Janssen after reading which request it was resolved to verify the sea-letters and passports submitted therewith, in order that these, as well as the journal attached thereto, subsequently be deposited at the Secretariat, and furthermore the shipowners of the aforementioned small vessel shall be permitted to unload the Indian products brought therewith, provided that, prior to proceeding to that unloading, they pay the determined import duties to the Company pursuant to Article 35 of the General Edict issued by the Right Honorable Commissioners-General concerning free navigation and trade; it having appeared from a list drawn up by the Commissioners of the Company's main cash treasury that, at the end of January, they found in the same treasury an amount of 5863 rixdollars in old, To the Right Honorable, Highly Esteemed Abraham Josias Sluisken, ordinary member of the Council of Dutch India and Commissioner over the Government of the Cape of Good Hope, dirty, and mutilated paper and cardboard currency, all of which, according to the written report by the Permanent Commission appointed for that purpose, were burnt; it was furthermore approved, thus it was understood, to have the said amount of 5863 rixdollars written off both from the trade books and from the main cash treasury; by the Captain of Artillery George Coenraad Kuchler, Captain-Lieutenant Adriaan de Vogel, and Trade Transferor Henricus Joens Voget, who, by resolution of this Board on the 13th of this month, were ordered to appraise the 5 pieces of cannons salvaged from the wreck of the ship Middelburg, burnt and sunk in Saldanha Bay, by the former Heemraad of Stellenbosch Gerhardus Munnik, having submitted the following report regarding their actions in this matter: dirty and 434 435 to approve the appraisal made therein of 5 pieces of cannons salvaged from the ship Middelburg, and to enter the amount thereof into the trade books in the manner as mentioned below. and the jurisdiction thereof, etc. etc., together with the Honorable Esteemed Commander and the Honorable Members of the Council of Policy. An extract resolution taken in the Council of Policy on the 13th of this current month having been handed to the undersigned, whereby they are ordered to appraise 5 pieces of cannon, namely: 4 of 8 lbs and 1 of 4 lbs these having been salvaged in Saldanha Bay from the sunken wreck of the ship Middelburg by the former Heemraad Gerhardus Munnik, according to the permission obtained for that purpose; so they have the honor to report: that, as appears from the report already made to the Right Honorable, Highly Esteemed Commissioner by the first undersigned on the 10th of this month, no more than three cannons of 8 lbs are usable, and since these have already lost much of their substance, they cannot be estimated in money value for more than 2/3 of their purchase price; so that this for the aforementioned 3 cannons would amount to: a sum of 300 guilders Holland currency; as regards the fourth cannon of 8 lbs and the other of 4 lbs, they can be entered into the trade books only at the price of iron ballast, and this would amount to a sum of: 72½ guilders Holland currency. Hoping hereby to have complied with the intention of your Right Honorable, Highly Esteemed and Honorable Esteemed Sirs, we submit this as a humble report. and furthermore, the decision on the following representation submitted by the Landdrost and Heemraden of Stellenbosch and Drakenstein is, salvaged from the sunken ship Middelburg, be taken into account, onto which account shall likewise be entered everything that will subsequently be salvaged from the said wreck by the mentioned Munnik. Thereupon was read the representation below, addressed by the Landdrost and Heemraden of Stellenbosch and Drakenstein to this government, concerning that which was demanded of them by resolution of this Council of the 14th of November last regarding the Carriage Money. To the Right Honourable, Most Worshipful Abraham Josias Sluisken, Ordinary Councillor of the Netherlands Indies, as well as Commissioner over the Government of the Cape of Good Hope and the dependencies thereof, etc. etc., together with the Right Honourable, Worshipful Lord Governor and the Honourable Members of the Council of Policy. especially during the rainy season when they were continually in use, while he, Joubert, being present at one ferry, had to leave the supervision of the other mostly to a stranger, which often, through improper management, as in the last completed rainy season, when the lower pontoon, because the person having the supervision over it was not properly vigilant, was struck off its rope by the high water and had drifted entirely toward the sea side, whereby the inhabitants who were accustomed to make use of the same were completely inconvenienced, besides the fact that he, Joubert, had suffered considerable detriment thereby; that he, Joubert, however much his income would diminish thereby, nevertheless for the convenience of his fellow inhabitants and for his own peace of mind, gladly wished that he might be permitted to sell separately the lower pontoon situated near the Heuningbergen, as being located far from his dwelling place, in such manner as the same formerly was with his predecessors and is now possessed by him, Joubert, and only to retain for himself the supervision of the upper pontoon situated at the corner of the Paardendiamant, as well as the dependency of the Roode Lands Kloof; because he believed himself to be properly all the better able to attend to these two posts along that road; that he, Joubert, furthermore believing that the separation of the two aforementioned pontoons could take place in the following manner: that namely the inhabitants living beyond the Vier en Twintig Rivieren, as well as those who from further away must pass the lower pontoon, might be obliged to pay the annual pontoon money separately to the pontoon keeper who would then be the owner of the said pontoon, while the inhabitants residing on this side of the aforementioned Vier en Twintig Rivieren, or coming up from further away and making use of the upper pontoon, to him, Joubert, as keeper of the same upper pontoon; and of which then specific lists could be formed, with the addition of the names of the places that are possessed by them, and that in addition each of the aforementioned pontoon keepers should have to agree to transport across, freely and without any payment, such inhabitants who are listed on the list of the other pontoon keeper and require the use of his pontoon; adding thereto that he had always shown himself obliging in his post as pontoon keeper, even at night and unseasonable times, and among others also on the occasion of the present war, not only crossing the Company's servants upon their summons, but also crossing a considerable number of Hottentots who were required at the Castle without enjoying any reward therefor, through which extraordinary use the upper pontoon had suffered noticeably, even to such an extent that he, Joubert, saw himself brought into the necessity of having to provide himself with a new pontoon; that furthermore many inhabitants, under the pretext that they were prevented by the internal war with the Caffres from coming up, because of this, as well as other bad payers through futile excuses, came to withhold from him the moneys legally due to him; as well as that he came to lack the necessary materials for repairing or else renewing the aforementioned pontoon and the same were at present to be obtained from the inhabitants either not at all, or else not other than at enormous high prices; wherefore he, Joubert, requested, through a resolution on behalf of this Board or else through favorable recommendation to Your Right Honorable and Honorable Sirs, to be able to obtain permission for the sale of the lower pontoon at the Heuningberg in the manner mentioned above, as well as that on behalf of Your Right Honorable and Honorable Sirs there may be sold to him out of the Company's warehouses such quantity of ship-carpentry timber, iron bolts, nails, rope-work and

Lutz J. de Villiers J.n Zoon signed Thus, after deliberation upon the said memorial, it was approved and understood to permit the burgher Gideon Jacobus Joubert, as owner and holder of both pontoons on the Berg River, to sell the lower of those pontoons, kept at the Honingberg, in such manner as he shall deem best; however, before he may proceed thereto, the said Landdrost and Heemraden shall have to submit with the utmost speed to this Government what arrangements, in their opinion, ought to be made and observed by each of the pontoon keepers in order to prevent all disputes between them, as well as which of the local residents and the future possessors of their places shall have to make payment of the customary pontoon fees to the keeper of the pontoon situated at Paarl Diamant, and which to that of the pontoon located at the Honingberg, in order to annex these arrangements to the deed of transfer of the last-mentioned pontoon and to give the public due notice thereof by publication and posting of notices. And since it has appeared to the Council from the aforesaid memorial that, through unfortunate accidents, the pontoon at the Honingberg has fallen into such poor condition that it must either be completely renewed or substantially repaired, it was, in consideration of the fact that this renewal or improvement must serve the general use and convenience, and that the pontoon keeper is unable to obtain various articles indispensable for that purpose anywhere else than from the Company's warehouses, approved to cause to be furnished to the said Gideon Jacobus Joubert by ordinance from the Company's warehouses, against payment of the purchase cost with an increase of 50 per cent for freight and sea risk, such materials as can be spared without notable inconvenience to the Company's own requirements in this Government, and which he shall come to need in order to renew the often-mentioned pontoon at the Honingberg or to repair it in such a manner that all the residents together will be able to make the necessary and required use thereof. judging, it being fair to leave to everyone's conscience in what manner he wishes to serve the maker of his being, as everyone is responsible for himself in that regard, we nevertheless hope that it may not be imputed to us as a crime, when we hereby, with all that respect and that awe which becomes us, make known, how we, standing in the sentiment of what our Religion has in our opinion revealed thus far, humbly request that in the district entrusted to our supervision, the spread of other Sentiments, and specifically those of the Herrnhuters, not be permitted; since it is indeed very naturally to be foreseen that these missionaries, with the following to be expected from their zeal, will before long constitute a separate and completely new denomination in our congregation; moreover, the measure of knowledge is generally so small among the people living there, that it is more than probable that some of them could go over to that publicly established denomination, especially if they might thereby prevent the difficulty of having to present their children to us for baptism; and how difficult it would be in that case to contest this freedom with anyone is something which we prefer to leave to the more practiced insight of Your Right Honorable and Honorable Sirs. Experience, finally, has already demonstrated by more than one example that the concept of toleration can sometimes bring about a complete indifference toward the accepted Religion, an abuse, surely, that would never be feared from people who adhere to their Religion out of conviction or reasoned grounds; but in proportion as we have less ground to be able to give this testimony of many of the people living there, and it is more probable that they are attached to that way of thinking out of habit and imitation, we must also all the more naturally fear that from the permitting of the Herrnhuter denomination in such circumstances, similar detrimental consequences may result, wherefore we hereby most respectfully request Your Right Honorable and Honorable Sirs, that the aforementioned Missionaries may be ordered to settle in such a district in which as yet no Christian denomination has been established. Yet however much the undersigned, and with him the four members of the church council who currently make up this Body, have thought it necessary to make this request respectfully, the two outgoing members have nevertheless not been of their opinion; and it is for no other reasons than because they explicitly requested it that we have forwarded their Honors' accompanying objection to Your Right Honorable and Honorable Sirs. Furthermore, having been taken into consideration by us that it is in the highest degree necessary to provide the rest with a ceiling, both to prevent the cold and the draft that is felt here quite noticeably in the winter, and also to make preaching easier by that means, for which we, according to a rough estimate, have thought no more than ƒ 2000 - to be necessary, which could be found from a certain Capital amounting to ƒ 5300 -. secured by a mortgage deed with the Citizen I. A. Haalman, it has appeared to us that this Sum of ƒ. 2000 - or if necessary more, could be employed for that purpose in a most useful manner, but to which decision we have not wished to proceed without the consent of Your Right Honorable and Honorable Sirs. Wherefore we hereby humbly request Your Right Honorable and Honorable Sirs' approval of this intention of ours, as well as that, whenever we might need any Timber on the Honorable Company's account for that purpose, we may be favored with the same. To reply in the manner as mentioned next: Thus, after careful deliberation regarding the said Missive and the written advice of the two outgoing Members of the church assembly added thereto, it has been resolved by the Council to write in reply to the Reverend preacher Meent Borchers and the further Members of the Stellenbosch church council, that whereas the Council has been able to perceive with pleasure from the above Missive that the Reverend church council jointly agree therein that all persecution on account of Religion is to be condemned, while the Supreme Being alone shall judge over the Conscience of his creatures, tolerance may rightly be placed among the virtues of a Christian, they also trust that the church council will take care for harmony among themselves and in the whole congregation; that whereas they fully agree with the church council that the Reformed Religion as taught in our churches contains everything necessary and comforting that is necessary to know for salvation, they may add thereto that the same Religion demands tolerance toward others who differ from these tenets and is therefore much to be praised; that on such grounds, it having been granted to the Herrnhuters mentioned in the Letter to the church council by the Most Honorable Lords Directors by honored Missive of the 22nd of December 1791 to proceed to this remote corner, in order to proclaim the Gospel to the Hottentots, to instruct them in the Christian doctrine, to baptize them if they embraced the same, to establish a Christian congregation, and to administer the Sacraments, and subsequently by this government

The church council of Stellenbosch, at the conclusion of their letter inserted herebefore of the Council having requested authorization to provide their church with a ceiling, it was approved and agreed to grant them the necessary authorization for that purpose, as the same is granted to them hereby; and to that end, such timber as they shall come to need, and which can with any possibility be spared without fear of inconvenience to the Company's own buildings, shall be supplied to the aforementioned church council from the Company's magazines at cost price. From the following certificate granted by the Secretary of this Council and the Notary Pieter Hendrik Faure as former sworn clerks at the Secretariat of this Council, at the requisition of the burgher Willem Marais. The undersigned hereby certify that shortly after their appointments as First and Second Sworn Clerks in the months of June and July 1788, the burgher Willem Marais had presented himself at the Political Secretariat, stating that already in the year 1785 or 1786 he had delivered to the then First Clerk Horak, serving here, a small map accompanied by an extract resolution taken in the meeting of Heemraden at Stellenbosch, from which it appeared that the land desired by him in freehold was to no one's detriment, for the obtaining of which he, Horak, had taken it upon himself to present a petition to the Council of Policy on behalf of him, Marais, thereby requesting the undersigned to be so good as to check whether this had been complied with by him, Horak. Saure It having convincingly appeared that by the said Marais, before it was determined by this government that recognition had to be paid to the Company for lands ceded in ownership, efforts were made by him to request to acquire in ownership the two morgen of land, for the acquisition of which he was permitted to make a request by resolution of the Landdrost and Heemraden of Stellenbosch dated 4 February 1784, it has now been approved and understood to grant and cede to him in ownership the requested land, as the same is hereby granted and ceded to him, without making any payment for it to the Honorable Company; and notice of this resolution shall be given to the Landdrost and Heemraden of Stellenbosch and Drakenstein, to serve for their guidance and information, and furthermore to consider as lapsed that which was ordered to them in this regard by resolution of 9 January last. Mr. Christoffel Brandt, Resident of False Bay, in compliance with what was required of His Honor concerning a certain plot of land of the size of 150 feet situated in Simons Bay requested in ownership by the Burgher Cornet Jan Willem Hurter, has today submitted the following report: To the Right Honorable Abraham Josias Sluijsken, Extraordinary Councillor of the Dutch Indies, as well as Commissioner over the Government of Cabo de Goede Hoop and its dependencies, etc., etc., etc., together with the Honorable Acting Governor and the further Honorable Council of Policy. Right Honorable Sir and Honorable Sirs, In dutiful compliance with Your Right Honorable and Honorable Sirs' desire and instruction, contained in Your Honors' venerated resolution dated 9 January last, namely to serve with considerations and a report on whether and to what extent the request made by petition by the Burgher Cornet Jan Willem Hurter to have in ownership a piece of land of the size of 150 feet situated in False Bay can be granted, the undersigned will take the liberty to remark beforehand: although the petitioner Hurter in his aforesaid petition did not specify the place where the land desired by him is situated, nor the purposes for which he desires that piece of land for himself in ownership, the undersigned has nevertheless been informed that the said land is said to lie between the Honorable Company's stable and the course of the drinking water, wherefore the undersigned shall hereby have the honor to report to Your Honors regarding the petitioner's request: That a piece of land of the size of 150 feet can be granted in ownership to the said Hurter, provided that that land comes to lie at least 150 to 200 feet from the ordinary drinking water that runs down to the jetty for the convenience of the ships, while the petitioner shall furthermore be placed under the obligation not to construct, either now or by his successors in time, on that land any warehouse for the storage and retailing of wines, much less a public tavern, in order thereby in the first case to prevent all pollution of the drinking water for the ships and the local inhabitants, and in the latter case to prevent the numerous unpleasantries and difficulties that would be caused to the undersigned by the establishment of a public tavern so closely behind the Company's warehouses by the common seamen, etc. Therewith believing to have complied with the honored intention of Your Right Honorable and Honorable Sirs, the undersigned has the honor to sign with respect, Right Honorable Sir and Honorable Sirs, Your Right Honorable and Honorable Sirs' very humble servant, (was signed) C. Brandt. Cabo de Goede Hoop, 6 February 1794. From which it has appeared that the plot requested by the said Hurter can be granted to him without any prejudice to the Company's interests or those of the public, under such obligations as the Resident Mr. Brandt has specified. It has therefore also been resolved to instruct Commissioners from the Court of Justice to have the aforesaid plot measured and mapped by the surveyor in their presence and in the presence of the Fiscal ad interim of this Government, in order subsequently to appraise how much ought to be paid by the petitioner to the Company as an acknowledgment for its acquisition. After all this, notice was given to the Council by the Honorable Commissioner that the slaves of the former Captain-Lieutenant at sea Willem de Haas found washed ashore: 1 teak beam of 15 to 16 inches thick, 25 feet long, 4 oak beams of 8 to 10 inches thick, 23 feet long, which beams, having been properly declared by the said de Haas, were found, according to the statement of the Master Attendant, to have belonged to the cargo of the hooker ship de Sterrenschans stranded here; it was thus agreed to have the same beams entered into the trade books and delivered to the timber warehouse for accounting, while a premium of four rixdollars shall be paid from the Company's treasury to the declarers or finders thereof. Lastly, it having been made known by the Acting Governor that no powder sugar is to be found in the Company's warehouses to be provided as rations for the hospital and otherwise, it was resolved to authorize His Honor, as Chief Administrator

Present the Noble Commissioner, together with the Honorable Administrator, and the Honorable Members Le Sueur, de Wet, van Rheede van Oudtshoorn, and Bergh, absent the Gentlemen Gordon and Brandt. Initially were resumed the resolutions taken at the meeting of the 10th of this month, and subsequently was read a representation prepared by Mr. de Wet as Bookkeeper of the General Public Revenues, accompanying the balance sheet account of the said Revenues during the book year 1792/3, as the same appear in the books closed as of the end of August 1793, together with a Memorial of such errors as have been found to have arisen in the arrears, both on the freehold and loan places, which are booked according to the extracted lists, reading as follows. To the Right Honorable Master Abraham Josias Sluysken, Ordinary Councillor of the Dutch East Indies, and Commissioner over the Government of the Cape of Good Hope and the dependencies thereof, etc. etc., together with the Honorable Administrator Johannes Isaac Rhenius, and the Honorable Council of Policy. Right Honorable Sir and Honorable Sirs. After the undersigned, Bookkeeper of the General Public Revenues, by decision of this Board of the 23rd of July of the past year, regarding the representation submitted by him, was pleased to find himself qualified to introduce immediately all the points of clarification and improvement proposed in the aforesaid representation, by which the Country's Revenues might be put on a more regular and clear footing, he has, so far as depended upon him, also complied with this without delay. To which end he has likewise dispatched to all whom it concerned the extracts both from the representation and the decision that followed upon it, and of that which should further serve to inform them and set them to work according to the plan for the regular administration of the cited Revenues, just as he has also, as quickly as possible, caused copies to be made of the extracted lists, both of the continuous loan places and of the bad arrears on those that have been abandoned, furthermore also of the freehold places, and of the lands that have been granted on quitrent, in such manner as the lists were attached to the repeatedly mentioned representation; and dispatched the same to the respective officers of justice, each as far as concerns his district, adding thereto all such further instructive papers for them as the register submitted herewith in copy shows. Awaiting the effect of this, he, the Bookkeeper, has meanwhile proceeded, following the authority which the aforementioned decision of the 23rd of July of the same year likewise entailed, to enter in the books all the distinct main headings which constitute the Country's Revenues, namely with regard to the loan places as well as the lands held in freehold under an annual recognition, or granted on quitrent, according to the said extracted lists, and concerning these further to observe the order prescribed to him. The books for the year 1792/3 now being balanced and closed, the undersigned, in accordance with the indications thereof, has the honor to present herewith to your Right Honorable and Honorable Sirs a balance sheet account of the said General Public Revenues as of the end of August 1793, which for the same book year amount to a sum of 149,217 rixdollars 37. 474 475. when some reliance could be placed on those arrears, which however cannot happen as long as the numerous errors regarding loan places remaining in the abovementioned extracted lists are uncorrected, besides other occurring reasons for this which the undersigned presented in his remonstrance dated 22 July last: regarding all of which, however, no clarification could yet be made in the course of the expired financial year. When one therefore takes into consideration the time that had to elapse for the extraction of the said lists from the so-called gamekeeper books, and that the copies thereof together with the further instructive papers for the respective officers of justice could not be prepared and dispatched earlier than around the end of the month of August last; that, moreover, the landdrosts of Zwellendam and Graaffe Reinet have been prevented by the expedition against the Kaffirs from doing anything to that effect up to now; and that the violent incursions of the Kaffirs have also prevented most of the inhabitants of both the said districts themselves from selling any livestock of importance or coming to this capital with other produce; that one can therefore attribute the extraordinary payments achieved in the last six months of the expired financial year solely to the means which the undersigned has been able to apply even at this capital to obtain them; then one may flatter oneself that when, alongside his efforts and activities, each officer, especially in the outer districts, duly applies his duties in time and without neglect according to the placards issued by the Right Honorable Commissioners General over the whole of the Netherlands Indies and this Colony, and what has been further prescribed to them in addition, even already in this current financial year, unforeseen intervening events aside, the payment of the recognition on the loan places will be considerably more substantial, and that this will also have to be followed by some settlement of 476 477 those arrears which, after having undergone a proper correction in their erroneous presentation, will genuinely remain as such. The undersigned has furthermore likewise attached hereto a memorandum of certain errors which have been discovered by him since the formation of the aforementioned lists, which have arisen therein either through the defectiveness and confusion of the gamekeeper books or through other causes, and very humbly requests Your Right Honorable and Honorable authorization to redress those errors in the new books in such manner as is noted for each of them in that memorandum. Petrus Jacobus du Toit, after having obtained in loan on 22 March 1785 the place De Bothaskraal situated on the Sneeuwberg behind the Baffels Hoek, renewing the loan of that place on 23 March 1786 under payment of one year's recognitie, was then registered for the second time in the Wildschutte books for the same place, and thereby also entered twice in the extracted lists and subsequently debited, namely: once for 7 years and 5 months: 178 rds. and for 3 months: 6 rds. Dirk Coetzee Cornelisz. has possessed in loan two places, known one as named De Welkomst, Johannes Smith Syamansz is recorded according to the Wildschutte books as having in loan the place Langgezogt, situated between the Hanglip on the Hottentots Hollands Mountains, and as being in arrears thereon as of ultimo August 1793 for 9 years and 7 months amounting to 230 rds. But the same place has Stephanus Malang situated in the Camdebo, and the other De Rietkuil, situated up on the Landdrosts Rivier in the Camdebo, of which both places, upon the voluntary cession made by him pursuant to Council Resolution of 19 June 1786, use was made for the placement of the buildings as well as otherwise for the Drostdy of Graaff-Reinet, without this having been properly noted in the Wildschutte books, wherefore he also appears in the extracted lists as still possessing the same places in loan and on each of the same as of ultimo August 1793 being in arrears 6 years and 7 months, while moreover thereon as of ultimo August 1793 another one year was charged to him, thus together 7 years and 7 months, amounting to: on De Welkomst on De Rietkuil for which arrears the said Coetzee therefore unjustly stands debited. situated since

492 495 whereupon it was resolved to express the Council's satisfaction to the said Mr. de Wet, and to exhort him to further contribute what is necessary to rectify the abuses regarding loan places since 7 October 1790, at whose expense the arrears under the cited date of Ultimo August 1793 for 2 years and 11 months, amounting to 79.20 rixdollars, ought to be written off from the arrears of Smit, insofar as it extends to the debit of Malan, in order to transfer the remaining 6 to the debit of Smith onto the account of arrears of recognition on abandoned loan places. Johannes Zwanepoel the elder is debited, according to the records of the Wildschutte books, as having fallen in arrears upon the abandonment of the place Het Fontein, situated in the Roggeveld, on 25 March 1775, for twelve years and 9 months to the amount of 306 rixdollars; which Swanepoel died in the year 1790, leaving behind eight children, and his modest estate having been administered by the Orphan Chamber without the Orphan Chamber at that time being able to discover that the said Zwanepoel was still in default for any overdue recognition, so that the modest remainder of 88.33 rixdollars from the estate was paid out to his heirs scattered inland and far and wide; and therefore, after reading these documents, it was resolved to authorize Mr. de Wet, as Bookkeeper of the General Public Revenues, with expression of the satisfaction of the Honorable Commissioner and the Council regarding his displayed zeal in collecting the Public Revenues, to rectify the loan place. T. de Wet. 96 The Widow Dirk van den Bank is likewise debited, according to the records of the Wildschutte books, on her loan place Het Goed Geloof, situated at Cogmans Kloof, as having fallen in arrears upon its abandonment on 31 December 1777 for 4 years to the amount of [illegible] rixdollars. The said Widow van den Bank, subsequently remarried to Jacob Fredrik Bek, died in the year 1789, and her estate being administered by the Orphan Chamber, there was indeed paid from that estate what was in arrears on another place which the said Bek held on loan; but towards the satisfaction of the aforementioned still outstanding arrears, as these were only recently discovered upon the establishment of the Office of the General Public Revenues, there were no longer any assets in the said estate, and no further recovery of those arrears can be found. To be written off. 496 497 The said Mr. de Wet shall, however, be ordered to adhere strictly to the arrangements of the Most Honorable Lords Commissioners-General, and the respective Landdrosts shall be ordered to supply to the aforementioned Mr. de Wet as speedily as possible everything that has already been required of them, or may further be demanded. The Commissioners from the Council of Justice having submitted a representation, the Commissioner and the Council, regarding his displayed zeal in the collection of the Public Revenues, resolved to exhort him to further contribute and set to work everything possible, in order to rectify the abuses regarding the loan places, so that reliance may thus be placed upon the amount that the Company has to expect annually from this considerable branch; without being flattered with revenues that are by far not secured and probably set much too high, and consequently to urge most strongly for the so highly necessary clarification; the said Mr. Bookkeeper of the Public Revenues being ordered, however, to adhere strictly to the orders and arrangements of the Most Honorable Lords Commissioners-General, by granting all possible facilities to the inhabitants who owe overdue recognition monies, by allowing those who are more than one year in arrears to suffice with paying, annually, besides the accrued recognition of the last year, two years of the owed arrears, unless the debtors themselves should be otherwise inclined or allow themselves to be persuaded thereto by good reasons; the Mr. Bookkeeper of the General Public Revenues being further authorized to redress the abuses stated in his Memorial and to write off or clear them in the books, in such and the same manner as has been noted by him in the margin; while, moreover, the respective Landdrosts of Stellenbosch, Swellendam, and Graaff-Reinet shall, by extract of this, be charged and ordered to supply to Mr. de Wet, with the utmost possible speed, everything that he has already required of them and might further demand, in order to clear the books kept by him of all abuses and false representations. From the report made by the commissioners from the College of Commissioners and annexed to the aforementioned representation, it having been evident that the strips of land requested respectively in ownership by the Ensign of the Burgher Militia, Johan George Lochner, and the Milk Farmer Andries Momsen, can be granted to them without any prejudice to the Company or the public, it was therefore decided to grant to the first-mentioned petitioner the requested plot measuring 5 morgen in ownership, upon payment of a recognition fee of 100 Rds. for the benefit of the Company, and to cede to the aforementioned Milk Farmer the requested piece of ground measuring about one morgen, upon payment of an acknowledgment fee of 66 2/3 Rds., both in accordance with the charts thereof formed by the sworn surveyor and under all such conditions, stipulations, and servitudes as specified by the commissioned members from the College of Commissioners in their said report. 506 507 To permit Heidenreich to construct a bridge under the aforementioned conditions. and also to express the council's satisfaction to the Commissioners regarding the good management of the grain warehouse and to enter the profits gained thereby into the trade books; furthermore to place the complaints made against the burgher Theron into the hands of the Fiscal to act therein according to duty should they be violated, or if they should tolerate and lend a hand to having them exceeded by others, as well as to have the said bridge repaired at the expense of the occupants of the said garden; and notice of this permission shall further be given to the Fiscal's office, with orders to carefully ensure that the person named Huidenieuh at the wharf and the future possessors of his little garden strictly comply with and follow these imposed regulations. The aforementioned representation having been submitted by Commissioners from the Council of Justice, together with the account of the profits gained during the year 1793 on the wheat purchased and resold by them pursuant to the authorization of the Most Noble Lords Commissioners-General, it has appeared to the council with special satisfaction therefrom that the calculated profit of rds. 5507. 6. gained on the administration of the grain warehouses far exceeds the profits that had been estimated to be drawn from this establishment for the Company, and consequently, by extract hereof, the council's satisfaction shall be expressed to the Board of Commissioners from the Council of Justice for the full evidence of zeal as well as devotion displayed both for the interests of the Company and those of the public in this administration entrusted to their care and oversight; and furthermore the said profits gained to the amount of rds. 550. 7. 6, which have already been transferred into the Company's treasury under written warrant at the end of last December, shall be entered into the trade books to the benefit of the profit account. From the declarations annexed to the aforementioned representation, provided by the Secretary of the Board of Burgher Councillors, Daniel Petrus Haupt, and the burgher Gerrit Gerretse at the requisition of the Burgher Councillor Abraham Fleck, it having appeared to the council with particular dismay that certain expressions were used by the burgher Pieter Theron with regard to the said Burgher Councillor Fleck, conflicting with the respect owed to a member of a public board, it was thought best in this regard and consequently resolved to deliver an extract from the aforementioned representation of Commissioners from the Council of Justice, together with authentic copies of the declarations submitted therewith and an extract hereof, to the ad interim Fiscal Willem Stephanus van Ryneveld, with instructions to act herein in such a manner as he shall find to be proper according to the duties of his office. Furthermore, regarding the request made to grant an annual bonus to the bookkeeper and the butler: Commissioners from the Council of Justice having further requested in the aforementioned representation that the bookkeeper of the colony's grain warehouses might be granted a monthly bonus of rds. 6, the first butler rds. 4, and the second butler rds. 3; taking into consideration that the said subordinates have, through their faithful diligence and good oversight, primarily contributed to bringing the profits of the said warehouses beyond expectations, it was approved and agreed to condescend to that request to the extent that authorization shall be granted to the aforesaid Commissioners, as is granted to them hereby, in order to reward the zeal shown by the aforementioned subordinates and in the expectation that the same will thereby be increasingly stimulated, to grant provisionally and indeed during this current year 1794 the bonus determined by the Commissioners in proportion to their qualifications, in order thereby to enable both this government and the Board of Commissioners from the Council of Justice to judge upon the expiration of this year whether they deserve the prolongation of this token of favor or not. and that the public shall accordingly be given the necessary notice of the appointment made thereof and of the alterations in their Instruction, and Commissioners shall be instructed in this regard as aforesaid; while the said Commissioners shall be enjoined to address their reports to this Council collegially in future, and not through two members from their midst. In execution of the resolution of this Government taken in the session of 22 Iannuarij last, the alterations, additions, and changes contained therein, made to the previously adopted Instruction for Wardmasters, as well as the appointments of Wardmasters now made, shall be made known to the public by publication and the posting of notices. Furthermore, the College of Commissioners from the Council of Justice shall be instructed to demand from the dismissed Wardmasters the copies of the Instructions handed to them, together with the nameplates affixed to their houses, in order to deliver the same nameplates and Instructions to the newly appointed Wardmasters now replacing the dismissed ones, and also to provide both these and the Wardmasters retained in their functions each with an authentic copy of the publication containing the alterations, additions, and changes made in the said Instructions, which copies shall for that purpose be delivered to the aforesaid Commissioners by the secretary of this Council. However, since for some time, and now again in the representation just dealt with, various reports submitted to them by deputies from their midst concerning various duties entrusted to them pursuant to the order given by this Council to the College have been sent to this Government by Commissioners from the Council of Justice, without Commissioners adding thereto their reflections on the same reports, to which they are nevertheless bound, since the duties required of them by this Government are assigned not to two members but to all collegially: it has in this regard been approved and understood to recommend and instruct the Commissioners from the Council of Justice, as they are hereby instructed and ordered, in future, regarding everything that shall be required of them by this Council, to report to the Council collegially as well. This is notwithstanding the facility which this Government grants to them to have the execution of these or those matters, especially ocular inspections, conducted by deputies from their midst, and to have these submit a report thereof to the College; yet which reports may and must then be dealt with by Commissioners in the reports addressed by the College to this Council. The often-mentioned College of Commissioners from the Council of Justice having furthermore addressed to this Government the following representation: To the Right Honorable Abraham Josias Sluysken, Ordinary Councillor of the Dutch Indies and Commissioner over the Government of the Cape of Good Hope and its dependencies, etc. etc., together with the Honorable Deputy Governor and the Right Honorable Councillors of Policy. Mr. de Wet, as administrator of the Colony's Grain Magazines, having brought to the attention of the College that regarding the space granted to the Commissioners for receiving 18000 muddens of wheat in relation to the warehouses at the Hospital, experience had shown that in the past year no more than 15000 muddens could be stored therein, thus 3000 muddens less than had been stated in a calculation given to the Commissioners-General, the Commissioners will need to be authorized by Your Right Honourable and Honourable Sirs, in order to store the grain properly, to rent the necessary storage space from private individuals, to pay those expenses from the profits to be obtained on the grain to be sold for the Honourable Company, and furthermore to provide themselves with as much additional space as will be necessary and required up to 5000 muddens, if Your Right Honourable and Honourable Sirs should see fit to order them to continue with the receipt up to 45000 muddens. The lower road behind the Castle up to the round house having been brought by the Commissioners into such a state that it can now be travelled upon with great ease, the undersigned make their dutiful report thereof to Your Right Honourable and Honourable Sirs, reiterating hereby their request to now be allowed to close the upper road by means of toll-gates until the winter, and likewise regularly in the future during the summer. Upon notifying the public of this, according to the understanding of the Commissioners, it should also be forbidden to drive loose cattle over the same during the time that the road shall be closed, as experience has shown that this contributes not a little to the deterioration 520 527 thus after deliberation on the same, it was approved to authorize the Commissioners to proceed with the receipt of wheat up to 45000 muddens of the roads. The fat having risen in price for a few days, the Commissioners believe this must be attributed to a considerable quantity that may possibly have been shipped off, or else to the prospect that the butchers have of being able to do so in the future; and as this causes no small hardship to the inhabitants in general and the poor community in particular, the Commissioners most humbly supplicate Your Right Honourable and Honourable Sirs to provisionally interdict and forbid the export of tail and kidney fat, as well as manufactured candles, and that until such time that, in relation to the kidney fat, the same can be obtained for rds 8 per 100 lb and thus proportionally for the other articles for less than at present. to receive, to store, it has therefore, as a consequence of the same authorization, been approved to authorize the Commissioners, as they are authorized hereby, to rent from private individuals at the lowest possible price as many warehouses as will be necessary to store and house the wheat which they shall be allowed and able to receive. It having furthermore appeared from the last-mentioned representation that the lower road leading from behind this Castle up to the Rondeboschje had been put into such a state by the Commissioners that it can now be ridden and driven upon with great ease, it has been approved and understood to qualify and authorize the Commissioners, as they are qualified and authorized hereby, to close off in the future the so-called new or upper road leading from behind the Castle up to the Rondeboschje, and specifically up to the other side of the last bridge on this side of the House De Drie Koppen, during the summer months, or from Primo October until ultimo March annually, with turnpikes in such a manner that along the same no wagons or other vehicles of whatever kind they may be, nor riding horses, can be driven, whereby through publication and affixing of notices it shall be interdicted and forbidden to all inhabitants and residents of this Colony, as well as all other persons without distinction, to ride or drive the mentioned road with wagons, other vehicles, or riding horses, as well as to let any cattle, be it horses, donkeys, oxen, sheep, or goats, run along the same; so that all wagons as well as other vehicles, riding horses, and loose cattle must be transported along the lower road during the aforementioned summer months; all on pain of a fine of Twenty Rixdollars, to be forfeited by whoever shall have used the said upper road for one or the other of the aforesaid purposes, or shall have had it used; of which fine one third shall go to the benefit of the informer, one third for the officer, and one third to the benefit of the Burgher Treasury. The Commissioners from the Council of Justice having, at the conclusion of their last-mentioned representation, brought to the knowledge of the Council that the price of fat had risen significantly in a few days, which is attributed by them either to the shipment of a substantial quantity, or to the prospect that the butchers have of being able to make such shipments in the future; the Noble Lord Commissioner communicated to the Council that the first of those given causes was certainly without foundation, since His Honor had granted no other permission for the shipment of fat than only 2000 lb of tallow to be loaded into the French ship Le Marchand Jovial and to be transported to the establishments of the Company or those of the English; and since therefore the increase in the price of fat could be attributed to the last given cause, it has been approved and understood, by publication and affixing of notices, to interdict and forbid that anyone, whosoever he may be, provisionally and until this prohibition shall again be lifted, shall be allowed to ship any kidney fat or rendered fat, or made candles, whether to ships of our own or to those of foreign nations, without any distinction; on pain that those who might attempt along clandestine ways to ship fat and are caught doing so, shall not only forfeit all the fat along with the casks which they have attempted to ship, but moreover shall incur a fine of One Hundred Fifty Rixdollars, of which one third shall be for the informer, one third for the officer, and one third for the diaconate poor of the Reformed Congregation of this place.
