Batavian Orphan Chamber, have found that the Orphan Masters there enjoy the 40th penny on everything that comes into the treasury on account of the estates, whether adult or minor heirs are entitled to the inheritance, and this on all credits without deduction of any burdens, as Your Right Honorable and Esteemed Honors may, if desired, further observe from the copy of such an account under Letter B annexed hereto. That upon considering and comparing those accounts with the new Instructions of the Cape Orphan Chamber, although the Commissioners-General in the aforesaid letter do indeed desire that the 40th penny shall be enjoyed in equality with Batavia, they immediately follow this with such restrictions as the aforementioned Article 53 further dictates, it has on the one hand appeared very questionable to the petitioners to proceed by virtue of their Instructions regarding the 40th penny according to the custom of Batavia, for the following reasons: 1080 1081 First, that, besides the great burden on the estates to enjoy the 40th penny without deduction of the debts attached thereto, this would also conflict with the intention of the preceding Article 6, containing an order on how to act with estates considered sufficient by the Orphan Masters and yet subsequently found insolvent due to emerging debts or charges, whereby it is at the same time determined that in such cases the members of the Orphan Masters shall not calculate the 40th penny of the sold goods, which must be calculated for the benefit of the estate. Second, that the aforementioned Article 53 of their Instructions only permits the 40th penny on the income of orphans, with the further explanation added thereto that under the word "income" in relation to Orphan Masters is understood everything that might be furnished to the Chamber for the account of the wards who are already placed under their supervision, or shall yet be placed, whether legacies or inheritances that might fall to the orphans early or late, and in a word, nothing excepted from what belongs to them or comes to their benefit. And from which it would then follow as a natural consequence that Orphan Masters may withhold no salary of the 40th penny from what is due to adult heirs 1082 1083 in estates, and must content themselves with the 40th penny of the balances that are transferred to the orphan book from closed estates for the benefit of minors, furthermore of their interest, considered as annual income, likewise of all legacies, inheritances, and bequests fallen to their wards and admitted to the Orphan Chamber. That, however, on the other hand, the petitioners had to take into consideration that, with due respect, there appears to be no reason at hand to assume with good ground that, in drafting the Instructions, the intention of the Commissioners-General could have been to have the 40th penny calculated solely on the inheritance of minors; since for the administration and liquidation of estates in which there are adult heirs, no less care and responsibility are required than for those in which only minors are interested. That furthermore, in many respects, the aim of the Commissioners-General to grant the Orphan Masters a fair salary in proportion to their increased labor would be rendered illusory, since estates are frequently administered in the Orphan Chamber in which the most

1084 1085 ...est heirs are of age, as is presently even the case with the estate of the late former burgher councilor Jacob van Reenen the elder, which devolved in the month of August last past according to his testamentary disposition upon the Orphan Chamber for settlement, upon which very few debts are attached, and which yielded upon sale upwards of ƒ 134000:-, yet wherein no minor heirs are found. For which considerations the memorialists find it most consistent with fairness, and thus would indeed lean towards the opinion that the 40th penny ought to be enjoyed by them: 1st. From the interests which are yearly credited to the pupils at the Orphan Chamber or on their respective accounts, considered as real revenues, and furthermore also from all legal inheritances and devolutions of estates which are delivered to the Chamber for the benefit of orphans placed under their supervision, or accepted and administered by the Orphan Masters. 2nd. From the net balances of the estates being closed by them, whether the balances serve for the benefit of or are apportioned between adult and minor heirs, and consequently after the satisfaction of the debts or burdens that attach to the estates. Yet since the memorialists do not consider themselves authorized to make any direct determinations in this matter, they have deemed it best to turn 1086 1087 whereupon it was resolved to explain and declare the 53rd Article of their Instructions, as is done in the margin noted to Your Right Honorable and Honorable Lordships with a humble request that it may be Your Lordships' pleasure to declare whether Your Right Honorable and Honorable Lordships agree with the opinions of the memorialists, and consequently also wish that they shall proceed thus with the calculation for the 40th penny, or, interpreting the aforesaid 53rd Article of the Instructions, to be pleased to order the memorialists how they shall have to conduct themselves in this regard. The Noble Lord Commissioner having made known that His Honour had appointed the sailor Lubertus Mundeleij as overseer of the Company's post the Zeekoevalleij; appointment by the ship's council of the ship Constantia of some boatmen and sailors; also to carry out, with that attention and diligence which is required, the commission which the Right Honourable Lords Commissioners General had assigned to him and Mr. Brandt to keep close supervision over the administration of the timber warehouse, with the request to be relieved thereof; and that His Honour, in view of the necessity that the said timber warehouse finally be surveyed and checked accurately and piece by piece, which will certainly be a work of long duration, and that the said Rheede van Oudtshoorn due to his numerous other commissions has no time left for this, had relieved him of that commission and assigned the same, alongside Mr. Brandt, to the Merchant Titular Jan Pieter Baumgardt, who accordingly shall have to perform in this matter everything that was demanded of Mr. van Reede van Oudtshoorn. And to seat in the Council at ƒ 30 per month. Right Honourable Lord, Before I succeeded in being admitted as a Burgher of the Cape, I dispatched a ship named Jean Bart, Captain Gandzon, the ship and cargo belonging to me, to the coast of Bengal and Madras. But when the said Captain had settled my affairs there and was returning to Mauritius, he was overtaken by contrary winds along the way, and through want of water was forced to resolve to call at the Island of Sumatra at Pedaire, where he immediately found everything he required. But as the said Captain prepared to depart anew and was settling his affairs with the natives, they took advantage of the moment when the said Captain was drinking a coconut to thrust a poisoned poniard through his chest, which deprived him of life. The Governor of Pulo Penang, learning of this deed, immediately dispatched an English ship to save whatever he could, but nothing was found except the said ship, which was subsequently brought to Pondicherry and sold there for the benefit of the insurers. Cabarus and Sons, merchants at Bordeaux, who were instructed to have the said ship insured, having informed us that this was done in London, I take the liberty to submit to Your Right Honourable Honour how the war between France and several powers currently completely prevents all manner of correspondence, but that I possess all titles of ownership to present myself without fear to my creditors, if I obtain permission to depart for London, and to collect a capital which I intend to spend in Holland for the purchase of a ship to navigate in these seas, which offers a happy prospect to an enterprising man.
