to proceed by vessels to the Netherlands, resolved to grant the request made by the said Antonij Watering as the same is hereby granted, he consequently being permitted to depart thither on the English vessel Eliza, currently present and destined for St. Helena, and to proceed from there to England, under the express condition however that, upon safe arrival in England, he shall proceed to the Netherlands within the span of two months, and for the fulfillment of this obligation imposed upon him he must provide to the satisfaction of this Government two sufficient sureties, who shall be obliged to bind themselves that, in case the said Watering should fail to comply therewith and not present himself within two months after his arrival in one of the cities of the Republic where the Company maintains its chambers, they shall then pay into its treasury here, for the benefit and profit of the Company, the sum of One thousand rixdollars; of which request and the resolution following thereupon respectful notice shall be given at the very first opportunity to the Illustrious Assembly of Seventeen, with the request most favorably to facilitate the said Watering in the enterprises undertaken by him for the welfare of this country, and that there shall be handed to him a complete extract of this resolution, with the inclusion of his request, so that, if he complies with the conditions upon which the same was granted to him and should arrive in the Netherlands before any notice regarding him has been received there from this Council, he may prove the same and be able to implore the high favor of the High Commanding Lords Majors in a legal manner. Furthermore, there was read the following petition addressed to this Council by the Captain of the Burgher Guard Pieter van Breda: To the Right Honorable, Highly Esteemed Master Abraham Josias Sluysken, Extraordinary Councillor of the Dutch East Indies and Commissioner of this Government at the Cape of Good Hope and its dependencies, etc., etc., etc., together with the Right Honorable, Esteemed Administrator and the Esteemed Council of Policy: With all the greatest respect and in all submissiveness, the undersigned Captain of the Cape Burgher Guard, Pieter van Breda, makes known: Right Honorable, Highly Esteemed Sir, Esteemed Gentlemen, That the petitioner, having become the owner through purchase of the garden Oranjezigt in the confident belief that no encumbrance of lease or anything of the kind was attached to his property, has also enjoyed the undisturbed use thereof for a series of years. That some time ago, by the Bookkeeper General of the country's public revenues, the Right Honorable, Esteemed Sir Olof Godlieb de Wet, the petitioner was reminded that upon his, the petitioner's, aforementioned garden Oranjezigt, there were outstanding annual recognition dues since the year 1769, for which the petitioner had stood debited in the books since that time. The petitioner takes the liberty, with your Right Honorable, Highly Esteemed and Esteemed Sirs' favorable indulgence, to bring to your attention that his, the petitioner's, deceased father, the late former Burgher Councillor Michiel van Breda, until the year 1769, had indeed paid annual lease moneys to the Company for a part of the petitioner's garden as its then possessor; but that by the then late Right Honorable, Highly Esteemed Governor Ryk Tulbagh, in consideration of and in compensation for the service rendered to the Company and this Colony by the petitioner's late father—not to permit that a glorious and pure water spring, arising in his old freehold land already granted in full ownership to the previous owner Durand Soulliers in the year 1709 by the Governor then officiating here, the Right Honorable and Gallant Louis van Assenburgh, should serve for the general use, and in the same manner as it still takes place today—all the land possessed by him under lease was granted to him in full ownership, as appears from the chart and title deed of 22 August 1769, measuring 33 morgen, [illegible] square rods, and 123 ditto feet. That subsequently, in the year 1781, the then Right Honorable and Gallant Governor van Plettenberg, in order to remove the disputes prevailing among the neighbors, enlarged the petitioner's property to 41 morgen, 34 square rods, and 38 ditto feet, as appears from the title deed dated 9 October 1781, without any the slightest conditions. The petitioner thus maintaining that regarding this, in consideration of the fact that when full and free ownership was granted by Governor Ryk Tulbagh to the petitioner's late father for the reasons mentioned in his petition, an omission occurred in the result of the year 1769 in failing properly to write off and make known the same in the books for the largest part of the land, he therefore takes the liberty very humbly to request your Right Honorable, Highly Esteemed and Right Honorable, Esteemed Sirs that it may please your High Esteem to have this omission redressed and to liberate the petitioner from the obligation that has remained attached to him through this omission. It was thereupon resolved to write off the overdue recognition fee resting upon his land since that time. Messrs. Members of the Council Brandt and Bergh, pursuant to the qualification granted to their Honors regarding this matter, having submitted the following report: that regarding the garden presently still possessed by him, without attaching any obligations to the payment of an annual recognition fee, it was certainly the intention to exempt therefrom the two morgen of which that garden previously consisted and upon which that obligation was attached, as yielding a trivial income of forty-eight stuivers per year to the Company, and that therefore most certainly an oversight took place in this regard in the year 1769; it was deemed good and understood to declare, as it is declared by these presents, that the two morgen, 473 square roods and 21 square feet, of which the petitioner's garden Oranjezicht consisted prior to the 22nd of August 1769, were included and shall henceforth remain under the ownership of land ceded on that day to his deceased father Michiel van Breda, without being bound to pay therefrom, neither for the past nor for the future, the annual recognition fee of forty-four stuivers determined by title deed of the year 1709, and accordingly the overdue recognition fee attached to the aforementioned land since the year 1769 shall be written off. The Messrs. Members of the Council Christoffel Brandt and Egbertus Bergh, who by resolution of this assembly of the 8th of this current month were requested to serve the Council with their considerations on how the establishment of the post Zoetemelksvallei, pro rata with the ends for which it is still maintained, could be reduced, having submitted the following report: To the Right Honorable Abraham Josias Sluysken, Ordinary Member of the Council of Netherlands India and Commissioner over the Government of the Cape of Good Hope and its dependencies, etc., etc., together with the Honorable Acting Governor and the Honorable Members of the Council of Policy. Right Honorable Sir and Honorable Sirs, By resolution taken on the 8th of this month, of which the undersigned received an extract a few days ago, it having been assigned by your Honors to them to demand from the Boss Marthinus Theunisz stationed at the Company's post Soetemelksvallei an exact list of the personnel currently stationed at the said post, indicating to what tasks they are employed, as well as an inventory of all the Company's goods on hand there, in order to ascertain from the aforementioned documents and subsequently report to your Honors how many of the aforementioned personnel should still remain there, since the establishment has been greatly reduced by the successive sales of most of the livestock formerly maintained at this post, as well as which of the goods located there should henceforth also continue to be retained, all in order to enable your Honors to make such dispositions regarding superfluous personnel and goods as shall be deemed proper; they have, in compliance with what is prescribed above, initially had supplied to them the above-mentioned pertinent list of the number of personnel stationed at the Company's post Zoetemelksvallei and the nature of their employment, together with an accurate inventory of everything that has belonged to the further establishment of this post, and have perceived both from the said documents and from the further information obtained, that according to the pay books there currently still appear assigned to Zoetemelksvallei one Boss at the wage of 30 guilders per month, together with 8 common soldiers under his orders, of whom eight earn 10 guilders, three 13 guilders, and one 14 guilders, to which are also added two slaves from the Company's slave lodge; however, since under the supervision of the aforementioned Theunisz in his capacity as Boss of Zoetemelksvallei there have also belonged the stations situated around and near this post, 't Ziekenhuis, Tijgerhoek, Appelskraal, Bokke Rivier, Droogeboom, and several others that have either already been granted on loan to private individuals or, not being known under any fixed and definite name, cannot be stated nominatively, as well as the warm bath at the Zwarteberg

1130 1131 Berg, over all of which proper supervision had to be maintained, two of the aforementioned Europeans have been employed as overseers, one at the place 't Ziekenhuijs, currently leased to the said Theunisz., and one at Tijgerhoek, of which the burgher Nicolaas Conlijn obtained the usufruct for the duration of his life from the Lords Commissioners-General, and another at the Warm Bad, who is currently stationed there as well, so that properly speaking, for and on the post Zoetemelksvallei alone, there have been retained only the nine remaining common men and two Company slaves, besides the goods specified on the previously mentioned inventory annexed hereto, to which, for the sake of brevity, permission is taken to refer; and that of these nine men, some have been stationed in the forests to fell timber, which, before it was fetched by sea from Plettenbergsbaai, had to be furnished from this post Zoetemelksvallei for the Company's administration; others have properly prepared and shaped that timber at the post; and the remainder were charged with the transport thereof, first out of the forests to the post, and subsequently from the post to the Cape. Having subsequently taken into consideration how many of the aforementioned men and goods ought still hereafter to be retained No. 32 1133 to serve the purposes for which the post Zoetemelksvallei shall henceforth have to serve, it appeared to the undersigned that if henceforth no other use were to be made of this post than to pasture thereon the few draught animals and young oxen which the Company, under present circumstances, inevitably requires for its operations—which would entail that the costly and difficult transport by wagon of timber from the forests situated hereabouts to the Cape would be entirely abandoned in favor of the much easier procurement thereof by sea from Plettenbergsbaai—then two Europeans as foresters, together with two Company slaves for tending the livestock, with such of the goods on the aforementioned inventory as are listed in a separate memorandum accompanying this for the contemplation of Your Right Honorable and Honorable, would be fully sufficient to manage the operations of this post, provided that a third permanent European were stationed at the Warm Bad; that all the unnecessary places which the Company still possesses here in the vicinity and does not need for grazing its own livestock be granted on loan under certain conditions that would leave the government the power to immediately revoke the same whenever this might be necessary; 1134 1135 and that a competent and active individual be entrusted with the supervision of the aforementioned Bad, as well as the repeatedly mentioned post Zoetemelksvallei and the forests belonging under it, in order to ensure, firstly, that no one shall make use of the Bad except such persons to whom the respective chief commanders for the time being shall have granted a written permit, to enable the said supervisor to do so, which permits henceforth, for every person, be he whom he may, Company servant or burgher, freeman or slave, ought to be written on a designated stamp of 24 stuivers, or on a larger stamp proportioned to the number of persons intending to proceed to the Bad in the company or retinue of the one who obtained the consent, expressly stating by name who constitutes that company or retinue; secondly, that the buildings of the post be properly maintained and the livestock cared for; and lastly, above all, that no wood be felled without the special written consent of the chief commander in the forests situated along the Rivier Zonder End, which, except in very extraordinary cases, can consequently and must necessarily remain closed to private individuals, so that these forests, from which for a series of years successively almost all suitable trees 1136 1137 have been felled, may thus find the opportunity to recover. However, since at the post Zoetemelksvallei a start was already made some considerable time ago on building a new dwelling house, which is currently not only already raised to beam height, but for which everything necessary has long since been provided and prepared, as well as being at hand at the aforementioned post, so that if one were to proceed with this work already commenced, the said house could be entirely constructed within three or at most four months without requiring any further expenses to be incurred, other than that, besides the above-mentioned two Europeans and two slave boys who will remain permanently attached to that post, two to three additional persons of the remaining men be retained here until the end of March of next year to be employed for the aforementioned purpose; and it being indubitably certain that such a completion of a solid and strong new house, instead of the presently existing dwelling which due to its age and defects can no longer be used, would significantly influence the purchase price in the Company's favor in case of the sale of this post, the undersigned, submitting to the better

to the sentiment of your Right Honourable and Honourable Sirs, are of the opinion that the undertaken construction of the aforementioned new house ought to be continued until its complete erection, and that consequently, in reducing the number of men currently still present at the post de Zoetemelksvallei to the limit described herebefore, one should proceed in such a manner that immediately from there are discharged and sent hither 7 of the aforementioned thirteen men, and that by the end of March of the coming year 1794, another 3 others are summoned, whereupon in total there shall remain behind 3 Europeans and 2 Company slaves to be used, as stated herebefore, for attendance at the Bath, guarding of the forests, and whatever of the Company's livestock is still on hand. On the 19th of the current month, an extract resolution taken in the Council of Policy on Thursday the 31st of October having been delivered into the hands of the undersigned, whereby they were ordered and commissioned to carefully examine and take into inventory all tools, woodwork, and other goods found both in the guardhouse at Rogge Bay and in the dark hole in the Castle, to note therewith which tools, woodwork, are in such condition that they could still be used to the benefit and use of the Company, which then shall have to be handed over by them to the respective administrators to whose administration they belong, to be taken in by them as well as in the trade books unvalued though specified, etc. Having the honour to report to Your Right Honourable Grand Worships that they, having carefully examined everything and brought it under inventory, adding that which can be taken into the different administrations where it belongs for the use of the Company, to be issued again, and that which could be sold as unfit or presently useless to the Company, to wit, as: In the guardhouse of Rogge Bay is found: To be taken into the Trade Warehouse: 1 piece ripsaw. 5 drill bits. 3 hewing axes. 72 planes No. 3 without chisels, these chisels thus to be issued separately. 67 gouges. 8 pairs of match planes. Reason why the Honorable Commissioner deemed it necessary to have the resolutions of 30 November last altered and amended. Tuesday, 10 December 1793, in the morning. Initially, the Honorable Commissioner gave notice that, upon reading over the resolutions of 30 November last, it had occurred to His Honor that in the decision taken on the report of Mr. Van Rheede van Oudtshoorn concerning the deficit which, according to the report of the superintendent of the grain storehouse in Mossel Bay, Nicolaas Jacob Dohman, was supposed to have occurred in the grain there, it was stated among other things that the said deficit was attributed by the aforementioned Dohman to the bad condition of a building newly erected a few years ago; whereas in the report itself this is attributed to the continuous leakage of the storehouse, which had been caused by the nearly continuous rains that fell during the last winter season, with the addition that he had left untried no means at hand to repair the flat roofs as much as possible whenever the weather was somewhat dry, and to cover the grain in the storehouse with bags; and that His Honor had therefore deemed it necessary to have this recorded, in order hereby to alter and amend the aforementioned wording in the said resolutions of 30 November, which had been placed there through haste and had escaped His Honor's attention at the resumption of the same. as well as to appoint as assistants the former Attorney Reitz and, from the status of discontinued salary, the assistant to the minister of the congregation at Drakenstein, Ahling, whose salary upon his request made to that effect has been increased to f 120 per month; so it was resolved to grant the contractor for the supply of butter, who upon his request made to that effect would have had to step down, to continue for another two years in this his service; as well as that His Honour, to fill the vacancy left by bookkeeper Andries Stockenstroom, had reinstated as assistant at the Secretariat of Justice the former Attorney Mattheus Isaac Reitz, and likewise in place of the assistant Jan Weege, who was appointed secretary of Stellenbosch and Drakenstein, had returned to his previous rank as ordinary clerk at the Political Secretariat the assistant Lambertus Philippus van der Poel, who on 27 September 1791 had been placed on discontinued salary due to indisposition, both with the salary of f 20 per month, the first-mentioned under a new three-year contract and the last-mentioned under his current contract. Your Right Honourable and Honourable Sirs' very humble and obedient servant Petrus van der Merwe, burgher at Stellenbosch, takes the liberty to turn in all humility to Your Right Honourable and Honourable Sirs, respectfully bringing to your notice: How to the petitioner, as appears from the notarial deed accompanying this in all respect, granted by his father-in-law Frans Rossouw on 14 November 1782, was granted a certain unplanted piece of land with a length of one hundred and fifty and a width of twelve roods, belonging to his further place named the Waterpoel situated at the Rheboks Kloof. That the petitioner subsequently, with all zeal, has provided the said piece of land with the expenditure of some costs with the necessary buildings, and cultivated it in such a manner that he has obtained a reasonable living from it for himself and his family. That upon the death of his aforementioned father-in-law, the petitioner had to discover to his regret that the said piece of land belonged to the Honourable Company, whereby, if the same were not favourably granted to him, the petitioner would find himself plunged into the most bitter poverty. And as the granting of the aforementioned piece of land will not tend to anyone's prejudice, the petitioner turns in all submission to Your Right Honourable and Honourable Sirs, most humbly pleading, for the alleged reasons, to grant the said piece of land to him in ownership, he being not only prepared to pay the recognition due thereon to the Honourable Company, but moreover strictly to comply with a certain condition expressed in the said deed, namely that the water must be left undisturbed in its old course as it is at present. 1210 1211. the Burgher Johannes Lucas Visser having come to make a request for the ownership of a strip of land, and also by the sworn Land Surveyor Wernich a similar request having been made for several morgen of land in perpetual quitrent, had to declare whether they desired the aforementioned land on the specified conditions on loan or not. By the Burgher Johannes Lucas Visser, request having been made by petition for the ownership of a piece of land situated behind the Leeuwenbil above the Society House, it is, in consideration that Commissioners from the Council of Justice, on the occasion that a similar request was placed in their hands for reporting, have requested the Council not to grant any lands whatsoever situated along the Leeuwenberg or behind it to anyone, approved and resolved to decline the petitioner's request and to dismiss it, as the same is dismissed and declined hereby. The sworn Land Surveyor Jan Willem Wernich likewise having made a request by petition to obtain in perpetual quitrent a certain piece of land measuring 4 morgen and 166 square roods, situated adjacent to the erf owned by him at the Diepe Rivier, it is, in consideration that through such grants in places where farmers not only continually pass by but also mostly must unyoke their draught cattle, the pasture of the Cape Flats is more and more obstructed to the considerable prejudice of the collective inhabitants, unanimously resolved henceforth not to grant any lands whatsoever along the Diepe or other rivers running through the Cape Flats, neither in ownership, nor in perpetual quitrent, nor otherwise, and consequently the request made by the said Wernich shall be dismissed, as is done hereby. while the requests presented by some incapacitated servants in order to be placed on written-off pay have been rejected, further disposition regarding the aforementioned persons has been taken by government officials Johannes Leuwer and Jan Podliel Mader, with charge and order to examine accurately the infirmities of all the same persons and to state whether they are of such nature that they may lay claim to the compensation money stipulated in the Articles of War for the loss of limbs, or else to assess how much should be paid out to each of them, according to the further contents of the articles, for the maiming sustained by them in the Company's service, in order to furnish the Council with a report in writing at the earliest opportunity, whereupon, that report having been received, final disposition shall then be made on the aforementioned requests. The citizen Jan Hendrik Holtsmeijer having requested by petition to be allowed to discharge a female slave named Iuliaana van de Kaap from slavish servitude and to set her at liberty, the same has been granted to him, on condition that there shall be paid by him to the diaconate poor of the Reformed church of this town the rd_s 50:- stipulated for that purpose, and furthermore that sufficient surety be provided that the same female slave shall not become a charge to the diaconate within the set time of 20 years. The under-gunner Johan Mattheus Henches, as also the soldiers Ian Fredrik Schultz and Jacob Fredrik Heydendorff, and the sailor Jan Joseph Christiaan Gram having made request by petitions to be discharged from the service of the Company on account of various bodily infirmities and to be permitted to remain here on written-off pay, it has been resolved to decline all these requests and to reject them, as is done herewith, and consequently the named incapacitated persons shall have to be sent to the fatherland on the first occurring occasion according to the orders, unless any of the inhabitants should request the Noble Lord Commissioner to be allowed to take them from the Company's service into theirs by way of loan. The sailor Jan Jacob van Zulk, placed on written-off pay, having made request by petition to be appointed here as schoolkeeper in place of the schoolmaster Swartsenberg who has departed for Batavia, it has been resolved to place the same request into the hands of the Scholarchen of this place, with orders to serve the council with their considerations thereon. After this, it was made known by the Noble Lord Commissioner that among the oxen that are kept for transporting the ordnance and ammunition, twenty-one were found incapacitated by old age to be used for that purpose, and it was therefore resolved to have the said old and incapacitated oxen sold by public auction for the Company's account. To which end we have the honor to inform Your Right Honorable that the vessel must be caulked inside and outside, for which, according to the statement of the co-signatory and master of the ship carpenters, 200 lb of oakum is required, as well as 1½ barrels of pitch and 1 ditto rosin. 1 piece of spar timber of 18¾ palm for a spare main topmast. 1 ditto of 8 palm for a topgallant yard, in place of the topmast and yard delivered by the ship's officers lying in the Bay as per ordinance. 1 oak plank of 4 inches for repairing the topmast crosstree cleats, etc. 15 pieces of pine planks of 2 inches for repairing some sheathing. 60 lb of nails for the sheathing. ½ oak plank of 4 inches for the patch of the knee of the head. 225 lb of sheet lead and 45 lead nails for covering the knee of the head and for some tack-bolt stems. Furthermore, on both sides of the main chainplates, three new chain bolts; and we found the fore-topmast shrouds and backstays unfit, as well as some running rigging; both topgallant sails old and unserviceable; as well as its former messenger rope, presently bent for a buoy rope, unfit to entrust a Company vessel to. Therefore, in order to send the said keel to Europe with confidence, it needs to be provided with new fore-topmast shrouds and backstays, some iron and hawser ropes for the running rigging, two topgallant sails, and a new heavy rope.
