1362 1363 the said commissioners also being appointed to inspect some damaged cardboard coins salvaged from the burned-down house of the messenger at Graaffe Reynet, Krause, in order that following examination they may be exchanged for new pieces. It was agreed to consider the accounting satisfactory, but to sentence the junior merchant Muller to the prescribed fine of two months salary, which however was reduced by the noble Lord Commissioner to one month salary. The commissioners for the signing of the paper coins from 48 to 6 stivers having presented their accounting regarding the signing thereof. pieces considered best and accordingly resolved to have all the damaged cardboard coins brought along by him, Krause, from Graaffe Reijnet examined and checked by the commission appointed above for the inspection of the old, dirty and damaged coins, in order that their value may be assessed by them and made known on each piece under the signature of one of the members of that commission, and the same pieces of cardboard coin, having been thus described, being returned to the repeatedly mentioned Krause, to be exchanged by him with the commissioners for the exchange of old, dirty and worn-out coins for new pieces. Honorable, Respected Sirs: The mutilations which five servants named therein have sustained in the actual service of the Company, together with the reports regarding what compensation should be awarded to each of them, in proportion to their mutilations, pursuant to the articles of engagement, having submitted the following report on this matter: To the Right Honorable, Highly Respected Mr. Abraham Josias Sluysken, Ordinary Councillor of the Netherlands Indies and Commissioner of the Government of the Cape of Good Hope and its dependencies, etc., etc., etc., together with the Honorable, Respected Lord Governor and Right Honorable Lord Councillors of Policy. Right Honorable, Highly Respected Sir, Pursuant to the highly respected order and command given to us, the undersigned, on the 10th of July last, for an exact examination of the five persons injured and mutilated in the actual service of the Company, and concerning the compensation that could be awarded in proportion to their mutilations. We therefore have the honor to report with very great respect that, after an examination was conducted, we found that Godfried Biegt should be placed in the category of having lost two-thirds of his right arm, as the arm was broken in two places, an incapacity or powerlessness as well as a stiffness in the arm joint having remained behind; the hand was also severely injured, after which four fingers remained stiff, so that he can only use the thumb and bend the hand a little; and since the compensation money for the loss of the right arm has been fixed by the Right Honorable Lord Directors at ƒ 800, two-thirds of this sum could also be awarded to him as being proportionate to his mutilation. Johan Michiel Will, who, through extensive crushing of his right thighbone, lost a large amount of splinters or bone fragments, this part having remained crooked and considerably shorter than the healthy one, as it still has three fistulous openings in it and a complete incapacity in that part; if the crushing had not been too close to the hip joint, one would have amputated the limb and relieved him of this part, as he would be considerably happier with a wooden leg; and since the loss of a leg is fixed at ƒ 600:—:—, this part could be considered entirely as lost and a claim could be made for this sum. Johan Godfried Erfurth, who, after a fracture of his right thighbone, retained a slight shortening in that part, however in such a way that he is not able to serve as an assistant gunner; this mutilation could be placed under the category of having lost one-fourth of this part, and thus a fourth part of the amount standing for this, being ƒ 150:—:—, could be awarded. David Baars, having both hands so burned by the explosion of a powder chest that, after healing, a weakness remained in those parts which renders him unable to function as an assistant gunner; and since the loss of the left hand is fixed at ƒ 400:—:—, the weakness of both hands could be placed in the category of having lost half of the capacity of the left hand, and thus half of the amount for the loss of this part could be awarded to him. Andries Rikla, having had his right hand so crushed during the testing of signal cannons that, after healing, four fingers are entirely stiff, as is also a stiffness in the wrist joint of the hand, retaining only a slight movement in the thumb; this part could be considered as three-quarters lost, and since the compensation for the loss of the right hand is fixed at ƒ 600:—:—, he could, in proportion to the injury he sustained, lay claim to three-quarters of this sum. Hoping herewith to have complied with the order, we who, with the deepest deference and respect, take the liberty to call ourselves, Right Honorable, Highly Respected Sir, Honorable, Respected and Right Honorable Sirs, Your Honors' very humble and obedient servants, signed: J. found cause to summon the said Bosman before the Honorable Council of Justice of this Government, in order to prove his injurious words, if he were able, or else to recant them. And thus, during the pendency of this lawsuit, the petitioner was also not capable of further performing his aforementioned post as Corporal, as he did not wish to expose himself to the insults that would naturally fall to his lot from his fellow citizens on duty. Wherefore, with the prior advice and consent of his Captain, the Valiant Eduard Wuim, he kept himself absent from the usual yearly burgher exercise, both for the preservation of the civic peace and for the prevention of its disturbance. However, Most Honorable Grand Noble Lord and Honorable Sirs, the said Bosman his injurious expressions were of such a nature, like all the sayings of envious persons and boasters when viewed in the light of day, whereby the mentioned lawsuit made no progress, nor reached its full conclusion, but was as if smothered at birth, although to the satisfaction of the principal petitioner, who remained triumphant in the same, in such a manner that the mentioned Bosman saw fit, instead of proceeding according to standard form, to renounce, and thereupon, by the said Honorable Council of Justice, according to their usual leniency, this matter was referred to commissioners for the purpose of a settlement, whereupon the Honorable Gentlemen Commissioners from the last-mentioned Honorable Council also convened for the said purpose on the date 9 July 1789, as appears from the annexed Extract under Letter A. Placed in the hands of the Landdrost and Military Officers of Stellenbosch to report whether this could be complied with. Letter A, from which it clearly appears that the frequently mentioned Bosman, in addition to paying all the costs incurred in this matter, would execute a deed to the principal petitioner whereby he solemnly acknowledges him to be an honest and upright man, about whose life and conduct he knows nothing ill to say, which deed he then also executed, as appears from the deed under Letter B dated 30 December 1789, from which it evidently appears that his sayings were pure slander, and the principal petitioner has received full and satisfactory redress before God, Justice, and the world, so that no one, whoever he may be, as the principal petitioner trusts, need be ashamed to perform any service with him. Considerations regarding this matter demanded by His Honour from the Master of the Equippage, who has submitted the following document concerning it. His Honour, finding that this matter had never been dealt with in a fixed manner, as good order nevertheless requires, had demanded from the Master of the Equippage, Jan Arnold Voltelen, his considerations and report on how the supplies of firewood to the Company's ships under this Government ought to take place in the future, and received from the said Master of the Equippage concerning this the following document. To the Right Honourable Abraham Josias Sluysken, Councillor of Netherlands India, and Commissioner of this Government and its dependencies, etc., etc. Right Honourable Sir, The undersigned has taken the liberty, following the complaints made to him by Captain at Sea F. Groen, commanding the return ship Leiden lying at anchor here in the roads, to bring to the notice of Your Right Honour the impossibility of making do with an allowance of 7 loads, which according to the annexed declaration amounts to no more than 1¼ fathoms of firewood per month; the more so as the said vessel, like almost all return ships, is manned with Chinese in addition, who do not eat from the same pot as the Europeans, but prepare their food separately, and each must be provided with a separate and proportionally determined quantity of firewood. Having been ordered by Your Right Honour to serve with a report in this regard as to how far such was possible, and to what extent that supply could be provided proportionally to the Company's return ships as well as colonial vessels, it appears from the above-cited declaration of the ship's officers of the ship Leiden that the above-alleged, namely 14 loads for 2 months, made up only 2½ fathoms of wood. To what extent the calculation of the wagon loads against fathoms, or the carrying loads of the slaves against wagon loads is made here, the undersigned confesses to Your Right Honour not to know, but indeed that 2½ fathoms per month is accounted to a ship, which is in accordance with the allowance at Batavia, and with which the ship's officers can manage on a ship as strong as the Leiden or manned with 100 hands. In order that these fathoms of firewood, which are 6 feet long, 6 feet high, and 2½ to 3 feet wide, just as they are in Batavia and elsewhere, may be properly supplied to the ship's officers, the same could be laid down on the Jetty, or wherever else Your Right Honour might think fit, and having been measured by the fathom, be transported directly to the ships, whereby the ship's officers could then make no excuses or evasions that they had not received their firewood, and the accountability would from that moment remain with them. The colonial vessels, which have the opportunity, while lying in False Bay or elsewhere, to fell some wood, could, calculated at 50 hands as they are almost always manned, suffice with 2 fathoms, and those sailing with fewer crew in proportion. It is indeed true that the officers of the ship Leiden previously had to make shift with the firewood, but this arose from the fact that they had supplemented their stock of firewood taken at Batavia for the entire voyage to Europe, as well as what was cut as opportunity permitted during their stay in False Bay. 1479 on the ceiling, where the sawdust or frass of the worm had grown together to a considerable thickness, so that, according to the opinion of the aforementioned master carpenter, it is greatly to be feared that the entire roof structure will collapse onto the building during heavy rains or fierce winds; having subsequently also inspected the remaining buildings, we found the former house of the master carpenter and the wine cellar reasonably well conditioned, needing only a small repair, but the roofs of the horse stable and the former slave lodge were also in a very bad condition, the roof trusses being exposed to view in various places; and the roof itself here and there so full of holes that on the ceiling one could see the daylight through it; moreover, various wooden windows were missing from the aforementioned buildings, as your Right Honourable and Honourable Sirs will be pleased to see from the accompanying original report of the aforementioned master carpenter. We did not fail to interview the lessor about this, and to ask him why he did not comply with the 7th article of the conditions of lease, according to which he had accepted and bound himself to all repairs that had to be done to roofs, flats, etcetera, with the recommendation to provide for this as soon as possible, or that the Honourable Company would have those repairs executed for his account; whereupon he came to remonstrate that, however much he did not want to deny his obligation to maintain the place and the buildings standing with it in proper 1420 1421 condition in order to be able to deliver them again as such at the expiration of the lease years, he also understood at the same time that this could only apply to the repair of such defects as might come to the buildings during the time of the lease years, but impossibly to those with which, according to appearances, those buildings have already been afflicted for many years; that he in good faith, and in the firm assurance that everything was in such condition as one usually naturally assumes when leasing houses, etcetera, had accepted the lease on the stipulated conditions, but that immediately upon the first inspection to his greatest astonishment he had noticed in what bad condition the buildings generally were, of which he had not neglected to give proper notice to the Lord Commander of this Government. That in the meantime, seeing that no hands were put to work, he had found himself forced, if he wanted to preserve the buildings somewhat against the then impending winter season, to have the worst conditioned places of the roofs provided for at his own expense as much as possible, and for which he believed he had the right to request reimbursement from the Honourable Company. 1424. 1425. and to appoint the said gentlemen to the formation of the conditions, whereby, besides the aforementioned, it shall also be stipulated: that the contractor shall have the freedom to cut the required rafters and other woodwork necessary for the roofs on the site itself, according to the directions that will be given to him by the Commissioners. The manor house, as well as the stable and the so-called slave lodge of the garden Rustenburg, are to be repaired with the utmost speed by public tender to the lowest bidder, for defects that very certainly existed on those buildings before that garden was leased out. Accordingly, the said gentlemen Lesueur and Brandt are hereby commissioned to draft and submit to this Council for approval such conditions of tender for those repairs as their Honors shall deem may be carried out to the greatest advantage of the Company, whereby it must especially be stipulated that the contractor shall have the freedom to cut the required rafters and other woodwork necessary for the roofs on the estate itself, according to the directions that will be given to him by the Commissioners. Subsequently was read a petition addressed to this government by the junior merchant Oloff Martinus Bergh, reading as follows: To the Right Honorable, Highly Esteemed Sir, Mr. Abraham Josias Sluysken, Extraordinary Councillor of Dutch India and Commissioner over the Government of the Cape of Good Hope and its dependencies, etc., etc., together with the Honorable Acting Commander and the Honorable Members of the Council of Policy. Gives 1426. 1427. respectfully to know, your Right Honorable and Honorable sirs' very obedient and humble servant, Olof Martinus Bergh, junior merchant in the service of the Honorable Company, that the petitioner's late father-in-law, the former burgher councillor Jan Daniel Wieser, together with his deceased wife Anna Dorothea Hiebner, drew up a mutual will on 22 October 1788, wherein among other things it was desired by both of them that their female slave Francina of the Cape, together with her son Jacob of the Cape, should after the death of the longest-living be released from slavish servitude and set at liberty by their heirs, with the approval of the High Authorities; that the petitioner, who with his wife had lived for some years with his said deceased parents-in-law, has found himself fully convinced, by his own experience as well as by the testimony of the said testators, that the favorable disposition made regarding both of the aforesaid bondservants was solely due to and grounded upon the exemplary good conduct maintained by the female slave Francina, both regarding the care of the testators themselves and with respect to the care of the petitioner's wife; and that, although her son Jacob, by his dissolute, disobedient, indeed punishable conduct, had made himself entirely unworthy of this favor, the testators nevertheless allowed him to share in it, in the hope that they both, or one of them, being at that time not yet fifty years of age, would remain alive long enough to be able to correct and improve the said dissolute boy by suitable means, 1428. 1429. or else, if these means should in time have been found fruitless, to take such measures regarding him by virtue of the reservatory clause inserted in their will as would have been found necessary for his own best interest, and whereby could have been prevented and avoided the unfortunate consequences that must naturally arise from his bad conduct, especially when left to himself without any subordination or supervision; that, however, the petitioner's father-in-law having died shortly after the execution of that will, and thus the aforesaid disposition regarding the slave Jacob having become irrevocable, the testatrix immediately felt how detrimental this favorable disposition turned out to be for him, Jacob; and having become bedridden a short time thereafter, she had desired that after her death the female slave Francina should be set at liberty pursuant to the testamentary disposition, but that the slave Jacob should remain with the petitioner until he, through his amendment and good conduct, should have made himself worthy of being set at liberty by the petitioner; that the petitioner, having complied with this request, has kept the said Jacob with him until now and has done everything that could possibly serve to improve his morals and conduct, in order thereby to enable himself, in accordance with the will, desire, and intention of his deceased parents-in-law, to let the same slave Jacob enjoy the effect of the favor intended for him; that the oft-mentioned slave, however, far from

instead of allowing himself to be corrected through mild or strict admonitions and measures, and striving to obtain his freedom, as well as, upon being placed therein, being able to earn his livelihood through lawful means, on the contrary continued in his dissolute and disobedient conduct, to such an extent that, being constantly given over to drunkenness, he has in this state repeatedly committed misdemeanours that certainly would have prompted the petitioner to remove him from his house forever, had not his mother, Jacob's mother, begged the petitioner not to withdraw his supervision from him in order to prevent his and her shame, with the desire even not to be set at liberty until her son, through his conduct, might share in this favour; but that the said Jacob, caring as little for his own freedom as for that of his mother, and continuing more and more in his careless conduct, the petitioner can no longer bring himself to withhold from the female slave Francina, because of the unruly conduct of her son, the enjoyment of the repeatedly mentioned disposition, and is thus inclined to set her at liberty in accordance with his obligation, all the more because her advancing years and the sorrow caused her daily by her son make this all the more necessary; and that she is willing to accept this offer from the petitioner on condition that her son shall remain in his present state under the immediate supervision of the petitioner, until such time as he, through amendment, good conduct, and an industrious life, shall also merit it, and shall find himself able to earn his livelihood; all reasons for which the petitioner turns to Your Right Honorable and Honorable Lordships, humbly requesting that you may be pleased to permit him to release the repeatedly mentioned female slave Francina from her slavery and set her at liberty, he being prepared to pay the sum of fifty rijksdaalders stipulated for that purpose to the Reformed deaconry poor of this town, and moreover to provide the stipulated security that the said female slave Francina shall not become a charge upon the said deaconry within the period of twenty years; the petitioner further requesting that Your Right Honorable and Honorable Lordships be pleased to declare that the frequently cited slave boy Jacob shall have to remain in his present state under the immediate supervision of the petitioner until he makes himself worthy to obtain his freedom through a conduct as virtuous as it is orderly, and affords the petitioner, who in this intends nothing other than the true best interest of that creature, the pleasure of requesting permission for it, and enables him to proceed to it, without having any fear for his subsistence or dread that he will come to shame. 1442 1443 and that the said Commission submitted the following report. — to add to their report their considerations whether, in case the service were to require that the same ship were sent to India's Capital, one could with reason expect that the internal condition of that keel, unexpected accidents or disasters at sea aside, would allow it to repatriate from there again, and that his Honour from the Commission received from it the following written report: To the Right Honourable Sir A. I. Sluysken, Councillor of the Dutch Indies as well as Commissioner of this Government and the Jurisdiction thereof, etc. etc. etc. Right Honourable Sir, It pleased Your Right Honourable to order the undersigned to repair on board the ship Drechterland, which returned from Saldanha Bay after careening, in order there carefully to examine the condition in which that vessel presently finds itself, and whether the same can with peace of mind be dispatched whithersoever one shall think fit, with the addition of their opinion whether, in case the service were to require that the same ship were sent to India's Capital, one may with reason expect that the internal condition of that keel, unexpected accidents or disasters at sea aside, will allow that it shall repatriate from there again; so it is that they have the honour to report to Your Right Honourable that they have done so, and found the said vessel in everything fully capable of being sent to India's Capital. Yet that we are all of the opinion that there is an urgent necessity (because that vessel is weak above water and also in the hold) of 1444 1445 in my presence signed C. A. Verlee signed Corn:s van Eys: What appeared therefrom to this Council with particular regret knees, as well as being provided with a new sheathing, before one would dare with peace of mind to burden this vessel with a rich cargo, which would cause significant costs in the Indies; and it is to be foreseen that, in case one in India's Capital would not directly proceed to the latter, the said ship would in a short time become of little use to the Company, the more so as it is certain that the ship, on its passage from here to Batavia, is exposed (unexpected accidents or disasters at sea excluded) to working in high seas, which would expose it to even more repairs from above, which, befalling it on the voyage to Europe, can be performed there with more speed and less expense, and the ship can still be made of great importance to the Company there; for the benefit of the Honourable Company it appears to us, with humble submission, that that vessel ought to be sent to Europe. the representation submitted by the overseer of the Wood Magazine Boonacker. as well as heard regarding Pieter Diederik Boonacker the following representation having been submitted To the Right Honorable, Highly Esteemed Mister A. J. Sluysken, Ordinary Councillor of Dutch India, and Commissioner over the Government of the Cape of Good Hope and its dependencies. Right Honorable, Highly Esteemed Mister, The undersigned has taken the liberty to inform Your Right Honorable Esteem with regard to the wagon bolster wood, that when the same was brought in the year 1788, among other assortments of native woodwork from Plettenbergs Bay, the retail sale price of the said bolster wood was determined at eleven and a quarter Rixdollars per cento, but that the same, at that time of considerably less value, could not be sold for higher than seven Rixdollars per cento, although seven and a quarter Rixdollars was paid into the Company treasury by me, which loss of four and a quarter Rixdollars on the hundred pieces of bolster wood was nevertheless compensated to me by retailing the other items of wagon wood at a small, fixed price increase. However, since among the recently delivered cargo there are again bolster woods which would have to be sold for the same amount of 11¼ Rds., while the retail price has not yet been reduced to this day. Concerning this, it has pleased Your Right Honorable Esteem to have me submit a report, which I have the honor to do as follows: Namely that in no way the bolster wood can be sold for the aforementioned price of 11¼ Rds., but indeed for 6 Rds. per cento, and that the remaining items of wagon wood currently cannot bear any higher retail sale price to compensate for the reduction of price on the bolster wood. Herewith the undersigned hopes to satisfy the intention of Your Right Honorable Esteem and lets this serve as a report. signed P. D. Boonacker. To provide a copy into the hands of the Commissioners over the said Magazine, in order to report thereon to the Council. Meanwhile, the request accompanying the following representation regarding the salaries of the attorneys, submitted by the Honorable De Wet as President of the Council of Justice— It is considered best and consequently decided to provide a copy of the said writing into the hands of the Honorable Brandt and the titular merchant Jan Pieter Baumgardt, as Commissioners over the Wood Magazine, with instructions to report to the Council at what price they believe that the bolster wood mentioned therein can be purchased to the greatest advantage of the Company, so that, once that report is received, further and final disposition can be made concerning the request of the said Boonacker. The Honorable De Wet, as President of the Council of Justice, having submitted the following representation addressed by the said Council to this Government: Right Honorable, Highly Esteemed Mister and Honorable Esteemed Gentlemen. To the Right Honorable, Highly Esteemed Mister Abraham Josias Sluysken, Ordinary Councillor of Dutch India and Commissioner over the Government of the Cape of Good Hope and its dependencies etc. etc., together with the Honorable Esteemed Mister Officer Commanding and Honorable Gentlemen Councillors of Policy. The President and Members of the Council of Justice of this Government show with due respect: How, it being stipulated by the 16th article of the Instruction for the Admitted Attorneys here that, with respect to their taxed and moderated salary accounts in cases of insolvency, they shall enjoy preference over concurrent creditors, this stipulation has since had such effect that the aforesaid 16th article, being understood generally, the salary accounts of the attorneys have consequently also been ranked behind all preferential claims without making a distinction as to whether the salary arose from the collection of debts which were paid preferentially in the distributed estate, or whether it arose from the collection of concurrent debts or from other services having no relation to such an estate. Yet, although this interpretation indeed seems to correspond with the general wording in which the mentioned 16th article of the Instruction is phrased, such, however, in the judgment of the representers does not at all square with what is found determined in this regard in the statutory laws of Dutch India under the title of Desolate or Insolvent Estates, article 41, where it is expressly ordered that the preferred creditors shall take precedence with their necessary taxed costs as well as with their capitals; That therefore, especially since grievances in that regard had been presented from the side of the admitted attorneys, the representers have deemed it their duty to devise such redresses therein as in an equitable manner

1460 1461 manner can serve to secure, as far as the nature of the matter permits, the remuneration of their services to the attorneys practicing before the Court of Justice; it having occurred to the memorialists in all respect and deference in this correction that, however much in the distribution of insolvent estates the ranking of fee bills after all other preferred claims and merely above concurrent claims seems to agree with the literal content of the 16th article of the Instruction for the respective attorneys, whereby not the least distinction is made, this nevertheless cannot be deemed to accord with the intention of Your Right Honorable Grand Worships upon approving and establishing that Instruction, which intention, as the memorialists respectfully trust, can never have been to grant persons, from whom a greater attachment to the interests of Justice was required, fewer privileges than to those who, without admission, whenever they thought fit, had served litigating parties up to that time, and regarding whom the preference of earned salary had always been regulated in accordance with the provision appearing in that regard in the abovementioned 41st article from the statutory laws of Dutch India. 1462 1463 Granted by this Council. Taking into consideration the grounds and motives set forth in this memorial, and that it may please them to declare that, whereas the fee bills of the admitted attorneys, pursuant to the aforementioned 16th article of their Instruction, have preference over concurrent debts, nevertheless, with relation to the fee bills that arise from the collection of preferred debts, the same shall henceforth, pursuant to the 41st article from the statutory laws of Dutch India under the title of Desolate or Insolvent Estates, be placed on equal footing with such preferred debts, or that Your Right Honorable Grand Worships and Right Honorable Worships may otherwise be pleased to make such redress herein as they shall deem proper. Mr. van Reede van Oudtshoorn, as President of the Board of Commissioners of the Court of Justice, having made a request 1464 1465 And two new members were appointed to the Board of Commissioners from the Court of Justice. It having appeared from the following reports that some paper currency pieces had again been prepared. Communication from the Honorable Lord Commissioner for what reasons His Honor did not judge it advisable that a quantity of 16000 pounds of gunpowder be placed in the powder magazine at Stellenbosch. Thus it was resolved to have the amount thereof entered in the trade books and the main cash treasury. that, in place of the members whose terms have expired in that Board, Gerrit Meyer and Willem Stephanus van Ryneveld, two other members might again be appointed, the burgher councillor Hendrik Andreas Truter and the titular merchant Jan Pieter Baumgardt were chosen for this purpose, who shall thus serve the usual term in that Board. It having appeared from twelve incoming reports of the Commissioners for signing the cardboard currency that there had been prepared by them: 1000 pieces at Rds. 5 each 1000 pieces at Rds. 2 each 7000 pieces at Rds. 1 each 10000 pieces at Rds. 1/2 each 5600 pieces at Rds. 1/4 each 4200 pieces at Rds. 1/8 each thus it was understood to have all the said currency pieces, with an amount of Rixdollars 20925 or Ducats 13950, entered both in the trade books and in the main cash treasury. It was agreed solely to make this note thereof. 7 January: Communication from the Noble Lord Commissioner regarding the objection arisen on His Honour's part against allowing the supercargo of the American vessel The Three Brothers to land no more than 30 bales of coffee beans.
